Maloney of New York</cosponsor>, <cosponsor name-id="L000562">Mr. Lynch</cosponsor>, <cosponsor name-id="C001078">Mr. Connolly</cosponsor>, <cosponsor name-id="W000800">Mr. Welch</cosponsor>, and <cosponsor name-id="C001059">Mr. Costa</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct any entity of the Federal Government accepting a gift or donation to include certain conditions in the contract or agreement to accept such gift or donation, and for other purposes.</official-title></form><legis-body id="H78A886E8937247C29FCDA670F7DF0C4E" style="OLC"><section id="H92A08CD15E7B43509C235F7BBD264DBD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Government Integrity is Not for Trade or Sale Act</short-title> of 2021</quote> or the <quote><short-title>GIFTS Act</short-title> of 2021</quote>.</text></section><section id="H3ADC2673CE1544CB9A6052CEADBC2E70"><enum>2.</enum><header>Conditions for donation agreement</header><subsection id="H5D1E8A4AA1C0470EAB058B34AC370FB9"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Any covered contract entered into by an entity of the Federal Government, including an agency or an instrumentality, shall include terms and conditions agreed upon by any party to such contract that include prescriptive requirements that reflect the termination conditions described in subsection (b).</text></subsection><subsection id="HCC6194FA7EE6407499034072DD2F0761"><enum>(b)</enum><header>Termination conditions</header><text display-inline="yes-display-inline">The entity of the Federal Government described in subsection (a) may revoke any rights to name, designate, or redesignate the subject of any gift or donation (referred to in this section as <quote>naming rights</quote>) contained in the contract described in such subsection without incurring liability or creating an obligation to return the gift or donation that is the subject of such contract to the donor under the following conditions:</text><paragraph id="H94A14901B82F4FBFBD1BE2CCE446F773"><enum>(1)</enum><text display-inline="yes-display-inline">A certain period of time has elapsed after the date of the contract, given that such period—</text><subparagraph id="HEC1C893DFB8B4D9FB587A3A91358EC3D"><enum>(A)</enum><text>is at least 20 years; or</text></subparagraph><subparagraph id="H7FC9BD53AFFE46EFAF775DD571255541"><enum>(B)</enum><text display-inline="yes-display-inline">is otherwise agreed to by such entity and the donor.</text></subparagraph></paragraph><paragraph id="HF3C29AA66D6E44D68CC721F78043A123"><enum>(2)</enum><text display-inline="yes-display-inline">In the reasonable view of such entity—</text><subparagraph id="HE0A6A9C44CD4455D9C30F5BD4AE982EA"><enum>(A)</enum><text display-inline="yes-display-inline">an act, including a criminal act or an ethical violation, has been committed before, on, or after the date of the contract, by—</text><clause id="HF7D5F0E54C604BF8BB8E994859A417B8"><enum>(i)</enum><text>the donor or an agent of such donor; or</text></clause><clause id="H3592C7EEB77E48CBB4819F0453D25BA1"><enum>(ii)</enum><text display-inline="yes-display-inline">an individual with respect to which naming rights were awarded pursuant to the contract; and</text></clause></subparagraph><subparagraph id="H5F2DBEBD69EF4C1F811FE3615D391ED5"><enum>(B)</enum><text>because of the act described in subparagraph (A), the revocation of such rights is necessary to protect the reputation or integrity of the Federal Government.</text></subparagraph></paragraph></subsection><subsection id="H3D6E1F471E774071A38C9E385D250D8E"><enum>(c)</enum><header>Definition of covered contract</header><text display-inline="yes-display-inline">In this Act, the term <quote>covered contract</quote> means any agreement or contract entered into by an entity of the Federal Government to—</text><paragraph id="H9C1FD994F82D48B8894EDFDAB18CF907"><enum>(1)</enum><text display-inline="yes-display-inline">accept a gift or donation from a donor; and</text></paragraph><paragraph id="HB906E6062D484BA08F519D38C846E42D"><enum>(2)</enum><text display-inline="yes-display-inline">provide to the donor, or a third party as designated, naming rights in connection with the acceptance of such gift or donation.</text></paragraph></subsection></section></legis-body></bill>
