R. 5652</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211020">October 20, 2021</action-date><action-desc><sponsor name-id="V000133">Mr. Van Drew</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HHM00">Committee on Homeland Security</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Homeland Security Act of 2002 to establish the Acquisition Review Board in the Department of Homeland Security, and for other purposes.</official-title></form><legis-body id="H5CBF66BBEEE144F1BF01132E23F880E9" style="OLC"><section id="HB8C04E9C60024692A9C169A12C836989" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>DHS Acquisition Review Board Act of 2021</short-title></quote>.</text></section><section id="HC985096A1AED4BE5AD9FBB51A29A4A4D"><enum>2.</enum><header>Acquisition Review Board</header><subsection id="H4F410716AB6C476B8F5B8F227B18AEA6"><enum>(a)</enum><header>In general</header><text>Subtitle D of title VIII of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/391">6 U.S.C. 391 et seq.</external-xref>) is amended by adding at the end the following new section:</text><quoted-block id="HDDC9ACB99ECA4C14B76562518808EF69" style="OLC"><section id="HC168AB1C99074B91864C9FA41AD14CCF"><enum>836.</enum><header>Acquisition Review Board</header><subsection id="HA98FC3617E9A447DBE36D29D26F9B639"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">There is established in the Department an Acquisition Review Board (in this section referred to as the <quote>Board</quote>) to support the Under Secretary for Management in managing the Department’s acquisitions.</text></subsection><subsection id="HDFDE44166D644BBF9F6037A33B2CA755"><enum>(b)</enum><header>Composition</header><paragraph id="HBF581E51A5A74B928D04A146A244DB5D"><enum>(1)</enum><header>Chair</header><text display-inline="yes-display-inline">The Under Secretary for Management shall serve as chair of the Board.</text></paragraph><paragraph id="H4B3E11E797D44BF881A2F9DD41111145"><enum>(2)</enum><header>Oversight</header><text display-inline="yes-display-inline">The Under Secretary for Management may designate an employee of the Department to oversee the operations of the Board.</text></paragraph><paragraph id="H7EE72529A73D4106ACB874CD6F8A386C"><enum>(3)</enum><header>Participation</header><text display-inline="yes-display-inline"> The Under Secretary for Management shall ensure participation by other relevant Department officials with responsibilities related to acquisitions as permanent members of the Board, including the following:</text><subparagraph id="HB0736FDDBFA24EC9B5B6E92D44B9A6FC"><enum>(A)</enum><text>The Chair of the Joint Requirements Council.</text></subparagraph><subparagraph id="HD1FBAA9ABB0D460DB2759FBE286F4B22"><enum>(B)</enum><text>The Chief Financial Officer.</text></subparagraph><subparagraph id="H51558A54467542D384EEA33C5190DE67"><enum>(C)</enum><text>The Chief Human Capital Officer.</text></subparagraph><subparagraph id="HBCCAFBD988D340988AC3700A6E68DE04"><enum>(D)</enum><text>The Chief Information Officer.</text></subparagraph><subparagraph id="HDDE2D129E714482989C777D44BD224D8"><enum>(E)</enum><text>The Chief Procurement Officer.</text></subparagraph><subparagraph id="H1F8E85552A7A472EAA3DE5B72805D340"><enum>(F)</enum><text>The Chief Readiness Support Officer.</text></subparagraph><subparagraph id="H4DD0BDAFCB9F4EB694732CF57A18E8BC"><enum>(G)</enum><text>The Chief Security Officer.</text></subparagraph><subparagraph id="HBBF6F5DDD9484C33BC43AEE7C36906D2"><enum>(H)</enum><text>The Director of the Office of Test and Evaluation.</text></subparagraph><subparagraph id="H16B1AA6E50434D44BC67E07927FFBBE9"><enum>(I)</enum><text>Other relevant senior Department officials, as designated by the Under Secretary for Management.</text></subparagraph></paragraph></subsection><subsection id="HB86B4CA09FB04F5FA6513041003B09E8"><enum>(c)</enum><header>Meetings</header><text display-inline="yes-display-inline">The Board shall meet regularly for purposes of evaluating the progress and status of an acquisition program. The Board shall convene at the Under Secretary for Management’s discretion, and at such time as—</text><paragraph id="H7320B532D76A4992ACB0F7D284A890CA"><enum>(1)</enum><text display-inline="yes-display-inline">a new acquisition program is initiated;</text></paragraph><paragraph id="HB4AD47D0BDB04745B85F38CFA23E0128"><enum>(2)</enum><text>a major acquisition program—</text><subparagraph id="H8D0646A10E224CB1983CC1F53CCA96D6"><enum>(A)</enum><text>requires authorization to proceed from one acquisition decision event to another throughout the acquisition life-cycle;</text></subparagraph><subparagraph id="HAB04D58803CC4ABD90634913836B0921"><enum>(B)</enum><text display-inline="yes-display-inline">is in breach of its approved acquisition program baseline; or</text></subparagraph><subparagraph id="H0E07B375A95749FCB17DB66546592FBC"><enum>(C)</enum><text display-inline="yes-display-inline">requires additional review, as determined by the Under Secretary for Management; or</text></subparagraph></paragraph><paragraph id="H2E51B2E752274167A776CCC3F845C42D"><enum>(3)</enum><text>a non-major acquisition program requires review, as determined by the Under Secretary for Management.</text></paragraph></subsection><subsection id="H5E2894B8E68E496286B671E869203099"><enum>(d)</enum><header>Responsibilities</header><text>The responsibilities of the Board are as follows:</text><paragraph id="H88F7E1383B27454C9473FD7410993601" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Determine the appropriate acquisition level and acquisition decision authority for new acquisition programs based on the estimated eventual total expenditure of each such program to satisfy the mission need of the Department over the life-cycle of such acquisition regardless of funding source.</text></paragraph><paragraph id="HFDD19B3D9A8D439CA7B378125003E3B8"><enum>(2)</enum><text>Determine whether a proposed acquisition has met the requirements of key phases of the acquisition life-cycle framework and is able to proceed to the next phase and eventual full production and deployment.</text></paragraph><paragraph id="H7A7542FBCDCC46D49CD59FACD0087F1D"><enum>(3)</enum><text>Oversee whether a proposed acquisition’s business strategy, resources, management, and accountability is executable and is aligned with the mission and strategic goals of the Department.</text></paragraph><paragraph id="H20D717781A974EA2B04C634BE6E9CB28"><enum>(4)</enum><text>Support the person with acquisition decision authority for an acquisition in determining the appropriate direction for such acquisition at key acquisition decision events.</text></paragraph><paragraph id="H410B3B1E7C9845CEBF4055FAE7E3F087"><enum>(5)</enum><text display-inline="yes-display-inline">Conduct systematic reviews of acquisitions to ensure that such acquisitions are progressing in accordance with best practices and in compliance with the most recently approved documents for such acquisitions’ current acquisition phases.</text></paragraph><paragraph id="H6B19D8BE621042D9B2FE6EE85FF1C160"><enum>(6)</enum><text>Review the acquisition documents of each major acquisition program, including the acquisition program baseline and documentation reflecting consideration of tradeoffs among cost, schedule, and performance objectives, to ensure the reliability of underlying data.</text></paragraph><paragraph id="H26F1878A84EA42B19C02C2806F3CAB7D"><enum>(7)</enum><text>Ensure that practices are adopted and implemented to require consideration of trade-offs among cost, schedule, and performance objectives as part of the process for developing requirements for major acquisition programs prior to the initiation of the second acquisition decision event, including, at a minimum, the following practices:</text><subparagraph id="HEA6EC71FE7274FFFAF0A6C008A9B4743"><enum>(A)</enum><text>Department officials responsible for acquisition, budget, and cost estimating functions are provided with the appropriate opportunity to develop estimates and raise cost and schedule concerns before performance objectives are established for capabilities when feasible.</text></subparagraph><subparagraph id="HB00516C7534249879AD3B5EB35EE0067"><enum>(B)</enum><text>Full consideration is given to possible trade-offs among cost, schedule, and performance objectives for each alternative.</text></subparagraph></paragraph></subsection><subsection id="HBE4157E04C204EA8B77B8D2F610E284C"><enum>(e)</enum><header>Documentation</header><paragraph id="HB0592BB77749438D8892F0B5BEDF3D34"><enum>(1)</enum><header>In general</header><text>The chair of the Board shall ensure that all actions and decisions made pursuant to the responsibilities of the Board under subsection (d) are documented in an acquisition decision memorandum that includes—</text><subparagraph id="H02E9F636EC7643939B6B12EF53B672D3" commented="no"><enum>(A)</enum><text>a summary of the action at issue or purpose for convening a meeting under subsection (c);</text></subparagraph><subparagraph id="HD08AEADEE11F4BE6BB528004F89B5FD2"><enum>(B)</enum><text>the decision with respect to actions discussed during such meeting;</text></subparagraph><subparagraph id="H15F3818C5B0D44B38C45ACA84438420D"><enum>(C)</enum><text>the rationale for such a decision, including justifications for any such decision made to allow acquisition programs to deviate from the acquisition management policy of the Department;</text></subparagraph><subparagraph id="H8CF5B3CB60FF46058742C0CE719586D4"><enum>(D)</enum><text>any assigned items for further action; and</text></subparagraph><subparagraph id="H432A18137F244D3C9E765C11EC31B6D0"><enum>(E)</enum><text>the signature of the chair verifying the contents of such memorandum.</text></subparagraph></paragraph><paragraph id="HF982B65ACF914F58A01C817941D70FD3"><enum>(2)</enum><header>Submission of memorandum</header><text>Not later than seven days after the date on which the acquisition decision memorandum is signed by the chair pursuant to paragraph (1)(E), the chair shall submit to the Secretary, the Committee on Homeland Security of the House of Representatives, and the Committee on Homeland Security and Governmental Affairs of the Senate a copy of such memorandum.</text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7418023925684D0BB3325FDE44CCB01E"><enum>(f)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="H3CC762596B4842609CC9B5FF1A0C1AC1"><enum>(1)</enum><header>Acquisition</header><text>The term <term>acquisition</term> has the meaning given such term in section 131 of title 41, United States Code.</text></paragraph><paragraph commented="no" id="HDB32AC26F6B84A14AA877FFEFA5E34A6"><enum>(2)</enum><header>Acquisition decision authority</header><text>The term <term>acquisition decision authority</term> means the authority, held by the Secretary to—</text><subparagraph commented="no" id="HCD1C28A691E44838BC542254ECA60B84"><enum>(A)</enum><text display-inline="yes-display-inline">ensure acquisition programs are in compliance with Federal law, the Federal Acquisition Regulation, and Department acquisition management directives;</text></subparagraph><subparagraph commented="no" id="HC7D647DECDCA4E7C8CA0B7418360569B"><enum>(B)</enum><text display-inline="yes-display-inline">review (including approving, pausing, modifying, or cancelling) an acquisition program through the life-cycle of such program;</text></subparagraph><subparagraph commented="no" id="H23DC4CA87244425F8B4FAB3D06E355C4"><enum>(C)</enum><text>ensure that acquisition program managers have the resources necessary to successfully execute an approved acquisition program;</text></subparagraph><subparagraph commented="no" id="H81FCA07FD3CB43ABA04A7F91EE8E783B"><enum>(D)</enum><text>ensure appropriate acquisition program management of cost, schedule, risk, and system performance of the acquisition program at issue, including assessing acquisition program baseline breaches and directing any corrective action for such breaches; and</text></subparagraph><subparagraph commented="no" id="H1784FF2B7F9D473CB3EF5777809E475B"><enum>(E)</enum><text>ensure that acquisition program managers, on an ongoing basis, monitor cost, schedule, and performance against established baselines and use tools to assess risks to an acquisition program at all phases of the life-cycle of such program to avoid and mitigate acquisition program baseline breaches.</text></subparagraph></paragraph><paragraph commented="no" id="H4143E721DC274FBAA8F6037DBF0D044C"><enum>(3)</enum><header>Acquisition decision event</header><text display-inline="yes-display-inline">The term <term>acquisition decision event</term>, with respect to an acquisition program, means a predetermined point within each of the acquisition phases at which the acquisition decision authority determines whether such acquisition program shall proceed to the next acquisition phase.</text></paragraph><paragraph commented="no" id="H1814E5C13C574589AA29A3491CC0CA41"><enum>(4)</enum><header>Acquisition decision memorandum</header><text display-inline="yes-display-inline">The term <term>acquisition decision memorandum</term> means the official documented record of decisions, including the rationale for such decisions and any assigned actions, for the acquisition at issue, as determined by the person exercising acquisition decision authority for such acquisition.</text></paragraph><paragraph commented="no" id="HEA8080ED981B4EC9885C1B408608888D"><enum>(5)</enum><header>Acquisition program baseline</header><text>The term <term>acquisition program baseline</term>, with respect to an acquisition program, means a summary of the cost, schedule, and performance parameters, expressed in standard, measurable, quantitative terms, which must be satisfied to accomplish the goals of such program.</text></paragraph><paragraph commented="no" id="HE75626F3E97E47CFB359D379C04D7D4E"><enum>(6)</enum><header>Best practices</header><text>The term <term>best practices</term>, with respect to acquisition, means a knowledge-based approach to capability development that includes—</text><subparagraph commented="no" id="HF2E24040F5474E318B833C6DAB494989"><enum>(A)</enum><text>identifying and validating needs;</text></subparagraph><subparagraph commented="no" id="H75F99AA6657B4177BD4E9A797FD565F1"><enum>(B)</enum><text>assessing alternatives to select the most appropriate solution;</text></subparagraph><subparagraph commented="no" id="H549156FA147B4242A5C1CB287098CAF4"><enum>(C)</enum><text>clearly establishing well-defined requirements;</text></subparagraph><subparagraph commented="no" id="HC59374EDA1B64EC5BF2181EF81DFFA42"><enum>(D)</enum><text display-inline="yes-display-inline">developing realistic cost estimates and schedules that account for the entire life-cycle of such an acquisition ;</text></subparagraph><subparagraph commented="no" id="H7C4FFF1DA56647B286A95DE44CA73D1C"><enum>(E)</enum><text display-inline="yes-display-inline">securing stable funding that matches resources to requirements before initiating such development;</text></subparagraph><subparagraph commented="no" id="H0F8D6C1BCF854404A3C0BF471F9BD516"><enum>(F)</enum><text display-inline="yes-display-inline">demonstrating technology, design, and manufacturing maturity before initiating production of the item that is the subject of such acquisition;</text></subparagraph><subparagraph commented="no" id="H3DE9A87B30A44B02AD5AF7D9A8707AFE"><enum>(G)</enum><text display-inline="yes-display-inline">using milestones and exit criteria or specific accomplishments that demonstrate the attainment of knowledge to support progress;</text></subparagraph><subparagraph id="H7ADD871903234B278A618E72D0A34B1C"><enum>(H)</enum><text display-inline="yes-display-inline">regularly assessing and managing risks to achieving requirements and cost and schedule goals;</text></subparagraph><subparagraph commented="no" id="H2197B31D9BD14A258156C8731443BC83"><enum>(I)</enum><text>adopting and executing standardized processes with known success across programs;</text></subparagraph><subparagraph commented="no" id="H447A9CD492774156B692D02E34EBB7DC"><enum>(J)</enum><text>establishing an adequate workforce that is qualified and sufficient to perform necessary functions; and</text></subparagraph><subparagraph commented="no" id="H0E110A3D5DB74D8595B3F1059DA23871"><enum>(K)</enum><text>integrating the capabilities described in subparagraphs (A) through (J).</text></subparagraph></paragraph><paragraph commented="no" id="H71EA49D9A9A6446EB0D2183A7CA30504"><enum>(7)</enum><header>Major acquisition program</header><text display-inline="yes-display-inline">The term <term>major acquisition program</term> means—</text><subparagraph id="H64BB4E2DEF8E4AAE9AFF06B5697532B3"><enum>(A)</enum><text>a Department capital asset, service, or hybrid acquisition program that is estimated by the Secretary to require an eventual total expenditure of at least $300 million (based on fiscal year 2022 constant dollars) over its life-cycle cost; or</text></subparagraph><subparagraph id="H1AC9452F8E974C87ABE4AB56C128D004"><enum>(B)</enum><text display-inline="yes-display-inline">a program identified by the Under Secretary for Management as a program of special interest.</text></subparagraph></paragraph><paragraph id="H71EFAC3E496240FE957ECD77FB40FC75" commented="no"><enum>(8)</enum><header>Non-major acquisition program</header><text display-inline="yes-display-inline">The term <quote>non-major acquisition program</quote> means a Department capital asset, service, or hybrid acquisition program that is estimated by the Secretary to require an eventual total expenditure of less than $300,000,000 (based on fiscal year 2022 constant dollars) over its life-cycle.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H6EDDEBC9DFB64F1F9571FA78EECD8207"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101 et seq.</external-xref>) is amended by inserting after the item relating to section 835 the following new item:</text><quoted-block id="H837AF9D5B5B04132A57C720728B331E5" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="section">Sec. 836.
