R. 5749</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211027">October 27, 2021</action-date><action-desc><sponsor name-id="C001091">Mr. Castro of Texas</sponsor> (for himself and <cosponsor name-id="D000399">Mr. Doggett</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To impose natural gas trading limits during emergencies.</official-title></form><legis-body id="H42F41D37176044A195873E20BEB9A6CA" style="OLC"><section id="HFD0C5D5AF91E40BAA14E8850D908F5D1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Gas Consumer Emergency Market Protection Act</short-title></quote>.</text></section><section id="H7191379A9983472B87C7C6BEA7FB4735"><enum>2.</enum><header>Identification of beneficiaries of dramatic increases in natural gas prices in relation to Winter Storm Uri</header><subsection id="H3F3750C5911E44A79BA7728F9798564C"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Commodity Futures Trading Commission shall conduct a study designed to reveal who benefitted from the dramatic increases in natural gas prices on the spot market and day-ahead markets in relation to Winter Storm Uri.</text></subsection><subsection id="H607EED3CEE014690ABD0200E1DB9D031"><enum>(b)</enum><header>Report to the Congress</header><text>Within 180 days after the date of the enactment of this Act, the Commodity Futures Trading Commission shall submit to the Congress a written report that contains the results of the study required by subsection (a) and includes recommendations on how to address similar circumstances which may arise in the future.</text></subsection></section><section id="HA8E14814ADED4E739432A8F253F80A81"><enum>3.</enum><header>Rulemaking to require imposition of natural gas trading limits in the spot and day-ahead markets during emergency</header><text display-inline="no-display-inline">The Commodity Futures Trading Commission shall conduct a rulemaking requiring all facilities on or through which natural gas is traded on the spot market and the day-ahead market to impose limits on trading in natural gas during an emergency declared by an agency or instrumentality of the Federal Government, to prevent market distortions.</text></section><section id="H3CE19950FEDD4906B9C31343C82F8342"><enum>4.</enum><header>Prohibition on natural gas price gouging on spot or day-ahead market during emergency</header><text display-inline="no-display-inline">The Commodity Exchange Act (<external-xref legal-doc="usc" parsable-cite="usc/7/1">7 U.S.C. 1 et seq.</external-xref>) is amended by inserting after section 4t the following:</text><quoted-block style="OLC" id="H2FDA62696EA54D769E09EEA9AA640292" display-inline="no-display-inline"><section id="H608C9B57FB0F41B383A19BD7B392A31A"><enum>4u.</enum><header>Prohibition on natural gas price gouging on spot or day-ahead market during emergency</header><subsection id="H22B426FD6F954018A81EFBDB2427497D"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">If the Commission finds, after notice and opportunity for hearing, that, during an emergency declared by an agency or instrumentality of the Federal Government, a person has sold or offered for sale, or has attempted to sell or offer for sale, in or affecting interstate or foreign commerce, on any spot or day-ahead market, any quantity of natural gas for a price that exceeds such baseline price as the Commission may establish by rule, regulation or order, the Commission may subject the person to a civil penalty.</text></subsection><subsection id="H37D10D509D6E4D98A21CF98993B8B2C1"><enum>(b)</enum><header>Amount of penalty</header><text>The amount of a civil penalty imposed on a person under subsection (a) shall be not more than $1,000,000 per day.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
