R. 5844</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211103">November 3, 2021</action-date><action-desc><sponsor name-id="J000288">Mr. Johnson of Georgia</sponsor> (for himself and <cosponsor name-id="I000056">Mr. Issa</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for the modernization of electronic case management systems, and for other purposes.</official-title></form><legis-body id="H543DA33318FE4945BC61914D76886A1E" style="OLC"><section section-type="section-one" id="H66890E735139473691F2ABFE612E46A5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Open Courts Act of 2021</short-title></quote>.</text></section><section id="H426754BC46134E7996F8E723968AF64A"><enum>2.</enum><header>Modernization of electronic court records systems</header><subsection id="H618ED7CF442942349A211CE99A074F1C"><enum>(a)</enum><header>Consolidation</header><text>Not later than the date specified in subsection (e), the Director of the Administrative Office of the United States Courts, in coordination with the Administrator of General Services, shall develop, deliver, and sustain, consistent with the requirements of this section and section 3, one system for all public court records.</text></subsection><subsection id="H174C6160897C48EB9FCF59EA977F432C"><enum>(b)</enum><header>Requirements of system</header><text>The system described under subsection (a) shall comply with the following requirements:</text><paragraph id="HC25E5B8C03B4412B8F9665170895E330"><enum>(1)</enum><text>The system shall provide search functions, developed in coordination with the Administrator of General Services, for use by the public and by parties before the court.</text></paragraph><paragraph id="HE9CA4EE4BC9C48278409DE7393CB0F37"><enum>(2)</enum><text>The system shall make public court records automatically accessible to the public upon filing.</text></paragraph><paragraph id="H771D7A375F434877965A64DAA174F7C6"><enum>(3)</enum><text>Any information made available through a website established pursuant to section 205 of the E-Government Act of 2002 shall be included in the system.</text></paragraph><paragraph id="H05D27CF0E4C14824A026EEF0AD385E23"><enum>(4)</enum><text>Any website for the system shall substantially comply with the requirements under subsections (b) and (c) of section 205 of the E-Government Act of 2002.</text></paragraph><paragraph id="H34511CCBC87C4DBBB077C0E7E9CB6480"><enum>(5)</enum><text>To the extent practicable, external websites shall be able to link to documents on the system. Each website established pursuant to section 205 of the E-Government Act of 2002 shall contain a link to the system.</text></paragraph><paragraph id="H9FE21D3646CD442594475337ABF57037"><enum>(6)</enum><text>To the extent practicable, the system shall enable courts to automatically generate and submit, in a computer-readable format, the reports required by sections 2519(1) and 3103a(d)(1) of title 18, United States Code.</text></paragraph></subsection><subsection id="H6CCC2F23D82F4C94ABFAB8A18A388B4F"><enum>(c)</enum><header>Data standards</header><paragraph id="HE55CF40EAF904C0F927DCABCEE2A81F3"><enum>(1)</enum><header>Establishment of data standards</header><text>The Director of the Administrative Office of the United States Courts, in coordination with the Administrator of General Services and the Archivist of the United States, shall establish data standards for the system established under subsection (a).</text></paragraph><paragraph id="HA33E20521F0B46BCAF65CB7E61EDB793"><enum>(2)</enum><header>Requirements</header><text>The data standards established under paragraph (1) shall, to the extent reasonable and practicable—</text><subparagraph id="H9454536CF4EA441A8FBC475B9E756F28"><enum>(A)</enum><text>incorporate widely accepted common data elements;</text></subparagraph><subparagraph id="HC1EFECDADB064B6EA6DA67D282518AA8"><enum>(B)</enum><text>incorporate a widely accepted, nonproprietary, full text searchable, platform-independent computer-readable format; and</text></subparagraph><subparagraph id="HFB1A00C9209F49B19AB559BDBA243D65"><enum>(C)</enum><text>be capable of being continually upgraded as necessary.</text></subparagraph></paragraph><paragraph id="H840DE870E7EC46A5BD5E0BB53B224F38"><enum>(3)</enum><header>Deadlines</header><text>Not later than 6 months after the date of enactment of this Act, the Director of the Administrative Office of the United States Courts shall issue guidance to all Federal courts on the data standards established under this section.</text></paragraph></subsection><subsection id="H00822B12D19645C2894B99913995BD80"><enum>(d)</enum><header>Use of technology</header><text>In carrying out the duties under subsection (a), the Director shall use modern technology in order—</text><paragraph id="H6FA6113448D14FDDAC08F76DF77672A8"><enum>(1)</enum><text>to improve security, data accessibility, data quality, affordability, and performance; and</text></paragraph><paragraph id="HD346A39CE2D142FC8F05CBF74D837EA2"><enum>(2)</enum><text>to minimize the burden on pro se litigants.</text></paragraph></subsection><subsection id="HF15599E2F1CA41C08F157752574996AB"><enum>(e)</enum><header>Date specified</header><text>The date specified in this subsection is the date that is 2 years after the date of the enactment of this Act, unless the Administrator of General Services certifies to Congress, by not later than 90 days after such date of enactment, that an additional period of time is required. If the Administrator so certifies, the date specified in this subsection is the date that is 3 years after the date of enactment of this Act.</text></subsection><subsection id="H8D5006FF4C084471B695285D85D70AC1"><enum>(f)</enum><header>Funds for establishment, operation, and maintenance of modernized court records system</header><paragraph id="HC5CEA19C0AE34332AA6135DBA93EB05A"><enum>(1)</enum><header>Short term access fees to fund establishment of modernized court records system</header><subparagraph id="H8A10491BA7774C3B91F14FFD88895CD5"><enum>(A)</enum><header>In general</header><text>Section 303 of the Judiciary Appropriations Act, 1992 (title III of <external-xref legal-doc="public-law" parsable-cite="pl/102/140">Public Law 102–140</external-xref>; 105 Stat. 807) (<external-xref legal-doc="usc" parsable-cite="usc/28/1913">28 U.S.C. 1913</external-xref> note) is amended—</text><clause id="HBEFCA957A32A48AC9C1302B9578FF148"><enum>(i)</enum><text>in subsection (a), by inserting <quote>The Judicial Conference shall prescribe a schedule of additional fees for any person other than a government agency who accrues such fees for access in an amount of $25,000 or greater in any quarter. All fees collected shall be deposited as offsetting collections to the Judiciary Information Technology Fund pursuant to section 612(c)(1)(A) of title 28, United States Code, to reimburse expenses incurred in carrying out section 2 of the <short-title>Open Courts Act of 2021</short-title>.</quote> before <quote>The Director of the Administrative Office of the United States Courts</quote>; and</text></clause><clause id="HD3EDA97521834A229BC6B16F61C940C7"><enum>(ii)</enum><text>in subsection (b), by striking <quote>All fees hereafter</quote> and inserting <quote>Except as otherwise provided in this section, all fees hereafter</quote>.</text></clause></subparagraph><subparagraph id="H5700F21E89D74EDCAD1A7491680542EE"><enum>(B)</enum><header>Excess fees</header><text display-inline="yes-display-inline">Amounts deposited in the Judiciary Information Technology Fund pursuant to the amendments made by subparagraph (A) and not used to reimburse expenses incurred in carrying out section 2 of this Act may be used pursuant to section 612(a) of title 28, United States Code.</text></subparagraph><subparagraph id="HE5881A65590E43BD8CF7C10A8FF32EC3"><enum>(C)</enum><header>Effective date</header><text>The amendment made by subparagraph (A) shall take effect on the date of enactment of this Act.</text></subparagraph></paragraph><paragraph id="HC4CCD602C9F44C20B2003F62527E18A7"><enum>(2)</enum><header>Filing fees to fund operation and maintenance of modernized court records system</header><subparagraph id="HEBEAA299727244D28733C002A4464EC5"><enum>(A)</enum><header>In general</header><text>Section 303 of the Judiciary Appropriations Act, 1992 (title III of <external-xref legal-doc="public-law" parsable-cite="pl/102/140">Public Law 102–140</external-xref>; 105 Stat. 807) (<external-xref legal-doc="usc" parsable-cite="usc/28/1913">28 U.S.C. 1913</external-xref> note) is amended by striking subsections (a) and (b), and inserting the following:</text><quoted-block style="appropriations" display-inline="no-display-inline" id="H6E68CAF162B8458E8356D8ED63233E9D"><subsection id="H7169C1651890418BA1C43E64CC7691BB"><enum>(a)</enum><text display-inline="yes-display-inline">To cover the costs of carrying out section 2 of the <short-title>Open Courts Act of 2021</short-title>, the Judicial Conference may, only to the extent necessary, prescribe schedules of reasonable filing fees, pursuant to sections 1913, 1914, 1926, 1930, and 1932 of title 28, United States Code, which—</text><paragraph id="H12CD5D14CC274D5AAF6630F97D8177F6"><enum>(1)</enum><text display-inline="yes-display-inline">shall be based on the extent of use of the system described under such section 2 for purposes of such action;</text></paragraph><paragraph id="H4626237236EC4395B69BBDB4D440F25B"><enum>(2)</enum><text display-inline="yes-display-inline">shall in addition be based on factors including the nature of the action and claim for relief, the amount of damages demanded, the estimated complexity of the type of action, and the interests of justice;</text></paragraph><paragraph id="H041CA12FACBC4DE59C7B132C1098A496"><enum>(3)</enum><text display-inline="yes-display-inline">may be prescribed for the filing of a counterclaim;</text></paragraph><paragraph id="H4E4BCC05C14E407784355A6B55333042"><enum>(4)</enum><text>shall not apply in the case of a pro se litigant or litigant who certifies their financial hardship; and</text></paragraph><paragraph id="H1BF0B0C02A1A4B468B88CE4E39F52EE6"><enum>(5)</enum><text>shall not be a basis for denying access to the courts of the United States.</text></paragraph></subsection><subsection id="HC2907458F0AE48E2B0BB487CF74791BE"><enum>(b)</enum><text display-inline="yes-display-inline">The Judicial Conference and the Director shall transmit each schedule of fees prescribed under subsection (a) to Congress at least 90 days before the schedule becomes effective. All fees collected under subsection (a) shall be deposited as offsetting collections to the Judiciary Information Technology Fund pursuant to section 612(c)(1)(A) of title 28, United States Code, to reimburse expenses incurred in carrying out section 2 of the <short-title>Open Courts Act of 2021</short-title>.</text></subsection><subsection id="H048202FD76344008832E5E24B3F25B63"><enum>(c)</enum><text display-inline="yes-display-inline">The Judicial Conference shall review a schedule of fees prescribed under subsection (a) three years after it becomes effective and every three years thereafter to ensure that the fees meet the requirements of this section. If the fees do not meet the requirements of this section, the Judicial Conference shall prescribe a new schedule of fees pursuant to subsection (a) and submit the new schedule of fees to Congress pursuant to subsection (b).</text></subsection><subsection id="H9184D10B00C64DA3990E32F2FA0D7B6D"><enum>(d)</enum><text display-inline="yes-display-inline">Amounts deposited to the Judiciary Information Technology Fund pursuant to this section and not used to reimburse expenses incurred in carrying out section 2 of the <short-title>Open Courts Act of 2021</short-title> may be used pursuant to section 612(a) of title 28, United States Code.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H3BDBDAED1ECF4431AFEC378BEF1C4635"><enum>(B)</enum><header>Effective date</header><text>The amendment made by subparagraph (A) shall take effect on the date specified in subsection (e).</text></subparagraph></paragraph></subsection></section><section id="H641E2783A5834FCDBAE9D4E9AA54B656"><enum>3.</enum><header>Public access to electronic court records system requirement</header><subsection id="H0000348271014A659D12A153CFC2B571"><enum>(a)</enum><header>In general</header><text>Not later than the date specified in subsection (d), the Director of the Administrative Office of the United States Courts, in coordination with the Administrator of General Services, shall make all materials in the system established under section 2 publicly accessible, free of charge.</text></subsection><subsection id="H31975033B1C142A39B229863A03053DD"><enum>(b)</enum><header>Use of technology</header><text>In providing public access under subsection (a), the Director shall, in coordination with the Administrator of General Services, use modern technology in order—</text><paragraph id="H54504A2E220E4FEEAC4FA8C447D6A614"><enum>(1)</enum><text>to improve security, data accessibility, ease of public access, affordability, and performance; and</text></paragraph><paragraph id="H8315A783DED04401AF1C8F514AEB2D10"><enum>(2)</enum><text>to minimize the burden on pro se litigants.</text></paragraph></subsection><subsection id="H0507E5CA79DA49439169327ED466E4A9"><enum>(c)</enum><header>Date specified</header><text>The date specified in this subsection is the date that is 2 years after the date of the enactment of this Act, unless the Administrator of General Services certifies to Congress, by not later than 90 days after such date of enactment, that an additional period of time is required. If the Administrator so certifies, the date specified in this subsection is the date that is 3 years after the date of enactment of this Act.</text></subsection><subsection id="H7E31382972EA4096A86E791D4137B3EF"><enum>(d)</enum><header>Funding for public access to modernized electronic court records system</header><paragraph id="H6CBF2333D5DA461D837F5924CD4DA64D"><enum>(1)</enum><header>In general</header><text>Section 303 of the Judiciary Appropriations Act, 1992 (title III of <external-xref legal-doc="public-law" parsable-cite="pl/102/140">Public Law 102–140</external-xref>; 105 Stat. 807) (<external-xref legal-doc="usc" parsable-cite="usc/28/1913">28 U.S.C. 1913</external-xref> note) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HDE81811EC42B4C5A80D506358FF240B6"><subsection id="H90B7216124844712832E2898A429BD7E"><enum>(c)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H17CD55682CC4401A98BE94878177BED7"><enum>(1)</enum><text display-inline="yes-display-inline">To cover the costs of ensuring the public accessibility, free of charge, of all materials in the system described under sections 2 and 3 of the <short-title>Open Courts Act of 2021</short-title> in accordance with section 3 of such Act, the Judicial Conference shall collect an annual fee from Federal agencies equal to the Public Access to Court Electronic Records access fees paid by those agencies in 2018, as adjusted for inflation. All fees collected under this subsection shall be deposited as offsetting collections to the Judiciary Information Technology Fund pursuant to section 612(c)(1)(A) of title 28, United States Code, to reimburse expenses incurred in providing services in accordance with section 3 of the <short-title>Open Courts Act of 2021</short-title>.</text></paragraph><paragraph id="H48A706ADDC1B4286AED86A4A38FD7D3D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">To cover any additional marginal costs of ensuring the public accessibility, free of charge, of all materials in the system described under sections 2 and 3 of the <short-title>Open Courts Act of 2021</short-title> in accordance with section 3 of such Act, the Judicial Conference may prescribe schedules of reasonable filing fees, pursuant to sections 1913, 1914, 1926, 1930, and 1932 of title 28, United States Code. The schedules—</text><subparagraph id="HBEB86EE91E2F4F97AD344C5CE69E6666"><enum>(A)</enum><text>shall be based on the extent of use of the system described under such section 2;</text></subparagraph><subparagraph id="H4CC000035DF14B2AB81D7F57E5F079AB"><enum>(B)</enum><text>shall, in addition, be based on factors including the nature of the type of action and claim for relief, the amount of damages demanded, the estimated complexity of the type of action, and the interests of justice;</text></subparagraph><subparagraph id="H6C27F31084554AE6B5CBBF79A5160EDA"><enum>(C)</enum><text>may be prescribed for the filing of a counterclaim;</text></subparagraph><subparagraph id="HC0BB0895E29B4D308B484DAD5599A377"><enum>(D)</enum><text>shall not apply to a pro se litigant or a litigant who certifies their financial hardship; and</text></subparagraph><subparagraph id="H841E7D0A1E454325A326A338BCACDC99"><enum>(E)</enum><text>shall not be a basis for denying access to the courts of the United States.</text></subparagraph></paragraph><paragraph id="HDD43622697D3495CA35F925EE5A8B460" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H0379DC79100D4551800BF64BF181504F"><enum>(A)</enum><text>The Judicial Conference and the Director shall transmit each schedule of fees prescribed under this subsection to Congress at least 90 days before the schedule becomes effective. All fees collected under this subsection shall be deposited as offsetting collections to the Judiciary Information Technology Fund pursuant to section 612(c)(1)(A) of title 28, United States Code, to reimburse expenses incurred in providing services in accordance with section 3 of the <short-title>Open Courts Act of 2021</short-title>.</text></subparagraph><subparagraph id="H9F386EE7C0D74FEDBFE963CA68970D7D" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Judicial Conference shall review a schedule of fees prescribed under this paragraph three years after it becomes effective and every three years thereafter to ensure that the fees meet the requirements of this paragraph. If the fees do not meet the requirements of this paragraph, the Judicial Conference shall prescribe a new schedule of fees pursuant to this paragraph and submit the new schedule of fees to Congress pursuant to subparagraph (A).</text></subparagraph><subparagraph id="H00FEB52722FA4C53B8AE4675D9365A10" indent="up1"><enum>(C)</enum><text>Amounts deposited to the Judiciary Information Technology Fund pursuant to this subsection and not used to reimburse expenses incurred in carrying out section 3 of the <short-title>Open Courts Act of 2021</short-title> may be used to reimburse expenses incurred in carrying out section 2 of the <short-title>Open Courts Act of 2021</short-title>. Amounts not used to reimburse expenses incurred in carrying out section 2 of the <short-title>Open Courts Act of 2021</short-title> may be used pursuant to section 612(a) of title 28, United States Code.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="H7FEF768D7BF746C799A31FB6BFF6F361"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall take effect beginning on the date specified in subsection (d).</text></paragraph></subsection></section><section id="H3038CDA7BB174939AE823E5098683EC7"><enum>4.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or the amendments made by this Act, shall be construed to—</text><paragraph id="H5547A63C98B246018DDD5C01FD5D420A"><enum>(1)</enum><text>affect the filing fees or other filing procedures for prisoners; or</text></paragraph><paragraph id="H257A7EBA64B94A4093D494706C2CCDB1"><enum>(2)</enum><text>abrogate, limit, or modify the requirements described in section 1915 of title 28, United States Code.</text></paragraph></section><section id="H6821808F55874D35B6A9087ABC8293A6"><enum>5.</enum><header>Digital accessibility standards</header><text display-inline="no-display-inline">The system described under sections 2 and 3 of this Act or the amendments made by such sections shall comply with relevant digital accessibility standards established pursuant to section 508 of the Rehabilitation Act of 1973.</text></section><section id="H1C7495C7649546129F1B39F66C7D0E79"><enum>6.</enum><header>GAO review</header><subsection id="H9CA7959FC2A547C3AF31530937A756D2"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, and quarterly thereafter, the Comptroller General of the United States shall notify Congress whether the Director of the Administrative Office of United States Courts has—</text><paragraph id="H02DE216B47A041679E844698F707640B"><enum>(1)</enum><text>produced additional usable functionality of the system described under sections 2 and 3 of this Act;</text></paragraph><paragraph id="HD0F4550A4A4D4A88A4F476DD8A5AC431"><enum>(2)</enum><text>held live, publicly accessible demonstrations of software in development; and</text></paragraph><paragraph id="H05635763F0784122BD373A4345C10ED8"><enum>(3)</enum><text>allowed the Comptroller General or a designee to attend all sprint reviews held during the applicable period.</text></paragraph></subsection><subsection id="HF541B98E57694994942B2EF627FEC2B0"><enum>(b)</enum><header>Audit</header><text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, the Comptroller General of the United States shall—</text><paragraph id="H93AC5D4A53FF41DF95DA546C060A78DA"><enum>(1)</enum><text>conduct an audit of the system established under this Act, including the compliance of vendors with the quality assessment surveillance plan, code quality, and whether the system is meeting the needs of users; and</text></paragraph><paragraph id="H874F9966435F4535AA20B6C7A9DBE79B"><enum>(2)</enum><text>shall submit to Congress a report that contains—</text><subparagraph id="H3011C40DA46F400A98EE70795FBB91DE"><enum>(A)</enum><text>the results of the audit required under paragraph (1); and</text></subparagraph><subparagraph id="H28ABF96082184F02814365AF1AABF155"><enum>(B)</enum><text>any recommendations to improve the system established under this Act. </text></subparagraph></paragraph></subsection></section></legis-body></bill>
