R. 5640</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211020">October 20, 2021</action-date><action-desc><sponsor name-id="G000589">Mr. Gooden of Texas</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To ban the Federal procurement of certain drones and other unmanned aircraft systems, and for other purposes.</official-title></form><legis-body id="H95A06B9E73A64ECEBB6BDC28D5F23AC4" style="OLC"><section id="HD267D223F693407CA3E6CFC87D32233D" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Acquiring Foreign Espionage Act of 2021</short-title></quote> or the <quote><short-title>SAFE Drones Act</short-title></quote>.</text></section><section id="HABE9EA1E5CF944AC92FC8A01B42FBE08"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H980321C1AB42461A9628A6B10ECE860B"><enum>(1)</enum><header>Covered unmanned aircraft system</header><text>The term <term>covered unmanned aircraft system</term> has the meaning given the term <term>unmanned aircraft system</term> in section 44801 of title 49, United States Code. </text></paragraph><paragraph id="HC7AC8148F3134BA4A01B07C5C181BCBF"><enum>(2)</enum><header>Foreign adversary</header><text display-inline="yes-display-inline">The term <term>foreign adversary</term> has the meaning given such term in section 8(c) of the Secure and Trusted Communications Networks Act of 2019 (<external-xref legal-doc="usc" parsable-cite="usc/47/1607">47 U.S.C. 1607(c)</external-xref>). </text></paragraph></section><section id="H5CED855FDE2242419C94EA6BE70EE1A0"><enum>3.</enum><header>Prohibition on procurement of covered unmanned aircraft systems from foreign adversaries</header><subsection id="H7F6E009DC4EF43F3813F8E02DDAF4F3C"><enum>(a)</enum><header>In general</header><text>Except as provided under subsections (b) though (f), the head of an executive agency may not procure any covered unmanned aircraft system that are manufactured or assembled by a foreign adversary, which includes associated elements (consisting of communication links and the components that control the unmanned aircraft) that are required for the operator to operate safely and efficiently in the national airspace system. The Federal Acquisition Security Council, in coordination with the Secretary of Transportation, shall develop and update a list of associated elements. </text></subsection><subsection id="HAEACD292730B46FE9D7ECAD1032DA7F6"><enum>(b)</enum><header>Exemption</header><text>The Secretary of Homeland Security, the Secretary of Defense, and the Attorney General are exempt from the restriction under subsection (a) if the operation or procurement—</text><paragraph id="H0CEDEC7EDF4743BDADA328E9EFC73AB1"><enum>(1)</enum><text>is for the sole purposes of research, evaluation, training, testing, or analysis for—</text><subparagraph id="H92276E335BC940118FD70F33A87657A7"><enum>(A)</enum><text>electronic warfare;</text></subparagraph><subparagraph id="H90B1A16FC5DC471FBE72BF41D54F697D"><enum>(B)</enum><text>information warfare operations;</text></subparagraph><subparagraph id="HDA50786E88D54C588F5049B6C6ED9B18"><enum>(C)</enum><text>development of UAS or counter-UAS technology;</text></subparagraph><subparagraph id="HB04E276F57534103849B5D9F8A823188"><enum>(D)</enum><text>counterterrorism or counterintelligence activities; or</text></subparagraph><subparagraph id="HBF973CD4E78B4B5EA34E4177CD93484A"><enum>(E)</enum><text>Federal criminal or national security investigations, including forensic examinations; and</text></subparagraph></paragraph><paragraph id="H9C6BE25B172343F1B93ADF91D9C80212"><enum>(2)</enum><text>is required in the national interest of the United States.</text></paragraph></subsection><subsection id="H4D48D122880646E9873F9971059E8AC8"><enum>(c)</enum><header>Federal Aviation Administration Center of Excellence for Unmanned Aircraft Systems exemption</header><text>The Secretary of Transportation, in consultation with the Secretary of Homeland Security, is exempt from the restriction under subsection (a) if the operation or procurement is for the sole purposes of research, evaluation, training, testing, or analysis for the Federal Aviation Administration’s Alliance for System Safety of UAS through Research Excellence (ASSURE) Center of Excellence (COE) for Unmanned Aircraft Systems.</text></subsection><subsection id="HC9D8479399C3458FB711FB56958A4ED5"><enum>(d)</enum><header>National Transportation Safety Board exemption</header><text>The National Transportation Safety Board (NTSB), in consultation with the Secretary of Homeland Security, is exempt from the restriction under subsection (a) if the operation or procurement is necessary for the sole purpose of conducting safety investigations.</text></subsection><subsection id="HD743E2AF490D464EB5BB65F4631DA312"><enum>(e)</enum><header>National Oceanic Atmospheric Administration exemption</header><text>The Administrator of the National Oceanic Atmospheric Administration (NOAA), in consultation with the Secretary of Homeland Security, is exempt from the restriction under subsection (a) if the operation or procurement is necessary for the sole purpose of marine or atmospheric science or management. </text></subsection><subsection id="HC4EE853D8BDA485B96280D279163C07A"><enum>(f)</enum><header>Waiver</header><text>The head of an executive agency may waive the prohibition under subsection (a) on a case-by-case basis—</text><paragraph id="HAC3A7B01B61540ED85B6C7A835C08F20"><enum>(1)</enum><text>with the approval of the Secretary of Homeland Security or the Secretary of Defense; and</text></paragraph><paragraph id="H2C6726D877184AB3A7F13CBE4AEC1BB3"><enum>(2)</enum><text> upon notification to Congress.</text></paragraph></subsection></section><section id="HE2BFDA01E0C94138A6EAB1E9FB8733D3"><enum>4.</enum><header>Prohibition on operation of covered unmanned aircraft systems from foreign adversaries</header><subsection id="HF04412E4DD084E37A515A115489CD1FC"><enum>(a)</enum><header>Prohibition</header><paragraph id="H43D478057CA84EA0A644D540E464E4F0"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Beginning on the date that is 2 years after the date of the enactment of this Act, no Federal department or agency may operate a covered unmanned aircraft system manufactured or assembled by a foreign adversary.</text></paragraph><paragraph id="HEF0DFEDB47CC4E9387155F38275BFD35"><enum>(2)</enum><header>Applicability to contracted services</header><text>The prohibition under paragraph (1) applies to any covered unmanned aircraft systems that are being used by any executive agency through the method of contracting for the services of covered unmanned aircraft systems.</text></paragraph></subsection><subsection id="H0B7FA3D52DEC4ED5B6BE18725992B9FD"><enum>(b)</enum><header>Exemption</header><text>The Secretary of Homeland Security, the Secretary of Defense, and the Attorney General are exempt from the restriction under subsection (a) if the operation or procurement—</text><paragraph id="H260E474412D04F168BFFF1F378D97B02"><enum>(1)</enum><text>is for the sole purposes of research, evaluation, training, testing, or analysis for—</text><subparagraph id="H0DD12B9283314F0AA96153D55B39D9B6"><enum>(A)</enum><text>electronic warfare;</text></subparagraph><subparagraph id="H00D175E7E5554B27B7A73BE02D3AB54D"><enum>(B)</enum><text>information warfare operations;</text></subparagraph><subparagraph id="H232A05F7C60142CE90D743B691DB0AEC"><enum>(C)</enum><text>development of UAS or counter-UAS technology;</text></subparagraph><subparagraph id="H9970E5281B0C40ED821A4796E7360B1B"><enum>(D)</enum><text>counterterrorism or counterintelligence activities; or</text></subparagraph><subparagraph id="H464A55C5CE94474487C7E1CEC4D69BBA"><enum>(E)</enum><text>Federal criminal or national security investigations, including forensic examinations; and</text></subparagraph></paragraph><paragraph id="HB8CC36E6EAF146318105A7D418F051E2"><enum>(2)</enum><text>is required in the national interest of the United States.</text></paragraph></subsection><subsection id="HF1BAA037038F46D59A3BDC2DE0724DD5"><enum>(c)</enum><header>Federal Aviation Administration Center of Excellence for Unmanned Aircraft Systems exemption</header><text>The Secretary of Transportation, in consultation with the Secretary of Homeland Security, is exempt from the restriction under subsection (a) if the operation or procurement is for the sole purposes of research, evaluation, training, testing, or analysis for the Federal Aviation Administration’s Alliance for System Safety of UAE through Research Excellence (ASSURE) Center of Excellence (COE) for Unmanned Aircraft Systems. </text></subsection><subsection id="H805B8F9D73FF473A90468E5161B69743"><enum>(d)</enum><header>National Transportation Safety Board exemption</header><text>The National Transportation Safety Board (NTSB), in consultation with the Secretary of Homeland Security, is exempt from the restriction under subsection (a) if the operation or procurement is necessary for the sole purpose of conducting safety investigations.</text></subsection><subsection id="H3D1C771B8F354035BE0503785D5D58FE"><enum>(e)</enum><header>National Oceanic Atmospheric Administration exemption</header><text>The Administrator of the National Oceanic Atmospheric Administration (NOAA), in consultation with the Secretary of Homeland Security, is exempt from the restriction under subsection (a) if the operation or procurement is necessary for the sole purpose of marine or atmospheric science or management. </text></subsection><subsection id="HC0D71E04D9F84E6F9FB37DD0649566A3"><enum>(f)</enum><header>Waiver</header><text>The head of an executive agency may waive the prohibition under subsection (a) on a case-by-case basis—</text><paragraph id="HDF2BA29571834C1EA4EE8332F20F1D5C"><enum>(1)</enum><text>with the approval of the Secretary of Homeland Security or the Secretary of Defense; and</text></paragraph><paragraph id="H0FD9420AF92D47E6BFD1EFFC9086B1ED"><enum>(2)</enum><text>upon notification to Congress. </text></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6BC7E548512D49959FBA8F38D9F778C3"><enum>(g)</enum><header>Regulations and guidance</header><text>Not later than 180 days after the date of the enactment of this Act, the Secretary of Homeland Security shall prescribe regulations or guidance to implement this section.</text></subsection></section><section id="HF5B73D2F46F04F5BB8EDC641602FD9DC"><enum>5.</enum><header>Prohibition on use of Federal funds for purchases and operation of covered unmanned aircraft systems from foreign adversaries</header><subsection id="HBA03379589F34668935916732D6047F0"><enum>(a)</enum><header>In general</header><text>Beginning on the date that is 2 years after the date of the enactment of this Act, except as provided in subsection (b), no Federal funds awarded through a contract, grant, or cooperative agreement, or otherwise made available may be used—</text><paragraph id="H117E4FCDCC7643098DFC9C7F3D14FB16"><enum>(1)</enum><text display-inline="yes-display-inline">to purchase a covered unmanned aircraft system, or a system to counter unmanned aircraft systems, that is manufactured or assembled by a foreign adversary; or</text></paragraph><paragraph id="HF1214D660A7B4A8F82893652658D3F72"><enum>(2)</enum><text display-inline="yes-display-inline"> in connection with the operation of such a drone or unmanned aircraft system.</text></paragraph></subsection><subsection id="H733629AA51C84FBC8EF7793CFED77632"><enum>(b)</enum><header>Exemption</header><text>A Federal department or agency is exempt from the restriction under subsection (a) if—</text><paragraph id="HD2BD86CE0070472F9F13A3EFFD082501"><enum>(1)</enum><text>the contract, grant, or cooperative agreement was awarded prior to the date of the enactment of this Act; or</text></paragraph><paragraph id="H8F8DCD56B2FF4D9FBB31ACE441909728"><enum>(2)</enum><text>the operation or procurement is for the sole purposes of research, evaluation, training, testing, or analysis, as determined by the Secretary of Homeland Security, the Secretary of Defense, or the Attorney General, for—</text><subparagraph id="HC0B97336C71F4013BA93FD2D544FDF7B"><enum>(A)</enum><text>electronic warfare;</text></subparagraph><subparagraph id="H19E2C02B425D4BF4AC8E694434B38F09"><enum>(B)</enum><text>information warfare operations;</text></subparagraph><subparagraph id="HBBF52C38DCD44375888EBB35BC90BFA3"><enum>(C)</enum><text>development of UAS or counter-UAS technology;</text></subparagraph><subparagraph id="H0C8A6B00A18E4E86A641D91647267E3C"><enum>(D)</enum><text>counterterrorism or counterintelligence activities; or</text></subparagraph><subparagraph id="H1F99FD0F9F8F4B71B7027CA93DB1A955"><enum>(E)</enum><text>Federal criminal or national security investigations, including forensic examinations; or</text></subparagraph><subparagraph id="HE4D77EE8DEDD4AFBA74D14131E675018"><enum>(F)</enum><text>the safe integration of UAS in the national airspace (as determined in consultation with the Secretary of Transportation); and</text></subparagraph></paragraph><paragraph id="HF81D25B0D6E0432996EBC625CD3D610F"><enum>(3)</enum><text>is required in the national interest of the United States. </text></paragraph></subsection><subsection id="H1398264DAFF44A03B3BE0B9F19C6DC97"><enum>(c)</enum><header>Waiver</header><text>The head of an executive agency may waive the prohibition under subsection (a) on a case-by-case basis—</text><paragraph id="H8359554C2979491596F8AA88FDD61284"><enum>(1)</enum><text>with the approval of the Secretary of Homeland Security or the Secretary of Defense; and</text></paragraph><paragraph id="HB2D3F9FE1990480E871B9AECC112CDA7"><enum>(2)</enum><text>upon notification to Congress. </text></paragraph></subsection><subsection display-inline="no-display-inline" commented="no" id="H2372693AEA5B4633BC73710F2E52A238"><enum>(d)</enum><header>Regulations</header><text>Not later than 180 days after the date of the enactment of this Act, the Federal Acquisition Regulatory Council shall prescribe regulations or guidance, as necessary, to implement the requirements of this section pertaining to Federal contracts. </text></subsection></section><section id="HD2FED3EF306043F081786CE939EA4687"><enum>6.</enum><header>Prohibition on use of Government-issued Purchase Cards to purchase covered unmanned aircraft systems from foreign adversaries</header><text display-inline="no-display-inline">Effective immediately, Government-issued Purchase Cards may not be used to procure any covered unmanned aircraft system from a foreign adversary.</text></section><section id="HF10662EFA49648628A386A6585704C14"><enum>7.</enum><header>Management of existing inventories of covered unmanned aircraft systems from foreign adversaries</header><subsection id="H109D037155264A7B87E06BE85342B6D7"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Effective immediately, all executive agencies must account for existing inventories of covered unmanned aircraft systems manufactured or assembled by a foreign adversary in their personal property accounting systems, regardless of the original procurement cost, or the purpose of procurement due to the special monitoring and accounting measures necessary to track the items' capabilities. </text></subsection><subsection id="H6B9A301A75184B8E809D1395745503D8"><enum>(b)</enum><header>Classified tracking</header><text>Due to the sensitive nature of missions and operations conducted by the United States Government, inventory data related to covered unmanned aircraft systems manufactured or assembled by a foreign adversary may be tracked at a classified level.</text></subsection><subsection id="HBBA5F726E4824345A1FF6F2B17289B38" commented="no" display-inline="no-display-inline"><enum>(c)</enum><header>Exceptions</header><text>The Department of Defense and Department of Homeland Security may exclude from the full inventory process, covered unmanned aircraft systems that are deemed expendable due to mission risk such as recovery issues or that are one-time-use covered unmanned aircraft due to requirements and low cost.</text></subsection></section><section id="H1EA03FF0FBA14F26B5CA77074CE14347" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>8.</enum><header>Comptroller General report</header><text display-inline="no-display-inline">Not later than 275 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on the amount of commercial off-the-shelf drones and covered unmanned aircraft systems procured by Federal departments and agencies from foreign adversaries.</text></section><section id="H1A66D18160E24CB6835ABF9B3514A56C"><enum>9.</enum><header>Government-wide policy for procurement of unmanned aircraft systems</header><subsection id="H156212B66BBC445C813B73554F70EFE0"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of the Office of Management and Budget, in coordination with the Department of Homeland Security, Department of Transportation, the Department of Justice, and other Departments as determined by the Director of the Office of Management and Budget, and in consultation with the National Institute of Standards and Technology, shall establish a government-wide policy for the procurement of UAS—</text><paragraph id="H44BA5D05C7BF4B78A0BC0B23764D2139"><enum>(1)</enum><text>for non-Department of Defense and non-intelligence community operations; and</text></paragraph><paragraph id="HD4DB847C22FE4D489D837EA6F575A7CE"><enum>(2)</enum><text>through grants and cooperative agreements entered into with non-Federal entities. </text></paragraph></subsection><subsection id="H64027C3E9C894126A246C3D7E8A6BC75"><enum>(b)</enum><header>Information security</header><text>The policy developed under subsection (a) shall include the following specifications, which to the extent practicable, shall be based on industry standards and technical guidance from the National Institute of Standards and Technology, to address the risks associated with processing, storing and transmitting Federal information in a UAS:</text><paragraph id="HC27416755F4D42F782BDE10156D34678"><enum>(1)</enum><text>Protections to ensure controlled access of UAS.</text></paragraph><paragraph id="H48D8BEBAB93C430996713344CCD56CCA"><enum>(2)</enum><text>Protecting software, firmware, and hardware by ensuring changes to UAS are properly managed, including by ensuring UAS can be updated using a secure, controlled, and configurable mechanism.</text></paragraph><paragraph id="HDF0AEAF60DFA47EBAFC19C8525A81F62"><enum>(3)</enum><text>Cryptographically securing sensitive collected, stored, and transmitted data, including proper handling of privacy data and other controlled unclassified information.</text></paragraph><paragraph id="H2107E9597A774F449F95D355DF7FCAEE"><enum>(4)</enum><text>Appropriate safeguards necessary to protect sensitive information, including during and after use of UAS.</text></paragraph><paragraph id="HD96BCA45652041F3947D4A53F4F66FC3"><enum>(5)</enum><text>Appropriate data security to ensure that data is not transmitted to or stored in non-approved locations. </text></paragraph><paragraph id="HE27E4A3C786547318EF07B7445F105A6"><enum>(6)</enum><text>The ability to opt out of the uploading, downloading, or transmitting of data that is not required by law or regulation and an ability to choose with whom and where information is shared when it is required.</text></paragraph></subsection><subsection id="H13232DE82668487892F175D6A49C626B"><enum>(c)</enum><header>Requirement</header><text>The policy developed under subsection (a) shall reflect an appropriate risk-based approach to information security related to use of UAS.</text></subsection><subsection id="HA516CB318BE140FAB4D897DB0FD51C29"><enum>(d)</enum><header>Revision of acquisition regulations</header><text>Not later than 180 days after the date on which the policy required under subsection (a) is issued—</text><paragraph id="H7C9E5511E9FB41D0B74C34219DD67911"><enum>(1)</enum><text>the Federal Acquisition Regulatory Council shall revise the Federal Acquisition Regulation, as necessary, to implement the policy; and</text></paragraph><paragraph id="HD194F0853BD54C37906F14BA4D60E4A7"><enum>(2)</enum><text>any Federal department or agency or other Federal entity not subject to, or not subject solely to, the Federal Acquisition Regulation shall revise applicable policy, guidance, or regulations, as necessary, to implement the policy.</text></paragraph></subsection><subsection id="HC033A3B72DB743BDB119DEDDB30D84EB"><enum>(e)</enum><header>Exemption</header><text>In developing the policy required under subsection (a), the Director of the Office of Management and Budget shall incorporate an exemption to the policy for the following reasons:</text><paragraph id="H195728C14A7C42FBB49B9EF43DF2B220"><enum>(1)</enum><text>In the case of procurement for the purposes of training, testing, or analysis for—</text><subparagraph id="H2819462C299340349D558602B3B667A4"><enum>(A)</enum><text>electronic warfare; or</text></subparagraph><subparagraph id="H10E94E1887EA44CD834674E63E885E43"><enum>(B)</enum><text>information warfare operations.</text></subparagraph></paragraph><paragraph id="H7AFEB8843F4145489CD8D3585F78F214"><enum>(2)</enum><text>In the case of researching UAS technology, including testing, evaluation, research, or development of technology to counter UAS.</text></paragraph><paragraph id="H25AE05121272408180ACBBDFED1CEB76"><enum>(3)</enum><text>In the case of a head of the procuring department or agency determining, in writing, that no product that complies with the information security requirements described in subsection (b) is capable of fulfilling mission critical performance requirements, and such determination—</text><subparagraph id="H8D6CDAEC19EC466EBF076BC6FA28AD3A"><enum>(A)</enum><text>may not be delegated below the level of the Deputy Secretary of the procuring department or agency;</text></subparagraph><subparagraph id="H947CD87E44A14969906DFE4258BE559C"><enum>(B)</enum><text>shall specify—</text><clause id="HCEAC249DB2894697AEBE3B3186AEA5C4"><enum>(i)</enum><text>the quantity of end items to which the waiver applies, the procurement value of which may not exceed $50,000 per waiver; and</text></clause><clause id="HCC7F7E6F0BC6442DB73FF3D3156DF552"><enum>(ii)</enum><text>the time period over which the waiver applies, which shall not exceed 3 years;</text></clause></subparagraph><subparagraph id="H993F8104A387467E8AE97A12C9156124"><enum>(C)</enum><text>shall be reported to the Office of Management and Budget following issuance of such a determination; and</text></subparagraph><subparagraph id="HCF1C3991C84C4C6497280F1BE7DA7B9B"><enum>(D)</enum><text>not later than 30 days after the date on which the determination is made, shall be provided to the Committee on Homeland Security and Governmental Affairs of the Senate and the Committee on Oversight and Reform of the House of Representatives.</text></subparagraph></paragraph></subsection></section><section id="HE0ECAFD55CAF472EB2293EAB149BB9C1"><enum>10.</enum><header>Study</header><subsection id="HD90955808AE34B6F81B17EC6748F2B60"><enum>(a)</enum><header>Independent study</header><text>Not later than 3 years after the date of the enactment of this Act, the Director of the Office of Management and Budget shall seek to enter into a contract with a federally funded research and development center under which the center will conduct a study of—</text><paragraph id="HCAEB6BF686844946B3C801E0D0E566E1"><enum>(1)</enum><text>the current and future unmanned aircraft system global and domestic market;</text></paragraph><paragraph id="HA0981E6AD4DC479EB46B8B687AFFCE82"><enum>(2)</enum><text>the ability of the unmanned aircraft system domestic market to keep pace with technological advancements across the industry;</text></paragraph><paragraph id="H7C1ED6C146884F9CA4373588848A2FA6"><enum>(3)</enum><text>the ability of domestically made unmanned aircraft systems to meet the network security and data protection requirements of the national security enterprise;</text></paragraph><paragraph id="H2D111A34E034407C805F3B4E6C3737E7"><enum>(4)</enum><text>the extent to which unmanned aircraft system component parts, such as the parts described in section 3, are made domestically; and</text></paragraph><paragraph id="HBBDE80E558EF490C8A87A8A8703C3ECF"><enum>(5)</enum><text>an assessment of the economic impact, including cost, of excluding the use of foreign-made UAS for use across the Federal Government.</text></paragraph></subsection><subsection id="H5BF51D98FE564257B19943683F36656E"><enum>(b)</enum><header>Submission to OMB</header><text>Upon completion of the study in subsection (a), the federally funded research and development center shall submit the study to the Director of the Office of Management and Budget.</text></subsection><subsection id="HDCA526395F9C454FBEEDED2DDBCD4F29"><enum>(c)</enum><header>Submission to Congress</header><text>Not later than 30 days after the date on which the Director of the Office of Management and Budget receives the study under subsection (b), the Director shall submit the study to—</text><paragraph id="H4799BF24ADFD415185D48C82A9D4EE2C"><enum>(1)</enum><text>the Committee on Homeland Security and Governmental Affairs and the Select Committee on Intelligence of the Senate; and</text></paragraph><paragraph id="HAE81D66D2DAB41CFA8A243193B64572C"><enum>(2)</enum><text>the Committee on Homeland Security and the Committee on Oversight and Reform and the Permanent Select Committee on Intelligence of the House of Representatives.</text></paragraph></subsection></section><section id="HA164177EE1604B74A21D00EA969D9F1D"><enum>11.</enum><header>Sunset</header><text display-inline="no-display-inline">Sections 3, 4, and 5 shall cease to have effect on the date that is 5 years after the date of the enactment of this Act. </text></section></legis-body></bill>
