R. 5962</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211112">November 12, 2021</action-date><action-desc><sponsor name-id="N000191">Mr. Neguse</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To manage supply chain risk through counterintelligence training, and for other purposes.</official-title></form><legis-body id="H929CBD0077D6419B9E0A64CEF6BBE5B7" style="OLC"><section id="HE0BD2C4A86244FD39A0B4504F90063CF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supply Chain Security Training Act of 2021</short-title></quote>.</text></section><section id="HF1C9147F8A374E5D9445D98EFFD35496"><enum>2.</enum><header>Training program to manage supply chain risk</header><subsection id="H464C750000F74FB8817B6BB05DB9B941" display-inline="no-display-inline"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Administrator of General Services, through the Federal Acquisition Institute, shall develop a training program for officials with supply chain risk management responsibilities at Federal agencies.</text></subsection><subsection id="H68B7F3BDA4A54A3EAF66132202F231AD"><enum>(b)</enum><header>Content</header><text>The training program shall be designed to prepare such personnel to perform supply chain risk management activities and identify and mitigate supply chain security threats that arise throughout the acquisition lifecycle, including for the acquisition of information and communications technology. The training program shall—</text><paragraph id="HC0546330FF154271A2F5CB08E024EC7C"><enum>(1)</enum><text>include, considering the protection of classified and other sensitive information, information on current, specific supply chain security threats; and</text></paragraph><paragraph id="H5D4F159977FF4F8CA36E1CA35E6DE9DE"><enum>(2)</enum><text>be updated as determined to be necessary by the Administrator.</text></paragraph></subsection><subsection id="H61A0C31F9DFC4031A0DDA30D3D886910"><enum>(c)</enum><header>Coordination and consultation</header><text>In developing the training program, the Administrator shall—</text><paragraph id="HD0B8029CBC1F424281C6CCCCE6E160A0"><enum>(1)</enum><text>coordinate with the Federal Acquisition Security Council, the Secretary of Homeland Security, and the Director of the Office of Personnel Management; and</text></paragraph><paragraph id="H5E1A72C40A44447FB409572271DE632F"><enum>(2)</enum><text>consult with the Director of the Department of Defense’s Defense Acquisition University and the Director of National Intelligence.</text></paragraph></subsection><subsection id="HD893741520D24D6D8FD7BF29E267B9C7"><enum>(d)</enum><header>Guidance</header><paragraph id="H7713273B04024182BA8AE7DAE2DF8F87"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the training program is developed under subsection (a), the Director of the Office of Management and Budget shall promulgate guidance to Federal agencies requiring executive agency adoption and use of the training program. Such guidance shall—</text><subparagraph id="HBC559B8F9C654ACEB7DBE9DC08D73466"><enum>(A)</enum><text>allow executive agencies to incorporate the training program into existing agency training programs; and</text></subparagraph><subparagraph id="H7FA6FB93C4FB40FA9E83A2C5CC0D479E"><enum>(B)</enum><text>provide guidance on how to identify executive agency officials with supply chain risk management responsibilities.</text></subparagraph></paragraph><paragraph id="HDB1FD2E187074178A30FB80B6FD34D9F"><enum>(2)</enum><header>Availability</header><text>The Director of the Office of Management and Budget shall make the guidance promulgated under paragraph (1) available to Federal agencies of the legislative and judicial branches.</text></paragraph></subsection></section><section id="H7A52870E315F47C28D22A56C7015C2A3"><enum>3.</enum><header>Reports on implementation of program</header><text display-inline="no-display-inline">Not later than 180 days after the completion of the first course, and annually thereafter for the next three years, the Administrator of General Services shall submit to the appropriate congressional committees and leadership a report on implementation of the training program required under section 2.</text></section><section id="H70BF19AF38D14953BF3F7F38C9D5CABA"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="HB0552064DF674AB483B1307FE8FED7A3"><enum>(1)</enum><header>Appropriate congressional committees and leadership</header><text>The term <term>appropriate congressional committees</term> means—</text><subparagraph id="HFB37A150F8384416B7A67CE20AAB689E"><enum>(A)</enum><text>the Committee on Homeland Security and Governmental Affairs and the Committee on Armed Services of the Senate; and</text></subparagraph><subparagraph id="H7380015991534195AF198790941F0F07"><enum>(B)</enum><text>the Committee on Oversight and Reform and the Committee on Armed Services of the House of Representatives.</text></subparagraph></paragraph><paragraph id="H39A5DD4B148C4D4186274B0DA1FF4232"><enum>(2)</enum><header>Information and communications technology</header><text>The term <term>information and communications technology</term> has the meaning given the term in section 4713(k) of title 41, United States Code.</text></paragraph><paragraph id="H9FC7F0E1C2E743B59FA00D69A0364C9F"><enum>(3)</enum><header>Executive agency</header><text>The term <term>executive agency</term> has the meaning given the term in section 133 of title 41, United States Code.</text></paragraph><paragraph id="H0CA1F238226D4477BAB892B2F708B34B"><enum>(4)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> means any agency, committee, commission, office, or other establishment in the executive, legislative, or judicial branch of the Federal Government.</text></paragraph><paragraph id="H33D038B651F44EB2BB1ADC5C06AF9AE9"><enum>(5)</enum><header>Training program</header><text>The term <term>training program</term> means the training program developed pursuant to section 2(a). </text></paragraph></section></legis-body></bill>
