R. 5971</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211115">November 15, 2021</action-date><action-desc><sponsor name-id="C001111">Mr. Crist</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 18, United States Code, to punish the criminal offense of guardianship fraud, and for other purposes.</official-title></form><legis-body id="H0B8D374F0C514ED1931AA091CDC8C4A9" style="OLC"><section id="HB9EB144629024437BD35C29CA938782D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guardians Aren’t Above Prosecution Act of 2021</short-title></quote>.</text></section><section id="H21B868A270DF4E32B48DCB3CF8699BCC"><enum>2.</enum><header>Guardianship fraud</header><subsection id="HB8E9D0BA362946FEB6AFFD48CBDE0D9F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/47">Chapter 47</external-xref> of title 18, United States Code, is amended by adding at the end the following: </text><quoted-block style="USC" id="HF2324C323BC24F109388DD77B59AC294" display-inline="no-display-inline"><section id="HE74775148BF0457D923CEEB34CD704E4"><enum>1041.</enum><header>Rule of construction relating to guardianship fraud</header><text display-inline="no-display-inline">Nothing in this chapter may be construed to provide that a person designated under the law of any State as the guardian or conservator of another shall not be subject to the provisions of this chapter.</text></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H867517F39D1A45CE9FE37BE6E1D4DADB"><enum>(b)</enum><header>Clerical amendment</header><text display-inline="yes-display-inline">The table of sections for such chapter is amended by adding at the end the following: </text><quoted-block style="USC" id="HBD378AF47A3244328BF82AF1D1F38086" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">1041.
