which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committees on <committee-name committee-id="HWM00">Ways and Means</committee-name>, and <committee-name committee-id="HAS00">Armed Services</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Orphan Drug Act with respect to the definition of medical food, and for other purposes.</official-title></form><legis-body id="H32958F900C294BC0A0AB682E475F7138" style="OLC"><section id="H7343EC1A9F44429FB20D623DD8DD7EDA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Patient Access to Medical Foods Act</short-title></quote>.</text></section><section id="H5F6372CBA031400C921FFD3FD4F7BF25"><enum>2.</enum><header>Definition of medical food for purposes of Orphan Drug Act</header><subsection id="H39F3436821FF48789ED234FAF746E10A"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5(b)(3) of the Orphan Drug Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360ee">21 U.S.C. 360ee(b)(3)</external-xref>) is amended to read as follows: </text><quoted-block style="OLC" id="H09AE5289058D416FBD4100C4C77AEBE6" display-inline="no-display-inline"><paragraph id="HD67A6E072E144F25B5687BC4A2470427"><enum>(3)</enum><text display-inline="yes-display-inline">The term <term>medical food</term> means a food which—</text><subparagraph id="H44B6821F3616426EB70392EA10352E57"><enum>(A)</enum><text display-inline="yes-display-inline">is formulated to be consumed or administered enterally, including tube feeding and oral intake, and dispensed upon a written prescription of a practitioner licensed under the laws of the State in which such practitioner practices to administer drugs; and</text></subparagraph><subparagraph id="HA3587A772DCD4F64A06DD083816F3F1E"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="H06E9AAECEF2443DC8FC89DB5BA3A626C"><enum>(i)</enum><text display-inline="yes-display-inline">is intended for the specific dietary management of a disease or condition for which distinctive nutritional requirements, including conditions of inborn errors of metabolism, based on recognized scientific principles, are established by medical evaluation; or</text></clause><clause id="HC2E6703681FB45D1A7A2BEBD01B446D7" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of an individual for whom the prescribing physician determines the individual has failed on traditional therapies or determines continuing the traditional therapy is inappropriate for the patient due to comorbidities or severe side effects that endanger the health of the individual—</text><subclause id="H00C4A32914CB49E3A70A48A3828FF218"><enum>(I)</enum><text>has been shown to provide clinical benefit in well-controlled peer-reviewed clinical trials to patients with a disease or condition specified in clause (i); and</text></subclause><subclause id="H85968F334D4B4E48A72329ADB05CC53E"><enum>(II)</enum><text>is determined by the prescribing physician to be a safer therapeutic option or the only effective clinical option for the individual.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HAC5C7579BA9C4D14B6FE9CE8D01B1957" commented="no"><enum>(b)</enum><header>National Drug Code number</header><text>Section 5 of the Orphan Drug Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360ee">21 U.S.C. 360ee</external-xref>) is amended—</text><paragraph id="HE658206769D64EC49C41883AF9C7E786"><enum>(1)</enum><text>by redesignating subsection (c) as subsection (d); and</text></paragraph><paragraph id="HC8A69F4FEF8E4D59BFCDBF42CDE074F8"><enum>(2)</enum><text>by inserting after subsection (b) the following:</text><quoted-block style="OLC" id="H781CF3F609254F05B715BC9CA4A197AB" display-inline="no-display-inline"><subsection id="H7FA0BD3BA2E44E4A99E405427D48827D" commented="no"><enum>(c)</enum><header>National Drug Code number</header><text display-inline="yes-display-inline">Medical foods shall be eligible for a National Drug Code number.<italic></italic></text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="HFA6B67EF09E345C0B9B1F7077B4C47CC"><enum>3.</enum><header>Coverage of medically necessary food under Federal health programs and private health insurance</header><subsection id="H96299695900740AFA4E70826F02E1F3E"><enum>(a)</enum><header>Coverage under Medicare program</header><paragraph id="HA7E65FA545F04996B5FC63262EE81006"><enum>(1)</enum><header>Part B coverage</header><subparagraph id="H3962E522A1C442A9BF9B9C96040EDA2E"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1861(s)(2) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text><clause id="HB3C10D23D29C4FDCAFC4E6BA1DBD2029"><enum>(i)</enum><text>in subparagraph (GG), by striking <quote>and</quote> at the end;</text></clause><clause id="HA9DDA5502F794EEDA65E4EE8279097E5"><enum>(ii)</enum><text>in subparagraph (HH), by striking the period at the end and inserting <quote>; and</quote>; and</text></clause><clause id="H80181DFE444348FEB1B9E3FDD7246775"><enum>(iii)</enum><text>by adding at the end the following new subparagraph:</text><quoted-block style="OLC" id="H8ACD2E50C30D40C2B5FAD959ED3619E6" display-inline="no-display-inline"><subparagraph id="HC4BF9CC868A04FB39142CA1E8D090109" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">medically necessary food (as defined in subsection (kkk));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="H768A15876D494DA3B3AE1FCDC026586C"><enum>(B)</enum><header>Definition</header><text>Section 1861 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="other" id="H8E4367DF18634CB79BB9C87F9D747BB5" display-inline="no-display-inline" other-style="archaic"><subsection id="HB6EA36F8317B47929C3356F23869DDEB"><enum>(kkk)</enum><header>Medically Necessary Food</header><text display-inline="yes-display-inline">The term <term>medically necessary food</term> has the meaning given the term <term>medical food</term> in section 5(b)(3) of the Orphan Drug Act (<external-xref legal-doc="usc" parsable-cite="usc/21/360ee">21 U.S.C. 360ee(b)(3)</external-xref>).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph><subparagraph id="H7C1EC7435D144A579978E0310BAB3B67" commented="no"><enum>(C)</enum><header>Payment</header><text>Section 1833(a)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395l">42 U.S.C. 1395l(a)(1)</external-xref>) is amended—</text><clause id="H8B32A4058F8442DF939BAA0951B2DA39" commented="no"><enum>(i)</enum><text>by striking <quote>and</quote> before <quote>(DD)</quote>; and</text></clause><clause id="H56F14CDF05A44D34AA2D0662A0CC8F1B" commented="no"><enum>(ii)</enum><text>by inserting before the semicolon at the end the following: <quote>, and (EE) with respect to medically necessary food (as defined in section 1861(kkk)), the amount paid shall be an amount equal to 80 percent of the actual charge for the services.</quote>.</text></clause></subparagraph><subparagraph id="HC6B95AFAC25A484F82C1BBFCFA307D41"><enum>(D)</enum><header>Effective date</header><text>The amendments made by this paragraph shall apply to items and services furnished on or after January 1, 2022.</text></subparagraph></paragraph><paragraph id="H52275DE7F6B3480FAF6438CD38D65686"><enum>(2)</enum><header>Coverage as covered part D drug</header><subparagraph id="H84B1C1AC90BE44D19DE8FC05E3C7A702"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1860D–2(e)(1) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(e)(1)</external-xref>) is amended—</text><clause id="H8AF712BC341240E392DC9F054CB9E2A9"><enum>(i)</enum><text>in subparagraph (A), by striking at the end <quote>or</quote>;</text></clause><clause id="H9EBB9BD1A55A4AA786B234E8761ECAFC"><enum>(ii)</enum><text>in subparagraph (B), by striking at the end the comma and inserting <quote>; or</quote>; and</text></clause><clause id="H9E1DA9DDE9DC4B81AD3A8BD3F36D61A4"><enum>(iii)</enum><text>by inserting after subparagraph (B) the following new subparagraph:</text><quoted-block style="OLC" id="H3F4E64152CBA45B1AA848EBA922CEF48" display-inline="no-display-inline"><subparagraph id="H9C9F00A7CFDE4474881CF9C80FF53748"><enum>(C)</enum><text display-inline="yes-display-inline">a medically necessary food (as defined in section 1861(kkk)),</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></clause></subparagraph><subparagraph id="HCB195D28D72343469B50A88F387AB5F7"><enum>(B)</enum><header>Effective date</header><text>The amendments made by subparagraph (A) shall apply with respect to plan years beginning on or after January 1, 2022.</text></subparagraph></paragraph></subsection><subsection id="H82AA414A2B8C43EC889D7046509FC912"><enum>(b)</enum><header>Coverage under Medicaid program</header><paragraph id="H63B761945BCF4C95A9A9E2FA9DBB30BE"><enum>(1)</enum><header>In general</header><text>Section 1905(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended—</text><subparagraph id="H88E5094F17D648A3BDBA859D8C45F703"><enum>(A)</enum><text>in paragraph (29), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="H4EDE3E4C840C4588B73871BFA4C9F03F"><enum>(B)</enum><text>by redesignating paragraph (30) as paragraph (31); and</text></subparagraph><subparagraph id="HBE7908FC8A254F9BAB1E2D2B438CD06C"><enum>(C)</enum><text>by inserting after paragraph (29) the following new paragraph:</text><quoted-block id="HD3D41ACBF1CF4ABD8EB1A3171F05486E" style="OLC"><paragraph id="HEDEBE093A405472286654A5FDE84D037"><enum>(30)</enum><text display-inline="yes-display-inline">medically necessary food (as defined in section 1861(kkk)); and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H7B6BC365838840E0A53DF30A7B1092EC" commented="no"><enum>(2)</enum><header>Mandatory benefit</header><text>Section 1902(a)(10)(A) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)</external-xref>) is amended, in the matter preceding clause (i), by striking <quote>and (29)</quote> and inserting <quote>(29), and (30)</quote>. </text></paragraph><paragraph id="HB20E4FB2E45242539BAFB15482841BB9"><enum>(3)</enum><header>Effective date</header><subparagraph id="H38C7CEE590CA43AE8DAB6BC52FCA843A"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to subparagraph (B), the amendments made by this subsection shall apply with respect to medical assistance furnished on or after July 1, 2022.</text></subparagraph><subparagraph id="HAB5E1F05D6894FEB852425E82DB56DEB" commented="no"><enum>(B)</enum><header>Exception if state legislation required</header><text>In the case of a State plan for medical assistance under title XIX of the Social Security Act which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirement imposed by the amendments made by this subsection, the State plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet this additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of such session shall be deemed to be a separate regular session of the State legislature.</text></subparagraph></paragraph></subsection><subsection id="HC91F3AEE092F40FD8F510DCFE3EB8658"><enum>(c)</enum><header>Coverage under CHIP</header><paragraph id="H3490AE30DE5945CAA4A9D6287BC553B1"><enum>(1)</enum><header>In general</header><text>Section 2103(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(c)</external-xref>) is amended by adding at the end the following:</text><quoted-block id="H6734ADEA1B54491A8D416F7073EB2E0B" style="OLC"><paragraph id="H552AB72C58324D809B08ECD58B2187B4"><enum>(11)</enum><header>Medically necessary food</header><text>The child health assistance provided to a targeted low-income child shall include coverage of medically necessary food (as defined in section 1861(kkk)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HE92115EB7CAA4A06AB39D67B81EA06DC"><enum>(2)</enum><header>Conforming amendment</header><text>Section 2103(a) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397cc">42 U.S.C. 1397cc(a)</external-xref>) is amended, in the matter preceding paragraph (1), by striking <quote>and (8)</quote> and inserting <quote>, (8), and (11)</quote>.</text></paragraph><paragraph id="H5D4D823C6DC94C9B81A2ACD0A562BA36"><enum>(3)</enum><header>Effective date</header><subparagraph id="HE666894B746B497F8CBEE4AB73691B2E"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), the amendments made by this subsection shall apply with respect to child health assistance furnished on or after July 1, 2022.</text></subparagraph><subparagraph id="HA874D5364E0640F0A030C927F8F863F7" commented="no"><enum>(B)</enum><header>Exception if state legislation required</header><text>In the case of a State child health plan for child health assistance under title XXI of the Social Security Act which the Secretary of Health and Human Services determines requires State legislation (other than legislation appropriating funds) in order for the plan to meet the additional requirement imposed by the amendments made by this subsection, the State child health plan shall not be regarded as failing to comply with the requirements of such title solely on the basis of its failure to meet this additional requirement before the first day of the first calendar quarter beginning after the close of the first regular session of the State legislature that begins after the date of the enactment of this Act. For purposes of the previous sentence, in the case of a State that has a 2-year legislative session, each year of such session shall be deemed to be a separate regular session of the State legislature.</text></subparagraph></paragraph></subsection><subsection id="HF72C26E254734DF786520ABD176E7D23" commented="no"><enum>(d)</enum><header>Coverage under TRICARE</header><text>Paragraph (2) of section 1077(h) of title 10, United States Code, is amended to read as follows:</text><quoted-block style="USC" id="H069A34609EC44470B86C0CBAB6FB5A07" display-inline="no-display-inline"><paragraph id="HBD83A1A0E2C9477FAC3B2406B2EAEE16" indent="up1" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">In this section, the term <term>medically necessary food</term> has the meaning given the term <term>medical food</term> in section 5(b)(3) of the Orphan Drug Act.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HE55F64A45C9C4DA0B3AA253F7007F03A"><enum>(e)</enum><header>Coverage under private health insurance</header><paragraph id="H4F3D1F01A6E74134BA220A9D661212FE"><enum>(1)</enum><header>In general</header><text>Subpart II of part A of title XXVII of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300gg-11">42 U.S.C. 300gg–11</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block id="HF42A081D84AE4B54BD3330480AC5658A" style="OLC"><section id="H491986CB9C974A6898D31AE5EED78FFC"><enum>2730.</enum><header>Coverage of medically necessary food</header><text display-inline="no-display-inline">A group health plan and group or individual health insurance coverage offered by a health insurance issuer shall provide coverage for medically necessary food (as defined in section 1861(kkk) of the Social Security Act).</text></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph><paragraph id="HBDE56DF93747412DA9E6566D7A13479E"><enum>(2)</enum><header>Effective date</header><text>The amendment made by paragraph (1) shall apply to plan years beginning on or after January 1, 2022.</text></paragraph></subsection></section></legis-body></bill>
