which was referred to the <committee-name committee-id="HPW00">Committee on Transportation and Infrastructure</committee-name>, and in addition to the Committee on <committee-name committee-id="HII00">Natural Resources</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prevent the spread of aquatic invasive species in western waters, and for other purposes.</official-title></form><legis-body id="H8CE1E83258E84AA6893D003A11AA5CAA" style="OLC"><section id="H0E4FC21164CD42708BA4267A4D711559" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop the Spread of Invasive Mussels Act of 2021</short-title></quote>.</text></section><section id="H657307A8E1BF478887345BADE6AE38DB"><enum>2.</enum><header>Bureau of Reclamation assistance</header><subsection id="H94EE0F6D62224E07A6220D2313E414B6"><enum>(a)</enum><header>Definitions</header><text>In this section—</text><paragraph commented="no" id="HD243451ACB8F4AF2BD6CA4150BF18745"><enum>(1)</enum><text>the term <term>aquatic invasive species</term> has the meaning given that term <term>aquatic nuisance species</term> in section 1003 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4702">16 U.S.C. 4702</external-xref>);</text></paragraph><paragraph id="HCF06FDED933140F98BC71E6A777F5B53"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>reclamation project</term> has the meaning given that term in section 2803(3) of the Reclamation Projects Authorization and Adjustment Act of 1992 (<external-xref legal-doc="usc" parsable-cite="usc/16/460l">16 U.S.C.460<italic>l</italic></external-xref>-32(3));</text></paragraph><paragraph commented="no" id="H53D4331F60214A76A0A39DF0375CC73D"><enum>(3)</enum><text display-inline="yes-display-inline">the term <term>reclamation State</term> has the meaning given that term in section 4014 of the Water Infrastructure Improvements for the Nation Act (<external-xref legal-doc="usc" parsable-cite="usc/43/390b">43 U.S.C. 390b</external-xref> note);</text></paragraph><paragraph id="H8AF90CD055A04633BA2C94F4E188A1B4"><enum>(4)</enum><text display-inline="yes-display-inline">the term <term>recreational vessel</term> has the meaning given that term in section 502(25) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362(25)</external-xref>); and</text></paragraph><paragraph commented="no" id="H8E097CF2185A4734951CC1E53ACFD30C"><enum>(5)</enum><text>the term <term>Secretary</term> means the Secretary of the Interior, acting through the Commissioner of Reclamation.</text></paragraph></subsection><subsection id="HBA3454D506D14CEFB58B8B0DC9F6C65A"><enum>(b)</enum><header>Watercraft inspection in reclamation states</header><text>The Secretary shall provide financial assistance to a reclamation State to prevent the spread of aquatic invasive species into, within, and out of reclamation projects, including financial assistance to purchase, establish, operate, or maintain a watercraft inspection and decontamination station, if the Secretary determines that the financial assistance is—</text><paragraph id="H707309C023314194AFFE9808D88E076C"><enum>(1)</enum><text>necessary; and</text></paragraph><paragraph id="HDA32616E570D4DA2ABF3F148E350DD04"><enum>(2)</enum><text>in the interests of the United States.</text></paragraph></subsection><subsection id="HE6EF2D28ED9648CA8AF65C131C7D7F48"><enum>(c)</enum><header>Cost share</header><text>The non-Federal share of the cost of purchasing, establishing, operating, and maintaining a watercraft inspection and decontamination station (including a non-Federal watercraft inspection and decontamination station) under subsection (b), including personnel costs, shall be—</text><paragraph id="HD1A8E6FCCCE14D119E265E416BEC1C63"><enum>(1)</enum><text>25 percent; and</text></paragraph><paragraph id="H0A11378897A64D7285F00567419A14BF"><enum>(2)</enum><text>provided by the reclamation State, or a unit of local government in the reclamation State, in which the watercraft inspection and decontamination station or other project is located.</text></paragraph></subsection><subsection id="H2E42C0C339A14484A4069E72F59E0989"><enum>(d)</enum><header>Priority</header><text>In providing financial assistance to a reclamation State under subsection (b), the Secretary shall give priority to—</text><paragraph id="H5BE96B391F924ABC9D211952FB2B6915"><enum>(1)</enum><text display-inline="yes-display-inline">a watercraft inspection and decontamination station that has the highest likelihood of preventing the spread of aquatic invasive species at reservoirs of reclamation projects; and</text></paragraph><paragraph id="HC0DC55E6FDA74EA98D023FA7430BE204"><enum>(2)</enum><text>a project that—</text><subparagraph id="H6A70C0E9074B4C5AACF803F669F0124D"><enum>(A)</enum><text>would prevent the spread of an aquatic invasive species to waters under the jurisdiction of the Secretary, including an irrigation, reclamation, or other water project;</text></subparagraph><subparagraph id="H769F01A225E844E69D6C46613BE0ED06"><enum>(B)</enum><text>aligns with—</text><clause id="H01231AC8394F467F863B9A8350C7367A"><enum>(i)</enum><text>priorities of the reclamation State; and</text></clause><clause id="H56CBC42167014E4AB427B14DF4CE5410"><enum>(ii)</enum><text>the document submitted to the Aquatic Nuisance Species Task Force entitled <quote>Quagga-Zebra Mussel Action Plan for Western U.S. Waters</quote> and dated September 29, 2020, and any subsequent updates to such document submitted to the Task Force; and</text></clause></subparagraph><subparagraph id="H38569A52295C4E2E987AE51EBD01CAE3"><enum>(C)</enum><text display-inline="yes-display-inline">includes a plan for minimizing disruptions to boating access for non-contaminated recreational vessels to the greatest extent practicable, which may include recommendations provided by the Aquatic Nuisance Species Task Force established under section 1201(b) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721(b)</external-xref>).</text></subparagraph></paragraph></subsection><subsection id="H6844C7A585D34D6D85D9923EAE124473"><enum>(e)</enum><header>Coordination</header><text>In carrying out this section, the Secretary shall consult and coordinate with—</text><paragraph id="HE063027908284580B771EA7B48F0B4B4"><enum>(1)</enum><text>each of the reclamation States;</text></paragraph><paragraph id="H49D918696A914E5797393EFF2C048738"><enum>(2)</enum><text>affected federally recognized Indian Tribes; and</text></paragraph><paragraph id="H19B838DA650D4556B9567D54E308AB4E"><enum>(3)</enum><text>the heads of appropriate Federal agencies.</text></paragraph></subsection><subsection id="HED507D9A7BC142CFA1D7B6C4B15903EE"><enum>(f)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $25,000,000 for fiscal year 2022 and each fiscal year thereafter.</text></subsection></section><section id="H3DF7B792AEC3492C9C2DEE02DBFA7CC5"><enum>3.</enum><header>Recreational vessel inspection and decontamination authority</header><subsection id="H8B9B9FCBECBC419080BB3405B821744D" commented="no"><enum>(a)</enum><header>Recreational vessel defined</header><text display-inline="yes-display-inline">Section 1003 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4702">16 U.S.C. 4702</external-xref>) is amended—</text><paragraph id="H374AF6098539491790B32AC6D3F84439" commented="no"><enum>(1)</enum><text>by inserting after paragraph (12) the following:</text><quoted-block style="OLC" id="H696D2220DF244DB08F142F2CDD377A96" display-inline="no-display-inline"><paragraph id="H7F7BAAD38E3A49D9AF481C8806718EB4" commented="no"><enum>(13)</enum><text display-inline="yes-display-inline"><quote>State</quote> means each of the several States, the District of Columbia, American Samoa, Guam, Puerto Rico, the Northern Mariana Islands, and the Virgin Islands of the United States.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph><paragraph id="H203C4ED59C2B426D9F26889BD3C164F1" commented="no"><enum>(2)</enum><text>in paragraph (16), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HE87A73EEE00A48518125443E912B8B08" commented="no"><enum>(3)</enum><text>in paragraph (17), by striking the period and inserting <quote>; and</quote>; </text></paragraph><paragraph id="HBA1983ED6F974EF381B926FAB731161A" commented="no"><enum>(4)</enum><text>by redesignating paragraphs (13) through (17) as paragraphs (14) through (18), respectively; and</text></paragraph><paragraph id="H1187B7DE0AF34375BA243A200D0F5AFB" commented="no"><enum>(5)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HE517D472D0614935A0F5C1523720FE68"><paragraph id="H0CF9BBF588E142878CB28BE095907178" commented="no"><enum>(19)</enum><text display-inline="yes-display-inline"><quote>recreational vessel</quote> has the meaning given that term in section 502(25) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1362">33 U.S.C. 1362(25)</external-xref>).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H4728C52447BD43868CF0581E0EB96A84"><enum>(b)</enum><header>Observers</header><text display-inline="yes-display-inline">Section 1201 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="H1F2A921B9CFD477A8AC779BE0B0EAB7F" display-inline="no-display-inline"><subsection id="H8FB53F9620E8412FA700F84744C694E2"><enum>(g)</enum><header>Observers</header><text display-inline="yes-display-inline">The chairpersons designated under subsection (d) may invite representatives of nongovernmental entities to participate as observers of the Task Force.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H5EA52483B44448128037F77F9CE96CC0"><enum>(c)</enum><header>Aquatic Nuisance Species Task Force</header><text>Section 1201(b) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721(b)</external-xref>) is amended—</text><paragraph id="H4FB8A7A7737B41D48272619C3DA53C01"><enum>(1)</enum><text>in paragraph (6), by striking <quote>and</quote> at the end;</text></paragraph><paragraph id="HB0C00519E8ED415EBA23E4153C4CAB9E"><enum>(2)</enum><text>by redesignating paragraph (7) as paragraph (10); and</text></paragraph><paragraph id="HB56842770BA342FD814D2DE4D5FB30FD"><enum>(3)</enum><text>by inserting after paragraph (6) the following:</text><quoted-block act-name="" id="H3017DA27A6E948AD851B0B65C2F058BA" style="OLC"><paragraph id="H7D067B92BBE1462A9421167E48E193DE"><enum>(7)</enum><text>the Director of the National Park Service;</text></paragraph><paragraph id="HAE787B9868DC4161940C66B4073C60B5"><enum>(8)</enum><text>the Director of the Bureau of Land Management;</text></paragraph><paragraph id="HC066800D9A734C75902C2E0D308A6754"><enum>(9)</enum><text>the Commissioner of Reclamation; and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HB4251B0111D74A54839284E1F43DF4D0"><enum>(d)</enum><header>Aquatic nuisance species program</header><text display-inline="yes-display-inline">Section 1202 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4722">16 U.S.C. 4722</external-xref>) is amended—</text><paragraph id="HECB089F1684845338C53BEB26E123F65"><enum>(1)</enum><text>in subsection (b)—</text><subparagraph id="H0BA65A8002F84B7BAE84BCB84A4EBFAA"><enum>(A)</enum><text>in paragraph (5), by striking <quote>and</quote> at the end;</text></subparagraph><subparagraph id="HAC662AB7B4F24D29ADACE1A47D23AD56"><enum>(B)</enum><text>in paragraph (6), by striking the period at the end and inserting <quote>; and</quote>; and</text></subparagraph><subparagraph id="HDD1AA820ABC643AFB940DAE976A9764E"><enum>(C)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HA71E43EF6048442293F37252BB290E2D" style="OLC"><paragraph id="HF6D30C02F28D4FBDA09A7F9883E81381"><enum>(7)</enum><text>not later than 90 days after the date of enactment of the <short-title>Stop the Spread of Invasive Mussels Act of 2021</short-title>, recommend legislative, programmatic, or regulatory changes to eliminate remaining gaps in authorities between members of the Task Force to effectively manage and control the movement of aquatic nuisance species into, within, or out of waters of the United States.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HC260C1ADAC634120889E46B1E18A8238"><enum>(2)</enum><text>in subsection (c), by adding at the end the following:</text><quoted-block style="OLC" id="H828D79E3974E4047B7D588F512490F39" display-inline="no-display-inline"><paragraph id="H393B90355BF94D75A1EEDA44AF2FCD33"><enum>(3)</enum><header>Mandatory inspection and decontamination</header><text display-inline="yes-display-inline">To limit the movement of aquatic nuisance species into, within, or out of waters of the United States, each member of the Task Force may, as appropriate and in coordination with States—</text><subparagraph id="H13259E8EED384696A01460941A851E51"><enum>(A)</enum><text display-inline="yes-display-inline">conduct mandatory inspections and decontamination of recreational vessels;</text></subparagraph><subparagraph id="H059D7D2E27AD414DACFDDAB5EDC9D1BE"><enum>(B)</enum><text display-inline="yes-display-inline">if necessary, impound, quarantine, or otherwise prevent entry of a recreational vessel; and</text></subparagraph><subparagraph id="H654181B7534649ACB1798042C9807D2B"><enum>(C)</enum><text display-inline="yes-display-inline">partner with State and local governmental agencies to conduct inspections and decontaminations under this paragraph and accept any such inspections and decontamination by States and local government agencies for the purposes of allowing entry by recreational vessels to water regulated by such member of the Task Force.</text></subparagraph></paragraph><paragraph id="H544E9AD8F016453992AF8E34F73D8E8F"><enum>(4)</enum><header>Exceptions</header><subparagraph id="HA20BEDF0085D460A9DEEC66BE82E703F"><enum>(A)</enum><text display-inline="yes-display-inline">Nothing in paragraph (3) shall be construed to—</text><clause id="H23279CE6042D47A59A44B109E719FAB0"><enum>(i)</enum><text>limit the authority of the Commandant of the Coast Guard to regulate vessels provided under any other provision of law;</text></clause><clause id="H798EB645FDC148AD952770E272D19976"><enum>(ii)</enum><text>limit the authority, jurisdiction, or responsibilities of a State to manage, control, or regulate fish and wildlife under the laws and regulations of the State;</text></clause><clause id="H9BC155D2137F4A73B7DC5E517E2806CA"><enum>(iii)</enum><text>authorize members of the Task Force to control or regulate within a State the fishing or hunting of fish and wildlife; or</text></clause><clause id="HB25B8E22A1C74F99B3461C215C30FC5C"><enum>(iv)</enum><text display-inline="yes-display-inline">authorize State and local governmental agencies to impound or quarantine vessels using Federal authority.</text></clause></subparagraph><subparagraph id="HCD98A80AD2E9489FB54A024C9716831E"><enum>(B)</enum><text display-inline="yes-display-inline">Authorities granted in paragraph (3) shall not apply at locations where—</text><clause id="HB449003A002F44338D136915E0598EC1"><enum>(i)</enum><text display-inline="yes-display-inline">inspection or decontamination activities would duplicate efforts by the Coast Guard under the Vessel Incidental Discharge Act of 2018 (Title IX of <external-xref legal-doc="public-law" parsable-cite="pl/115/282">Public Law 115–282</external-xref>; 132 Stat. 4322);</text></clause><clause id="HEEA98F91CD3141EAA9011A693322FA36"><enum>(ii)</enum><text display-inline="yes-display-inline">inspection or decontamination activities would duplicate efforts by the Coast Guard under section 312(o) of the Federal Water Pollution Control Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1322">33 U.S.C. 1322(o)</external-xref>);</text></clause><clause id="HBAF173172EE74E06A8600884D2EC75CF"><enum>(iii)</enum><text>inspection or decontamination activities are conducted by the Coast Guard under any other provision of law; or</text></clause><clause id="H020A8C0D3DEC49268A2EA748C6E78F96"><enum>(iv)</enum><text>the Coast Guard is exercising its authority to direct vessel traffic pursuant to section 70002 or section 70021 of title 46, United States Code.</text></clause></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H5AFBEF6D9DB5412C83BAC75B79D65868"><enum>(3)</enum><text>in subsection (e)—</text><subparagraph id="HBFB588C6DE454CB6868A21003354C53C"><enum>(A)</enum><text>in paragraph (1)—</text><clause id="H6E24BB09F9074DCE8468C1A7FCBC3741"><enum>(i)</enum><text>in the first sentence, by inserting <quote>, economy, infrastructure,</quote> after <quote>environment</quote>; and</text></clause><clause id="H4F360980186344BE8E6C52076BAFDE63"><enum>(ii)</enum><text>in the second sentence, by inserting <quote>(including through the use of recreational vessel inspection and decontamination stations)</quote> after <quote>aquatic nuisance species</quote>;</text></clause></subparagraph><subparagraph id="H49D7F5AA49F44DB1BC592D0A4F8183A1"><enum>(B)</enum><text>in paragraph (2), in the second sentence, by inserting <quote>infrastructure, and the</quote> after <quote>ecosystems,</quote>; and</text></subparagraph><subparagraph id="HC467A2AC77CD4733BE7FC03975F6F821"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text><quoted-block style="OLC" id="H98A137B972F14C59AB45554227586513" display-inline="no-display-inline"><paragraph id="H5118654307E04C17B5A28A817DF36047"><enum>(4)</enum><header>Technical assistance and recommendations</header><text display-inline="yes-display-inline">The Task Force may provide technical assistance and recommendations for best practices to an agency or entity engaged in inspections or decontaminations under subsection (c) or receiving funds under section 2 of the Stop the Spread of Invasive Mussels Act of 2021 for the purpose of—</text><subparagraph id="HF6A7661369F8487EB74B38CA3382CB84"><enum>(A)</enum><text>effectively managing and controlling the movement of aquatic nuisance species into, within, or out of waters of the United States; and</text></subparagraph><subparagraph id="HBE728DE47EFE4CAEAEECBCCCF33458AE"><enum>(B)</enum><text display-inline="yes-display-inline">inspecting recreational vessels in a manner that minimizes disruptions to public access for boating and recreation in non-contaminated vessels.</text></subparagraph></paragraph><paragraph id="H580874356A3743E1A07662D6C47BCC41"><enum>(5)</enum><header>Coordination</header><text display-inline="yes-display-inline">In carrying out paragraph (4), including the development of recommendations, the Task Force may coordinate with—</text><subparagraph id="H79897BD3B32343708A6745CD26CB5BEB"><enum>(A)</enum><text>State fish and wildlife management agencies;</text></subparagraph><subparagraph id="H2874EBD94C964141B9DDCA46AC0DB6EA"><enum>(B)</enum><text>other State agencies that manage fishery resources of the State, sustain fishery habitat, or manage and remove aquatic nuisance species; and</text></subparagraph><subparagraph id="HE2BED797CEBE4C74AF8482441A408AA1"><enum>(C)</enum><text>relevant nongovernmental entities.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section><section id="H90E62925172246D78F7D714E21E62F1C" commented="no"><enum>4.</enum><header>Technical corrections and conforming amendments</header><text display-inline="no-display-inline">The Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4701">16 U.S.C. 4701 et seq.</external-xref>) is further amended—</text><paragraph id="H2938CECD4A5C47AE9DFD5944580B02DD" commented="no"><enum>(1)</enum><text>in section 1002(b)(2), by inserting a comma after <quote>funded</quote>;</text></paragraph><paragraph id="H62E0F36FF31743A3BF88B74FDB9F3321"><enum>(2)</enum><text>in section 1003, in paragraph (7), by striking <quote>Canandian</quote> and inserting <quote>Canadian</quote>;</text></paragraph><paragraph id="H8F27E9528B114F8388ABE51B29A9B6A5"><enum>(3)</enum><text>in section 1203(a)—</text><subparagraph id="H0503E778975B4B109D6650E0866D9719"><enum>(A)</enum><text>in paragraph (1)(F), by inserting <quote>and</quote> after <quote>research,</quote>; and</text></subparagraph><subparagraph id="H479B998FFCED416C9E975F841F75ED7D"><enum>(B)</enum><text>in paragraph (3), by striking <quote>encourage</quote> and inserting <quote>encouraged</quote>;</text></subparagraph></paragraph><paragraph id="HFBFE4ADEC4EA444F87561B3D346291CE"><enum>(4)</enum><text>in section 1204(b)(4), in the paragraph heading, by striking <quote><header-in-text level="paragraph" style="OLC">Adminisrative</header-in-text></quote> and inserting <quote><header-in-text level="paragraph" style="OLC">Administrative</header-in-text></quote>;</text></paragraph><paragraph id="H36B66F06DD9743FBBE6519D0C7E81641"><enum>(5)</enum><text>in section 1209, by striking <quote>subsection (a)</quote> and inserting <quote>section 1202(a)</quote>;
