R. 5627</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211019">October 19, 2021</action-date><action-desc><sponsor name-id="L000566">Mr. Latta</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HWM00">Ways and Means</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend titles XVIII and XIX of the Social Security Act to prohibit certain vaccine mandates as conditions of participation under the Medicare and Medicaid programs.</official-title></form><legis-body id="H1C5925E8AD06461B8B3B1C209BF6D036" style="OLC"><section id="H8A8BDDE423A041AFAF3605199E167462" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Care Workforce Protection from Mandates Act</short-title></quote>. </text></section><section id="HFED186AD7BD64AB6A02A0782D12483C2"><enum>2.</enum><header>Prohibiting under Medicare and Medicaid certain vaccine mandates as conditions of participation</header><subsection id="H95DFC24CD9A2401CBB6D9D9110BEF131"><enum>(a)</enum><header>Medicare</header><text display-inline="yes-display-inline">Section 1866 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H682E32AA765A4159AA07A6124FABC253" display-inline="no-display-inline"><subsection id="H488A6CDAFC704570A8BB792E8000126B"><enum>(l)</enum><header>Limitation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, the Secretary may not require, as a condition to participate under this title or to be eligible to receive payment, reimbursement, or a contract under this title, a provider of services or supplier to mandate COVID–19 vaccinations for the employees or contractors of such provider of services or supplier unless before implementing such requirement, with respect to providers of services and suppliers, the Secretary certifies that such requirement would not result in any staffing shortages for such providers of services and suppliers.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF86A718124C546739BFA0058456B4529"><enum>(b)</enum><header>Medicaid</header><text>Section 1902 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="H9B2D11C781FE4A12B5FB2DFF2E4859CA" display-inline="no-display-inline"><subsection id="H3FA0D176E6564179B4BC5B99A0E43BD9"><enum>(tt)</enum><header>Limitation</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this title, the Secretary may not require, as a condition to provide services under a State plan under this title (or waiver of such plan) or to be eligible to receive payment, reimbursement, or a contract under such State plan (or waiver), an individual or entity to mandate COVID–19 vaccinations for the employees or contractors of such individual or entity unless before implementing such requirement, with respect to individuals and entities, the Secretary certifies that such requirement would not result in any staffing shortages for such individuals and entities.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></legis-body></bill>
