which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To increase language access to mental health services at certain health centers, and for other purposes.</official-title></form><legis-body id="HED405A5EF1E2497AB25813137DB19B4E" style="OLC"><section id="H9ED57FCBDF974D30BFFAFB602CC37EC4" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Mental Health Workforce and Language Access Act of 2021</short-title></quote>.</text></section><section id="H8A366304BBBF4CB3BF1A38366ACBA78B"><enum>2.</enum><header>Pilot program to increase language access at Federally qualified health centers</header><subsection id="H8A91BB7220B04FC6B2AF8B667227E493"><enum>(a)</enum><header>Loan repayments to qualified health care professionals</header><paragraph id="HD0C867FE7E6C4D6C9148EE639981A622"><enum>(1)</enum><header>In general</header><text>For the purpose of increasing language access to mental health services, the Secretary shall carry out a demonstration project under which—</text><subparagraph id="H1EE466F4B8C64EF5BC27E53CAD12C012"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary matches qualified mental health professionals with Federally qualified health centers;</text></subparagraph><subparagraph id="H5D8671BF2C19470380938C96A2A11556"><enum>(B)</enum><text>the qualified mental health professionals each agree to a period of obligated service at a Federally qualified health center with which they are so matched; and</text></subparagraph><subparagraph id="H20D91CEB856C47D3B371AC3876A4ECBC"><enum>(C)</enum><text display-inline="yes-display-inline">the Secretary agrees to make loan repayments under section 338B of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254l-1">42 U.S.C. 254l–1</external-xref>) on behalf of such qualified mental health professionals.</text></subparagraph></paragraph><paragraph id="H6076CA290B23440696548E4BB1DEB70E"><enum>(2)</enum><header>Preference</header><text display-inline="yes-display-inline">In matching qualified mental health professionals with Federally qualified health centers under paragraph (1), the Secretary shall give preference to placement at Federally qualified health centers at which at least 20 percent of the patients are best served in a language other than English, as indicated by data in the Uniform Data System (or any successor database).</text></paragraph><paragraph id="H9357C3A823374226BD7544C6D3B61699"><enum>(3)</enum><header>Enhanced compensation</header><text display-inline="yes-display-inline">For each year of obligated service that a qualified mental health professional contracts to serve under paragraph (1) at a Federally qualified health center at which at least 20 percent of the patients are best served in a language other than English, as indicated by data in the Uniform Data System (or any successor database), the Secretary may pay the higher of—</text><subparagraph id="H63EE603C1F2146349A4C01A5EEC73430"><enum>(A)</enum><text>$10,000 above the maximum amount otherwise applicable under section 338B(g)(2)(A) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254l-1">42 U.S.C. 254l–1(g)(2)(A)</external-xref>); or</text></subparagraph><subparagraph id="H5EB4ACF1AF7947C698D9DB128CFDAE17"><enum>(B)</enum><text display-inline="yes-display-inline">if the qualified health professional is fluent in a language other than English that is needed by such Federally qualified health center, $15,000 above such maximum amount.</text></subparagraph></paragraph><paragraph id="HCF2B5E2B92F64FA4A6017446074A2D2A"><enum>(4)</enum><header>Achieving fluency</header><text display-inline="yes-display-inline">A qualified mental health professional subject to the pay amount specified in paragraph (3)(A) at the beginning of the professional’s period of obligated service may transition to being subject to the higher pay amount specified in paragraph (3)(B) if the professional is determined by the Federally qualified health center at which the professional serves to have achieved fluency in a language other than English needed by that health center. </text></paragraph></subsection><subsection id="HC4377A262B6D440E9F20673F3D1672EC"><enum>(b)</enum><header>Grants to health centers</header><paragraph id="HFC9FA73638734A5998A7F80754DED65B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall carry out a demonstration program consisting of awarding grants under section 330 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b</external-xref>) to Federally qualified health centers to recruit, hire, employ, and supervise qualified mental health professionals who are fluent in a language other than English to provide mental health services in such other language.</text></paragraph><paragraph id="H639F37143C8043A5AB7DCB988AC90578"><enum>(2)</enum><header>Preference</header><text display-inline="yes-display-inline">In selecting grant recipients under paragraph (1), the Secretary shall give preference to Federally qualified health centers at which at least 20 percent of the patients are best served in a language other than English, as indicated by data in the Uniform Data System (or any successor database).</text></paragraph><paragraph id="H943748ACC8BD45C380B4E3731BD0BCC3"><enum>(3)</enum><header>Marketing</header><text display-inline="yes-display-inline">A Federally qualified health center receiving a grant under this subsection shall use a portion of the grant funds to disseminate information about, and otherwise market, the mental health services supported through the grant.</text></paragraph></subsection><subsection id="H5B9BE78D704C46F8A5180BD94903A1FF"><enum>(c)</enum><header>Reports</header><paragraph id="HF70847AE557446F0A48A9BDC679CFCC8"><enum>(1)</enum><header>Initial report</header><text display-inline="yes-display-inline">Not later than 6 months after the first loan repayment awards have been made under subsection (a) and the first grants have been awarded under subsection (b), the Secretary shall submit to the Committees on Appropriations of the House of Representatives and the Senate, and to other appropriate congressional committees, a report on the implementation of the programs under this section. Such report shall include—</text><subparagraph id="H9FF1E891F94D4719B72B3DDB3F33511B"><enum>(A)</enum><text display-inline="yes-display-inline">the languages spoken by the qualified mental health professionals receiving loan repayments pursuant to subsection (a) or recruited pursuant to a grant under subsection (b);</text></subparagraph><subparagraph id="H9A578C8AE24D4FB68B157742BE05D2FE"><enum>(B)</enum><text>the Federally qualified health centers at which such professionals were placed;</text></subparagraph><subparagraph id="H18D8E0A9BA2E40BFB243E6D0818E46D8"><enum>(C)</enum><text>how many Federally qualified health centers received funding through the grant program under subsection (b);</text></subparagraph><subparagraph id="HF8E704ED6A4C49EC82F3BBD981DAA508"><enum>(D)</enum><text display-inline="yes-display-inline">an analysis, conducted in consultation with the Federally qualified health centers receiving grants under section (b), of the effectiveness of such grants at increasing language access to mental health services; and</text></subparagraph><subparagraph id="HE4C927CB953141A09545EC753866A7DE"><enum>(E)</enum><text display-inline="yes-display-inline">best practices, developed in consultation with Federally qualified health centers receiving grants under section (b), for the recruitment and retention of mental health professionals at Federally qualified health centers.</text></subparagraph></paragraph><paragraph id="HBFB74688019F42DAAA5C85FBBC3134D0"><enum>(2)</enum><header>Final report</header><text display-inline="yes-display-inline">Not later than the end of fiscal year 2026, the Secretary shall submit to the Committees on Appropriations of the House of Representatives and the Senate, and to other appropriate congressional committees, a final report on the implementation of the programs under this section, including the information, analysis, and best practices listed in subparagraphs (A) through (E) of paragraph (1).</text></paragraph></subsection><subsection id="HFD00EBD10FE14B1C886895C0CFA86BD6"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H77B201306B234E53A03C315BFA4F49EC"><enum>(1)</enum><text>The term <term>Federally qualified health center</term> has the meaning given the term in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>).</text></paragraph><paragraph id="H31CAB737E2654E94A69AE54650ABBB50"><enum>(2)</enum><text display-inline="yes-display-inline">The term <term>qualified mental health professional</term> means—</text><subparagraph id="H3AF3D468645E4C46A6966C08EE289A55"><enum>(A)</enum><text>physicians, allopathic physicians, osteopathic physicians, nurse practitioners, and physician assistants with a specialty in mental health and psychiatry;</text></subparagraph><subparagraph id="H2316D0BBC15F4453858B3FCBDEFA622C"><enum>(B)</enum><text>health service psychologists;</text></subparagraph><subparagraph id="HDDFF1EDDE33F4EF4AF1B452A28845387"><enum>(C)</enum><text>licensed clinical social workers;</text></subparagraph><subparagraph id="HA90DE5A40B284AC19DF88E75405429D3"><enum>(D)</enum><text>psychiatric nurse specialists;</text></subparagraph><subparagraph id="HC8F2D31B8F434BB695609907EC0332F3"><enum>(E)</enum><text>marriage and family therapists;</text></subparagraph><subparagraph id="HD90DE4E650B044BEBD64798218EFE932"><enum>(F)</enum><text>licensed professional counselors;</text></subparagraph><subparagraph id="HC7513EA781AC4730BA17A222E7788AAB"><enum>(G)</enum><text>substance use disorder counselors;</text></subparagraph><subparagraph id="H60457364D1754EB6AB3B0C7E56A5FFDD"><enum>(H)</enum><text>occupational therapists; and</text></subparagraph><subparagraph id="H0BDFD33CA5204B88B1400F6E99360E12"><enum>(I)</enum><text display-inline="yes-display-inline">other individuals who—</text><clause id="HC48AD8A9E96A4BC3BD8E5078AFC34DB9"><enum>(i)</enum><text>have not yet been licensed or certified to serve as a professional listed in any of subparagraphs (A) through (H); and</text></clause><clause id="HDCFA07F9A05C48D4A1F385D2E2751FF2"><enum>(ii)</enum><text>will serve at the Federally qualified health center under the supervision of a licensed individual or certified professional so listed.</text></clause></subparagraph></paragraph><paragraph id="HA750FBC7EDBD4B5694226C946CF80EB7"><enum>(3)</enum><text>The term <term>Secretary</term> means the Secretary of Health and Human Services. </text></paragraph></subsection><subsection id="HB52A61740677491AA2E67E4F70C6E2F6"><enum>(e)</enum><header>Authorization of appropriations</header><paragraph id="HB4AE696304674C2787FE6C04C019909F"><enum>(1)</enum><header>In general</header><text>To carry out this section, there is authorized to be appropriated $75,000,000 for each of fiscal years 2022 through 2026.</text></paragraph><paragraph id="H3BD497B1F4B54688A0ED2E350A5F7935"><enum>(2)</enum><header>Supplement not supplant</header><text display-inline="yes-display-inline">Amounts made available to carry out this section shall be in addition to amounts otherwise available to provide mental health services at Federally qualified health centers pursuant to sections 338B and 330 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254l-1">42 U.S.C. 254l–1</external-xref>, 254b).</text></paragraph></subsection></section></legis-body></bill>
