which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To increase the principal obligation limits for mortgage insurance under the National Housing Act for residences in eligible metropolitan cities and urban counties, and for other purposes.</official-title></form><legis-body id="HC91D9382220144B3BBAEF0EB990D68C9" style="OLC"><section id="HF6BFDEC661314DE190C2E184ABA9F4DB" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>FHA Fairness Act</short-title></quote>.</text></section><section id="H12CA5E8462B643EE940A31D35D7A8A8D"><enum>2.</enum><header>FHA Principal obligation limits for residences in eligible cities and counties</header><subsection id="H195AD99B16DC4A18BBCDD2F690088394"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 203(b) of the National Housing Act (<external-xref legal-doc="usc" parsable-cite="usc/12/1709">12 U.S.C. 1709</external-xref>) is amended—</text><paragraph id="H583EF2BA44304B50AA6A4B9904220B90"><enum>(1)</enum><text>by striking paragraph (2) and inserting the following:</text><quoted-block style="OLC" id="H128E569FEBF6457FACC2CD6F25E8F827" display-inline="no-display-inline"><paragraph id="H4AC1195191B04FBAAC09ACEF66C73E86"><enum>(2)</enum><text display-inline="yes-display-inline">Involve a principal obligation (including such initial service charges, appraisal, inspection, and other fees as the Secretary shall approve) in an amount—</text><subparagraph id="H52AD58AD21A64D03A73F36D80205790D"><enum>(A)</enum><text display-inline="yes-display-inline">not to exceed the lesser of—</text><clause id="H8B39500A2527469BB83D92A72EDB5E54"><enum>(i)</enum><text>in the case of a 1-family residence, the greater of 115 percent of the median 1-family house price in the area, as determined by the Secretary, or, in the case of a residence located in an eligible city or county, 125 percent of the median 1-family house price in the eligible city or county, as determined by the Secretary; and, in the case of a 2-, 3-, or 4-family residence, the greater of the percentage of such median price that bears the same ratio to such median price as the dollar amount limitation determined under the sixth sentence of section 1454(a)(2) of this title for a 2-, 3-, or 4-family residence, respectively, bears to the dollar amount limitation determined under such section for a 1-family residence as determined by the Secretary, or, the 125 percent of the median 2-, 3-, or 4-family house price, as applicable, in the eligible city or county in which the residence is located, as defined by the Secretary; or</text></clause><clause id="HDF16CE3F2F754177B4719534BF372AA1"><enum>(ii)</enum><text>150 percent of the dollar amount limitation determined under the sixth sentence of such section 1454(a)(2) for a residence of applicable size; except that the dollar amount limitation in effect under this subparagraph for any size residence for any area may not be less than the greater of—</text><subclause id="H3B562ACAF4824D55963ED66DB8E2F49F"><enum>(I)</enum><text>the dollar amount limitation in effect under this section for the area on October 21, 1998; or </text></subclause><subclause id="HD40C56E44AB6465D84285995C3B84868"><enum>(II)</enum><text>65 percent of the dollar amount limitation determined under the sixth sentence of such section 1454(a)(2) for a residence of the applicable size; and </text></subclause></clause></subparagraph><subparagraph id="H0F342BBE71DB4743BB3C85DFABE1D178"><enum>(B)</enum><text>not to exceed 100 percent of the appraised value of the property.</text></subparagraph><continuation-text continuation-text-level="paragraph">For purposes of the preceding sentence, the term <term>area</term> means a metropolitan statistical area as established by the Office of Management and Budget; and the median 1-family house price for an area shall be equal to the median 1-family house price of the county within the area that has the highest such median price.</continuation-text><continuation-text continuation-text-level="paragraph">Notwithstanding any other provision of this paragraph, the amount which may be insured under this section may be increased by up to 20 percent if such increase is necessary to account for the increased cost of the residence due to the installation of a solar energy system (as defined in subparagraph (3) of the last paragraph of section 2(a) of this Act) therein.</continuation-text><continuation-text continuation-text-level="paragraph">Notwithstanding any other provision of this paragraph, the Secretary may not insure, or enter into a commitment to insure, a mortgage under this section that is executed by a first-time homebuyer and that involves a principal obligation (including such initial service charges, appraisal, inspection, and other fees as the Secretary shall approve) in excess of 97 percent of the appraised value of the property unless the mortgagor has completed a program of counseling with respect to the responsibilities and financial management involved in homeownership that is approved by the Secretary; except that the Secretary may, in the discretion of the Secretary, waive the applicability of this requirement.</continuation-text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H4B742324AF5F40588D53FEB89EB588D5"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="HE10D1432821C4FDC9EFF5268AB1F3FC7" display-inline="no-display-inline"><paragraph id="H75E215012F1E42BFB621FCC25CDB7B30"><enum>(10)</enum><header>Definitions</header><text display-inline="yes-display-inline">For the purposes of this subsection:</text><subparagraph id="H57C6373F983045A2A2699C8B29DF1E47"><enum>(A)</enum><header>Eligible city or county</header><text display-inline="yes-display-inline">The term <quote>eligible city or county</quote> means a metropolitan city or urban county (as such terms are defined in section 102 of the Housing and Community Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5302">42 U.S.C. 5302</external-xref>)) that has a median 1-family home price that exceeds 115 percent of the median 1-family home price for the area within which such city or county is located and is located in an area that, as determined by the Secretary, experienced a decrease in maximum principal obligation amount under this paragraph for 1-family residences equal to or in excess of 20 percent between January 1, 2013, and January 1, 2014.</text></subparagraph><subparagraph id="H50F9B45F962442D6A93CC93AFED4682B"><enum>(B)</enum><header>Area</header><text display-inline="yes-display-inline">The term <quote>area</quote> means a metropolitan statistical area as established by the Office of Management and Budget.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H83A0491DDF66426E9C341F974DB21B92"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendment made by this Act shall apply only to mortgages with respect to which the Commissioner assigns a case number on or after January 1, 2023.</text></section></legis-body></bill>
