R. 5861</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211104">November 4, 2021</action-date><action-desc><sponsor name-id="E000296">Mr. Evans</sponsor> (for himself and <cosponsor name-id="F000471">Mr. Fitzgerald</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HSM00">Committee on Small Business</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To streamline the process for granting certain waivers for requirements on contracts awarded under section 8(a) of the Small Business Act, and for other purposes.</official-title></form><legis-body id="HC7F6A1A86A2940479D30F3AFF7AA9BE8" style="OLC"><section id="HD1FB039B101E4C489E2DD957BD44F186" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Waiver Authorization Streamlining Act of 2021</short-title></quote>. </text></section><section id="H4A47CD12F4144C80920F44DF55D30780"><enum>2.</enum><header>Waiver authorization streamlining</header><text display-inline="no-display-inline">Section 8(a)(21) of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/637">15 U.S.C. 637(a)(21)</external-xref>) is amended—</text><paragraph id="H2E7A332E1B0B4F39984CA0A6BED2EB53"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>subparagraph (B)</quote> and inserting <quote>subparagraphs (B) and (F)</quote>;</text></paragraph><paragraph id="H4BAAFC95C7634B99BDA7AC8EB17A1CD3"><enum>(2)</enum><text>in subparagraph (B)—</text><subparagraph id="H806A3B84078147DEABBAE44522DC88EB"><enum>(A)</enum><text>by striking clause (iii); and</text></subparagraph><subparagraph id="H87BB14D8A4B1452281BBBAD12CD80878"><enum>(B)</enum><text>by redesignating clauses (iv) and (v) as clauses (iii) and (iv), respectively;</text></subparagraph></paragraph><paragraph id="HF64D8934C9364A909766269B6DC5177E"><enum>(3)</enum><text>by moving subparagraph (C) two ems to the left; and</text></paragraph><paragraph id="H0EC6E065E2024FE6808E1EA8D85B5D71"><enum>(4)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H91E4397E790045378B67A46FAA689D98" display-inline="no-display-inline"><subparagraph id="H4DF9D4A2A62140BA8CDE0BB58BD0A14B" indent="up2"><enum>(F)</enum><text display-inline="yes-display-inline">In the event either a contract awarded pursuant to this subsection or ownership and control of a concern performing a contract awarded pursuant to this subsection will pass to another small business concern, the requirements of subparagraph (A) shall not apply if—</text><clause id="H77658A913CC9462CB7B53AE0F192E9B8"><enum>(i)</enum><text display-inline="yes-display-inline">the acquiring small business concern is a program participant; and</text></clause><clause id="H22023128B1E34A899E8D5866A04069A1"><enum>(ii)</enum><text display-inline="yes-display-inline">upon a request submitted prior to the passage of the contract or the actual relinquishment of ownership and control, as applicable, the Administrator (or the delegee of the Administrator) determines that the acquiring small business concern would otherwise be eligible to directly receive the award pursuant to this subsection.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
