which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Child Nutrition Act of 1966 to support women, infants, and children impacted by substance use disorder, and for other purposes.</official-title></form><legis-body id="HAEDBC48B17484AB889585B3115C8A187" style="OLC"><section id="H86DBF0B9752A4634B13EBF9EFBC439FE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Healthy Mothers and Infants Act of 2021</short-title></quote> .</text></section><section id="HC21B70878F6D44F680D82AABDF6C34AB"><enum>2.</enum><header>Amendments to special supplemental nutrition program</header><subsection id="H7815F27E642B47F0AC3B7E9FB008482B"><enum>(a)</enum><header>Special supplemental nutrition program for women, infants, and children</header><text>Section 17 of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786</external-xref>) is amended—</text><paragraph id="HACA29A29882F42859E9357697526A472"><enum>(1)</enum><text>in subsection (a), by striking <quote>drug abuse</quote> and inserting <quote>substance use disorder</quote>;</text></paragraph><paragraph id="HF4B1B412BFC7460BB651C3CD92E0ED6A"><enum>(2)</enum><text>in subsection (b)—</text><subparagraph id="HD3D3E49D0BA84188AF7506A9A01F7936"><enum>(A)</enum><text>in paragraph (8), by striking <quote>drug abuse</quote> and inserting <quote>substance use disorder</quote>; and</text></subparagraph><subparagraph id="HC50743E71168465E827374D88AD259C3"><enum>(B)</enum><text>in paragraph (16)—</text><clause id="H6EA4A87072A747B6A9F921E34BD6A372"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by striking <quote>Drug abuse education</quote> and inserting <quote>Substance use disorder education</quote>;</text></clause><clause id="H6F22EBAD207F4A1BBEFE0EABB390662D"><enum>(ii)</enum><text>in subparagraph (A), by striking <quote>dangers of drug abuse</quote> and inserting <quote>harm of substance use on pregnancy and lactation</quote>; and</text></clause><clause id="HA7214DB5199A4A7C8F180279714E1615"><enum>(iii)</enum><text>in subparagraph (B)—</text><subclause id="H12975B0E417042ED9A118F8DF7CA80F4"><enum>(I)</enum><text>by striking <quote>are suspected drug abusers</quote> and inserting <quote>may have a substance use disorder</quote>;</text></subclause><subclause id="H9B34FA46CC764ED3AAC02E502E71300B"><enum>(II)</enum><text>by striking <quote>drug abuse clinics,</quote>; and</text></subclause><subclause id="HDCE5402FF81C44399FA3ED3E9B6F4881"><enum>(III)</enum><text>by striking <quote>drug abuse professionals</quote> and inserting <quote>resources</quote>;</text></subclause></clause></subparagraph></paragraph><paragraph id="H6FED6546F3364C408B9295EBAD8A342D"><enum>(3)</enum><text>in subsection (e)—</text><subparagraph id="H9F486E3E0BCD4AC9B0AC39ADEE35F512"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="HD1D69070F9B8480A94E8BCA2976B7EDF"><enum>(i)</enum><text>by striking <quote>drug abuse</quote> each place it appears and inserting <quote>substance use disorder</quote>; and</text></clause><clause id="H1D44A52FFDA14B5E97461327D7B4B7A5"><enum>(ii)</enum><text>by striking <quote>effects of drug</quote> and inserting <quote>effects of a substance use disorder</quote>; and</text></clause></subparagraph><subparagraph id="H18AE265BBC52407EA6F180B72C479BAD"><enum>(B)</enum><text>in paragraph (5), by striking <quote>substance abuse</quote> and inserting <quote>substance use disorder</quote>;</text></subparagraph></paragraph><paragraph id="HF2FDDD322C3042608F30296936E03B3B"><enum>(4)</enum><text>in subsection (f)—</text><subparagraph id="HAEC4C7B81A0C4E27BD546379EB271ABD"><enum>(A)</enum><text>in paragraph (1)(C)(ix), by striking <quote>drugs</quote> and inserting <quote>illicit or other harmful substances</quote>; and</text></subparagraph><subparagraph id="H0CFDA40E44A2449D9A8ACDBF487588D5"><enum>(B)</enum><text>in paragraph (13), by striking <quote>drug abuse education</quote> and inserting <quote>substance use disorder education</quote>;</text></subparagraph></paragraph><paragraph id="H7EAB2AC717034E9DA22C774334C7868F"><enum>(5)</enum><text>in subsection (k)(1)—</text><subparagraph id="H1F0646AF87324601B37F642948FA831F"><enum>(A)</enum><text>by striking <quote>1 member</quote> and inserting <quote>one member</quote>; and</text></subparagraph><subparagraph id="HCB0035EAAB024D0AAD3975AA0EAD3BF8"><enum>(B)</enum><text>by striking <quote>drug abuse</quote> and inserting <quote>substance use disorder</quote>; and</text></subparagraph></paragraph><paragraph id="H6C5EE914F47B4E9AA449598ECE8E9480"><enum>(6)</enum><text>by redesignating subsections (l) through (q) as subsections (m) through (r), respectively, and by inserting after subsection (k) the following:</text><quoted-block id="H5C4026FC7D634813AE10E1105B7D18AA" style="OLC"><subsection id="H1B9EA2B9187D49A3ADF6ECC014F289D4"><enum>(l)</enum><header>Activities To support WIC-Eligible individuals impacted by substance use disorder</header><paragraph id="H3E92DAF4FBB1445A899D79520CCB8C88"><enum>(1)</enum><header>In general</header><text>The Secretary shall—</text><subparagraph id="H7723F1B2A04F4681B9FA3E9980F6FB31"><enum>(A)</enum><text>develop and disseminate nutrition education materials for individuals eligible for the program; and</text></subparagraph><subparagraph id="HB6BABCDB30EC49B2B26BFF2B88EAC684"><enum>(B)</enum><text>conduct outreach to individuals who are potentially eligible for the program and who are impacted by a substance use disorder.</text></subparagraph></paragraph><paragraph id="HE3BD0C9955994805A666C774347F0723"><enum>(2)</enum><header>Purpose</header><text>The purpose of this subsection is to ensure that individuals participating in the program who are impacted by a substance use disorder receive accurate nutrition education from trained staff in an effective and unbiased manner.</text></paragraph><paragraph id="HC987DDF2838B4657B3D17B7E93F8D11F"><enum>(3)</enum><header>Nutrition education materials</header><text>The Secretary shall collaborate with the Secretary of Health and Human Services to develop appropriate evidence-based nutrition education materials for individuals impacted by a substance use disorder, including—</text><subparagraph id="H70E82A6284B84BBE8FEBE4062ACE2C6B"><enum>(A)</enum><text>nutrition education materials for individuals with substance use disorder during pregnancy and in the postpartum period; and</text></subparagraph><subparagraph id="H3C0B0E33D2FE4B28A19F251737047F1C"><enum>(B)</enum><text>nutrition education materials for infants impacted by prenatal substance exposure and neonatal abstinence syndrome.</text></subparagraph></paragraph><paragraph id="HCD424991EF474E1CAE861738456374A9"><enum>(4)</enum><header>Nutrition education clearinghouse</header><text display-inline="yes-display-inline">The Secretary shall make available to all State agencies through an online clearinghouse any nutrition education and training materials related to nutrition for individuals impacted by a substance use disorder or neonatal abstinence syndrome that have been produced by the Secretary or the Secretary of Health and Human Services (or produced by a State agency and approved by the Secretary), including educational materials developed under paragraph (15) of section 515(b) of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-21">42 U.S.C. 290bb–21(b)</external-xref>) and guidance issued under section 1005 of the SUPPORT for Patients and Communities Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref> note).</text></paragraph><paragraph id="H24898F6E11F9496EAC7F651324934691"><enum>(5)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this subsection $1,000,000 for fiscal year 2022, to remain available until expended.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2048BFCBD6FF4995B65DB441B32CBBDD"><enum>(b)</enum><header>Conforming amendments</header><text>Section 17(q) of the Child Nutrition Act of 1966 (<external-xref legal-doc="usc" parsable-cite="usc/42/1786">42 U.S.C. 1786(q)</external-xref>), as redesignated by subsection (a) is amended—</text><paragraph id="H300AF45CD59C42D08BFD936153687624"><enum>(1)</enum><text>in paragraph (1), by striking <quote>subsection (o)(1)(A)</quote> and inserting <quote>subsection (p)(1)(A)</quote>; and</text></paragraph><paragraph id="H2D8EA93FACE14169AB6A2994201C6008"><enum>(2)</enum><text>in paragraph (2)(B), by striking <quote>subsection (o)(1)(A)</quote> and inserting <quote>subsection (p)(1)(A)</quote>.</text></paragraph></subsection></section></legis-body></bill>
