<official-title display="yes">To amend the Public Health Service Act to provide best practices on student suicide awareness and prevention training and condition State educational agencies, local educational agencies, and tribal educational agencies receiving funds under section 520A of such Act to establish and implement a school-based student suicide awareness and prevention training policy.</official-title>

<section id="H8FBC0B2B12724A92B0EA7E47852B1C2A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Suicide Training and Awareness Nationally Delivered for Universal Prevention Act of 2021</short-title></quote> or the <quote><short-title>STANDUP Act of 2021</short-title></quote>.</text></section> <section id="H2F8BBF6C40834B75A59CE0A242AD908B"><enum>2.</enum><header>Student suicide awareness and prevention training</header> <subsection id="H1BE9D108F614472BA6A15B4C6BC21E44"><enum>(a)</enum><header>In general</header><text>Title V of the Public Health Service Act is amended by inserting after section 520A of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-32">42 U.S.C. 290bb–32</external-xref>) the following:</text>

<section id="H62E501B6EC9348FB92D476DEE415CB09"><enum>520B.</enum><header>Student suicide awareness and prevention training policies</header> 
<subsection id="H0666D41EF8294CC98CA5A524B814FD9B"><enum>(a)</enum><header>In general</header><text>As a condition on receipt of funds under section 520A, each State educational agency, local educational agency, and Tribal educational agency that receives such funds, directly or through a State or Indian Tribe, for activities to be performed within secondary schools, including the Project AWARE State Education Agency Grant Program, shall—</text> <paragraph id="H30F89A1BA2E34312BB2C045ACB5BED1B"><enum>(1)</enum><text>establish and implement a school-based student suicide awareness and prevention training policy;</text></paragraph> 
<paragraph id="H97F5745D1C24405F87DE9C99B613E06B"><enum>(2)</enum><text>consult with stakeholders (including principals, teachers, parents, local Tribal officials, and other school leaders) in the development of the policy under subsection (a)(1); and</text></paragraph> <paragraph id="H4BBED834699E4B2D8D2E0DFD9ED018CC"><enum>(3)</enum><text>collect and report information in accordance with subsection (c).</text></paragraph></subsection> 
<subsection id="HCCB9DDCF6D8549388802801A6B8CB54F"><enum>(b)</enum><header>School-Based student suicide awareness and prevention training policy</header><text>A school-based student suicide awareness and prevention training policy implemented pursuant to subsection (a)—</text> <paragraph id="HADB1058806FC45ABABE71C3BB7F16112"><enum>(1)</enum><text>shall be evidence-based;</text></paragraph> 
<paragraph id="H268D7F73221A433D86E51E699C1B628A"><enum>(2)</enum><text display-inline="yes-display-inline">shall be culturally and linguistically appropriate; </text></paragraph> <paragraph id="HCB688BA59EE5439B876F5DED518ECFF8"><enum>(3)</enum><text>shall provide evidence-based training to students in grades 6 through 12, in coordination with school-based mental health service providers as defined in section 4102(6) of the Elementary and Secondary Education Act of 1965, if applicable, regarding—</text> 
<subparagraph id="H430253D818D042569307C386825F6B6A"><enum>(A)</enum><text>suicide education and awareness, including warning signs of self-harm or suicidal ideation;</text></subparagraph> <subparagraph id="H1D369E04FDC04DDE8434756C93405B6C"><enum>(B)</enum><text>methods that students can use to seek help for themselves and others; and</text></subparagraph> 
<subparagraph id="H274C118FF42949B4AB0FDBD926B25739"><enum>(C)</enum><text>student resources for suicide awareness and prevention;</text></subparagraph></paragraph> <paragraph id="HDE75CFED6D754BF7B1273D0233133768"><enum>(4)</enum><text>shall provide for retraining of such students every school year;</text></paragraph> 
<paragraph id="H816F11A055C24673AED6E9D5AD848C80"><enum>(5)</enum><text>may last for such period as the State educational agency, local educational agency, or Tribal educational agency involved determines to be appropriate; </text></paragraph> <paragraph id="H4524BA7CFE97441BBE3ED553896B7462"><enum>(6)</enum><text>may be implemented through any delivery method, including in-person trainings, digital trainings, or train-the-trainer models; and</text></paragraph> 
<paragraph id="HA295245703B344178E394A1AE0AE7A78"><enum>(7)</enum><text display-inline="yes-display-inline">may include discussion of comorbidities or risk factors for suicidal ideation or self-harm, including substance misuse, sexual or physical abuse, mental illness, or other evidence-based comorbidities and risk factors.</text></paragraph></subsection> <subsection id="H77E72415C3D0417F9534D2F6F591239F"><enum>(c)</enum><header>Collection of information and reporting</header><text display-inline="yes-display-inline">Each State educational agency, local educational agency, and Tribal educational agency that receives funds under section 520A shall, with respect to each school served by the agency, collect and report to the Secretary the following information:</text> 
<paragraph id="HB06648DA43E54495A1C27CC7CA2D60F7"><enum>(1)</enum><text>The number of student trainings conducted.</text></paragraph> <paragraph id="H18832BE4148C45CD9BB6019978E02663"><enum>(2)</enum><text>The number of students trained, dis­ag­gre­gat­ed by age and grade level.</text></paragraph> 
<paragraph id="HB3641D7BA3934CB5821FCAE049362C65"><enum>(3)</enum><text>The number of help-seeking reports made by students after implementation of such policy.</text></paragraph></subsection> <subsection id="HECBBFECDEA9C48C29FFDF319032F28EA"><enum>(d)</enum><header>Evidence-Based program listing</header><text>The Secretary of Health and Human Services shall coordinate with the Secretary of Education to make publicly available the policies established by State educational agencies, local educational agencies, and Tribal educational agencies pursuant to this section and the training that is available to students and teams pursuant to such policies, including identification of whether such training is available to trainees at no cost.</text></subsection> 
<subsection id="H889DFC5C3BA04F4AA438849DC600431D"><enum>(e)</enum><header>Implementation timeline</header><text display-inline="yes-display-inline">A State educational agency, local educational agency, or Tribal educational agency shall establish and begin implementation of the policies required by subsection (a)(1) not later than the beginning of the third fiscal year following the date of enactment of this section for which the agency receives funds under section 520A.</text></subsection> <subsection id="H97713BB31988421A942E5062C80AD33D"><enum>(f)</enum><header>Definitions</header><text>In this section and section 520B–1:</text> 
<paragraph id="H8FE08DBFB4D7484EBC1705C677A7FD0A"><enum>(1)</enum><text>The term <term>evidence-based</term> has the meaning given to such term in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph> <paragraph id="H375D1E1D8AEA48AD9A8D27875812FEA0"><enum>(2)</enum><text>The term <term>local educational agency</term> has the meaning given to such term in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph> 
<paragraph id="H79D058DB1C664BA5B1E3A1CDD3841161"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>State educational agency</term> has the meaning given to such term in section 8101 of the Elementary and Secondary Education Act of 1965.</text></paragraph> <paragraph id="H47835408BD1A499BB4B3996C0D1D949C"><enum>(4)</enum><text display-inline="yes-display-inline">The term <term>Tribal educational agency</term> has the meaning given to the term <term>tribal educational agency</term> in section 6132 of the Elementary and Secondary Education Act of 1965.</text></paragraph></subsection></section> 
<section id="H7B496D5567384685AF5D6FE42D689F55"><enum>520B–1.</enum><header>Best practices for student suicide awareness and prevention training</header><text display-inline="no-display-inline">The Secretary of Health and Human Services, in consultation with the Secretary of Education and the Bureau of Indian Education, shall—</text> <paragraph id="HF8AB13367EC04DFC85100EE0E63BD55A"><enum>(1)</enum><text>publish best practices for school-based student suicide awareness and prevention training, pursuant to section 520B, that are based on—</text> 
<subparagraph id="HC68D0EA0A9064B0C8F02C4496C961BDB"><enum>(A)</enum><text>evidence-based practices; and</text></subparagraph> <subparagraph id="HB8F052DF21354FBDB07F5D98223634A3"><enum>(B)</enum><text display-inline="yes-display-inline">input from relevant Federal agencies, national organizations, Indian Tribes and Tribal organizations, and related stakeholders;</text></subparagraph></paragraph> 
<paragraph id="HF99D4EA1B4AB4CCCB33A88ACDAF2C28E"><enum>(2)</enum><text>publish guidance, based on the best practices under paragraph (1), to provide State educational agencies, local educational agencies, and Tribal educational agencies with information on student suicide awareness and prevention best practices;</text></paragraph> <paragraph id="HC3B78EB9DAD1445096B3A4550D6F6792"><enum>(3)</enum><text>disseminate such best practices to State educational agencies, local educational agencies, and Tribal educational agencies; and</text></paragraph> 
<paragraph id="H0E4A32FED2BC4939B0AE0424AAD517B3"><enum>(4)</enum><text>provide technical assistance to State educational agencies, local educational agencies, and Tribal educational agencies.</text></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> <section id="H017AB87F1DA94668BBE43B2FC33B90DD"><enum>3.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall only apply with respect to applications for assistance under section 520A of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-32">42 U.S.C. 290bb–32</external-xref>) that are submitted after the date of enactment of this Act.</text></section>
