R. 5966</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211112">November 12, 2021</action-date><action-desc><sponsor name-id="T000483">Mr. Trone</sponsor> (for himself and <cosponsor name-id="E000294">Mr. Emmer</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to direct the Secretary of Veterans Affairs to repay the estates of deceased beneficiaries for certain benefits paid by the Secretary and misused by fiduciaries of such beneficiaries.</official-title></form><legis-body id="H7E37DD111BC64D1FBC844C6499C6618D" style="OLC"><section id="H5545E15D19534504AEAA0FCBA9E27368" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Restoring Benefits to Defrauded Veterans Act</short-title></quote>.</text></section><section id="H1CAC1B4CB20146D9AA9F93F6E0D437D3" section-type="subsequent-section"><enum>2.</enum><header>Repayment by the Secretary of Veterans Affairs of estates of deceased beneficiaries for certain benefits paid by the Secretary and misused by fiduciaries</header><text display-inline="no-display-inline">Section 6107 of title 38, United States Code, is amended—</text><paragraph id="HEE254F09782241088EF104252C376EFC"><enum>(1)</enum><text>by redesignating subsections (c) and (d) as subsections (d) and (e), respectively;</text></paragraph><paragraph id="H6A2F491AE74D4B8693B7462AB73F2FF9"><enum>(2)</enum><text>by inserting after subsection (b) the following new subsection (c):</text><quoted-block style="USC" id="HF56E9AB40E8340B98D64D8D8E19D9CA4" display-inline="no-display-inline"><subsection id="H23E9EDD4787A4C648FB299604017427D"><enum>(c)</enum><header>Reissuance of amounts in the case of a deceased beneficiary</header><paragraph commented="no" display-inline="yes-display-inline" id="H8D802C89DA3A422BB29209D569AA2E52"><enum>(1)</enum><text display-inline="yes-display-inline">If a beneficiary described in subsection (a) predeceases a payment under subsection (a) or (b), the Secretary shall pay such benefits, subject to paragraph (2), to an individual or entity in the following order:</text><subparagraph id="H36D95FC006044DA980D8225C10EF5E80" indent="up2"><enum>(A)</enum><text display-inline="yes-display-inline">The estate of the beneficiary.</text></subparagraph><subparagraph id="H7C2F70CACD074387B3EE90B216DBEFBD" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">A successor fiduciary serving the beneficiary when the beneficiary died.</text></subparagraph><subparagraph id="HFDC53ACAE3534BF8AE5DA01675F6C657" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">The next inheritor determined by a court of competent jurisdiction.</text></subparagraph></paragraph><paragraph id="H1EA5E47A80A2496192EF486B4600B07F" indent="up1"><enum>(2)</enum><text>The Secretary may not make a payment under this subsection to a fiduciary who misused benefits of the beneficiary.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="HB61DFF277CF345E7BB226A1E7F51E72B"><enum>(3)</enum><text>in subsection (e), as redesdignated, by striking <quote>subsection (a) or (b)</quote> and inserting <quote>this section</quote>.</text></paragraph></section></legis-body></bill>
