R. 5902</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211105">November 5, 2021</action-date><action-desc><sponsor name-id="I000056">Mr. Issa</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend title 35, United States Code, to clarify the relation of Inter Partes Review proceedings and Post-Grant Review proceedings to other administrative proceedings, and for other purposes.</official-title></form><legis-body id="H43A80505ECA542A99B02F02C2D5077B6" style="OLC"><section id="H0D4A18D6AD194A53A4C4461D16A103D9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Conducting Legally Efficient Administration and Resolution of Patents Act of 2021</short-title></quote> or the <quote><short-title>CLEAR Patents Act of 2021</short-title></quote>.</text></section><section id="HBE4F765A72EE4B52BE58DE47BEA7190E" section-type="subsequent-section"><enum>2.</enum><header>Relation of Inter Partes Review proceedings and Post-Grant Review proceedings to other administrative proceedings</header><subsection id="H4BD78EC4DC704487ADC57EDA71CABCB4"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Title 35, United States Code, is amended—</text><paragraph id="HFD07164BDBC041E9A1B6561230A47AED"><enum>(1)</enum><text>in section 315, by adding at the end the following: </text><quoted-block style="OLC" id="HC6D107CD3C034916849203A71F2BC046" display-inline="no-display-inline"><subsection id="H292E024D09484E1EA4B529DBECAB3614"><enum>(f)</enum><header>Relation to other administrative proceedings</header><text display-inline="yes-display-inline">If the Director institutes an inter partes review of a patent, any proceeding before a Federal agency (as that term is defined in section 201) that would be materially affected by one or more of the claims of the patent being cancelled under such review shall be stayed until a final written decision by the Board is issued under such review or such review is otherwise terminated. </text></subsection><after-quoted-block>; and </after-quoted-block></quoted-block></paragraph><paragraph id="HA7F8401EE58044B9A3AB128A40019E30"><enum>(2)</enum><text>in section 325, by adding at the end the following: </text><quoted-block style="OLC" id="HD3D2826AD02645C9B451E7604BD4AAD0" display-inline="no-display-inline"><subsection id="H8E2E9B7F75FA49D1B740166C906C8C33"><enum>(f)</enum><header>Relation to other administrative proceedings</header><text display-inline="yes-display-inline">If the Director institutes a post-grant review of a patent, any proceeding before a Federal agency (as that term is defined in section 201) that would be materially affected by one or more of the claims of the patent being cancelled shall be stayed until a final written decision by the Board is issued under such review or such review is otherwise terminated.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8852FD9268D94DD28AC0857101A1DC7A"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">This section, and the amendments made by this section, shall apply with respect to—</text><paragraph id="H67F0B8DA54474435959129606B5251DB"><enum>(1)</enum><text>an inter partes review proceeding or post-grant review proceeding initiated on or after the date of the enactment of this Act; and</text></paragraph><paragraph id="H60AC919D06CC4A738669A82177E455F5"><enum>(2)</enum><text>a proceeding before a Federal agency initiated on or after the date that is 6 months before the date of the enactment of this Act. </text></paragraph></subsection></section></legis-body></bill>
