Boyle of Pennsylvania</sponsor> (for himself and <cosponsor name-id="L000585">Mr. LaHood</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to include certain over-the-counter dietary supplement products as qualified medical expenses.</official-title></form><legis-body id="HA21E5F13D4D646619041DA4943D16533" style="OLC"><section id="HA2459B052DCB470AACF4714E5520C020" section-type="section-one"><enum>1.</enum><header>Inclusion of dietary supplement products as qualified medical expenses</header><subsection id="H1445164A917E45F695A000EBB7F07857"><enum>(a)</enum><header>HSAs</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/223">Section 223(d)(2)</external-xref> of the Internal Revenue Code of 1986 is amended—</text><paragraph id="H436C79BA295D435C8DB0760D00242279"><enum>(1)</enum><text>in subparagraph (A), by inserting <quote>or dietary supplement products</quote> after <quote>menstrual care products</quote>; and</text></paragraph><paragraph id="HE7CC16E917A747188747D5608F7DA993"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H58855AE23D164A76A4596A9EE1263D75"><subparagraph id="H66CEFC914E8E43ACACB66A945E85C6F4"><enum>(E)</enum><header>Dietary supplement product</header><text>For purposes of this paragraph, the term <term>dietary supplement product</term> means a nutritional product that is labeled with—</text><clause id="H6E2BEEE1EF134B9498592246B5B4DA88"><enum>(i)</enum><text>a statement describing how the product is intended to affect the structure or function of the human body, or </text></clause><clause id="H6FC1C64A2B91403CB4EC9FB9861A1E82"><enum>(ii)</enum><text>a statement characterizing the mechanism by which the product acts to maintain such structure or function.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H8719304F2D25430DB20379F12C06DF17"><enum>(b)</enum><header>Archer MSAs</header><text>The last sentence of section 220(d)(2)(A) of such Code is amended by inserting <quote>or dietary supplement products (as defined in section 223(d)(2)(E))</quote> after <quote>menstrual care products (as defined in section 223(d)(2)(D))</quote>.</text></subsection><subsection id="H974611FD43234181BE169E6508C8770D"><enum>(c)</enum><header>Health flexible spending arrangements and health reimbursement arrangements</header><text>Section 106(f) of such Code is amended—</text><paragraph id="H909C6904415949FEBA2E900C65EB36A2"><enum>(1)</enum><text>by inserting <quote>or dietary supplement products (as defined in section 223(d)(2)(E))</quote> after <quote>menstrual care products (as defined in section 223(d)(2)(D))</quote>; and</text></paragraph><paragraph id="H8132A0D3CF8F46D1B111289E7389BAB1"><enum>(2)</enum><text>in the heading, by inserting <quote><header-in-text style="OLC" level="subsection">and dietary supplement products</header-in-text></quote> after <quote><header-in-text style="OLC" level="subsection">menstrual care products</header-in-text></quote>.</text></paragraph></subsection><subsection id="H92AAA24B368A485099D5D9149BD02C8A"><enum>(d)</enum><header>Effective dates</header><paragraph id="HDF9EA5328C6E4F71B990A4D7E2D57156"><enum>(1)</enum><header>Distributions from savings accounts</header><text>The amendment made by subsections (a) and (b) shall apply to amounts paid or incurred after December 31, 2021.</text></paragraph><paragraph id="HEE554E5FD4394C7A9889209464061099"><enum>(2)</enum><header>Reimbursements</header><text>The amendment made by subsection (c) shall apply to expenses paid or incurred after December 31, 2021. </text></paragraph></subsection></section></legis-body></bill>
