<section id="H81C770EFBAC64CF0B0D6A4743392A36C" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>People-Centered Assistance Reform Effort Act</short-title></quote> or the <quote><short-title>People CARE Act</short-title></quote>.</text></section> <section id="H22D7C9C2C3264BF89C29C741D8385241"><enum>2.</enum><header>Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to structure means-tested welfare programs so that—</text>
<paragraph id="HD67A3E7547C0455AA928B234338C1B41"><enum>(1)</enum><text display-inline="yes-display-inline">welfare programs work in an integrated manner and provide social workers with the tools to assist people holistically;</text></paragraph> <paragraph id="H25946AD21F414D63871D956FBE1726E1"><enum>(2)</enum><text display-inline="yes-display-inline">welfare programs work together in a streamlined and comprehensible manner, and, over time, individuals on such programs will earn enough income on their own to transition off of means-tested welfare programs; and</text></paragraph>
<paragraph id="HD592D03A51D9453F83E271E4B6A0C44C"><enum>(3)</enum><text>means-tested welfare programs increase employment, encourage healthy families and further educational attainment so that households maintain an income above the poverty level without services and benefits from the Federal Government.</text></paragraph></section> <section id="H3E45191907ED44EBBA853FECC1BC94F6" section-type="subsequent-section"><enum>3.</enum><header>Definition of means-tested welfare program</header> <subsection id="H26D33CE3D21E4476A4D69ECD88C4E54D"><enum>(a)</enum><header>Means-Tested welfare program</header><text display-inline="yes-display-inline">In this Act, the term <term>means-tested welfare program</term>—</text>
<paragraph id="H8CBF74A83E9D4CD5AB8F88E227DC8806"><enum>(1)</enum><text>means any Federal program that is designed to specifically provide assistance or benefits exclusively to low-income Americans;</text></paragraph> <paragraph id="H0C12E211EC344BD59569A98CC3579D27"><enum>(2)</enum><text>does not include such a program if the program—</text>
<subparagraph id="HC1141E81BE364AF7A177B2B1634418A8"><enum>(A)</enum><text>is based on earned eligibility;</text></subparagraph> <subparagraph id="HBE905A0FD09141CCB682F1B94771A45A"><enum>(B)</enum><text>is not need-based;</text></subparagraph>
<subparagraph id="H607175898D4E43BAA7290E199D6D8AFC"><enum>(C)</enum><text display-inline="yes-display-inline">provides to an individual benefits under title 38, United States Code, or other provisions of law administered by the Secretary of Veterans Affairs; or</text></subparagraph> <subparagraph id="HFA4539288F1A4B9C9A8A4EAE01E91FE1"><enum>(D)</enum><text>offers universal or near universal eligibility to the working population and their dependents; and</text></subparagraph></paragraph>
<paragraph id="H10721FD9E6E5441FB907423B606293CB"><enum>(3)</enum><text>includes community and economic development programs targeted to low-income communities or populations.</text></paragraph></subsection> <subsection id="H340C4CE19CDC473B93EED28B2D20F191"><enum>(b)</enum><header>Programs included</header><text display-inline="yes-display-inline">For purposes of subsection (a), the following Federal programs shall be considered means-tested welfare programs:</text>
<paragraph id="HB10E1085A12E411C81BE82D951A368C2"><enum>(1)</enum><header>Cash and general assistance</header>
<subparagraph id="HE992DA5F7BBA4B0EB9D80900406176A4"><enum>(A)</enum><text>The Supplemental Security Income program under title XVI of the Social Security Act.</text></subparagraph> <subparagraph id="H652A31ABACA94EA59C35DEB9EEBFF398"><enum>(B)</enum><text>The earned income tax credit determined under <external-xref legal-doc="usc" parsable-cite="usc/26/32">section 32</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph>
<subparagraph id="H33C93F710EA849F6B176DE452D6D76D6"><enum>(C)</enum><text>The refundable portion of the child tax credit determined under <external-xref legal-doc="usc" parsable-cite="usc/26/24">section 24</external-xref> of the Internal Revenue Code of 1986.</text></subparagraph> <subparagraph id="HF64202B1515843CEA66E9774DD130CB6"><enum>(D)</enum><text>The program of block grants to States for temporary assistance for needy families under part A of title IV of the Social Security Act.</text></subparagraph>
<subparagraph id="H2783CC42D14146DC8B4883D302F97623"><enum>(E)</enum><text>The foster care and adoption assistance program under part E of title IV of the Social Security Act.</text></subparagraph> <subparagraph id="H7904CDD2F8FE4183B9C120CF6E7976EC"><enum>(F)</enum><text>General Assistance to Indians.</text></subparagraph>
<subparagraph id="HD7AC693DECBB40CCA2F67451B56B9E5D"><enum>(G)</enum><text>The programs operated under the Assets for Independence Act.</text></subparagraph></paragraph> <paragraph id="H5F7ECA86DD8347DDA89BBC6182719805"><enum>(2)</enum><header>Medical</header> <subparagraph id="HB99631D3C2AD4FBFB3ACF10FF2915D8F"><enum>(A)</enum><text display-inline="yes-display-inline">The Medicaid program under title XIX of the Social Security Act.</text></subparagraph>
<subparagraph id="H539868BFB0304EB4BCB9926ADE5F14B1"><enum>(B)</enum><text>The State Children's Health Insurance Program under title XXI of the Social Security Act.</text></subparagraph> <subparagraph id="H35C872FA03D94664A7FF3AD1F083129B"><enum>(C)</enum><text display-inline="yes-display-inline">Health programs operated by the Indian Health Service, Indian tribes, tribal organizations, and Urban Indian organizations (as those terms are defined in section 4 of the Indian Health Care Improvement Act (<external-xref legal-doc="usc" parsable-cite="usc/25/1603">25 U.S.C. 1603</external-xref>)).</text></subparagraph>
<subparagraph id="H69A07E16F3DD4B8ABDDF91BF0FDC9519"><enum>(D)</enum><text display-inline="yes-display-inline">The health center programs under section 330 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254b">42 U.S.C. 254b</external-xref>).</text></subparagraph> <subparagraph id="H568F110313A545AE846D5F5643FBA1E9"><enum>(E)</enum><text display-inline="yes-display-inline">The Maternal and Child Health Services Block Grant program under title V of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/701">42 U.S.C. 701 et seq.</external-xref>).</text></subparagraph>
<subparagraph id="HBFBB07A34B0F4233AC09DD52EDE68970"><enum>(F)</enum><text display-inline="yes-display-inline">The Healthy Start Initiative under section 330H of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/254c-8">42 U.S.C. 254c–8</external-xref>).</text></subparagraph> <subparagraph id="HCE7C62159F8D49E8B11EC5029A893F9C"><enum>(G)</enum><text display-inline="yes-display-inline">Premium tax credits and cost sharing reductions available pursuant to the Patient Protection and Affordable Health Care Act (PPACA) and the amendments made by such Act.</text></subparagraph></paragraph>

<subparagraph id="HFA57ED6F15664ACFBBCDA7CF868753DC"><enum>(A)</enum><text display-inline="yes-display-inline">The supplemental nutrition assistance program under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text></subparagraph> <subparagraph id="H5E4707BD7CB944C2B0757ACA0F49412E"><enum>(B)</enum><text display-inline="yes-display-inline">The school lunch program under the Richard B. Russell National School Lunch Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>).</text></subparagraph>

<paragraph id="H1E19899F34BD41C09273764215AA9C6D"><enum>(1)</enum><text display-inline="yes-display-inline">The Old-Age, Survivors, and Disability Insurance Benefit program under title II of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/401">42 U.S.C. 401 et seq.</external-xref>).</text></paragraph> <paragraph id="H789E34A58755439BA0E850B5BCA16D4A"><enum>(2)</enum><text display-inline="yes-display-inline">The Medicare program under title XVIII of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395">42 U.S.C. 1395 et seq.</external-xref>).</text></paragraph>
<paragraph id="H642A263FE7C44E2D970066DF3741E652"><enum>(3)</enum><text display-inline="yes-display-inline">A program designed exclusively or primarily to provide to an individual benefits under title 38, United States Code, or other provisions of law administered by the Secretary of Veterans Affairs.</text></paragraph> <paragraph id="H4AF1040FE20A4200B927C33AD66F1687"><enum>(4)</enum><text display-inline="yes-display-inline">A program that provides for the receipt of <quote>regular compensation</quote>, <quote>extended compensation</quote>, or <quote>additional compensation</quote> (as such terms are defined by section 205 of the Federal-State Extended Unemployment Compensation Act (<external-xref legal-doc="usc" parsable-cite="usc/26/3304">26 U.S.C. 3304</external-xref> note)).</text></paragraph>

<subsection id="H4222BFF577944CF2865A54DF106628F9"><enum>(d)</enum><header>Special rules</header>
<paragraph id="HF942997D4E994AEA8A58F83C91C12DFE"><enum>(1)</enum>
<subparagraph commented="no" display-inline="yes-display-inline" id="H8051E0A7EDFE47FAB8B3F47E8504C947"><enum>(A)</enum><text>For purposes of subsection (a), only the refundable portion of the following tax credits shall be considered means-tested welfare programs:</text> <clause id="HFE86A0E850DA40F9A763F8AD7EA0F3CF" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">The earned income tax credit under <external-xref legal-doc="usc" parsable-cite="usc/26/32">section 32</external-xref> of the Internal Revenue Code of 1986.</text></clause>
<clause id="H76ECFC8A9F704BC9BE4881E372A6539D" indent="up1"><enum>(ii)</enum><text>The child tax credit under <external-xref legal-doc="usc" parsable-cite="usc/26/24">section 24(d)</external-xref> of the Internal Revenue Code of 1986.</text></clause></subparagraph> <subparagraph id="H4ABA8BEDAAF4499CA5D8495871B0C571" indent="up1"><enum>(B)</enum><text>For purposes of subsection (a), only the refundable portion of the premium and out-of-pocket health care subsidies to be paid under the Patient Protection and Affordable Health Care Act shall be considered a means-tested welfare program.</text></subparagraph>
<subparagraph id="H9B5D59BFA4114CA5AF82489ABDFB26A5" indent="up1"><enum>(C)</enum><text>For purposes of this subparagraph, the term <term>refundable portion</term> means the portion of the credit which is paid to an individual in excess of the amount of Federal income tax owed by the individual.</text></subparagraph></paragraph> <paragraph id="H1D6F55509DB049EBB0246CC23ADD393C"><enum>(2)</enum><text>For purposes of subsection (a), only the costs of the free and reduced price segments of the school lunch and school breakfast programs shall be considered means-tested welfare programs.</text></paragraph></subsection>
<subsection id="H88A707F488EB4788AA97B0D2A4415FF1"><enum>(e)</enum><header>Exclusion of certain State and local expenditures</header><text>For purposes of subsection (a), expenditures by State and local governments of funds that are—</text> <paragraph id="H62BCC20461AD4EEEB5FC3E8E5BDA9AC9"><enum>(1)</enum><text>obtained by the State and local government from taxes, fees, or other sources of revenue established by the State or local government; and</text></paragraph>
<paragraph id="HBF69FB9F428D4CECA45E5BCBBE0A7F8F"><enum>(2)</enum><text>not received as any form of grant from the Federal Government,</text></paragraph><continuation-text continuation-text-level="subsection">shall not be considered means-tested welfare programs, without regard to whether the State and local expenditures take the form of contributions to a Federal program described in subsection (a) or listed in subsection (b).</continuation-text></subsection></section> <section id="H36B6888902DB4163B93ADE9D990074FC"><enum>4.</enum><header>Establishment of People-Centered Assistance Reform Effort Commission</header> <subsection id="H5D3579A6B303474CB345AA7C26E9CAEC"><enum>(a)</enum><header>Establishment</header><text>There is established in the legislative branch a commission to be known as the <quote>People-Centered Assistance Reform Effort Commission</quote> or the <quote>CARE Commission</quote> (in this Act referred to as the <quote>Commission</quote>).</text></subsection>
<subsection id="H2B0443533FC94C5C8B800603E1F6DD67"><enum>(b)</enum><header>Duties</header>
<paragraph id="HECA7CDE4D14C4FC8B4F93980C0C0F612"><enum>(1)</enum><header>In general</header><text>The Commission—</text> <subparagraph id="H95657F91F78E4473BDFD2D58F9B011E6"><enum>(A)</enum><text>shall review all means-tested welfare programs within the Federal Government to—</text>
<clause id="H55C4F01F3915411785C1B96A2DEF374F"><enum>(i)</enum><text>identify changes in law (which may include ways to streamline functions and increase efficiency within agencies or programs) that will achieve the purposes set forth in section 2;</text></clause> <clause id="HB38A0B3F02DB4F179137D5550FD7A676"><enum>(ii)</enum><text>evaluate whether each means-tested welfare program could be consolidated with another means-tested welfare program, or a program subject to the availability of discretionary appropriations with similar goals, and make recommendations for consolidating the programs that are identified;</text></clause>
<clause id="H2A57EC6A51DC4472ADA24A3EFFEA5E5D"><enum>(iii)</enum><text display-inline="yes-display-inline">evaluate the potential benefits of consolidating or repurposing any means-tested welfare program that does not have proven beneficial outcomes that assist in achieving purposes set forth in section 2 and make recommendations regarding consolidating or repurposing means-tested welfare programs that are identified;</text></clause> <clause id="HCCF13FF689114265AD89272FD670D717"><enum>(iv)</enum><text>identify opportunities and make recommendations regarding ways for the Federal Government to reduce the cost or increase the efficiency of means-tested welfare program by contracting with private entities, or delegating authority to States, to perform activities relating to the program;</text></clause>
<clause id="H677B680C3FE4412592249C5E1B0AB87C"><enum>(v)</enum><text>identify means-tested welfare programs and entitlement authorities that should be modified to be carried out subject to the availability of discretionary appropriations;</text></clause> <clause id="H5C183BE2FE014EED8E4F59ACB2A63586"><enum>(vi)</enum><text display-inline="yes-display-inline">identify changes to the law that would allow caseworkers to have a wholistic view of the person and all programs for which the individual or family would be eligible, and identify other tools that caseworkers should have access to in order to achieve the goals set forth in section 2;</text></clause>
<clause id="H71D51743F262457F911FD53165319E07"><enum>(vii)</enum><text display-inline="yes-display-inline">identify and eliminate benefit cliffs by designing on/off ramps such as gradual benefit reductions as individuals’ wages increase, such that the gradual reduction in government benefits does not exceed the increase in wages; and</text></clause> <clause id="H65654D842E144B89B4A9C56DBAF291B0"><enum>(viii)</enum><text>identify other ways to achieve the purposes set forth in section 2 as determined by the Commission;</text></clause></subparagraph>
<subparagraph id="H8D5C38FBD8394E689FD6525AE8E95633"><enum>(B)</enum><text display-inline="yes-display-inline">in carrying out subparagraph (A), establish a system for evaluating the effectiveness of welfare programs, which includes income and employment outcomes for individuals and families in their respective programs, and engage in such other activities as the Committee deems appropriate to evaluate the effectiveness of the programs;</text></subparagraph> <subparagraph id="HB3093C0CC1884E58995D243DF3D74F50"><enum>(C)</enum><text>may review the offsetting receipts and discretionary appropriations of the Federal Government, as determined appropriate by the Commission; and</text></subparagraph>
<subparagraph id="HC2FCFC506BED44AE8B1621B8B1577920"><enum>(D)</enum><text>may develop the criteria for achieving the purposes set forth in section 2.</text></subparagraph></paragraph> <paragraph id="H8074F82B1DA64411AF6B657B8DC8D9F3"><enum>(2)</enum><header>Consultation and working groups</header> <subparagraph id="HA4712B84E383408182E56C0F7C459E13"><enum>(A)</enum><header>In general</header><text>In carrying out the review under paragraph (1)(A), the Commission shall—</text>
<clause id="HCA574B257ED74776A0CC006F2D132FC3"><enum>(i)</enum><text>consult with experts in company restructuring, reorganizing, and cost cutting; and</text></clause> <clause id="H0F5EB49B84D84681A05DB89AA373E321"><enum>(ii)</enum><text>establish working groups for means-tested welfare programs, as determined appropriate by the Commission, to provide recommendations to the Commission.</text></clause></subparagraph>
<subparagraph id="HA60904DC403C45079FEE9B7D0FE4CD0B"><enum>(B)</enum><header>Members of working groups</header><text>The individuals serving on a working group established under subparagraph (A)(ii) shall be employees or contractors of the Commission with expertise in a program reviewed by the working group.</text></subparagraph></paragraph> <paragraph id="HE1EB4DC6A6694341BF311E2F972D7CBB"><enum>(3)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 18 months after the date on which all members of the Commission are appointed, and upon an affirmative vote of a majority of the members of the Commission, the Commission shall submit to Congress and make publicly available a report containing—</text>
<subparagraph id="H12849A38932B45C2AB8AF8B0FFA182D1"><enum>(A)</enum><text>a detailed statement of the findings, conclusions, and recommendations of the Commission; and</text></subparagraph> <subparagraph id="H7A6E01AD608C40CC80C195528CAD122C"><enum>(B)</enum><text>the assumptions, scenarios, and alternatives considered in reaching such findings, conclusions, and recommendations.</text></subparagraph></paragraph>
<paragraph id="H952BE65AEC5D47E0B3FE2A80FA6D64B9"><enum>(4)</enum><header>Legislation to carry out changes in law to achieve purposes</header><text>The Commission shall—</text> <subparagraph id="HC4F69DA013DC4E199D57DEAE3FAB6B08"><enum>(A)</enum><text display-inline="yes-display-inline">identify changes in law that will result in the consolidation and realignment in programs and outlays that will achieve the purposes set forth in section 2;</text></subparagraph>
<subparagraph id="H36BC75E6BC8A48A5B0C6521F0D2804EC"><enum>(B)</enum><text display-inline="yes-display-inline">include in the report submitted under paragraph (3) a bill consisting of proposed legislative language to carry out the changes in law identified under subparagraph (A) (in this Act referred to as the <quote>Commission bill</quote>), except that the bill may not include provisions creating a new program or agency, unless such program or agency is the result of a consolidation or realignment of existing programs and agencies which will have the predicted outcome of achieving the purposes of section 2; and</text></subparagraph> <subparagraph id="H523E434C16574233A2BD12FDFCE50B88"><enum>(C)</enum><text>include in such report an estimate of the savings in outlays that will be achieved by the enactment of the Commission bill, as developed in conjunction with the Director of the Congressional Budget Office and the Director of the Office of Management and Budget.</text></subparagraph></paragraph>
<paragraph commented="no" id="H1AB2B041F65D4953974ECE29A3929101"><enum>(5)</enum><header>Information to members of congress</header><text>After submission of the Commission bill under paragraph (4), the Commission shall promptly provide, upon request, to any Member of Congress information used by the Commission in making its recommendations.</text></paragraph></subsection> <subsection id="HF73165EBE4254B11BA4FCE34F0355A1E"><enum>(c)</enum><header>Membership</header> <paragraph id="H89131585D3D44170A282F2ECB7F315F3"><enum>(1)</enum><header>In general</header><text>The Commission shall be composed of 8 members, appointed as follows:</text>
<subparagraph id="H56E21C52F97F400F8769715611349B35"><enum>(A)</enum><text>The majority leader of the Senate shall appoint 2 members.</text></subparagraph> <subparagraph id="H96A2F91FD1EE4E64BCE4E109DDB74285"><enum>(B)</enum><text>The minority leader of the Senate shall appoint 2 members.</text></subparagraph>
<subparagraph id="H615E9A2C7EFD4DEEB6A3A1D1336E72A6"><enum>(C)</enum><text>The Speaker of the House of Representatives shall appoint 2 members.</text></subparagraph> <subparagraph id="H1838838BAE2D4D1480C9DB967340FD13"><enum>(D)</enum><text>The minority leader of the House of Representatives shall appoint 2 members.</text></subparagraph></paragraph>
<paragraph id="H58059FDA0EC74FF08FCB104AA0C34761"><enum>(2)</enum><header>Disqualifications</header><text>An individual may not be appointed as a member of the Commission if the individual was registered as a lobbyist under the Lobbying Disclosure Act of 1995 (<external-xref legal-doc="usc" parsable-cite="usc/2/1601">2 U.S.C. 1601 et seq.</external-xref>) at any time during the 5-year period ending on the date of the appointment.</text></paragraph> <paragraph id="H1674A050669E4555A3ECD003B42E09A1"><enum>(3)</enum><header>Chairperson</header><text>The members of the Commission shall select a Chairperson from among the members of the Commission.</text></paragraph>
<paragraph id="H7716E9D68ED24EFA97B751C6A2D0A81B"><enum>(4)</enum><header>Date</header><text>Not later than 1 month after the date of enactment of this Act, all members of the Commission shall be appointed.</text></paragraph> <paragraph id="H7FE31BAB3F324CCC92E6DC387B422973"><enum>(5)</enum><header>Period of designation</header><text>Members shall be appointed for the life of the Commission. Any vacancy in the Commission shall not affect its powers, but shall be filled not later than 14 days after the date on which the vacancy occurs in the same manner as the original appointment.</text></paragraph>
<paragraph id="H824D122D88D54D969B264C74E56F33BE"><enum>(6)</enum><header>Compensation</header>
<subparagraph id="H136B851CACCE4175B7A2BDD9E5281798"><enum>(A)</enum><header>In general</header><text>Each member of the Commission shall be compensated at a rate equal to the daily equivalent of the annual rate of basic pay prescribed for a position at level IV of the Executive Schedule under section 5314 of title 5, United States Code, for each day (including travel time) during which such member is engaged in the performance of the duties of the Commission.</text></subparagraph> <subparagraph id="HFE8708F2F505404EBD08ABAE076BAFF5"><enum>(B)</enum><header>Travel expenses</header><text>Members may be allowed travel expenses, including per diem in lieu of subsistence, in accordance with sections 5702 and 5703 of title 5, United States Code, while away from their homes or regular places of business in performance of services for the Commission.</text></subparagraph></paragraph></subsection>
<subsection id="HBA8D01390B5146F896E9B4F11E19385D"><enum>(d)</enum><header>Powers of the commission</header>
<paragraph id="H48FCE590A4F9497FB8577990AB32E269"><enum>(1)</enum><header>Hearings</header><text>The Commission may, for the purpose of carrying out this Act—</text> <subparagraph id="H533E4EDDE9FD44189E81B6642C2AF0AF"><enum>(A)</enum><text>hold such hearings, sit and act at such times and places, take such testimony, receive such evidence, and administer such oaths as the Commission considers advisable to carry out its duties; and</text></subparagraph>
<subparagraph id="H1C0F833548F04A4B94B2E3360C000215"><enum>(B)</enum><text>require, by subpoena or otherwise, the attendance and testimony of such witnesses and the production of such books, records, correspondence, memoranda, papers, documents, tapes, and materials as the Commission considers advisable to carry out its duties.</text></subparagraph></paragraph> <paragraph id="HB73BE946EC5D4ABE89EC1B8225806C68"><enum>(2)</enum><header>Information from federal agencies</header><text>The Commission may request directly, or require, by subpoena or otherwise, from any Federal agency such information as the Commission considers necessary to carry out its duties. Upon a request of the Chairperson of the Commission, the head of a Federal agency shall furnish such information to the Commission.</text></paragraph>
<paragraph id="HDD714A893BFE44EF85FFA835C97C45F7"><enum>(3)</enum><header>Issuance and enforcement of subpoenas</header>
<subparagraph id="H2EE5612AC3E14CC28893CC0F6E7D5B33"><enum>(A)</enum><header>Issuance</header><text>Subpoenas issued under paragraph (1) or (2) shall bear the signature of the Chairperson of the Commission and shall be served by any person or class of persons designated by the Chairperson for that purpose.</text></subparagraph> <subparagraph id="H8769BB2386A146218B5D8E3EBAABAD2F"><enum>(B)</enum><header>Enforcement</header><text>In the case of contumacy or failure to obey a subpoena issued under paragraph (1) or (2), the United States district court for the judicial district in which the subpoenaed person resides, is served, or may be found may issue an order requiring such person to appear at any designated place to testify or to produce documentary or other evidence. Any failure to obey the order of the court may be punished by the court as a contempt of that court.</text></subparagraph></paragraph>
<paragraph id="H7C7B61C3BC0842F6A01071D4915CF9ED"><enum>(4)</enum><header>Witness allowances and fees</header><text>Section 1821 of title 28, United States Code, shall apply to witnesses requested or subpoenaed to appear at any hearing of the Commission. The per diem and mileage allowances for witnesses shall be paid from funds available to pay the expenses of the Commission.</text></paragraph> <paragraph id="HC18F7BDEBCC44BAAA3F32A36655629EA"><enum>(5)</enum><header>Information from the congressional budget office and office of management and budget</header><text>The Commission may secure directly from the Congressional Budget Office and Office of Management and Budget such information, including estimates and analysis, as the Commission considers advisable to carry out its duties. Upon request of the Chairperson of the Commission, the Director of the Congressional Budget Office or Office of Management and Budget shall furnish such information, including estimates and analysis, to the Commission.</text></paragraph>
<paragraph id="H5F58472565E846F89BBD19C593E0205B"><enum>(6)</enum><header>Information from the library of congress</header><text>Upon the request of the Commission, the Librarian of Congress shall provide to the Commission, on a reimbursable basis, administrative support services, research services, and research staff necessary for the Commission to carry out its responsibilities under this Act.</text></paragraph></subsection> <subsection id="HFDAA463A55184B5B993F42BA2CE60897"><enum>(e)</enum><header>Staff of the commission</header> <paragraph id="H63A58E2508B64BBD88B8028F636BAB90"><enum>(1)</enum><header>Appointment and compensation of staff</header><text>The Chairperson may appoint and fix the compensation of a staff director and such other employees as may be necessary to enable the Commission to carry out its functions, without regard to the provisions of title 5, United States Code, governing appointments in the competitive service, but at rates not to exceed the annual rate of basic pay prescribed for a position at level V of the Executive Schedule under section 5316 of title 5 of the United States Code.</text></paragraph>
<paragraph id="H330000E68A36475D9DCBC8E08AA87C9E"><enum>(2)</enum><header>Agency assistance</header><text>Upon the request of the Chairperson, the head of any agency may detail an employee of the agency to the Commission without reimbursement, and such detail shall be without interruption or loss of civil service status or privilege.</text></paragraph></subsection> <subsection id="H73599E48AD0F40AA83ABDDEC4D276928"><enum>(f)</enum><header>Consultant, temporary, and intermittent services</header><text>The Chairperson of the Commission is authorized to procure the services of experts and consultants and temporary and intermittent services in accordance with section 3109 of title 5, United States Code, but at rates not to exceed the daily rate paid a person occupying a position at level V of the Executive Schedule under section 5316 of title 5, United States Code, for each day during which such consultant or expert is engaged in the performance of the duties of the Commission.</text></subsection>
<subsection commented="no" id="HE326EC33073B4DA48DD5B111585105BC"><enum>(g)</enum><header>Consideration of suggestions from the public through website</header><text>In carrying out its duties under this Act, the Commission shall—</text> <paragraph commented="no" id="H3A943CDFB5AD4E5ABD9CD665B6CF4C54"><enum>(1)</enum><text>establish a website for the purpose of allowing any member of the public to submit suggestions to the Commission for its consideration; and</text></paragraph>
<paragraph commented="no" id="H4EEB0D16289B47A2B2828C5E2F9A2833"><enum>(2)</enum><text>consider each such suggestion submitted through the website.</text></paragraph></subsection> <subsection id="HBA2096D27A534A499786FE9409A7DFC4"><enum>(h)</enum><header>Federal Advisory Committee Act</header><text>The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Commission.</text></subsection>
<subsection id="H65F7A4DE705B44EF979EC752B009C37B"><enum>(i)</enum><header>Termination</header><text>The Commission shall terminate on the day after the earlier of—</text> <paragraph id="H91E86F683BDD40BEB97E36E3A3FF81C9"><enum>(1)</enum><text>the date on which the Commission bill is enacted into law; or</text></paragraph>
<paragraph id="H4C0B03CAF2084B2FB9A670A61ADCB040"><enum>(2)</enum><text>the last day of the Congress during which the Commission bill is introduced in the Senate or the House under section 5(a).</text></paragraph></subsection></section> <section id="H5171D7F14DCD49FCBFD351BA7EA9BD4A"><enum>5.</enum><header>Expedited procedures</header> <subsection id="HC58D6D8E7E08491B9B26B264A08D7A06"><enum>(a)</enum><header>Introduction of Commission bill</header><text>The Commission bill—</text>
<paragraph id="H0D518A7571A145C5A09C949119C5D042"><enum>(1)</enum><text>shall be introduced in the Senate (by request), with any technical changes necessary to carry out the intent of the bill, by the majority leader of the Senate or by a Member of the Senate designated by the majority leader of the Senate not later than 5 legislative days after the date on which the bill is submitted to Congress under section 4(b)(4); and</text></paragraph> <paragraph id="H453426515B3F4FCAAE145E66CE0EC0BB"><enum>(2)</enum><text>shall be introduced in the House of Representatives (by request), with any technical changes necessary to carry out the intent of the bill, by the Speaker of the House of Representatives or by a Member of the House of Representatives designated by the Speaker of the House of Representatives not later than 5 legislative days after the date on which the bill is submitted to Congress under section 4(b)(4).</text></paragraph></subsection>
<subsection id="HB05B376087DF456AAE5A92316C891216"><enum>(b)</enum><header>Expedited consideration in House of Representatives</header>
<paragraph id="H1396B73E416C46109F2B56DA81A01440"><enum>(1)</enum><header>Placement on calendar</header><text>Upon introduction in the House of Representatives, the Commission bill shall be placed immediately on the appropriate calendar.</text></paragraph> <paragraph id="HE7E24A796DD74FFEA2327D15D6EC66FD"><enum>(2)</enum><header>Proceeding to consideration</header> <subparagraph id="HE0109D587F1647348F4E5DB13FE31BF3"><enum>(A)</enum><header>In general</header><text>It shall be in order, not later than 90 legislative days after the date the Commission bill is introduced in the House of Representatives, to move to proceed to consider the Commission bill in the House of Representatives.</text></subparagraph>
<subparagraph id="HE7F68E3F01964CFAA7E5DEE49DC26DB4"><enum>(B)</enum><header>Procedure</header><text>For a motion to proceed to consider the Commission bill—</text> <clause id="H0A37563CAD824F9CB36E83A0FCE3743E"><enum>(i)</enum><text>all points of order against the motion are waived;</text></clause>
<clause id="H8FE0AD2D08734656AE71039E32FBCE5F"><enum>(ii)</enum><text>such a motion shall not be in order after the House of Representatives has disposed of a motion to proceed on the Commission bill;</text></clause> <clause id="H9889202DCAF443C19EB609C615357260"><enum>(iii)</enum><text>the previous question shall be considered as ordered on the motion to its adoption without intervening motion;</text></clause>
<clause id="H28FD0BA5656A4A5CAF457C41A3F97F84"><enum>(iv)</enum><text>the motion shall not be debatable; and</text></clause> <clause id="H493CDF5FFF604A488C88EF359FDB639F"><enum>(v)</enum><text>a motion to reconsider the vote by which the motion is disposed of shall not be in order.</text></clause></subparagraph></paragraph>
<paragraph id="HEA7862572AFE48258806D3BF60CADB89"><enum>(3)</enum><header>Consideration</header><text>When the House of Representatives proceeds to consideration of the Commission bill—</text> <subparagraph id="H4AAC9278F739495186B74CEB0852C62D"><enum>(A)</enum><text>the Commission bill shall be considered as read;</text></subparagraph>
<subparagraph id="HC78BC50E5E63449C8FB23FEDEF6AF20D"><enum>(B)</enum><text>all points of order against the Commission bill and against its consideration are waived;</text></subparagraph> <subparagraph id="HC1781BC4A714456EA7A3F608C0F1E3FE"><enum>(C)</enum><text>the previous question shall be considered as ordered on the Commission bill to its passage without intervening motion except 10 hours of debate equally divided and controlled by the proponent and an opponent;</text></subparagraph>
<subparagraph id="H526E43A2DFC4405E9FBD0853AE282583"><enum>(D)</enum><text>an amendment to the Commission bill shall not be in order; and</text></subparagraph> <subparagraph id="HDB5B0ACC1B0A46EBA26D27BB37632989"><enum>(E)</enum><text>a motion to reconsider the vote on passage of the Commission bill shall not be in order.</text></subparagraph></paragraph>
<paragraph id="H10F2870A021546828181544DF0A40CC4"><enum>(4)</enum><header>Vote on passage</header><text>In the House of Representatives, the Commission bill shall be agreed to upon a vote of a majority of the Members present and voting, a quorum being present.</text></paragraph></subsection> <subsection id="HA71502B9C96B42A4B0979D1EABD4BA87"><enum>(c)</enum><header>Expedited consideration in Senate</header> <paragraph id="HDB33F99E0A624430B5C409FAA548EC9B"><enum>(1)</enum><header>Placement on calendar</header><text>Upon introduction in the Senate, the Commission bill shall be placed immediately on the calendar.</text></paragraph>
<paragraph id="H3CF301FAC17A43118D99D8F2D1E08677"><enum>(2)</enum><header>Proceeding to consideration</header>
<subparagraph id="HD74813EF4A814BB6A46C63EC2103E628"><enum>(A)</enum><header>In general</header><text>Notwithstanding rule XXII of the Standing Rules of the Senate, it is in order, not later than 90 legislative days after the date the Commission bill is introduced in the Senate (even though a previous motion to the same effect has been disagreed to) to move to proceed to the consideration of the Commission bill.</text></subparagraph> <subparagraph id="HA4A4D247AFC34C7D9945B87871281372"><enum>(B)</enum><header>Procedure</header><text>For a motion to proceed to the consideration of the Commission bill—</text>
<clause id="HAD5B5BC3B43E4D5FB6E7D5FC1E43BF6F"><enum>(i)</enum><text>all points of order against the motion are waived;</text></clause> <clause id="HB6BA07D5E3794309A5EAB67C02E5CD20"><enum>(ii)</enum><text>the motion is not debatable;</text></clause>
<clause id="H7B9CB06DCCE6400A93A5FC8E0ADC8B1E"><enum>(iii)</enum><text>the motion is not subject to a motion to postpone;</text></clause> <clause id="H5D81124134FB4F53AA64CC1F59CF5608"><enum>(iv)</enum><text>a motion to reconsider the vote by which the motion is agreed to or disagreed to shall not be in order; and</text></clause>
<clause id="H12E220E4757D4C62AA73B86C3C624688"><enum>(v)</enum><text>if the motion is agreed to, the Commission bill shall remain the unfinished business until disposed of.</text></clause></subparagraph></paragraph> <paragraph id="HBD1FEBBEB2C34A918B792E286B19B574"><enum>(3)</enum><header>Floor consideration</header> <subparagraph id="HD20161A003B248F0B355EC373BE5E7DB"><enum>(A)</enum><header>In general</header><text>If the Senate proceeds to consideration of the Commission bill—</text>
<clause id="HB89FC7C168784D41AF0F9EE80A1CECB9"><enum>(i)</enum><text>all points of order against the Commission bill (and against consideration of the Commission bill) are waived;</text></clause> <clause id="H10091CD3C6DA4005A7C243E0FE6CEE32"><enum>(ii)</enum><text>consideration of the Commission bill, and all debatable motions and appeals in connection therewith, shall be limited to not more than 30 hours, which shall be divided equally between the majority and minority leaders or their designees;</text></clause>
<clause id="H0DD2C5C4EFF545AA8B465E6C7919A1BF"><enum>(iii)</enum><text>a motion further to limit debate is in order and not debatable;</text></clause> <clause id="H4237D8487C7540F3B095B018A740D9F8"><enum>(iv)</enum><text>an amendment to, a motion to postpone, or a motion to commit the Commission bill is not in order; and</text></clause>
<clause id="H80E6B19F33234EB6B471B5E452534DD4"><enum>(v)</enum><text>a motion to proceed to the consideration of other business is not in order.</text></clause></subparagraph> <subparagraph id="H1A7FBD3D3B1347188F062E6882426F12"><enum>(B)</enum><header>Vote on passage</header><text>In the Senate—</text>
<clause id="H3A0229095BFE4AE69E97D40AA90FD2DF"><enum>(i)</enum><text>the vote on passage shall occur immediately following the conclusion of the consideration of the Commission bill, and a single quorum call at the conclusion of the debate if requested in accordance with the rules of the Senate; and</text></clause> <clause id="HE7311A59D9624A4095626DAD0FB46D23"><enum>(ii)</enum><text>the Commission bill shall be agreed to upon a vote of a majority of the Members present and voting, a quorum being present.</text></clause></subparagraph>
<subparagraph id="H0D25BC1036D947FEB8B7CECA4D72AC86"><enum>(C)</enum><header>Rulings of the chair on procedure</header><text>Appeals from the decisions of the Chair relating to the application of this subsection or the rules of the Senate, as the case may be, to the procedure relating to the Commission bill shall be decided without debate.</text></subparagraph></paragraph></subsection> <subsection id="H1DA32D0A661743798F72A9D46A0579D7"><enum>(d)</enum><header>Rules relating to Senate and House of Representatives</header> <paragraph id="HE5C06EF37A824B3F9A7E278427062DF3"><enum>(1)</enum><header>Coordination with action by other house</header><text>If, before the passage by one House of the Commission bill of that House, that House receives from the other House the Commission bill—</text>
<subparagraph id="HD73A31D7AB5E4BCE9050D0BD10C36679"><enum>(A)</enum><text>the Commission bill of the other House shall not be referred to a committee; and</text></subparagraph> <subparagraph id="HDD7543E1746C4965932CFD6643794CBB"><enum>(B)</enum><text>with respect to the Commission bill of the House receiving the resolution—</text>
<clause id="H8EFC3C755DE147BD8F35325B0498B0CD"><enum>(i)</enum><text>the procedure in that House shall be the same as if no Commission bill had been received from the other House; and</text></clause> <clause id="HD79FFAA1A2AC4861AE59D269FE1E787B"><enum>(ii)</enum><text>the vote on passage shall be on the Commission bill of the other House.</text></clause></subparagraph></paragraph>
<paragraph id="H5B49812A060041D686A50396918944C7"><enum>(2)</enum><header>Treatment of commission bill of other house</header><text>If one House fails to introduce or consider the Commission bill under this section, the Commission bill of the other House shall be entitled to expedited floor procedures under this section.</text></paragraph> <paragraph id="H9D4B01F0540D4BED82E4337605416A91"><enum>(3)</enum><header>Treatment of companion measures</header><text>If, following passage of the Commission bill in the Senate, the Senate receives the companion measure from the House of Representatives, the companion measure shall not be debatable.</text></paragraph>
<paragraph id="H4E9F0C0D6A8448A1A74492A9989BAE6F"><enum>(4)</enum><header>Vetoes</header><text>If the President vetoes the Commission bill, consideration of a veto message in the Senate under this section shall be not more than 10 hours equally divided between the majority and minority leaders or their designees.</text></paragraph></subsection> <subsection id="H5F9ED1CCBE7A4D5F8EFC1BB046361ED3"><enum>(e)</enum><header>Rules of House of Representatives and Senate</header><text>This section is enacted by Congress—</text>
<paragraph id="HF1C7C096432A47A49531B00357C8D398"><enum>(1)</enum><text>as an exercise of the rulemaking power of the Senate and House of Representatives, respectively, and as such is deemed a part of the rules of each House, respectively, but applicable only with respect to the procedure to be followed in that House in the case of the Commission bill, and supersede other rules only to the extent that it is inconsistent with such rules; and</text></paragraph> <paragraph id="HC90504BF32E3423A91BF4D3E284ABA58"><enum>(2)</enum><text>with full recognition of the constitutional right of either House to change the rules (so far as relating to the procedure of that House) at any time, in the same manner, and to the same extent as in the case of any other rule of that House.</text></paragraph></subsection></section>
