which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Children’s Online Privacy Protection Act of 1998 to provide that a school may not act as the agent of a parent of a child for purposes of providing verifiable parental consent to the collection, use, or disclosure of personal information of the child, and for other purposes.</official-title></form><legis-body id="HBF572AAC480A448A9480CEE5ECFD6189" style="OLC"><section id="HF65CC69059424E86B0789DD42CB01E97" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Safeguarding Children’s Privacy in Schools Act</short-title></quote>.</text></section><section id="HA912ED3168B9478BB5D16A9609382627"><enum>2.</enum><header>Protection of rights of parents regarding personal information of students</header><text display-inline="no-display-inline">The Children’s Online Privacy Protection Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/15/6501">15 U.S.C. 6501 et seq.</external-xref>) is amended—</text><paragraph id="H0D8E7FFDE43240D2BDAF632202410008"><enum>(1)</enum><text>in section 1302, by amending paragraph (9) to read as follows:</text><quoted-block style="OLC" id="HA45D3ADACBD34E53B012729AE7D69995" display-inline="no-display-inline"><paragraph id="H31E34E91CD824293996A234A0330BDE9"><enum>(9)</enum><header>Verifiable parental consent</header><text display-inline="yes-display-inline">The term <quote>verifiable parental consent</quote>, with respect to the collection, use, and disclosure (as applicable) by an operator of the personal information of a child—</text><subparagraph id="H3ADFDBA957D3402184E82158865693E4"><enum>(A)</enum><text>means consent by a parent of the child to the collection, use, and disclosure (and to any subsequent use of the information) that is obtained by the operator—</text><clause id="H1FD37AB803DD4B58AD6C929AB074F0D5"><enum>(i)</enum><text>before the information is collected from the child; and</text></clause><clause id="HB576E18E2CFA4F98863E6178DA6A8855"><enum>(ii)</enum><text>after notice to the parent of the operator’s personal information collection, use, and disclosure practices; and</text></clause></subparagraph><subparagraph id="H0BA7DCB1011C45A0B3F70258341CD0AC"><enum>(B)</enum><text>may include consent to future collection, use, and disclosure described in the notice.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph><paragraph id="H9CBEB0AF16B84A6586F1605D929C8854"><enum>(2)</enum><text>in section 1303—</text><subparagraph id="HA187779F540647778FCB0ABADB4BF3D5"><enum>(A)</enum><text>in subsection (b)(2)(C)—</text><clause id="H67375F9019E14F0F88A188CA63D231B9"><enum>(i)</enum><text>in clause (i), by striking <quote>; or</quote> and inserting a semicolon;</text></clause><clause id="H2EFB36B7BA8849C6A3675C3AB8EF1FD4"><enum>(ii)</enum><text>by striking clause (ii); and</text></clause><clause id="H4F124E2ABFA14F309E98D9E5F738129D"><enum>(iii)</enum><text>by striking <quote>that request—</quote> and all that follows through <quote>if, before</quote> and inserting <quote>that request, if, before</quote>; and </text></clause></subparagraph><subparagraph id="HD0A11E01AD704EC3B1D51FD1123C8574"><enum>(B)</enum><text>by adding at the end the following:</text><quoted-block style="OLC" id="H82E944D17ECC4CCD93FD642BA1BE0973" display-inline="no-display-inline"><subsection id="H41AF46F8A2624221A7D0600DF63FDB3C"><enum>(e)</enum><header>Prohibition on school or local educational agency acting as agent of parent</header><paragraph id="HFD9AEE33A2884FB7B7CA7392D815B72F"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">An elementary school, secondary school, or local educational agency, or an employee or other agent of such school or agency, may not act as the agent of a parent of a child enrolled in such school (or in a school served by such agency, as the case may be) for purposes of providing verifiable parental consent under the regulations prescribed under subsection (b), making any request under such regulations, or receiving any notice or other information required to be provided to a parent of the child under such regulations.</text></paragraph><paragraph id="HB9D44B01C4E64639B7FD9A8DE9F19808"><enum>(2)</enum><header>Definitions</header><text>In this subsection, the terms <quote>elementary school</quote>, <quote>secondary school</quote>, and <quote>local educational agency</quote> have the meanings given such terms in section 8101 of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></section></legis-body></bill>
