R. 5728</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211026">October 26, 2021</action-date><action-desc><sponsor name-id="C001104">Mr. Cawthorn</sponsor> (for himself, <cosponsor name-id="D000615">Mr. Duncan</cosponsor>, <cosponsor name-id="G000552">Mr. Gohmert</cosponsor>, <cosponsor name-id="G000595">Mr. Good of Virginia</cosponsor>, <cosponsor name-id="M000871">Mr. Mann</cosponsor>, <cosponsor name-id="M001190">Mr. Mullin</cosponsor>, <cosponsor name-id="P000605">Mr. Perry</cosponsor>, and <cosponsor name-id="W000814">Mr. Weber of Texas</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Secretary of Labor from using funds to draft, promulgate, or enforce a rule mandating that employers require employees to be vaccinated against COVID–19, and for other purposes.</official-title></form><legis-body id="H3B3C4B285EDA4105BA1286FAE7A4FE70" style="OLC"><section id="HFCFFE7DA9E70432BBA156134A7D28ACF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>JAB Act</short-title></quote> or the <quote><short-title>Justice for All Businesses Act</short-title></quote>. </text></section><section id="H286D7F63E01649DB9892B646843D4184" section-type="subsequent-section"><enum>2.</enum><header>Prohibition of Funding for OSHA Vaccine-and-Testing Emergency Temporary Standard</header><text display-inline="no-display-inline">No funds may be used by the Secretary of Labor to draft, promulgate, or enforce a rule mandating that employers require employees to be vaccinated against or tested for COVID–19.</text></section><section id="HC85B3100326D4C4D8B3D9D273A845275"><enum>3.</enum><header>Prohibition on Assessing Penalties with Respect to OSHA Vaccine-and-Testing Emergency Temporary Standard</header><text display-inline="no-display-inline">The Secretary of Labor shall not assess civil monetary or criminal penalties under section 17 of the Occupational Safety and Health Act (<external-xref legal-doc="usc" parsable-cite="usc/29/666">29 U.S.C. 666</external-xref>) for violations of a rule mandating that employers require employees to be vaccinated against or tested for COVID–19.</text></section></legis-body></bill>
