which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles XVIII and XIX of the Social Security Act to provide for the improvement of patient safety and to reduce the incidence of injury and death from opioid-induced respiratory depression under the Medicare and Medicaid programs.</official-title></form><legis-body id="HB17D41E0AA264AE6BB0335D5DA5A91A3" style="OLC"><section id="H41043C06437B47B8804E6D13510D08DE" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Inpatient Opioid Safety Act of 2021</short-title></quote>. </text></section><section id="H77DF6844B0D64F41932D87461D7C0D66" section-type="subsequent-section"><enum>2.</enum><header>Preventing opioid-induced respiratory depression and deaths under the Medicare and Medicaid programs through required monitoring</header><subsection id="HC5767975A13F42C2B1F3EBF887B08E69"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1866(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc(a)(1)</external-xref>) is amended—</text><paragraph id="HC0B7325B7700466F879D1F02959C89B0"><enum>(1)</enum><text>in subparagraph (X), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H82E172C0BB6041678B81A82C7FBE635A"><enum>(2)</enum><text>in subparagraph (Y)(ii)(V), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HA0857DAEBDD5464A911465E982954DEB"><enum>(3)</enum><text>by inserting after subparagraph (Y) the following new subparagraph:</text><quoted-block style="OLC" id="HC7685DD581ED4909A4BA971E25980FEB" display-inline="no-display-inline"><subparagraph id="H8AEC31CF73884B74ABB93D5973A4A04D" indent="up1"><enum>(Z)</enum><text display-inline="yes-display-inline">in the case of a hospital or critical access hospital and with respect to an individual who is furnished, on or after July 1, 2022, any opioid (regardless of route of administration) while an inpatient of such hospital or critical access hospital, to furnish to such individual, during the period beginning at the time such opioid is furnished and ending 12 hours later (or, if earlier, the time such individual is discharged), continuous physiologic electronic monitoring through a monitor that—</text><clause id="H3D28FB2F1358410CA8B80D3FEB7DE170"><enum>(i)</enum><text display-inline="yes-display-inline">measures the adequacy of the respiration of such individual to detect opioid-induced respiratory depression needing intervention;</text></clause><clause id="H8979CBD5D98E4B9FA5DE9D8DBC30163B"><enum>(ii)</enum><text display-inline="yes-display-inline">can be configured to manage excess false alarms; and</text></clause><clause id="H074068DB80C0429D92C1A4766AA2D6BF"><enum>(iii)</enum><text display-inline="yes-display-inline">records and transmits information on blood oxygenation or ventilation of such individual,</text></clause><continuation-text continuation-text-level="subparagraph">unless, before furnishing such opioid, a physician or practitioner (as defined in section 1842(b)(18)(C)) treating such individual determines that such monitoring is contraindicated and records such determination in the treatment records of such individual.</continuation-text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H2F2C330B907742DF99B1C906B027FFAE"><enum>(b)</enum><header>Medicaid</header><text>Section 1902(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)</external-xref>)—</text><paragraph id="HA2FDEB85DCA047D9864ADB52CEEE0AA6"><enum>(1)</enum><text>in paragraph (86), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="H32F90AA2D1244487926E526F7AAD8DA7"><enum>(2)</enum><text>in paragraph (87), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HC7C53593AFD54232AA7A1A6B3C82223D"><enum>(3)</enum><text>by inserting after paragraph (87) the following new paragraph:</text><quoted-block style="OLC" id="HF069E3DD4F724BA1A2C3E41FBF4DA30B" display-inline="no-display-inline"><paragraph id="H3D692C86934E421E84533937C27D9898"><enum>(88)</enum><text display-inline="yes-display-inline">provide that no hospital is eligible to receive payments under such plan unless such hospital furnishes continuous physiologic electronic monitoring in accordance with the provisions of section 1866(a)(1)(Z).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section></legis-body></bill>
