which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To establish a grant program that provides grants to States, Indian Tribal governments, Federally qualified health centers, rural health clinics, local governments, and community-based organizations to establish and support PrEP programs, and for other purposes.</official-title></form><legis-body id="H930565FD02E14693BB3C615BDC837A0E" style="OLC"><section id="HDAD7EEFAADF4434280A16D60154EE5A8" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>PrEP Assistance Program Act</short-title></quote>.</text></section><section id="H7A5622AF0DF945FAAAB2ED210CF2D587"><enum>2.</enum><header>Pre-exposure prophylaxis program grant</header><subsection id="H7247C2FBC28F49F8950C7475EF223533"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary of Health and Human Services shall establish a program that provides grants to States, Indian Tribal governments, Federally qualified health centers, rural health clinics, local governments, and community-based organizations to establish and support PrEP programs. </text></subsection><subsection id="HC0A0CFE84714439F98232A86E91B3BC1"><enum>(b)</enum><header>Applications</header><text display-inline="yes-display-inline">To be eligible to receive a grant under subsection (a), a State, Indian Tribal government, Federally qualified health center, rural health clinic, local government, or community-based organization shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require, including a description of how any amounts awarded shall be used.</text></subsection><subsection id="HFA715C144AF14C6F8FA3566AF121925A"><enum>(c)</enum><header>Amount</header><text display-inline="yes-display-inline">Any grant provided to a State, Indian Tribal government, Federally qualified health center, rural health clinic, local government, or community-based organization under this section may not exceed $10,000,000.</text></subsection><subsection id="H0714D7CA4ACD478CBFBFEFE6CB426E49"><enum>(d)</enum><header>Use of funds</header><paragraph id="HB8832FF1519046FC829855AABC848822"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Any State, Indian Tribal government, Federally qualified health center, rural health clinic, local government, or community-based organization that is awarded an amount under subsection (a) shall use such amount for expenses associated with establishing a PrEP program or supporting an existing PrEP program.</text></paragraph><paragraph id="HACA887B7A4244997A94A9A1AF27BBE4C"><enum>(2)</enum><header>Eligible expenses</header><text display-inline="yes-display-inline">The Secretary shall publish a list of eligible expenses associated with establishing a PrEP program or supporting an existing PrEP program and this list shall include—</text><subparagraph id="H705EEE35C1154D0395CE8599DE523479" display-inline="no-display-inline"><enum>(A)</enum><text>clinic and laboratory fees;</text></subparagraph><subparagraph id="HF8CA92A4C6AD4406BD673A70A47EA5B2"><enum>(B)</enum><text>office visits;</text></subparagraph><subparagraph id="HA165C98DADDF424A990C7361FE702B89"><enum>(C)</enum><text>PrEP medication;</text></subparagraph><subparagraph id="HCD80E0CDA3F74AF8ABEDAE9E5BE091DD"><enum>(D)</enum><text display-inline="yes-display-inline">blood and urine testing as required in association with the use of PrEP medication;</text></subparagraph><subparagraph id="H0C094822A4184DB7881E8C48659BB24A"><enum>(E)</enum><text display-inline="yes-display-inline">sexually transmitted disease testing in accordance with guidelines issued by the Centers for Disease Control and Prevention;</text></subparagraph><subparagraph id="HEB2D6409337C4D1185285D54E4CD2EDA"><enum>(F)</enum><text display-inline="yes-display-inline">adherence services and counseling;</text></subparagraph><subparagraph id="HA7D1E49B4089400494F33B3F7B51BC4C"><enum>(G)</enum><text display-inline="yes-display-inline">outreach activities directed toward assisting health professionals to become eligible to prescribe pre-exposure prophylaxis medications in the State or Indian Tribal government where the program is operating;</text></subparagraph><subparagraph id="HC945CF18A5414AB089BDCCA2DD30B9F5"><enum>(H)</enum><text display-inline="yes-display-inline">outreach activities directed toward physicians that provide education about PrEP; and</text></subparagraph><subparagraph id="H8C07C8AC9B7A4824AEA391382782BE03"><enum>(I)</enum><text>other similar items or services.</text></subparagraph></paragraph></subsection><subsection id="HB27D9611908E4CF1B92E324E13391097"><enum>(e)</enum><header>Payment for services</header><text>An individual that receives a service or item from a PreP program established or supported using amounts under this section may not be required to provide payment for such service or item.</text></subsection><subsection id="H6F361059F65F4A209D0B48C4CB8C43BD"><enum>(f)</enum><header>Matching</header><paragraph id="HFFEDDE1AB90545AFBB240A25F983FEF5"><enum>(1)</enum><header>In general</header><text>Except with respect to an Indian Tribal government, a grantee under this section shall contribute, to the PrEP program established or supported by the grant, an amount equal to not less than 10 percent of the amount of the grant.</text></paragraph><paragraph id="H0B4515FFFB374DE8AB031412BDEB1556"><enum>(2)</enum><header>Exception</header><text display-inline="yes-display-inline">The Secretary may waive the requirement under paragraph (1) for Federally qualified health centers, rural health clinics, and community-based organizations if the Secretary determines such a waiver is necessary.</text></paragraph></subsection><subsection id="H0D5507CCABA241A79D0D69FECDA0B65D"><enum>(g)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">The Secretary shall, in each of the first 5 years beginning 1 year after the date of the enactment of this Act, submit to Congress, and make public on the Internet website of the Department of Health and Human Services, a report on the impact of grants provided to States, Indian Tribal governments, Federally qualified health centers, rural health clinics, local governments, and community-based organizations under this Act.</text></subsection><subsection id="H36337D06FE6F46A5B6B550688BECBCCA"><enum>(h)</enum><header>Authorization of Appropriations</header><text>There are authorized to be appropriated to carry out this Act $400,000,000 for each of the first 5 fiscal years beginning after the date of the enactment of this Act.</text></subsection><subsection id="H5E7B7AEE74214AC4AD6EC0B772ED6A46"><enum>(i)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this Act:</text><paragraph id="H62BA9861DFA6448CB3A390032BAE8B75"><enum>(1)</enum><header>Community-based organization</header><text display-inline="yes-display-inline">The term <quote>community-based organization</quote> means a nonprofit or private organization that—</text><subparagraph id="HCCE0FF8AD0214CB6BEC76C1FCE56F1B9"><enum>(A)</enum><text>represents a community or significant segments of a community;</text></subparagraph><subparagraph id="H6E7E19ED03D444B689ABFCF290A94745"><enum>(B)</enum><text>provides health care or health-related services to high-risk or high-need individuals in a community; and</text></subparagraph><subparagraph id="H2038F908D1404341997835AE6C90D994"><enum>(C)</enum><text>demonstrates effectiveness with respect to such health care or health-related services.</text></subparagraph></paragraph><paragraph id="HE754334528DA4C4396D63ABDF1C688C2"><enum>(2)</enum><header>Federally qualified health center</header><text display-inline="yes-display-inline">The term <term>Federally qualified health center</term> has the meaning given the term in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>).</text></paragraph><paragraph id="H08503EDBA4664A3189C0DE9622B0228C"><enum>(3)</enum><header>Indian Tribal government</header><text display-inline="yes-display-inline">The term <term>Indian Tribal government</term> means the governing body of any Indian or Alaska Native tribe, band, nation, pueblo, village, or community that the Secretary of the Interior acknowledges to exist as an Indian tribe under the Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/479a">25 U.S.C. 479a et seq.</external-xref>).</text></paragraph><paragraph id="H5DE2BCEAA18945D3B16D730C4D95B497"><enum>(4)</enum><header>PrEP program</header><text display-inline="yes-display-inline">The term <term>PrEP program</term> means a program designed to provide pre-exposure prophylaxis and pre-exposure prophylaxis- related services to individuals.</text></paragraph><paragraph id="H5683CF8EB4F74F5B9442D07AA6F350E6"><enum>(5)</enum><header>Pre-exposure prophylaxis</header><text display-inline="yes-display-inline">The term <term>pre-exposure prophylaxis</term> means any medication approved by the Federal Drug Administration and designed to prevent individuals at risk of contracting human immunodeficiency virus (HIV) from contracting human immunodeficiency virus (HIV).</text></paragraph><paragraph id="HFBEBAC1C8AB64774B0297E62697811A0"><enum>(6)</enum><header>Rural health clinic</header><text display-inline="yes-display-inline">The term <quote>rural health clinic</quote> has the meaning give such term in section 1861(aa) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)</external-xref>). </text></paragraph><paragraph id="H6DD04AB98A3947AF90BD30DE46E435BB"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services. </text></paragraph><paragraph id="H4D2A21D3AD514EE581DFA222173614AB"><enum>(8)</enum><header>State</header><text display-inline="yes-display-inline">The term <term>State</term> means each State of the United States, the District of Columbia, Puerto Rico, the Virgin Islands, Guam, American Samoa, and the Commonwealth of the Northern Mariana Islands.</text></paragraph></subsection></section></legis-body></bill>
