R. 5860</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211104">November 4, 2021</action-date><action-desc><sponsor name-id="B001309">Mr. Burchett</sponsor> (for himself, <cosponsor name-id="H001077">Mr. Higgins of Louisiana</cosponsor>, <cosponsor name-id="M001199">Mr. Mast</cosponsor>, <cosponsor name-id="G000590">Mr. Green of Tennessee</cosponsor>, <cosponsor name-id="D000615">Mr. Duncan</cosponsor>, <cosponsor name-id="H001091">Mrs. Hinson</cosponsor>, <cosponsor name-id="C001039">Mrs. Cammack</cosponsor>, <cosponsor name-id="M001212">Mr. Moore of Alabama</cosponsor>, <cosponsor name-id="M001215">Mrs. Miller-Meeks</cosponsor>, <cosponsor name-id="T000165">Mr. Tiffany</cosponsor>, <cosponsor name-id="G000591">Mr. Guest</cosponsor>, <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>, <cosponsor name-id="N000190">Mr. Norman</cosponsor>, and <cosponsor name-id="C001118">Mr. Cline</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HGO00">Oversight and Reform</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To exempt essential workers from Federal COVID–19 vaccine mandates.</official-title></form><legis-body id="H51DAAB50A97141D38281D6C3C4C86DDC" style="OLC"><section id="HFD3378AB99754154AA98235F71CD6C11" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keeping Our COVID–19 Heroes Employed Act</short-title></quote>.</text></section><section id="H3743A6BB47784C9195D3010D1B6E5E52"><enum>2.</enum><header>Exemption from vaccine mandates</header><subsection id="HED8E540B38864249AEF6B3FAAD24A1BA"><enum>(a)</enum><header>In general</header><text>Any requirement imposed by an entity described in subsection (b) that individuals be vaccinated against COVID–19 shall provide for an exemption from such requirement for all essential workers.</text></subsection><subsection id="H1E69F275FE6F45E5A0EDB99CCB72BE58"><enum>(b)</enum><header>Entities described</header><text>An entity described in this subsection is any of the following:</text><paragraph id="H88BB41C3CF844D369673DAA388E6B2A5"><enum>(1)</enum><text>The Federal Government.</text></paragraph><paragraph id="H08E578E5144249C08E87AB3674C2F30C"><enum>(2)</enum><text>A public or private Federal contractor.</text></paragraph><paragraph id="HF3727AC1EE404FA0A72E60F35B3D884E"><enum>(3)</enum><text>A private entity receiving Federal funds.</text></paragraph><paragraph id="H7138598F25AC4ACDBA7B28F721D4D05B"><enum>(4)</enum><text>A public entity receiving funding under the Coronavirus Preparedness and Response Supplemental Appropriations Act, 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/123">Public Law 116–123</external-xref>), the Families First Coronavirus Response Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/127">Public Law 116–127</external-xref>), the Coronavirus Aid, Relief, and Economic Security Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/136">Public Law 116–136</external-xref>), the Paycheck Protection Program and Health Care Enhancement Act (<external-xref legal-doc="public-law" parsable-cite="pl/116/139">Public Law 116–139</external-xref>), division M or N of the Consolidated Appropriations Act, 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/260">Public Law 116–260</external-xref>), or the American Rescue Plan Act of 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/117/2">Public Law 117–2</external-xref>), as a condition for retaining such funds or receiving future disbursements of such funds.</text></paragraph></subsection><subsection id="H815B2D34FD4B42E39C7D797E8CBA2D79"><enum>(c)</enum><header>Essential workers defined</header><text>For purposes of this section, the term <term>essential worker</term> means an individual—</text><paragraph id="H4FD379210503430C9621CFA74965A989"><enum>(1)</enum><text>whom a relevant State, Indian Tribe, or territory deemed essential during the response to the COVID–19 pandemic; or</text></paragraph><paragraph id="H071287609B244B8CB2D22F161418294A"><enum>(2)</enum><text display-inline="yes-display-inline">who was exempt from any restrictions in response to the COVID–19 pandemic imposed by a relevant State, Indian Tribe, or territory.</text></paragraph></subsection></section></legis-body></bill>
