<official-title display="yes">To amend the Immigration and Nationality Act to increase the civil penalty for unlawfully entering the United States, and for other purposes.</official-title>

<section id="HDB05F774608C47C2AEA8A3682C7A0EAD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Build Better Borders Act of 2021</short-title></quote> . </text></section> <section id="H0280DE8ED6344AC4A38D35551F26AD16"><enum>2.</enum><header>Increased civil penalties for unlawful entry</header><text display-inline="no-display-inline">Section 275(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325(b)(1)</external-xref>) is amended by striking <quote>at least $50 and not more than $250</quote> and inserting <quote>$450,000</quote>. </text></section> 
<section id="H4FC696C615574D4093A0400126738B66"><enum>3.</enum><header>Border wall trust fund</header> 
<subsection id="HEB318FF7F3C44DEDA35718B5065B594E"><enum>(a)</enum><header>Establishment of fund</header><text>At the end of subchapter III of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/33">chapter 33</external-xref> of title 31, United States Code, insert the following:</text> <quoted-block id="HF8054429101A4962A028BFF509024E1A" style="USC"> <section id="H6473047EA8884ABF84B14206C271A649"><enum>3344.</enum><header>Secure the Southern Border Fund</header> <subsection id="H01B451E2BE2040B782C902A837B02A0D"><enum>(a)</enum><header>In general</header><text>Not later than 60 days after the date of enactment of this section, the Secretary of the Treasury shall establish an account in the Treasury of the United States, to be known as the <quote>Secure the Southern Border Fund</quote>, into which funds collected under section 275(b)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1325">8 U.S.C. 1325(b)(1)</external-xref>) shall be deposited.</text></subsection> 
<subsection id="H211FC666E03B48258FC9497FD880D3B5"><enum>(b)</enum><header>Appropriation</header><text>Funds deposited in the Secure the Southern Border Fund shall be available until expended. Such funds are authorized to be appropriated, and are appropriated, to the Secretary of Homeland Security only—</text> <paragraph id="HE84A229E8604421ABA97FC3262A18919"><enum>(1)</enum><text>to plan, design, construct, or maintain a barrier along the international border between the United States and Mexico; and</text></paragraph> 
<paragraph id="H3AFE4658512845F78BC0002D834FD1C4"><enum>(2)</enum><text>to purchase and maintain necessary vehicles and equipment for U.S. Border Patrol agents.</text></paragraph></subsection> <subsection id="H28574CCE94CC432F804CC5F414A4818C"><enum>(c)</enum><header>Limitation</header><text>Not more than 5 percent of the funds deposited in the Secure the Southern Border Fund may be used for the purpose described in subsection (b)(2).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1B16EB10DB144AF2A8A25929BB59C4AE"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/31/33">chapter 33</external-xref> of title 31, United States Code, is amended by inserting at the end the following:</text> <quoted-block id="H1A86044E7D93496AA31F7D5F5C7ECAF8" style="USC"> <toc regeneration="no-regeneration"> <toc-entry level="section">3344. Secure the Southern Border Fund.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> </legis-body> </bill>
