R. 5876</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211104">November 4, 2021</action-date><action-desc><sponsor name-id="M001180">Mr. McKinley</sponsor> (for himself, <cosponsor name-id="G000577">Mr. Graves of Louisiana</cosponsor>, <cosponsor name-id="B001248">Mr. Burgess</cosponsor>, and <cosponsor name-id="C001120">Mr. Crenshaw</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name>, and in addition to the Committee on <committee-name committee-id="HFA00">Foreign Affairs</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the implementation of climate finance plans, and for other purposes.</official-title></form><legis-body id="HCFDADB1FA4214CBAB773D1A09B443133" style="OLC"><section id="H18F57DE78D8344B4AB72B75F346CADED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Affordable and Reliable Energy in Developing Countries Act of 2021</short-title></quote>.</text></section><section id="HE9ECA418A14446A29076DAB57BC42341"><enum>2.</enum><header>Prohibition on implementation of climate finance plans</header><subsection id="H6CF343BA1C914D6396EF8C7FD85B8086"><enum>(a)</enum><header>Prohibition</header><paragraph id="H9EF35D1259FB4ABC94C97EBEE3CB4B34"><enum>(1)</enum><header>Federal agency; Government corporation</header><text display-inline="yes-display-inline">No Federal agency or Government corporation may implement a climate finance plan that would prohibit, or have the effect of prohibiting, the financing of a covered project.</text></paragraph><paragraph id="HF77DA63989964C7D8A86102E985B8E30"><enum>(2)</enum><header>United States position in international financial institutions</header><text>The Secretary of the Treasury shall instruct the United States Executive Director at each international financial institution to use the voice and vote of the United States to oppose the provision by the institution of any form of support for the implementation of a climate finance plan described in paragraph (1).</text></paragraph></subsection><subsection id="HAA6C571E13254C49AD8B623D5E8C270D"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HD718092BEA134BD1BABEBF910826D87A"><enum>(1)</enum><header>Climate finance plan</header><text display-inline="yes-display-inline">The term <term>climate finance plan</term> means a climate finance plan, as described in Executive Order 14008 (86 Fed. Reg. 7619).</text></paragraph><paragraph id="HEB23C208C8C54A50BA5F63DF46B483C0"><enum>(2)</enum><header>Covered project</header><text display-inline="yes-display-inline">The term <term>covered project</term> means a project to construct a facility that—</text><subparagraph id="H9D41521179B248AFB0018A29344039CF"><enum>(A)</enum><text>uses a fossil fuel or nuclear reaction as a source of energy to generate electricity; and</text></subparagraph><subparagraph id="H5A9375C3DE80478B87D22FC74AA7BF12"><enum>(B)</enum><text>would—</text><clause id="H2C48B2E0786149FCBFEC0917AA9DF8F9"><enum>(i)</enum><text>provide affordable electricity in a developing country;</text></clause><clause id="HA5F30075C7CA4492901933A97107731B"><enum>(ii)</enum><text display-inline="yes-display-inline">increase the export of clean energy technologies, including carbon capture, utilization, and storage, wind, solar, or nuclear technologies, from the United States or any domestic resource with a lower lifecycle emissions rate than large scale global alternatives;</text></clause><clause id="H4E005368241542F0940C35A1D953F044"><enum>(iii)</enum><text>not put the United States at a competitive disadvantage with the People’s Republic of China or another country that continues to encourage the construction of facilities that use a fossil fuel or nuclear reaction as a source of energy to generate electricity; or</text></clause><clause id="HD25FB8C9972C40A782106051D352A772"><enum>(iv)</enum><text>prevent the loss of jobs in the United States.</text></clause></subparagraph></paragraph><paragraph id="HADE8FFC1451E49418A8810A288BCE36C" commented="no"><enum>(3)</enum><header>Federal agency</header><text>The term <term>Federal agency</term> has the meaning given the term <term>agency</term> in section 551 of title 5, United States Code.</text></paragraph><paragraph id="HD912C986822F4A238A37279514AA46AA"><enum>(4)</enum><header>Fossil fuel</header><text display-inline="yes-display-inline">The term <term>fossil fuel</term> means natural gas, petroleum, coal, or any form of solid, liquid, or gaseous fuel derived from natural gas, petroleum, coal which may be used to create useful heat.</text></paragraph><paragraph id="H05DCB926B8C34240B8BB05F9F4C30514" commented="no"><enum>(5)</enum><header>Government corporation</header><text display-inline="yes-display-inline">The term <term>Government corporation</term> has the meaning given that term in section 103 of title 5, United States Code.</text></paragraph><paragraph id="H57966D765FEB4355A6E4C9D5DAE47B39"><enum>(6)</enum><header>International financial institution</header><text>The term <term>international financial institution</term> has the meaning given the term in section 1701(c)(2) of the International Financial Institutions Act.</text></paragraph></subsection></section></legis-body></bill>
