which was referred to the <committee-name committee-id="HVR00">Committee on Veterans' Affairs</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 38, United States Code, to improve the due process accorded veterans with respect to recovery of overpayments made by the Department and other amounts owed by veterans to the United States, to improve the processing of veterans benefits by the Department of Veterans Affairs, and for other purposes.</official-title></form><legis-body id="H1EB98C7BC6384B7891606C07032C0AC0" style="OLC"><section id="H1CE5D55F70B145EFB57810136BE3AB84" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>VA Overpayment Accountability Act</short-title></quote>.</text></section><section id="H7D59F5D2775340A4AC0DEFF869A6A883"><enum>2.</enum><header>Repair of credit</header><subsection id="H4411F7A4F08F42779554DD8A066C3342"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/38/53">Chapter 53</external-xref> of title 38, United States Code, is amended by adding at the end the following new section:</text><quoted-block display-inline="no-display-inline" id="H05CAD32D5F134BD38BD16BFE40A0A9B2" style="USC"><section id="H4FCD91B4ACF246E68AF0E1E9B121F48C"><enum>5320A.</enum><header>Correction of erroneous information submitted to consumer reporting agencies</header><subsection id="H014D41D402B04622BD336F1B95C78F87"><enum>(a)</enum><header>Correcting errors by the Department</header><text>In any case in which the Secretary finds that the Department has submitted erroneous information to a consumer reporting agency about the indebtedness of any person who has been determined by the Secretary to be indebted to the United States by virtue of the participation of that person in a benefits program administered by the Secretary, the Secretary shall—</text><paragraph id="H13A483FE37194B9C8890A529570CF6FE"><enum>(1)</enum><text>instruct the consumer reporting agency to remove such erroneous information from the consumer report of such person or take such other action as may be required to ensure that such erroneous information is not included in the report of such person; and</text></paragraph><paragraph id="H622AE55194554081A940DC0118812641"><enum>(2)</enum><text>transmit to the consumer reporting agency such information as the consumer reporting agency may require to take such appropriate actions.</text></paragraph></subsection><subsection id="H02374CA5889742BDA49C57791FC08219"><enum>(b)</enum><header>Correcting errors by debt collectors</header><text display-inline="yes-display-inline">In any case in which the Secretary finds that a debt collector acting on behalf of the Department has submitted erroneous information to a consumer reporting agency about the indebtedness of any person who has been determined by the Secretary to be indebted to the United States by virtue of the participation of that person in a benefits program administered by the Secretary, the Secretary shall instruct the debt collector to request the consumer reporting agency remove such erroneous information from the consumer report of such person or take such other action as may be required to ensure such erroneous information is not included in the report of such person.</text></subsection><subsection id="HE70ED6B759D4474E82BAFD200F2C7224"><enum>(c)</enum><header>Notice</header><text>Not later than 60 days after the date on which the Secretary issues an instruction under subsection (a)(1) or (b) with respect to a person, the Secretary shall notify the person that the Secretary issued such instruction.</text></subsection><subsection id="H5E059DDA5DA641E6AD792DB73A498EC8"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H50E8CCD4B0484D3E9B995D9F6D2FC309"><enum>(1)</enum><text>The terms <term>consumer report</term> and <term>consumer reporting agency</term> have the meanings given such terms in section 603 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681a">15 U.S.C. 1681a</external-xref>).</text></paragraph><paragraph id="H6AE4A2B4B3F0483BBE829A7A1ADCED81"><enum>(2)</enum><text>The term <term>debt collector</term> has the meaning given such term in section 803 of the Fair Debt Collection Practices Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1692a">15 U.S.C. 1692a</external-xref>).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2FED7466ACF34A46A854A69CC59FAF36"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text><quoted-block display-inline="no-display-inline" id="H0C69724107944CEE80A69D2269791627" style="OLC"><toc><toc-entry bold="off" level="section">5320A. Correction of erroneous information submitted to consumer reporting agencies.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H7B5E003A9CD54CD39F50F1472BE911F6"><enum>(c)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall take effect on the date of the enactment of this Act and shall apply with respect to deductions made under section 5314 of such title, administrative costs under section 5315 of such title, and suits filed under section 5316 of such title on or after such date.</text></subsection></section><section id="H743CBA6B289D4C99A526647F6DB90C0C" section-type="subsequent-section"><enum>3.</enum><header>Improved processing of benefits by Department of Veterans Affairs</header><text display-inline="no-display-inline">The Secretary of Veterans Affairs shall improve the information technology of the Department of Veterans Affairs (including the eBenefits system or successor system) as may be necessary to achieve the following:</text><paragraph commented="no" display-inline="no-display-inline" id="H97E1183AEB134A6A91859B6368253B16"><enum>(1)</enum><header>Notification of debts incurred</header><text>The Secretary shall provide a notification to a person who—</text><subparagraph id="H06861EE83CDF4121BF4720E890CA12E8"><enum>(A)</enum><text>is entitled to a payment from the Secretary under a benefits program administered by the Secretary;</text></subparagraph><subparagraph id="H865335DE1C3A46B89882BDB1FC6336BC"><enum>(B)</enum><text>incurs a debt to the United States under that benefits program; and</text></subparagraph><subparagraph id="H5573BADA9C144ABCA853B0C0A767BFA7"><enum>(C)</enum><text display-inline="yes-display-inline">elects to receive such notifications.</text></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0338619C9AB4481795BA30F1BBE15F85"><enum>(2)</enum><header>Review of information regarding dependents</header><text display-inline="yes-display-inline">A person entitled to a payment from the Secretary under a benefits program administered by the Secretary may review information relating to dependents of that person.</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4948BD10838D4A0194C087C1ED577CD8"><enum>(3)</enum><header>Tracking metrics</header><text>The Secretary shall be able to track—</text><subparagraph commented="no" display-inline="no-display-inline" id="HB862DFB4335F479AA155B878C0A975AB"><enum>(A)</enum><text display-inline="yes-display-inline">the number and amount of payments made by the Secretary to a person entitled to a payment from the Secretary under a benefits program administered by the Secretary who incurs a debt to the United States under such program;</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H395901AAA09749C59A5B63A5EB9A4974"><enum>(B)</enum><text>the average debt to the United States incurred by a person described in subparagraph (A);</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HDB3A36B3B6AA4E28B37FC9019CBB2CC4"><enum>(C)</enum><text>how frequently the Secretary approves and denies applications for relief under section 5302(a) of title 38, United States Code; and</text></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9B5AD91EB3EB4A438386A6271DE9CA7D"><enum>(D)</enum><text>such other metrics the Secretary determines appropriate.</text></subparagraph></paragraph></section><section id="H7948A52BF6E245C2ABA6F924600A0CA5"><enum>4.</enum><header>Audit of erroneous payments by Veterans Benefits Administration; plan of correction</header><subsection id="H1BFB6757A12042ECB6D440A0689363D2"><enum>(a)</enum><header>Audit</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall complete an audit to determine the following:</text><paragraph id="H4548EC0C1D1A48A3B5ABF197FA2AE5C0"><enum>(1)</enum><text>The frequency by which the Department of Veterans Affairs makes an error that results in a payment to a person by virtue of such person's participation in a benefits program administered by the Secretary that such person is not entitled to or in an amount that exceeds the amount to which the person is entitled.</text></paragraph><paragraph id="H1A74E2716CE749048B602B5B3C962BD1"><enum>(2)</enum><text>Whether and to what degree vacant positions in the Veterans Benefits Administration affect such frequency.</text></paragraph></subsection><subsection id="HF2AECD87D2B24A41BEE2C79A3B54AA89"><enum>(b)</enum><header>Plan</header><text display-inline="yes-display-inline">Not later than 30 days after the completion of the audit under subsection (a), the Secretary of Veterans Affairs shall submit to the Committees on Veterans' Affairs of the Senate and House of Representatives a plan and description of resources necessary to align information technology systems to ensure that errors described in subsection (a)(1) are not the result of communication or absence of communication between information technology systems.</text></subsection></section></legis-body></bill>
