R. 5975</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211115">November 15, 2021</action-date><action-desc><sponsor name-id="K000395">Mr. Keller</sponsor> (for himself, <cosponsor name-id="M001208">Mrs. McBath</cosponsor>, and <cosponsor name-id="T000483">Mr. Trone</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Director of the Bureau of Prisons to address deficiencies and make necessary upgrades to the security camera and radio systems of the Bureau of Prisons to ensure the health and safety of employees and inmates.</official-title></form><legis-body id="HD4CBA9C1C57C4E5EB0061FC190E0424D" style="OLC"><section id="H9CC05B7BFDC64DD88E19F24503AD9150" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prison Camera Reform Act of 2021</short-title></quote>.</text></section><section id="H1588176F2D6F4ADF8C32C8E51611E1FE"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text><paragraph id="H703EDE68CCFD454991D7D77365EB2478"><enum>(1)</enum><text>The Bureau of Prisons has 122 institutions located throughout the United States. The Bureau of Prisons employs nearly 38,000 employees and is responsible for more than 150,000 Federal inmates.</text></paragraph><paragraph id="HFD718E18E7F4470C9F6485589A5338A1"><enum>(2)</enum><text>Video footage from security camera systems and reliable communication over radio systems within Bureau of Prisons institutions are essential to protecting the health and safety of Bureau of Prisons employees and Federal inmates.</text></paragraph><paragraph id="H0E9466CFB7C945B390C5D16638DBC47F"><enum>(3)</enum><text>Based on the experience of Bureau of Prisons correctional staff, the noticeable presence of functioning security cameras serves as an effective deterrent to criminal behavior and misconduct.</text></paragraph><paragraph id="HFBD80732B8EB45A5AE21408F05F94C4B"><enum>(4)</enum><text>Well-documented deficiencies of camera systems at Bureau of Prisons’ facilities have hindered investigators’ ability to substantiate allegations of serious misconduct by staff and inmates, including sexual and physical assaults, medical neglect, and introduction of contraband.</text></paragraph><paragraph id="H74F3186580B44B63B429CDE67404CC93"><enum>(5)</enum><text>In a 2016 report, the Office of the Inspector General for the Department of Justice determined that <quote>deficiencies within the BOP's security camera system have affected the OIG’s ability to secure prosecutions of staff and inmates in BOP contraband introduction cases, and these same problems adversely impact the availability of critical evidence to support administrative or disciplinary action against staff and inmates</quote>.</text></paragraph><paragraph id="HE84F5C926B8244EFA344CCD039D310E8"><enum>(6)</enum><text>Shortcomings in the land-mobile radio systems at Bureau of Prison facilities institutions impede the communication abilities of staff, slowing or preventing the response of correctional officers during an emergency or threat of attack, and jeopardizing the safety of both staff and Federal inmates.</text></paragraph></section><section id="HCCED270CB73C482F84F5933C63E7AFBD"><enum>3.</enum><header>Required plan for reform of BOP security camera and radio coverage and capabilities</header><subsection id="H1B03E36D47EA45E2B16EDD2B19C185D9"><enum>(a)</enum><header>Plan</header><text>Not later than 90 days after the date of enactment of this Act, the Director of the Bureau of Prisons shall—</text><paragraph id="H83197F9330324EC08DE0D6C45DADB20F"><enum>(1)</enum><text>evaluate the security camera, land-mobile radio (referred to in this Act as <quote>LMR</quote>), and public address (referred to in this Act as <quote>PA</quote>) systems in use by the Bureau of Prisons as of the date of enactment of this Act; and</text></paragraph><paragraph id="HE9F783FF04AA4C5CBC30A4FBCD5EFEEC"><enum>(2)</enum><text>submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a plan for ensuring that all Bureau of Prisons correctional facilities have the security camera, LMR, and PA system coverage and capabilities necessary to—</text><subparagraph id="H821DF2B3501848739642870E62B1D596"><enum>(A)</enum><text>ensure the health and safety of staff and Federal inmates; and</text></subparagraph><subparagraph id="H51E03C5432A74C9FBB079CC5794AE37F"><enum>(B)</enum><text>ensure the documentation and accessibility of video evidence that may pertain to misconduct by staff or inmates, negligent or abusive treatment of inmates, or criminal activity within correctional facilities.</text></subparagraph></paragraph></subsection><subsection id="H23294412C2584260ACBA4E9904D43E47"><enum>(b)</enum><header>Contents</header><text>The plan required under subsection (a) shall—</text><paragraph id="H015CB416CB984B2FAD03840A4AE1B7F5"><enum>(1)</enum><text>identify and include plans to address any deficiencies in the security camera system in use at Bureau of Prisons correctional facilities, including those related to—</text><subparagraph id="H1C2622102A44404EBCD80731C51808FD"><enum>(A)</enum><text>an insufficient number of cameras;</text></subparagraph><subparagraph id="H40A65C8738FA46E5BFE62292D0D3362D"><enum>(B)</enum><text>inoperable or malfunctioning cameras;</text></subparagraph><subparagraph id="HB23F2252BF5641BABC1407BCC814C28B"><enum>(C)</enum><text>blind spots;</text></subparagraph><subparagraph id="H755928F3931642C29429F8F38B538595"><enum>(D)</enum><text>poor quality video; and</text></subparagraph><subparagraph id="H1C377B3502F844698F52F9ED24148984"><enum>(E)</enum><text>any other deficits in the security camera system; </text></subparagraph></paragraph><paragraph id="H99CD978A82DC448B8F02EC5539E4C99C"><enum>(2)</enum><text>identify and include plans to adopt and maintain any security camera system upgrades needed to achieve the purposes described in subsection (a), including—</text><subparagraph id="H2CB35761BC87406D8F57925C59A7FB2A"><enum>(A)</enum><text>conversion of all analog cameras to digital surveillance systems, with corresponding infrastructure and equipment upgrade requirements;</text></subparagraph><subparagraph id="HF45F218D5FA54749B64D523BD6C1DC5F"><enum>(B)</enum><text>upgrades to ensure the secure storage, logging, preservation, and accessibility of recordings such that the recordings are available to investigators or Courts at such time as may be reasonably required; and</text></subparagraph><subparagraph id="HC0A37E7930304AED9BA141FE4365F302"><enum>(C)</enum><text>additional enterprise-wide camera system capabilities needed to enhance the safety and security of inmates and staff;</text></subparagraph></paragraph><paragraph id="HAAB3A0C51A79459FBA135B34EC54C559"><enum>(3)</enum><text>identify and include plans to address any deficiencies in the LMR and PA systems in use at Bureau of Prisons correctional facilities, including those related to—</text><subparagraph id="HF95320D6136E49E2BCED599E7791FA39"><enum>(A)</enum><text>an inadequate number of radios;</text></subparagraph><subparagraph id="HFA6281591A684ECF8C2E3C9FD4B4E34D"><enum>(B)</enum><text>inoperable, outdated, or malfunctioning LMR or PA systems;</text></subparagraph><subparagraph id="HD750838A986C4F62BEA685B0CE2C1AD1"><enum>(C)</enum><text>areas of Bureau of Prisons correctional facilities that lack adequate reception for radio operation;</text></subparagraph><subparagraph id="H03F5373E714546E897F88606FBFA7005"><enum>(D)</enum><text>radios that lack an emergency notification feature (also known as a <quote>man down</quote> function), which automatically sends an alert and transmits the location of that radio in the event the wearer is in a prone position; and</text></subparagraph><subparagraph id="HC829CFEA0C8348A7A84AAD14DD5276A3"><enum>(E)</enum><text>any other deficits in the LMR or PA systems;</text></subparagraph></paragraph><paragraph id="HD56235CC53BD4047AD3A8B6249F34E2F"><enum>(4)</enum><text>include an assessment of operational and logistical considerations in implementing the plan required under subsection (a), including—</text><subparagraph id="H3E9CC0A9FF05478C978E547B40DC9EB5"><enum>(A)</enum><text>a prioritization of facilities for needed upgrades, beginning with high security institutions;</text></subparagraph><subparagraph id="H73E27C54F4A74F2EB99969C2F88B5A2C"><enum>(B)</enum><text>the personnel and training necessary to implement the changes; and</text></subparagraph><subparagraph id="H1AC1882574EA4D3589F33A9FB45F12A3"><enum>(C)</enum><text>ongoing repair and maintenance requirements; and</text></subparagraph></paragraph><paragraph id="H8CB5404FC92D4503BD0ACB599F086B4E"><enum>(5)</enum><text>include a 3-year strategic plan and cost projection for implementing the changes and upgrades to the security camera, LMR, and PA systems identified under paragraphs (1) through (4).</text></paragraph></subsection><subsection id="HB023531899064674816A0887B731AE4F"><enum>(c)</enum><header>Implementation deadline</header><text>Not later than 3 years after the date on which the plan is submitted under subsection (a)(2), and subject to appropriations, the Director of the Bureau of Prisons shall complete implementation of the submitted plan.</text></subsection><subsection id="HFED64AF1B00F4F97843FA343118BA486"><enum>(d)</enum><header>Annual progress reports</header><text>Beginning 1 year after the date on which the plan is submitted under subsection (a)(2), and each year thereafter until the end of the 3-year period described in subsection (c), the Director of the Bureau of Prisons shall submit to the Committee on the Judiciary of the Senate and the Committee on the Judiciary of the House of Representatives a report on the progress of the implementation of the submitted plan.</text></subsection></section></legis-body></bill>
