which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To prohibit the Federal Government from mandating vaccination against COVID-19 for interstate travel.</official-title></form><legis-body id="H3F3F7EDDE1F3495F996B1DB623AB137B" style="OLC"><section id="H9DBDD7179ED64059B4509E57A5025C1E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Let Me Travel America Act</short-title></quote>.</text></section><section id="HACC16343B6064C0C80F3A4228BBC2171"><enum>2.</enum><header>Limitation on authority of Surgeon General</header><text display-inline="no-display-inline">Section 361 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/264">42 U.S.C. 264</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="HEF2E33C1BB824B9BB19A3D0C36D7363E"><subsection id="H0D2B110912A44B72810EE2A2FE5053BA"><enum>(f)</enum><text>Nothing in this section shall be construed to provide the Surgeon General, the Secretary of Health and Human Services, or any Federal agency with the authority to mandate vaccination against Coronavirus Disease 2019 (COVID-19) as a prerequisite for interstate travel, transportation, or movement.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HCB1A6A199C2343E7B54A0B14DB93DDD2"><enum>3.</enum><header>Interstate common carriers</header><subsection id="HFADF2219E9AA4D969C65C33AF7424D95"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/805">Chapter 805</external-xref> of title 49, United States Code, is amended by adding at the end the following:</text><quoted-block style="USC" display-inline="no-display-inline" id="HF166659EB6894E13AE3FA58E02A98883"><section id="H4F99FABBDCCF464680ED7E2650EFE9B1"><enum>80505.</enum><header>COVID-19 vaccination status</header><subsection id="H9B552C489A464911A9D2CA0CB641F9E2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">An entity described in subsection (b) may not deny service to any individual solely based on the vaccination status of the individual with respect to the Coronavirus Disease 2019 (COVID-19).</text></subsection><subsection id="HA04AEF1C81694967AAEAF1E1B3AB33BF"><enum>(b)</enum><header>Entity described</header><text display-inline="yes-display-inline">An entity referred to in subsection (a) is a common carrier or any other entity, including a rail carrier (as defined in section 10102, including Amtrak), a motor carrier (as defined in section 13102), a water carrier (as defined in that section), and an air carrier (as defined in section 40102), that—</text><paragraph id="HFF7D73D70A1948DDB399DF4DEFA8F992"><enum>(1)</enum><text display-inline="yes-display-inline">provides interstate transportation of passengers; and</text></paragraph><paragraph id="H3DB5F7842D03406B8E11276742FECB26"><enum>(2)</enum><text display-inline="yes-display-inline">is subject to the jurisdiction of the Department of Transportation or the Surface Transportation Board under this title.</text></paragraph></subsection><subsection id="H7223CA1567FD4E45A1F0F09FD694F975"><enum>(c)</enum><header>Savings provision</header><text>Nothing in this section applies to the regulation of intrastate travel, transportation, or movement, including the intrastate transportation of passengers.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HDBAAD232530D49CC804B27885002C1FB"><enum>(b)</enum><header>Clerical amendment</header><text>The analysis for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/49/805">chapter 805</external-xref> of title 49, United States Code, is amended by inserting after the item relating to <external-xref legal-doc="usc" parsable-cite="usc/49/80504">section 80504</external-xref> the following:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H8EDC0707C566468389E25C246AFE357C"><toc><toc-entry level="section" bold="off">80505. COVID-19 vaccination status.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="H815C2B9BF325485D9DA6DBC64847144B"><enum>4.</enum><header>Rule of construction</header><text display-inline="no-display-inline">Nothing in this Act, or an amendment made by this Act, shall be construed to permit or otherwise authorize Congress or an executive agency to enact or otherwise impose a COVID-19 vaccine mandate.</text></section></legis-body></bill>
