which was referred to the <committee-name committee-id="HBA00">Committee on Financial Services</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Housing and Urban Development to improve services for survivors of domestic violence, dating violence, sexual assault, or stalking and their families.</official-title></form><legis-body id="H66358D7C34494CC3AAFF21D049D1F486" style="OLC"><section id="HCD61F10F7EE64F0C90FEDFA0FC8999C9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Help End Abusive Living Situations Act</short-title></quote> or the <quote><short-title>HEALS Act</short-title></quote>.</text></section><section id="H1D0FEDA416864F59AFA90B9D6A2DE58B"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text><paragraph id="H6875568EF64649B2AEEDBD687B3D817A"><enum>(1)</enum><text>the terms <term>dating violence</term>, <term>domestic violence</term>, <term>sexual assault</term>, and <term>stalking</term> have the meanings given those terms in section 40002(a) of the Violence Against Women Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/34/12291">34 U.S.C. 12291(a)</external-xref>);</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8527773F550147A29E72B4BD227B6904"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>Secretary</term> means the Secretary of Housing and Urban Development;</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3FF6B7EF69C9450695C5C57F8CD72D3F"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>victim service provider</term> has the meaning given the term in section 401 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB1CF716D91904F259A1F67893DAEE257"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>victim service provider project</term> means a project administered by a victim service provider designed to meet the needs of survivors of domestic violence, dating violence, sexual assault, or stalking and their families.</text></paragraph></section><section id="H3CA840CD5CD84A058B89FA7D63F7C1EA"><enum>3.</enum><header>Strengthening housing resources protections for survivors of domestic violence, dating violence, sexual assault, or stalking</header><subsection id="H1CC7D525C688411D9196729BCBAB7530"><enum>(a)</enum><header>Notice of funding availability</header><text>Subtitle C of title IV of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11360">42 U.S.C. 11360 et seq.</external-xref>) is amended—</text><paragraph id="H81C3DF295E51459CA624844C529B2304"><enum>(1)</enum><text>in section 422 (<external-xref legal-doc="usc" parsable-cite="usc/42/11382">42 U.S.C. 11382</external-xref>)—</text><subparagraph id="H2FABE5E85AE947779FC4AB32AD3EA595"><enum>(A)</enum><text>in subsection (a)—</text><clause id="HD19BF79DA84443BD9892EF099CBEFD7D"><enum>(i)</enum><text>by striking <quote>The Secretary</quote> and inserting the following:</text><quoted-block display-inline="no-display-inline" id="H7F33228F18BB4638BDF3509E0CF36057" style="OLC"><paragraph id="H1F0D31DE44564CF4B37E6D8C7D372D9F"><enum>(1)</enum><header>In general</header><text>The Secretary</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause><clause id="H9028A3F449824AF292A2D2B74D63E53C"><enum>(ii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HB3C9936D898247CDA6DB899FA322BD7A" style="OLC"><paragraph id="H0FBA59071A5442A9B27CAB4798390443"><enum>(2)</enum><header>Scoring</header><text>For purposes of scoring applicants in the notice of funding availability, the Secretary shall neither prioritize nor deprioritize the following categories of projects solely on the basis of the category:</text><subparagraph id="HFDD7BA2527584405A4F728DE5E218E88"><enum>(A)</enum><text>Rapid re-housing.</text></subparagraph><subparagraph id="HE0905F6F9E5F4BF4BA83A280BFC41B5C"><enum>(B)</enum><text>Permanent supportive housing.</text></subparagraph><subparagraph id="H1A1A517F7B394B4FA42A35DF4B253472"><enum>(C)</enum><text>Transitional housing.</text></subparagraph><subparagraph id="H514A14BCA63840DEB694ECAA9AA1E45B"><enum>(D)</enum><text>Short-term emergency shelter.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></clause></subparagraph></paragraph><paragraph id="HF45320A3962E4BD18C139C6AF9B63BBE"><enum>(2)</enum><text>in section 428(d)(2) (<external-xref legal-doc="usc" parsable-cite="usc/42/11386b">42 U.S.C. 11386b(d)(2)</external-xref>)—</text><subparagraph id="H3948BDABF509489BADD34C394AB32F6F"><enum>(A)</enum><text>in subparagraph (B), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HCACDDD3BD6D244D4B2F6956F9448224E"><enum>(B)</enum><text>by redesignating subparagraph (C) as subparagraph (D); and</text></subparagraph><subparagraph id="H4F0247617C094C40877BFFF19A524CA6"><enum>(C)</enum><text>by inserting after subparagraph (B) the following:</text><quoted-block display-inline="no-display-inline" id="HF6BF4FD4B9A84780948C30239E04B9FA" style="OLC"><subparagraph id="HBB585BA86FAF4FBC9C0E714029790D4C"><enum>(C)</enum><text>transitional housing for various populations, including, for survivors of domestic violence, dating violence, sexual assault, or stalking and their families, projects providing transitional or permanent housing that provide trauma-informed services, maximize client choice, and address the special needs of those survivors; and</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection><subsection id="HF9F56CDE72174E7983C12F5F19CB4D39"><enum>(b)</enum><header>Strategic plan</header><text>In the next strategic plan required after the date of enactment of this Act under section 306 of title 5, United States Code, the Secretary shall include as a goal or objective—</text><paragraph id="HB190C7D58F184AEEB2080B853F87F707"><enum>(1)</enum><text>responding, including allocating appropriate resources, to the housing needs of survivors of domestic violence, dating violence, sexual assault, or stalking and their families; and</text></paragraph><paragraph id="H2A59FD5F310B4C19B2EEE04A60FF33E1"><enum>(2)</enum><text>collaborating with the Office of Violence Against Women of the Department of Justice to ensure that there is no conflict between the rapid re-housing requirements of that Office and of the Department of Housing and Urban Development.</text></paragraph></subsection><subsection id="HA3DABF39AFD64B2C951D3C39A8E19F35"><enum>(c)</enum><header>Evaluation</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall develop—</text><paragraph id="H488B7AE0030D481DBB63E1DFD4DA4A25"><enum>(1)</enum><text>in accordance with the selection criteria under section 427(b)(1) of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11386a">42 U.S.C. 11386a(b)(1)</external-xref>), as amended by section 4, measurable criteria upon which applicants for a grant under section subtitle C of title IV of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11381">42 U.S.C. 11381 et seq.</external-xref>) are evaluated to demonstrate their local policy priorities focused on survivors of domestic violence, dating violence, sexual assault, or stalking and their families, including survivor-centered coordinated entry processes that appropriately assess and prioritize those survivors and take into account the safety and confidentiality needs of those survivors and their families; and</text></paragraph><paragraph id="HA1A4A843D60C4B8C83DEF788D906A006"><enum>(2)</enum><text>mechanisms that promote the provision of technical assistance and support for programs to improve outcomes and maintain grant funding.</text></paragraph></subsection><subsection id="HCD526A2AE2574FAD85B3E4BEBC3CC362"><enum>(d)</enum><header>Research agenda</header><text display-inline="yes-display-inline">Not later than 180 days after the date of enactment of this Act, the Secretary shall develop a research agenda that—</text><paragraph id="H5C54D9D5E0844D8EBDC59BA7ECCBCF87"><enum>(1)</enum><text display-inline="yes-display-inline">works and collaborates with the Family Violence Prevention and Services Program of the Department of Health and Human Services and the Office of Violence Against Women of the Department of Justice; and</text></paragraph><paragraph id="H0DFDD69BD1F04C6392A54E8FD1C5A254"><enum>(2)</enum><text display-inline="yes-display-inline">focuses on survivors of domestic violence, dating violence, sexual assault, or stalking and their families, concentrating on the housing modalities that best support them and the mechanisms that best facilitate their efforts to secure housing, while also paying attention to the critical safety concerns and the link between trauma and residential stability.</text></paragraph></subsection></section><section id="HC18835B9671848FB8BA43C0582768AA7"><enum>4.</enum><header>Increasing access to safe shelter for survivors of domestic violence, dating violence, sexual assault, or stalking</header><text display-inline="no-display-inline">Section 427 of the McKinney-Vento Homeless Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/11386a">42 U.S.C. 11386a</external-xref>) is amended—</text><paragraph id="H3552FEA074CA466DBF000228C4933C1F"><enum>(1)</enum><text>in subsection (b)(1)—</text><subparagraph id="HC894621E01B04E15A99BAF0D4BA76F12"><enum>(A)</enum><text>in subparagraph (B)(iv)(I), by inserting <quote>, including survivors of domestic violence, dating violence, sexual assault, or stalking and their families</quote> after <quote>subpopulations</quote>;</text></subparagraph><subparagraph id="H9541FF8937424078927808B6FA50A9F3"><enum>(B)</enum><text>in subparagraph (C)—</text><clause id="H7047C6FE1E2440CD9E0E76DE11412AC2"><enum>(i)</enum><text>in clause (iii), by striking <quote>and</quote> at the end;</text></clause><clause id="H203C76231E6B44128772FE2AA35B0455"><enum>(ii)</enum><text>in clause (iv), by adding <quote>and</quote> at the end; and</text></clause><clause id="H923053EB954F4969BD4D435F156279EB"><enum>(iii)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H23DCA04F4EDB4442AA3CDDA10A0F5E34" style="OLC"><clause id="H5BA9937052F94C74BAB354480E375AD9"><enum>(v)</enum><text>meets the safety and trauma needs of survivors of domestic violence, dating violence, sexual assault, or stalking and their families, including access to safe shelter;</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HB935CDAD4D6E463CBF1AF90DB6704AB3"><enum>(C)</enum><text>in subparagraph (F)(ii), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HAC732378A2164840BB7E1BD1DACACF01"><enum>(D)</enum><text>by redesignating subparagraph (G) as subparagraph (H); and</text></subparagraph><subparagraph id="H1BD23699E30E4001B1B290B59805DCD9"><enum>(E)</enum><text>by inserting after subparagraph (F) the following:</text><quoted-block display-inline="no-display-inline" id="H6B0E04DC41EA4594B6AE145A3139CD1A" style="OLC"><subparagraph id="H057D262A6E5140F98B0739839ACA37FC"><enum>(G)</enum><text>the extent to which the assistance to be provided within the geographic area will meet the safety and trauma needs of survivors of domestic violence, dating violence, sexual assault, or stalking and their families, including access to safe shelter; and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HB37794B8BEC746679E0003517410ACC2"><enum>(2)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF08F6210A53747B1843670D9965F52BD" style="OLC"><subsection id="H3D6DBC06E94A4FD590321CFD53C5E96F"><enum>(d)</enum><header>Equal consideration of transitional housing projects</header><text>In awarding funds to recipients under this subtitle, the Secretary shall consider transitional housing projects on an even basis with any other project of a qualified applicant.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HA72841F47D0D43B2AA9D7AF97C084740"><enum>5.</enum><header>Report to Congress</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report on—</text><paragraph id="HE8CFE57E334D429A840EA28D94CF4E07"><enum>(1)</enum><text>the trends in allocating resources beginning after the date of enactment of the Homeless Emergency Assistance and Rapid Transition to Housing Act of 2009 (<external-xref legal-doc="public-law" parsable-cite="pl/111/22">Public Law 111–22</external-xref>; 123 Stat. 1663) to address the housing needs of survivors of domestic violence, dating violence, sexual assault, or stalking and their families; and</text></paragraph><paragraph id="H86220EB9F0694F92A1B6387C121B6B81"><enum>(2)</enum><text>the increase in the effectiveness of those resources for promoting self-sufficiency and assisting survivors in finding employment beginning after the date of enactment of this Act.</text></paragraph></section></legis-body></bill>
