which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To provide for certain requirements for the collection, transmission, processing, or disclosure of camera or microphone data by the manufacturer of an internet-connected device or developer of an application installed on such a device, and for other purposes.</official-title></form><legis-body id="HA04D70A964CD49A8A6B152031EA5D971" style="OLC"><section id="H4C051D9F1D8A4A15A3B7CD4546BDEE60" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Prevent Recording of Individuals with Video and Audio Technologies when not Enabled Act</short-title></quote> or the <quote><short-title>PRIVATE Act</short-title></quote>. </text></section><section id="H1EC285C7C0A64D26827DB511D305D5AE"><enum>2.</enum><header>Treatment of camera and microphone data by internet-connected devices and applications</header><subsection id="H6322680C404B4D0BA8CA6433AF45992D"><enum>(a)</enum><header>Prohibition</header><paragraph id="H615BDF1B4D9048E98F9D8F0C2D890F96"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">A covered entity may not collect any data using the camera or microphone of a covered device of an individual, cause any data so collected to be transmitted from the device, or process or disclose to another person any data so collected, unless—</text><subparagraph id="H8802CAAABB76477099DB80DA928147A4"><enum>(A)</enum><text display-inline="yes-display-inline">the collection, transmission, processing, or disclosure is consistent with reasonable consumer expectations within the context of the interaction between the covered entity and the individual; or</text></subparagraph><subparagraph id="H68623771CBD1426FA98F751E555F4426"><enum>(B)</enum><text>the covered entity obtains the express, affirmative consent of the individual to the collection, transmission, processing, or disclosure in the manner required by subsection (b).</text></subparagraph></paragraph><paragraph id="H77FFBF9A5CA549CA915DF7EBB0BBDEAE"><enum>(2)</enum><header>Reasonable consumer expectations</header><text>For purposes of paragraph (1)(A), the collection, transmission, processing, or disclosure of data is not consistent with reasonable consumer expectations if—</text><subparagraph id="H633542FD544F412992ECA8D2D4A2684B"><enum>(A)</enum><text>the collection, transmission, processing, or disclosure is not reasonably required for the functionality of the covered device manufactured by the covered entity or the covered application developed by the covered entity (as the case may be); or</text></subparagraph><subparagraph id="HF5FF1E52A41D45C1A8DD65D365238CD4" commented="no"><enum>(B)</enum><text>the data is collected, transmitted, or processed (regardless of whether the processing occurs on the covered device or on the systems of the covered entity) when the individual is not actively using the covered device or covered application (as the case may be).</text></subparagraph></paragraph></subsection><subsection id="HF63D04B2F62745B09B0ECD05FA6C0EA0"><enum>(b)</enum><header>Requirements for obtaining express, affirmative consent</header><paragraph id="H15C7A933B2E94A578CB400919EC3B253"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">To obtain the express, affirmative consent of an individual to the collection of data using the camera or microphone of a covered device of the individual, the causing of any data so collected to be transmitted from the device, or the processing or disclosure to another person of any data so collected, a covered entity shall—</text><subparagraph id="H76CB63EA216346B69A3DCCB495C86CBA"><enum>(A)</enum><text>provide to the individual a brief notice of the collection, transmission, processing, or disclosure that meets the requirements of paragraph (2); and</text></subparagraph><subparagraph id="H15606614408A451AB5306600C403204C"><enum>(B)</enum><text>obtain an affirmative response from the individual indicating that the individual consents to the collection, transmission, processing, or disclosure.</text></subparagraph></paragraph><paragraph id="H6C53CC0B79FB4D8BA2F7F1D3D2626F87"><enum>(2)</enum><header>Brief notice</header><text display-inline="yes-display-inline">The brief notice required by paragraph (1)(A) shall—</text><subparagraph id="H4CEDF46BFA7D42FA8E26AD432F769A4B"><enum>(A)</enum><text>briefly describe the collection, transmission, processing, or disclosure for which consent is sought;</text></subparagraph><subparagraph id="H77A9741F012941B0808A06038EC26345"><enum>(B)</enum><text>be provided in a conspicuous manner;</text></subparagraph><subparagraph id="H438F102B927446DDB41A901D69CE67DA"><enum>(C)</enum><text>be separate from any other privacy policy or terms or conditions relating to the covered device or covered application;</text></subparagraph><subparagraph id="HBFF7AD6E70924A74AD23F1505DEE4FDF"><enum>(D)</enum><text>be in plain language;</text></subparagraph><subparagraph id="H5610D1B5BB4F458480D3C4BF7039D106"><enum>(E)</enum><text>be provided—</text><clause id="HF653BCBFAEC145BBABCE6644785DEB07"><enum>(i)</enum><text>in the case of a covered device that has a screen (or a covered application installed on a covered device that has a screen)—</text><subclause id="H4C27E2B1B0FC4D04B6626895C3B83661"><enum>(I)</enum><text>in the form of text displayed on the screen; and</text></subclause><subclause id="HC5466D084300422E8656A9D3FAC4FD45"><enum>(II)</enum><text>if the individual so chooses, in spoken form; and</text></subclause></clause><clause id="HA039D1C0C8214F329BB4F90B9A89F700"><enum>(ii)</enum><text display-inline="yes-display-inline">in the case of a covered device that does not have a screen (or a covered application installed on a covered device that does not have a screen)—</text><subclause id="HFF548BA43D7B463582B22730025DA5C1"><enum>(I)</enum><text>in spoken form; and</text></subclause><subclause id="HE60C145154504F15AFA775E9CE6DFF43"><enum>(II)</enum><text>if the individual so chooses, in an alternative form that is accessible to individuals with a hearing impairment; and</text></subclause></clause></subparagraph><subparagraph id="H9F4981464F144F0B8C437A12D7528FE3"><enum>(F)</enum><text display-inline="yes-display-inline">clearly and conspicuously direct the individual to a website on which the individual may access the privacy policy required by paragraph (3).</text></subparagraph></paragraph><paragraph id="H2007A80617134AF28316EEC1EFB15030"><enum>(3)</enum><header>Privacy policy for camera and microphone data</header><text display-inline="yes-display-inline">A covered entity that collects any data using the camera or microphone of a covered device of an individual, causes any data so collected to be transmitted from the device, or processes or discloses to another person any data so collected, shall maintain on a publicly available website a privacy policy that describes in detail, but using plain language, the collection, transmission, processing, or disclosure, including the purposes of the collection, transmission, processing, or disclosure. The privacy policy shall be separate from any other privacy policy or terms or conditions relating to the covered device or covered application and shall be displayed in a conspicuous manner on the website.</text></paragraph></subsection><subsection id="HC50FF89BE5A149CF98C94051CAC9E9BB"><enum>(c)</enum><header>Voice-Activated functionality</header><paragraph id="HC78145650F6942C092CC9E23E8DE07E7"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Notwithstanding subsection (a)(1)(A)—</text><subparagraph id="H824D3D31AAE64022947E7228DA9E61D7"><enum>(A)</enum><text display-inline="yes-display-inline">if the covered device of an individual has voice-activated functionality, the covered entity that manufactured the covered device may not, in connection with such functionality, collect any data using the camera or microphone of the covered device, cause any data so collected to be transmitted from the device, or process or disclose to another person any data so collected, unless, before such functionality is activated, the covered entity obtains the express, affirmative consent of the individual to the collection, transmission, processing, or disclosure; and</text></subparagraph><subparagraph id="HC2763991A8E34A0A8E6C438D51740A8D"><enum>(B)</enum><text display-inline="yes-display-inline">if a covered application installed on the covered device of an individual has voice-activated functionality, the covered entity that developed the covered application may not, in connection with such functionality, collect any data using the camera or microphone of the covered device, cause any data so collected to be transmitted from the device, or process or disclose to another person any data so collected, unless, before such functionality is activated, the covered entity obtains the express, affirmative consent of the individual to the collection, transmission, processing, or disclosure.</text></subparagraph></paragraph><paragraph id="H6103C777BABF4291A69B0CBEE3151CD4"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The express, affirmative consent required by paragraph (1) shall be obtained in the manner required by subsection (b), except that the brief notice required by subparagraph (A) of paragraph (1) of such subsection and the affirmative response required by subparagraph (B) of such paragraph shall be specific to the collection, transmission, processing, or disclosure of data in connection with the voice-activated functionality and separate from the notice provided and response obtained under such subparagraphs with respect to the collection, transmission, processing, or disclosure of data not in connection with such functionality.</text></paragraph></subsection><subsection id="H05CC780D969C491DAB27EE82D45A38D4"><enum>(d)</enum><header>Status of consent; revocation</header><text>A covered entity shall provide a convenient means, on the covered device manufactured by the covered entity or within the covered application developed by the covered entity (as the case may be), for an individual—</text><paragraph id="H4091AF15D7314B6494CBF98DABAC6375"><enum>(1)</enum><text>to revoke any consent provided under this section to the collection, transmission, processing, or disclosure of data; and</text></paragraph><paragraph id="H22F9133647FF41189CE1DF60D9271C3D"><enum>(2)</enum><text>to view whether the individual has provided or revoked any such consent.</text></paragraph></subsection><subsection id="HC7E9F94BB0E54CA18D69BF664BA1C248"><enum>(e)</enum><header>Federal Trade Commission guidance; safe harbor</header><paragraph id="H774DF0893FD7486D8A082C3EC7ADC63C"><enum>(1)</enum><header>Guidance</header><text display-inline="yes-display-inline">The Commission shall issue guidance containing examples of language for the brief notice required by subsection (b)(1)(A) (including text and spoken versions) and the privacy policy required by subsection (b)(3).</text></paragraph><paragraph id="HA015094429604147B087701D71F78CD6"><enum>(2)</enum><header>Safe harbor</header><subparagraph id="H30B63D07B19F4AF181BC49C996A24456"><enum>(A)</enum><header>Submission of brief notice or privacy policy to Commission</header><text display-inline="yes-display-inline">A covered entity may submit to the Commission for approval a brief notice that the covered entity intends to use to comply with subsection (b)(1)(A) or a privacy policy that the covered entity intends to use to comply with subsection (b)(3) with respect to the collection, transmission, processing, or disclosure of data. The covered entity shall include with the submission such information as the Commission may require about the collection, transmission, processing, or disclosure, as the Commission considers necessary to evaluate the adequacy of the brief notice or privacy policy.</text></subparagraph><subparagraph id="H9FF4463BEFEC4B8C816F987CEDF1CD17"><enum>(B)</enum><header>Approval or rejection</header><text display-inline="yes-display-inline">Not later than 120 days after receiving a brief notice or privacy policy from a covered entity under subparagraph (A), the Commission shall approve or reject the brief notice or privacy policy and inform the covered entity of the approval or rejection.</text></subparagraph><subparagraph id="H5181DD1BA31D4E01BD1AEAFB311B7B22"><enum>(C)</enum><header>Effect</header><text display-inline="yes-display-inline">If the Commission approves a brief notice or privacy policy under subparagraph (B), the brief notice or privacy policy shall be considered to meet the requirements of subsection (b)(1)(A) or (b)(3), respectively, with respect to the collection, transmission, processing, or disclosure of data to which the brief notice or privacy policy relates, to the extent the covered entity conducts the collection, transmission, processing, or disclosure in a manner that is consistent in all material respects with the information provided to the Commission under subparagraph (A).</text></subparagraph></paragraph></subsection><subsection id="HF73CF1FA08A3473C9A0920A077097CF1"><enum>(f)</enum><header>Enforcement by Federal Trade Commission</header><paragraph id="H3CDB19CE95FF4EACAA4FB98A56861FDD"><enum>(1)</enum><header>Unfair or deceptive acts or practices</header><text>A violation of this section or a regulation promulgated under this section shall be treated as a violation of a regulation under section 18(a)(1)(B) of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/57a">15 U.S.C. 57a(a)(1)(B)</external-xref>) regarding unfair or deceptive acts or practices. </text></paragraph><paragraph id="H707EF1A93B4A4C5480828E560B75570D"><enum>(2)</enum><header>Powers of Commission</header><text display-inline="yes-display-inline">The Commission shall enforce this section and the regulations promulgated under this section in the same manner, by the same means, and with the same jurisdiction, powers, and duties as though all applicable terms and provisions of the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/15/41">15 U.S.C. 41 et seq.</external-xref>) were incorporated into and made a part of this section. Any person who violates this section or a regulation promulgated under this section shall be subject to the penalties and entitled to the privileges and immunities provided in the Federal Trade Commission Act.</text></paragraph></subsection><subsection id="HAAEEA9F09BF14C34B3C5BA0D27EE9882"><enum>(g)</enum><header>Rulemaking</header><text>The Commission may promulgate regulations under section 553 of title 5, United States Code, to implement this section.</text></subsection><subsection id="HE93E5C16FC3244CE8DEA97128E414135"><enum>(h)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H89BFDC797BF34BBB998250D386BF05B8"><enum>(1)</enum><header>Commission</header><text>The term <quote>Commission</quote> means the Federal Trade Commission.</text></paragraph><paragraph id="H938EEECD67D44FCEBB71EB35245E5579" commented="no"><enum>(2)</enum><header>Covered application</header><text display-inline="yes-display-inline">The term <quote>covered application</quote> means a software application that is designed to be installed on a covered device.</text></paragraph><paragraph id="HF77336EC73B340B28B35F2607957DF18" commented="no"><enum>(3)</enum><header>Covered device</header><text>The term <quote>covered device</quote> means a device that—</text><subparagraph id="H74D5FFFFDE9346EBB8498F339070B8D3" commented="no"><enum>(A)</enum><text>is capable of connecting to the internet, either directly or indirectly through a network;</text></subparagraph><subparagraph id="HB7E7CE4131534CFE86C9F8F4BBCC4FF7" commented="no"><enum>(B)</enum><text>has computer processing capabilities for collecting, transmitting, or otherwise processing data; and</text></subparagraph><subparagraph id="HB19C2C74E4FC447BBC18B9D134F90D31" commented="no"><enum>(C)</enum><text display-inline="yes-display-inline">has a camera or microphone.</text></subparagraph></paragraph><paragraph id="H833CDE2724FE4AFCB54DFF8EE46BA502"><enum>(4)</enum><header>Covered entity</header><text>The term <quote>covered entity</quote> means—</text><subparagraph id="HA612E2A8A6A646D8852F5DCD2A131F78"><enum>(A)</enum><text>a manufacturer of a covered device; and</text></subparagraph><subparagraph id="HDAE5FB4AD3D244D884325584D5AEF9FB"><enum>(B)</enum><text>a developer of a covered application.</text></subparagraph></paragraph><paragraph id="H0D62700BF8A64A1CA8C5EFC797CCD68D"><enum>(5)</enum><header>Voice-activated functionality</header><text>The term <quote>voice-activated functionality</quote> means a functionality of a covered device or covered application that—</text><subparagraph id="H1D8E56AE106D4B169D08EC9EA3790931"><enum>(A)</enum><text>allows an individual to control the covered device or covered application using voice commands; and</text></subparagraph><subparagraph id="H2E95382ECFDA4A7F8A6FA7A4361FE0A5"><enum>(B)</enum><text>uses the microphone of the covered device being controlled, or the microphone of the covered device on which the covered application being controlled is installed, to listen for such commands when the individual is not actively using the covered device or covered application, respectively.</text></subparagraph></paragraph></subsection></section></legis-body></bill>
