committee-id="HII00">Committee on Natural Resources</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To promote water supply reliability and improved water management for rural communities, the State of California, and the Nation, and for other purposes.</official-title></form><legis-body id="H5780AAC625A243F9924921BCBF05410A" style="OLC"><section id="H5D2BC999F03B46698261194E0CE25FCD" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Securing Access for the central Valley and Enhancing (SAVE) Water Resources Act</short-title></quote>.</text></section><section id="HDDE431066E18401EBCE6F0EB77064DCA" section-type="subsequent-section"><enum>2.</enum><header>Water Infrastructure Fund</header><subsection id="H879D0495E47545129C6F5AAEAE1F6419"><enum>(a)</enum><header>Establishment</header><text>There is established in the Treasury of the United States a fund, to be known as the <quote>Water Infrastructure and Drought Solutions Fund</quote> (referred to in this section as the <quote>Fund</quote>), consisting of—</text><paragraph id="H7156FB0E22DF44928CB422396BA12580"><enum>(1)</enum><text>such amounts as are deposited in the Fund under subsection (b); and</text></paragraph><paragraph id="H1DBEEBAAFEC6444596A63F0AB5BA19F6"><enum>(2)</enum><text>any interest earned on investment of amounts in the Fund under subsection (c)(1)(B).</text></paragraph></subsection><subsection id="H0C37271D8F6C410DA1FFCE38E8C6AF48"><enum>(b)</enum><header>Deposits to fund</header><paragraph id="H5458A0BCAEE54A78B6879DFA3B1D8A3B"><enum>(1)</enum><header>In general</header><text>For each of fiscal years 2032 through 2062, the Secretary of the Treasury shall deposit in the Fund $750,000,000 of the revenues that would otherwise be deposited for the fiscal year in the reclamation fund established by the first section of the Act of June 17, 1902 (32 Stat. 388, chapter 1093), of which—</text><subparagraph id="HF1FEE458A339443591E25FC29EF50606"><enum>(A)</enum><text>$250,000,000 shall be expended by the Secretary of the Interior for new surface or ground water storage projects provided that—</text><clause id="H0CE5834939A94563906ACE437BC57AF6"><enum>(i)</enum><text>expenditures are made for nonreimbursable public benefits under Federal reclamation law (the Act of June 17, 1902 (32 Stat. 388, chapter 1093), and Acts supplemental to and amendatory of that Act); and</text></clause><clause id="H39DECF7FA00C436FA44AA5DF34DA6802"><enum>(ii)</enum><text>Federal expenditures account for no more than 50 percent of total costs for any project;</text></clause></subparagraph><subparagraph id="H0110FB4156EC4D6F8C9213C426BCFB66"><enum>(B)</enum><text>$250,000,000 shall be expended by the Secretary of the Interior for water reclamation and reuse projects authorized under title XVI of <external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref> and section 4009 of <external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>; and</text></subparagraph><subparagraph id="H044DF43ABFA0490CAD381C2F757D33DE"><enum>(C)</enum><text display-inline="yes-display-inline">$250,000,000 shall be expended by the Secretary of the Interior for WaterSMART grants authorized under the Omnibus Public Lands Management Act of 2009 (<external-xref legal-doc="usc" parsable-cite="usc/42/10364">42 U.S.C. 10364</external-xref>).</text></subparagraph></paragraph><paragraph id="HB7D8E1607E4B465B99325EE9C80578D9"><enum>(2)</enum><header>Availability of amounts</header><text>Amounts deposited in the Fund under this section shall—</text><subparagraph id="HFF281515D5C34DF1B5CABA4AFAFE105E"><enum>(A)</enum><text>be made available in accordance with this section, without further appropriation; and</text></subparagraph><subparagraph id="HDBDD497A9D8C405EB404493F353D4EA0"><enum>(B)</enum><text>be in addition to amounts appropriated for such purposes under any other provision of law.</text></subparagraph></paragraph></subsection><subsection id="H18E346F095DB43D086912119BFEC37E2"><enum>(c)</enum><header>Expenditures from fund</header><paragraph id="H1FC18001074840B3AABD838B82383DFB"><enum>(1)</enum><header>In general</header><text>Subject to subsection (b), for each of fiscal years 2032 through 2062, the respective Secretary may expend from the Fund, in accordance with this section, not more than an amount equal to the sum of—</text><subparagraph id="H5F76038449D4401A86A205391CCB49E5"><enum>(A)</enum><text>the amounts deposited in the Fund that year under subsection (b); and</text></subparagraph><subparagraph id="H68DC69359E314B2C9CC350351F89656D"><enum>(B)</enum><text>the amount of interest accrued in the Fund for the fiscal year in which the expenditures are made.</text></subparagraph></paragraph><paragraph id="H5D8C834C25ED45FCB6EF8173DE5A5B40"><enum>(2)</enum><header>Additional expenditures</header><subparagraph id="H21CEA5669CED4D599EB7A0B264DF9B57"><enum>(A)</enum><header>In general</header><text>The Secretary may expend more in any fiscal year than the amounts described in subsection (a) if the additional amounts are available in the Fund as a result of a failure of the Secretary to expend all of the amounts available under subsection (a) in 1 or more prior fiscal years.</text></subparagraph><subparagraph id="H29F817C7BA0F45B58C3D748E43198C26"><enum>(B)</enum><header>Retention in accounts</header><text>Any additional amounts referred to in paragraph (1) shall—</text><clause id="H4768CED42E7D4600A24C4BD7AF989E3B"><enum>(i)</enum><text>accrue interest in accordance with this section; and</text></clause><clause id="HAB63506F529D4DB8BB0866CA6EF58EE2"><enum>(ii)</enum><text>only be expended for the purposes for which expenditures from the Fund are authorized.</text></clause></subparagraph></paragraph></subsection></section><section id="HEFF0A39B28DF446587A155B96638744C"><enum>3.</enum><header>Ground water recharge planning</header><subsection id="H1CF0CA1AC97841C582CDBB07FD8A5C68"><enum>(a)</enum><header>Findings and purpose</header><paragraph id="H0119CFC62A844C0B8ABA6E3859AF6697"><enum>(1)</enum><header>Findings</header><text>The Congress finds that—</text><subparagraph id="H9443CDC59308462EA10DC298D8711A29"><enum>(A)</enum><text>there is a lack of information regarding local ground water storage and recharge opportunities in the Western United States;</text></subparagraph><subparagraph id="HAD0F56A154234365A4BC55DE9857EA63"><enum>(B)</enum><text>additional information regarding local ground water storage and recharge opportunities can help inform future Federal and State funding activities and assist State government initiatives such as implementation of part 2.74 of the California Water Code (commonly known as the <quote>Sustainable Groundwater Management Act</quote>); and</text></subparagraph><subparagraph id="H679BC03DC1614D0D94A96D6A912A4D1A"><enum>(C)</enum><text>challenges associated with drought and extreme aridity from changing weather patterns will require additional investment in ground water storage and recharge.</text></subparagraph></paragraph><paragraph id="H3DC3935B54924D9FB6776B51EA35558F"><enum>(2)</enum><header>Purpose</header><text>The purpose of this section is to help inform future Federal, State, local, and other investment in ground water recharge projects.</text></paragraph></subsection><subsection id="H8D75AE8C95F043488D33623F913372AD"><enum>(b)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H869F57E5D50F40A6BA4A06C4298523A4"><enum>(1)</enum><header>Critically overdrafted basins</header><text>The term <term>critically overdrafted basins</term> means those basins identified by the California Department of Water Resources pursuant to part 2.74 of the California Water Code (commonly known as the <quote>California’s Sustainable Groundwater Management Act</quote>).</text></paragraph><paragraph id="H186BD9887E3F49D992204A921F4ED379"><enum>(2)</enum><header>Reclamation state</header><text>The term <term>Reclamation State</term> means any Reclamation State (as defined in section 4014 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note)).</text></paragraph><paragraph id="H8361B0F877F44E218D44DA51FE4121E0"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior, acting through the Director of the United States Geological Survey.</text></paragraph></subsection><subsection id="HF14FAA1E2180438999E4441E0CF4F8D2"><enum>(c)</enum><header>Evaluation and report</header><paragraph id="H700503843C584855839967247C2A946D"><enum>(1)</enum><header>In general</header><text>Not later than 4 years after the date of the enactment of this Act, the Secretary shall complete an evaluation and report to Congress that identifies potential ground water storage and recharge opportunities in each Reclamation State including recharge opportunities in critically overdrafted basins.</text></paragraph><paragraph id="HFF76F6BBC3AC4475B79E3CEBA444BAC4"><enum>(2)</enum><header>Report</header><text>The report to Congress shall include—</text><subparagraph id="H4A19739AEF04489BA75A8AB860F33C83"><enum>(A)</enum><text>an assessment of potentially beneficial storage and recharge locations based on the Secretary’s assessment of—</text><clause id="H035412A266BC45CDBB2693A7A88B1F08"><enum>(i)</enum><text>hydrologic attributes;</text></clause><clause id="HEAA275766AAF454BA81AC786D2618748"><enum>(ii)</enum><text>geologic attributes;</text></clause><clause id="HF0CAD27B550848B19A95443F56756CE8"><enum>(iii)</enum><text>engineering attributes;</text></clause><clause id="H4AA9182E3E4244738B6DB6466AE14F67"><enum>(iv)</enum><text>water supply benefits;</text></clause><clause id="HA82A966AFF594D36BA6D8E94A418B804"><enum>(v)</enum><text>environmental benefits;</text></clause><clause id="HB82C05C7732A439DA9214F98A88D81F5"><enum>(vi)</enum><text>infrastructure benefits related to mitigation of subsidence-related infrastructure damage; and</text></clause><clause id="H245CE22CC144451D8815D2B4E4C2FF9A"><enum>(vii)</enum><text>sustainability benefits for critically overdrafted basins; and</text></clause></subparagraph><subparagraph id="H235A154D5ABE4656BE7D82E95C5CFE76"><enum>(B)</enum><text>an assessment of potential conveyance infrastructure needs to move excess runoff to the recharge locations identified by the Secretary under this section.</text></subparagraph></paragraph><paragraph id="H6224053BF99C4453A371DB3E8A06EDA6"><enum>(3)</enum><header>Coordination</header><text>To the maximum extent practicable, the Secretary shall coordinate research activities with Reclamation State agencies, ground water sustainability agencies, universities, and nonprofit organizations in a manner designed to assist with implementation of State-led initiatives such as part 2.74 of the California Water Code (commonly known as the <quote>Sustainable Groundwater Management Act</quote>).</text></paragraph></subsection></section><section id="H8D7BEBCCA414434A8C9A7B633069F0E2"><enum>4.</enum><header>Reclamation Infrastructure Finance and Innovation Pilot Program</header><subsection id="H742F692082644C38950C8E6EA801703A"><enum>(a)</enum><header>Short title</header><text>This section may be cited as the <quote>Reclamation Infrastructure Finance and Innovation Act</quote>.</text></subsection><subsection id="H5066DC8C3DBE40E4A3F1CDFE30C4FAD6"><enum>(b)</enum><header>Establishment</header><text>The Secretary of the Interior (referred to in this section as the <quote>Secretary</quote>) shall establish and carry out a pilot program under which the Secretary shall provide to eligible entities described in section 5025 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3904">33 U.S.C. 3904</external-xref>) financial assistance in accordance with this section to carry out eligible projects described in subsection (c).</text></subsection><subsection id="H9CF828852AD9456DBF892C75F0E60A27"><enum>(c)</enum><header>Eligible projects</header><paragraph id="HC3A7D23BA06C48E2BBF79FCC3C9E7CE2"><enum>(1)</enum><header>In general</header><text>A project eligible to receive assistance under the pilot program under this section is a water supply project that, as determined by the Secretary—</text><subparagraph id="H09F20745AF964AC5ACE100E98BC2D4BD"><enum>(A)</enum><text>is located in—</text><clause id="H15BB9D9ECCEB4F9EAA237EF68CD347C3"><enum>(i)</enum><text>the State of Alaska;</text></clause><clause id="H4C247CBCCA8945CA901A83BB3EA1E6B5"><enum>(ii)</enum><text>the State of Hawaii; or</text></clause><clause id="HEB0196D15DE5418DBFEF87CE6431AD34"><enum>(iii)</enum><text>a Reclamation State (as defined in section 4014 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/322">Public Law 114–322</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note));</text></clause></subparagraph><subparagraph id="HBC8424BC889F4A0E869137C8F0C0CFF5"><enum>(B)</enum><text>would contribute directly or indirectly (including through ground water recharge) to a safe, adequate water supply for domestic, agricultural, environmental, municipal, or industrial use; and</text></subparagraph><subparagraph id="H3BF1D9C8DAAD4DB4BB79E74396BA3013"><enum>(C)</enum><text>is otherwise eligible for assistance under this section.</text></subparagraph></paragraph><paragraph id="H2F83C01614974F718E1A646E8221ED20"><enum>(2)</enum><header>Small community projects</header><text>For projects eligible for assistance under this section and section 5028(a)(2)(B) of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3907">33 U.S.C. 3907(a)(2)(B)</external-xref>), the Secretary may assist applicants in combining 1 or more projects into a single application in order to meet the minimum project cost of $5,000,000 required under that section.</text></paragraph></subsection><subsection id="H570C012CBBDA4B7FB93C5E551575016B"><enum>(d)</enum><header>Eligible entities</header><text>The following entities are eligible to receive assistance under this section:</text><paragraph id="HC290125D389B4463BD9DD6732A0C954F"><enum>(1)</enum><text>An entity described in section 5025 of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3904">33 U.S.C. 3904</external-xref>).</text></paragraph><paragraph id="HDB7734148A0D41A2B6DC1BD759CC4AB4"><enum>(2)</enum><text>A conservancy district, reclamation district, or irrigation district.</text></paragraph><paragraph id="H2900F1D815BB410CBF243D43E21AC4F8"><enum>(3)</enum><text>A canal company or mutual water company.</text></paragraph><paragraph id="H7F9E296030184C71B55C0435C8750E1C"><enum>(4)</enum><text>A water users’ association.</text></paragraph><paragraph id="HA885F6D6514E475F8B1953E86C732E96"><enum>(5)</enum><text>An agency established by an interstate compact.</text></paragraph><paragraph id="H419EA5EDB3324420AE3E0B663421A052"><enum>(6)</enum><text>Any other individual or entity that has the capacity to contract with the United States under the reclamation laws.</text></paragraph></subsection><subsection id="H853D4D6B29154DE2B34763CFC547C39B"><enum>(e)</enum><header>Requirements</header><paragraph id="H04D0ADA350014A8B94EE16C1B9547EA9"><enum>(1)</enum><header>Project selection</header><text>In selecting eligible projects to receive assistance under the pilot program under this section, the Secretary shall ensure diversity with respect to—</text><subparagraph id="HFA4FA0D2E6C741B4915ED53343B17FFD"><enum>(A)</enum><text>project type; and</text></subparagraph><subparagraph id="H8CBB0D7537AB4691AE2BDD3646C7CE71"><enum>(B)</enum><text>geographical location within the States referred to in subsection (c)(1).</text></subparagraph></paragraph><paragraph id="H8D4796A2F6B64E5FA6075377113FC6B9"><enum>(2)</enum><header>Importation of other requirements</header><text>The following shall apply to the pilot program under this section:</text><subparagraph id="H3A82E24DE43D4445AB3FCA2BFEFAD2D3"><enum>(A)</enum><text>Sections 5022, 5024, 5027, 5028, 5029, 5030, 5031, 5032, and 5034(a) of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3901">33 U.S.C. 3901</external-xref>, 3903, 3906, 3907, 3908, 3909, 3910, 3911, and 3913(a)), except that—</text><clause id="HEDE3EFB855BC4B55A787BA35160F1F03"><enum>(i)</enum><text>any reference contained in those sections to the Secretary of the Army shall be considered to be a reference to the Secretary of the Interior;</text></clause><clause id="H7DBCD90CEBB84622B394EA0058271B90"><enum>(ii)</enum><text>any reference contained in those sections to an eligible project shall be considered to be a reference to an eligible project described in subsection (b);</text></clause><clause id="HC67763D0DF764F888372642796431A27"><enum>(iii)</enum><text>paragraphs (1)(E) and (6)(B) of subsection (a), and subsection (b)(3), of section 5028 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/3907">33 U.S.C. 3907</external-xref>) shall not apply with respect to this section; and</text></clause><clause id="H3C1EB408B2A741F6A3D7AD98D018A096"><enum>(iv)</enum><text>subsections (e) and (f) of section 5030 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/33/3909">33 U.S.C. 3909</external-xref>) shall not apply with respect to this section.</text></clause></subparagraph><subparagraph id="HB0EAA4643A5C4964A280309045ABD878"><enum>(B)</enum><text>The agreement between the Administrator of the Environmental Protection Agency and the Commissioner of Reclamation required under section 4301 of the America’s Water Infrastructure Act of 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/270">Public Law 115–270</external-xref>).</text></subparagraph><subparagraph id="HD497CAC9B529426091CF0380797723E6"><enum>(C)</enum><text>Other applicable environmental laws, including the National Environmental Policy Act of 1969 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321 et seq.</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H80677F4B5ECD4CCDB9830FB8BD4A77DF"><enum>(f)</enum><header>Authorization of appropriations</header><paragraph id="H0CE565227B874DDCB752F801935281FB"><enum>(1)</enum><header>In general</header><text>There is authorized to be appropriated to the Secretary to carry out the pilot program under this section $150,000,000 for fiscal years 2022 through 2026, to remain available until expended.</text></paragraph><paragraph id="HBB3A5A9091034ABF8C325FBB52859E56"><enum>(2)</enum><header>Administrative costs</header><text>Of the funds made available under paragraph (1), the Secretary may use for administrative costs of carrying out the pilot program under this section (including for the provision of technical assistance to project sponsors pursuant to paragraph (3) and in obtaining necessary approvals and transfer to the Administrator of the Environmental Protection Agency to provide assistance in administering and servicing Federal credit instruments under the pilot program) not more than $5,000,000 for each applicable fiscal year.</text></paragraph><paragraph id="H07821A1E557D429C87D69764BD3D2732"><enum>(3)</enum><header>Small community projects</header><subparagraph id="H13B039AB135A47C18DBD51A642982F63"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the Commissioner may use the funds made available under paragraph (2) to provide assistance, including assistance to pay the costs of acquiring the rating opinion letters under section 5028(a)(1)(D) of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3907">33 U.S.C. 3907(a)(1)(D)</external-xref>), to assist project sponsors in obtaining the necessary approval for small community projects that are eligible for assistance under section 5028(a)(2)(B) of the Water Resources Reform and Development Act of 2014 (<external-xref legal-doc="usc" parsable-cite="usc/33/3907">33 U.S.C. 3907(a)(1)(D)</external-xref>) or subsection (b)(3).</text></subparagraph><subparagraph id="HC4A02F9EC5DD4FCDADFCC0ADCA72CD97"><enum>(B)</enum><header>Limitation</header><text>Assistance provided to a project sponsor under subparagraph (A) may not exceed an amount equal to 75 percent of the total administrative costs incurred by the project sponsor in securing financial assistance under this section.</text></subparagraph></paragraph></subsection><subsection commented="no" id="H0190B075818A4C0A957280F00C54CC8C"><enum>(g)</enum><header>Limitation</header><text>No project that receives financial assistance under this section may be financed (directly or indirectly), in whole or in part, with proceeds of any obligation the interest on which is exempt from the tax imposed under <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/26/1">chapter 1</external-xref> of the Internal Revenue Code of 1986.</text></subsection><subsection id="HB3DEAED340764D4FAA211216469D1F67"><enum>(h)</enum><header>Eligibility for assistance</header><paragraph id="H40746790C76345CDAB36BFAAF524E83F"><enum>(1)</enum><header>Eligible projects</header><text>The following projects may be carried out using assistance made available under this section:</text><subparagraph id="H97381FCC56CA4C0D85AD54707DC30FFD"><enum>(A)</enum><text>A project for the reclamation and reuse of municipal, industrial, domestic, and agricultural wastewater, and naturally impaired ground water, which the Secretary, acting through the Commissioner of Reclamation, is authorized to undertake.</text></subparagraph><subparagraph id="H68640201ACA84CCC9FDAC8802FAAD967"><enum>(B)</enum><text>Any water infrastructure project not specifically authorized by law that—</text><clause id="H7A3DF20829CB4AF781EE8D7923737CB0"><enum>(i)</enum><text>the Secretary determines, through the completion of an appraisal investigation and feasibility study, would contribute to a safe, adequate water supply for domestic, agricultural, environmental, or municipal and industrial use; and</text></clause><clause id="HC572A56F2C524B7FA5C209399032396C"><enum>(ii)</enum><text>is otherwise eligible for assistance under this section.</text></clause></subparagraph><subparagraph id="H76703A83EB8F47A5BEF7873BEF3E84A9"><enum>(C)</enum><text>A new water infrastructure facility project, including—</text><clause id="H8FD67AB3392342B58DF93EB7C10B1A8D"><enum>(i)</enum><text>a water conduit, pipeline, or canal; and</text></clause><clause id="H040D249A733943C5A675AFE1C77DD092"><enum>(ii)</enum><text>pumping, power, and associated facilities. </text></clause></subparagraph><subparagraph id="H586584E7DCD4401C9A96A194D80CFCC9"><enum>(D)</enum><text>A project for enhanced energy efficiency in the operation of a water system.</text></subparagraph><subparagraph id="H0D4AF753B8FB499B94687899960091F8"><enum>(E)</enum><text>A project for accelerated repair and replacement of all, or a portion, of an aging water distribution facility.</text></subparagraph><subparagraph id="HD8DE8BC60FFD415C8C198259B3E389FF"><enum>(F)</enum><text>A brackish or sea water desalination project.</text></subparagraph><subparagraph id="HBC8470F350FB4D009D91EA0203214CB7"><enum>(G)</enum><text>Acquisition of real property or an interest in real property for water storage, reclaimed or recycled water, or wastewater, if the acquisition is integral to a project described in subparagraphs (A) through (F).</text></subparagraph><subparagraph id="H7AF516D6E9F245BD844E555CDFC8193C"><enum>(H)</enum><text>A project to deliver water to wildlife refuges.</text></subparagraph><subparagraph id="H79BD08BA32B044FFB85187CD0F3834AF"><enum>(I)</enum><text>A combination of projects, each of which is eligible under subparagraphs (A) through (H), for which an eligible entity submits a single application.</text></subparagraph></paragraph><paragraph id="H3DD201A790CC4F2C958CD5647EBED657"><enum>(2)</enum><header>Activities eligible for assistance</header><text>For the purposes of this section, an eligible activity with respect to an eligible project under subsection (a) includes the cost of—</text><subparagraph id="H7FF178D9EF764313BFC15ABC5B86FAB5"><enum>(A)</enum><text>development-phase activities, including planning, feasibility analysis, revenue forecasting, environmental review, permitting, transaction costs, preliminary engineering and design work, and other preconstruction activities;</text></subparagraph><subparagraph id="HD2319B5EC8C144359167E4B6A182B2F0"><enum>(B)</enum><text>construction, reconstruction, rehabilitation, and replacement activities;</text></subparagraph><subparagraph id="HAE38F3ACED7345888420EF63BDA23961"><enum>(C)</enum><text>the acquisition of real property (including water rights, land relating to the project, and improvements to land), environmental mitigation, construction contingencies, and acquisition of equipment;</text></subparagraph><subparagraph id="HDF838F327532489C89DDF30C63591ECF"><enum>(D)</enum><text>capitalized interest necessary to meet market requirements, reasonably required reserve funds, capital issuance expenses, and other carrying costs during construction;</text></subparagraph><subparagraph id="H2FB27703DA3F4B738F8D003DA87CB8AF"><enum>(E)</enum><text>refinancing interim construction funding, long-term project obligations, or a secured loan, loan guarantee, or other credit enhancement made under this section;</text></subparagraph><subparagraph id="HB904480A64524E8C8BB81447084E1C40"><enum>(F)</enum><text>refinancing long-term project obligations or Federal credit instruments, if that refinancing provides additional funding capacity for the completion, enhancement, or expansion of any project selected for assistance under this Act;</text></subparagraph><subparagraph id="H03BE585FE1D94C25BD9AC3888A060F8A"><enum>(G)</enum><text>reimbursement or success payments to any public or private entity that achieves predetermined outcomes on a pay-for-performance or pay-for-success basis; and</text></subparagraph><subparagraph id="H3F54F9CCBEA64959B4F1D16BB236E9F2"><enum>(H)</enum><text>grants, loans, or credit enhancement for community development financial institutions, green banks, and other financial intermediaries providing ongoing finance for projects that meet the purposes of this section.</text></subparagraph></paragraph></subsection></section><section id="H39C295E3B27B44F094DCF027158E2D2B"><enum>5.</enum><header>Feasibility studies</header><text display-inline="no-display-inline">As soon as practicable after the date of the enactment of this Act, in compliance with all environmental and other applicable laws, the Secretary of the Interior shall complete all remaining feasibility studies associated with the following projects:</text><paragraph id="HF30609489DB34896AC314F37F95D2483"><enum>(1)</enum><text>Del Puerto Canyon Reservoir, located in the foothills of the Coast Range mountains west of Patterson, California.</text></paragraph><paragraph id="HC80166B63BDA410DADB17E1AC90FB403"><enum>(2)</enum><text>San Luis Reservoir in the San Joaquin Valley, California.</text></paragraph></section><section id="H0E9688A06EFF4E4BBF72273E7AF580B6"><enum>6.</enum><header>Rural water supply program reauthorization</header><text display-inline="no-display-inline">The Rural Water Supply Act of 2006 (<external-xref legal-doc="public-law" parsable-cite="pl/109/451">Public Law 109–451</external-xref>) is amended—</text><paragraph id="HD35133AF747F480681F441D94029DB64"><enum>(1)</enum><text>in section 109(a) (<external-xref legal-doc="usc" parsable-cite="usc/43/2408">43 U.S.C. 2408(a)</external-xref>), by striking <quote>2016</quote> and inserting <quote>2026</quote>; and</text></paragraph><paragraph id="H0D6B0FCDC1004A40A136E069A62F9FF8"><enum>(2)</enum><text>in section 110 (<external-xref legal-doc="usc" parsable-cite="usc/43/2409">43 U.S.C. 2409</external-xref>), by striking <quote>2016</quote> and inserting <quote>2026</quote>.</text></paragraph></section><section id="H6865DCB77E4F4E93A325E275FCFCA253"><enum>7.</enum><header>Competitive grant program for the funding of water recycling and reuse projects</header><subsection id="HAAF0E77F84AA4B20974C212C7132617A"><enum>(a)</enum><header>Competitive grant program for the funding of water recycling and reuse projects</header><text>Section 1602(f) of the Reclamation Wastewater and Groundwater Study and Facilities Act (title XVI of <external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/43/390h">43 U.S.C. 390h et seq.</external-xref>) is amended by striking paragraphs (2) and (3) and inserting the following:</text><quoted-block id="H7EB5337EA46C4540884257ACDD017BE5" style="OLC"><paragraph id="HFE7B0A3DD69A4857BDFFF180C92C6D0F"><enum>(2)</enum><header>Priority</header><text>When funding projects under paragraph (1), the Secretary shall give funding priority to projects that meet one or more of the following criteria:</text><subparagraph id="H2F872DE7700D430FAFD19551E639C03C"><enum>(A)</enum><text>Projects that are likely to provide a more reliable water supply for States and local governments.</text></subparagraph><subparagraph id="HCDD4A2234AB94A7BA7586ADA9DD1C1F8"><enum>(B)</enum><text>Projects that are likely to increase the water management flexibility and reduce impacts on environmental resources from projects operated by Federal and State agencies.</text></subparagraph><subparagraph id="H9E1E48D3BD234D70BD1BC188F226E4AF"><enum>(C)</enum><text>Projects that are regional in nature.</text></subparagraph><subparagraph id="HB7B03FEF8E66459E95F75F29C3B59054"><enum>(D)</enum><text>Projects with multiple stakeholders.</text></subparagraph><subparagraph id="H2E9521C77B68441784EE19ADFBF4B7BF"><enum>(E)</enum><text>Projects that provide multiple benefits, including water supply reliability, eco-system benefits, groundwater management and enhancements, and water quality improvements.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H2467E14CEE1E404599E69005D4E546CF"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 1602(g) of the Reclamation Wastewater and Groundwater Study and Facilities Act (title XVI of <external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/43/390h">43 U.S.C. 390h et seq.</external-xref>) is amended—</text><paragraph id="H4A8E778A162E40DB8F14FC36EFC8A569"><enum>(1)</enum><text>by striking <quote>$50,000,000</quote> and inserting <quote>$500,000,000 through fiscal year 2025</quote>; and</text></paragraph><paragraph id="HFFA1811D96D84473A8A21FF462CBBD18"><enum>(2)</enum><text>by striking <quote>if enacted appropriations legislation designates funding to them by name,</quote>.</text></paragraph></subsection><subsection id="H898FCA6C6DCB4E409C4C21CCB0BA21A6"><enum>(c)</enum><header>Duration</header><text>Section 4013 of the WIIN Act (<external-xref legal-doc="public-law" parsable-cite="pl/114/332">Public Law 114–332</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note) is amended—</text><paragraph id="HAEB437A16106483ABE69AB8F6F8DA49E"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and</quote>;</text></paragraph><paragraph id="HB13610CF877D444EB635E2A43DFD9DAF"><enum>(2)</enum><text>in paragraph (2), by striking <quote>4007, 4009(a), and 4009(c).</quote> and inserting <quote>4007 and 4009(a); and</quote></text></paragraph><paragraph id="HC13A52051C7A463EAB23619A687396D1"><enum>(3)</enum><text>by adding at the end the following:</text><quoted-block id="H760E9A4E7B3F4A218383BC582A5B1C98" Reclamation Wastewater and Groundwater Study and Facilities Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390h-13">43 U.S.C. 390h–13(d)</external-xref>) is amended by striking <quote>$20,000,000 (October 1996 prices)</quote> and inserting <quote>$30,000,000 (January 2019 prices)</quote>.</text></subsection></section><section id="HC2AACD8DA5A14834B9C9F038A8B32B67"><enum>8.</enum><header>Water technology award program and investment programs</header><subsection id="H5789B8B252F449A2B6CD9E76B8CB60E9"><enum>(a)</enum><header>Award program established</header><text>The Secretary of the Interior, working through the Bureau of Reclamation, shall establish a program to award prizes to eligible persons described in subsection (b) for achievement in 1 or more of the following applications of water technology:</text><paragraph id="H6AEA11F88021400693DD8B707AD16005"><enum>(1)</enum><text>Demonstration of desalination of brackish or sea water with significantly less energy than commercially available reverse osmosis technology.</text></paragraph><paragraph id="HE531C982354D4C3E92008A081BE17B9A"><enum>(2)</enum><text>Demonstration of portable or modular desalination units that can process 1 to 5,000,000 gallons per day that could be deployed for temporary emergency uses in coastal communities or communities with brackish ground water supplies.</text></paragraph><paragraph id="H0D48EED652874C39AB007FB1C96ECDD6"><enum>(3)</enum><text>Demonstration of significant advantages over commercially available reverse osmosis technology as determined by the board established under subsection (c).</text></paragraph><paragraph id="H0C4FC66FBCE5441BA514C71711EB5594"><enum>(4)</enum><text>Reducing open water evaporation.</text></paragraph><paragraph id="H363C2BD082A74386A399E17504E9BB60"><enum>(5)</enum><text>Improving methods to treat and reuse agricultural drainage waters.</text></paragraph><paragraph id="HA8596B1FB7A74AA8BCC5A866F6874A25"><enum>(6)</enum><text>Reducing the loss of threatened and endangered fish due to fish predation.</text></paragraph><paragraph id="H0A2C65DB670A4E56BDE910F95818741A"><enum>(7)</enum><text>Reducing the entrainment of fish larvae on screens and intakes.</text></paragraph></subsection><subsection id="H28063E2D4EDA446E83377825B1E72F5A"><enum>(b)</enum><header>Eligible person</header><text>An eligible person described in this subsection is—</text><paragraph id="H675FC94A1BE042DD9986A742F088A4C8"><enum>(1)</enum><text>an individual who is—</text><subparagraph id="H15554E6483E54A9E81B5AEE8ABE07F2E"><enum>(A)</enum><text>a citizen or legal resident of the United States; or</text></subparagraph><subparagraph id="H962582D552614D99873090756A7D6AAF"><enum>(B)</enum><text>a member of a group that includes citizens or legal residents of the United States;</text></subparagraph></paragraph><paragraph id="H12AEACC66C51425DA0E9BF6558D937E2"><enum>(2)</enum><text>an entity that is incorporated and maintains its primary place of business in the United States; or</text></paragraph><paragraph id="H36E3E8FFE5394991AB9286EEEAF8D732"><enum>(3)</enum><text>a public water agency.</text></paragraph></subsection><subsection id="H26EFC3EABFCB4AEF8D2451AFA237EC5F"><enum>(c)</enum><header>Establishment of board</header><paragraph id="HC2705BFB21374AB9B3ACA92071A1EF3A"><enum>(1)</enum><header>In general</header><text>The Secretary of the Interior shall establish a board to administer the program established under subsection (a).</text></paragraph><paragraph id="HA5805CF82C3F427BBCED248EE0BC83E1"><enum>(2)</enum><header>Membership</header><text>The board shall be composed of not less than 15 and not more than 21 members appointed by the President, of whom—</text><subparagraph id="H2CA500409CA841289C0B3474854E9C02"><enum>(A)</enum><text>not less than 1 shall—</text><clause id="H6D0C6B414959441D96020FC7DB561533"><enum>(i)</enum><text>be a representative of the interests of academic, business, and nonprofit organizations; and</text></clause><clause id="H91116133D0224484B9D9EF5E8AEA453F"><enum>(ii)</enum><text>have expertise in—</text><subclause id="HD78A199B18204BFFBCBC8D8FEAAB1A8C"><enum>(I)</enum><text>the field of water technology; or</text></subclause><subclause id="HA69CBFC575914129B478A2EEA1C1CAD8"><enum>(II)</enum><text>administering award competitions; and</text></subclause></clause></subparagraph><subparagraph id="H90128CE7BE5B48259B68F7528EF6D4F2"><enum>(B)</enum><text>not less than 1 shall be—</text><clause id="H7584440DB98740E38FA5C6CA5BF2ED87"><enum>(i)</enum><text>a representative of agricultural water users;</text></clause><clause id="HFA10E26EDE074619914943043D7D3500"><enum>(ii)</enum><text>a representative of municipal and industrial water users;</text></clause><clause id="H8F3098893B7047108DE0965E6BDC18EE"><enum>(iii)</enum><text>a representative of the Bureau of Reclamation of the Department of the Interior; and</text></clause><clause id="HFAA058DFE1654B4C95E72A00C17E8F82"><enum>(iv)</enum><text>a representative of the National Science Foundation.</text></clause></subparagraph></paragraph></subsection><subsection id="HF1274A474EC94D83ACF1810013644F5A"><enum>(d)</enum><header>Awards</header><text>Subject to the availability of appropriations, the board established under subsection (c) may make awards under the program established under subsection (a) as follows:</text><paragraph id="HB6E4F18E561541A18AB16CB0F1E0B493"><enum>(1)</enum><header>Financial prize</header><text>The board may hold a financial award competition and award a financial award in an amount determined before the commencement of the competition to the first competitor to meet such criteria as the board shall establish.</text></paragraph><paragraph id="H92526E9A9A2D4C09A792AB38D8E46CA4"><enum>(2)</enum><header>Recognition prize</header><subparagraph id="H3288FE32DB454401AEF4938DC306AA0E"><enum>(A)</enum><header>In general</header><text>The board may recognize an eligible person for superlative achievement in 1 or more applications described in subsection (a).</text></subparagraph><subparagraph id="H3BE6331897D54AF0A25F2109C4ECC5B9"><enum>(B)</enum><header>No financial remuneration</header><text>An award under this paragraph shall not include any financial remuneration.</text></subparagraph><subparagraph id="H783E90E2C7B04D839AE075ED090B6D24"><enum>(C)</enum><header>National technology and innovation medal recommendations</header><text>For each eligible person recognized under this paragraph, the board shall recommend to the Secretary of Commerce that the Secretary recommend to the President under section 16(b) of the Stevenson-Wydler Technology Innovation Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/15/3711">15 U.S.C. 3711(b)</external-xref>) that the President award the National Technology and Innovation Medal established under section 16(a) of such Act to such eligible person.</text></subparagraph></paragraph></subsection><subsection id="HFD8868277C73406F9CFDE8B35E437152"><enum>(e)</enum><header>Administration</header><paragraph id="H654526E827F04A5D87971F1167A72838"><enum>(1)</enum><header>Contracting</header><text>The board established under subsection (c) may contract with a private organization to administer a financial award competition described in subsection (d)(1).</text></paragraph><paragraph id="HB1C54F21342841DA9058D6BDAC9258AB"><enum>(2)</enum><header>Solicitation of funds</header><text>A member of the board or any administering organization with which the board has a contract under paragraph (1) may solicit gifts from private and public entities to be used for a financial award under subsection (d)(1).</text></paragraph><paragraph id="H4105F9AF60A74035BD5A83FE4A8CD041"><enum>(3)</enum><header>Limitation on participation of donors</header><text>The board may allow a donor who is a private person described in paragraph (2) to participate in the determination of criteria for an award under subsection (d), but such donor may not solely determine the criteria for such award.</text></paragraph><paragraph id="HFA0D865ED6CA462CB5E1DBF68D5DBE21"><enum>(4)</enum><header>No advantage for donation</header><text>A donor who is a private person described in paragraph (3) shall not be entitled to any special consideration or advantage with respect to participation in a financial award competition under subsection (d)(1).</text></paragraph></subsection><subsection id="H0C5C158542A54642BD9D00CFB69CE92B"><enum>(f)</enum><header>Intellectual property</header><text>The Federal Government may not acquire an intellectual property right in any product or idea by virtue of the submission of such product or idea in any competition under subsection (d)(1).</text></subsection><subsection id="H09F36B2D74044A69B126BE5C02638E20"><enum>(g)</enum><header>Liability</header><text>The board established under subsection (c) may require a competitor in a financial award competition under subsection (d)(1) to waive liability against the Federal Government for injuries and damages that result from participation in such competition.</text></subsection><subsection id="H37148675283140A59792C82438896795"><enum>(h)</enum><header>Annual report</header><text>Each year, the board established under subsection (c) shall submit to Congress a report on the program established under subsection (a).</text></subsection><subsection id="H7C80DCD1758B4133A2BF94EB27067B0D"><enum>(i)</enum><header>Authorization of appropriations</header><paragraph id="H2CCC324D7DBF43CD86C13596471BF6A4"><enum>(1)</enum><header>In general</header><text>There are authorized to be appropriated sums for the program established under subsection (a) as follows:</text><subparagraph id="H855E84CCB2A24C7BAF06150234D4F7C4"><enum>(A)</enum><text>For administration of prize competitions under subsection (d), $750,000 for each fiscal year.</text></subparagraph><subparagraph id="H2ABF982DB78E4571A9BE3B24E45BE921"><enum>(B)</enum><text>For the awarding of a financial prize award under subsection (d)(1), in addition to any amounts received under subsection (e)(2), $2,000,000 for each fiscal year.</text></subparagraph></paragraph><paragraph id="H4F069B03BEDC4ED4AAAC4BE8365D5B58"><enum>(2)</enum><header>Availability</header><text>Amounts appropriated pursuant to the authorization of appropriations under paragraph (1) shall remain available until expended.</text></paragraph></subsection><subsection id="HE9C936201F2B4034B1F2D610AB87BD3D"><enum>(j)</enum><header>Water Technology Investment Program Established</header><text display-inline="yes-display-inline">The Secretary of the Interior, working through the Bureau of Reclamation, shall establish a program, pursuant to the Reclamation Wastewater and Groundwater Study and Facilities Act (title XVI of <external-xref legal-doc="public-law" parsable-cite="pl/102/575">Public Law 102–575</external-xref>), the Water Desalination Act of 1996 (<external-xref legal-doc="public-law" parsable-cite="pl/104/298">Public Law 104–298</external-xref>), and other applicable laws, to promote the expanded use of technology for improving availability and resiliency of water supplies and power deliveries, which shall include—</text><paragraph id="H7CA7C87827C54AEBBCDF32DF3394B3F9"><enum>(1)</enum><text display-inline="yes-display-inline">investments to enable expanded and accelerated deployment of desalination technology;</text></paragraph><paragraph id="HEE42052478424EFCA92962456CF4A1C5"><enum>(2)</enum><text>investments to enable expanded and accelerated use of recycled water; and</text></paragraph><paragraph id="HE6D85AFB7DE2447293FDD4CD30B5B94F"><enum>(3)</enum><text>investments that improve water management, using best available science, and include real-time monitoring of wildlife and water deliveries.</text></paragraph></subsection><subsection id="H25761060F46A4FBF9C007684B8AD4658"><enum>(k)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated $5,000,000 for each fiscal year for the Secretary to carry out the purposes and provisions of subsection (j). Funds made available under this subsection shall be considered a nonreimbursable Federal expenditure and shall remain available until expended.</text></subsection></section></legis-body></bill>
