which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ensure that institutions of higher education with COVID–19 vaccination requirements provide an opportunity for religious exemption from such requirements, and for other purposes.</official-title></form><legis-body id="HCFA3B9737B4243469A838813E8718A04" style="OLC"><section id="HA69092B4A82B410AA465140D6403D172" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Protecting Religious Students from Vaccine Mandates Act of 2021</short-title></quote>. </text></section><section id="H4A231ECA90E748BE861183ECB8665312"><enum>2.</enum><header>Provision of religious exemption from COVID–19 vaccination requirements</header><subsection id="H34E3FBDC40E541C69EF625D8AC07EC06"><enum>(a)</enum><header>Religious exemption requirement</header><text display-inline="yes-display-inline">A public institution of higher education that has a COVID–19 vaccination requirement shall, through December 31, 2024—</text><paragraph id="HD84AE16BD5EB4C36A7D281E60C3B98B1"><enum>(1)</enum><text display-inline="yes-display-inline">provide a reasonable opportunity for an individual to receive a religious exemption from such vaccination requirement; and </text></paragraph><paragraph id="H5AE189BB35CE44489A592A536B1746DE"><enum>(2)</enum><text>make a good-faith effort to notify individuals who are subject to such vaccination requirement of the opportunity to receive, and procedures to apply for, such a religious exemption, using easily accessible forms of communication such as the website of the institution or official digital or written correspondence from the institution to such individuals.</text></paragraph></subsection><subsection id="H5E3E335D1F6741A4BC3F49E2753CA88F"><enum>(b)</enum><header>Annual report</header><text>An institution of higher education described in <internal-xref idref="H34E3FBDC40E541C69EF625D8AC07EC06" legis-path="2.(a)">subsection (a)</internal-xref> shall submit to the Secretary of Education an annual report, for each calendar year through 2024, that—</text><paragraph id="H7269A67996AA412798534543BCC379DE" display-inline="no-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">certifies that the institution meets the requirements under paragraphs (1) and (2) of such subsection; and</text></paragraph><paragraph id="HFCB4A3F9ACA44C95AFDC955AAD022403"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of an institution that has denied such a religious exemption to 20 or more individuals during a calendar year, includes reasoning for such denials by such institution, whether the exemptions were denied due to an undue hardship for the institution, and if so, evidence to demonstrate such undue hardship to the Secretary of the Education.</text></paragraph></subsection><subsection id="HFADA2D7765A340B7B6C95D2864D82949"><enum>(c)</enum><header>Enforcement</header><paragraph id="HC7A271BCC2504B06BD6D15B53A65F4F9"><enum>(1)</enum><header>In general</header><text>Unless the Secretary of Education has determined that an institution of higher education is unable to comply with the requirements under <internal-xref idref="H34E3FBDC40E541C69EF625D8AC07EC06" legis-path="2.(a)">subsection (a)</internal-xref> due to an undue hardship for the institution based on evidence provided in accordance with <internal-xref idref="HFCB4A3F9ACA44C95AFDC955AAD022403" legis-path="2.(b)(3)">subsection (b)(2)</internal-xref>, a public institution of higher education that has a COVID–19 vaccination requirement and that fails to comply with the requirements under <internal-xref idref="H34E3FBDC40E541C69EF625D8AC07EC06" legis-path="2.(a)">subsection (a)</internal-xref> shall not be awarded Federal funds for any purpose, directly or indirectly, including through a contract or subcontract, except that students at the institution may receive Federal student financial aid.</text></paragraph><paragraph id="HC06848A72913435CB39312B5857F6B84"><enum>(2)</enum><header>Sunset</header><text>The authority to enforce compliance with the requirements under subsection (a) shall expire on December 31, 2024.</text></paragraph></subsection><subsection id="H8D7A8C0D525249C9990D37878CF4CD7E"><enum>(d)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed as discouraging institutions of higher education from promoting or offering COVID–19 vaccinations on campus.</text></subsection><subsection id="H7B95B37304A24BD79A644E9913A95902"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H296FE253A19247D29319A0C50D1FD959"><enum>(1)</enum><header>COVID–19 vaccination requirement</header><text display-inline="yes-display-inline">The term <term>COVID–19 vaccination requirement</term> means any requirement by an institution of higher education that, as a condition for enrollment, attendance, receipt of student aid, participation in athletics or other student activities, or employment at the institution, requires an individual to have received one or more vaccinations intended to prevent or mitigate the virus that causes COVID–19.</text></paragraph><paragraph id="H36B6EA8D855A47AD9DF8DE1C5E73E445"><enum>(2)</enum><header>Institution of higher education</header><text display-inline="yes-display-inline">The term <term>institution of higher education</term> has the meaning given such term in section 101 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001</external-xref>).</text></paragraph><paragraph id="H16B8D314B9E8411A9F54781CAA7FE0DA" commented="no"><enum>(3)</enum><header>Religious exemption</header><text display-inline="yes-display-inline">The term <term>religious exemption</term> means an exemption granted to an individual to permit such individual to be exempted from a COVID–19 vaccination requirement of an institution of higher education if such individual demonstrates that receiving such a vaccination would violate the sincerely held religious beliefs of the individual.</text></paragraph></subsection></section></legis-body></bill>
