R. 5600</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211015">October 15, 2021</action-date><action-desc><sponsor name-id="S001200">Mr. Soto</sponsor> (for himself, <cosponsor name-id="B001257">Mr. Bilirakis</cosponsor>, <cosponsor name-id="C001111">Mr. Crist</cosponsor>, <cosponsor name-id="F000466">Mr. Fitzpatrick</cosponsor>, and <cosponsor name-id="D000624">Mrs. Dingell</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HJU00">Committee on the Judiciary</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To assist States in improving guardianship oversight and data collection.</official-title></form><legis-body id="H52B775AB3E6B4F8C89DD97F5D5F421CE" style="OLC"><section section-type="section-one" id="H1864E468E1FA4502BA406E62DFDE28A5"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Guardianship Accountability Act of 2021</short-title></quote>.</text></section><section id="H9FAFD9D9FF1F41B296ED95D77D1CE4FD"><enum>2.</enum><header>Findings; purposes</header><subsection id="HD76C85E86AFB4393B5F7C85D32662129"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text><paragraph id="HD31EE34DB2534B8495CAFEB7B009397D"><enum>(1)</enum><text>An estimated 1,300,000 adults and approximately $50,000,000,000 in assets are under the care of guardians in the United States.</text></paragraph><paragraph id="H81E4C493FBC94BE2876E33BE11C13D2E"><enum>(2)</enum><text>Most guardians are selfless, dedicated individuals who play an important role in safeguarding individuals in need of support. However, unscrupulous guardians acting with little oversight have used guardianship proceedings to obtain control of individuals in need of support.</text></paragraph><paragraph id="H50F2E689D04441A4A538AE878A79BC57"><enum>(3)</enum><text>Once a guardianship is imposed, there are often few safeguards in place to protect against individuals who choose to abuse the system and few states are able to report accurate or detailed guardianship data.</text></paragraph><paragraph id="H33F6732B5FD44B669962A8D448BABFE4"><enum>(4)</enum><text>A full guardianship order may remove more rights than necessary and thus may not be the best means of providing support and protection to an individual. If individuals subject to guardianship regain capacity, all or some rights should be quickly and efficiently restored.</text></paragraph><paragraph id="HC5C876CDDDE84A708C2F46797FEF92DB"><enum>(5)</enum><text>States should encourage courts to use alternatives to guardianship through State statutes, including the adoption of the Uniform Guardianship, Conservatorship, and Other Protective Arrangements Act, to ensure better protections and control for individuals being considered for guardianship and those pursuing a restoration of their rights.</text></paragraph><paragraph id="HBC8B5C54B463493EB18C74D275DC9F8A"><enum>(6)</enum><text>A national resource center on guardianship is needed to collect and publish information for the benefit of courts, policy makers, individuals subject to guardianship, guardians, community organizations, and other stakeholders.</text></paragraph></subsection><subsection id="H5FBCCF38F917487495D5C414135AF562"><enum>(b)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are to help States improve guardianship oversight and data collection by—</text><paragraph id="H90E1AE253DBB4F35B82689B20A6737FB"><enum>(1)</enum><text>designating a National Resource Center on Guardianship;</text></paragraph><paragraph id="HE7E584C1E4D943A5A6564339DDEED5D9"><enum>(2)</enum><text>authorizing grants for the purpose of developing State Guardianship Databases; and</text></paragraph><paragraph id="H2C77C7A2DD1F47BEA287E3BA380B4DA3"><enum>(3)</enum><text>establishing procedures for sharing background check information related to appointed guardians with other jurisdictions.</text></paragraph></subsection></section><section id="H20187870FE4C44FCA3455382C9F1E8D3"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text><paragraph id="H786EA9B56AE040A18855E7E2D2CE49E8"><enum>(1)</enum><header>Guardianship</header><text>The term <term>guardianship</term> means a legal relationship established by a court when a person is determined to lack the ability to meet essential requirements for physical health, safety, or self-care because the person is unable to receive and evaluate information or make or communicate decisions about their person or property, even with appropriate supportive services, technological assistance, supported decision making, or other less restrictive alternatives.</text></paragraph><paragraph id="H298B02D9D522484DA7D7C5BF7B1613A4"><enum>(2)</enum><header>Individuals subject to guardianship</header><text>The term <term>individuals subject to guardianship</term> means any individual 18 years or older placed under a guardianship.</text></paragraph><paragraph id="HDF33126ADD90486092CEED7F47877C88"><enum>(3)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Health and Human Services.</text></paragraph></section><section id="HE7482D2D5A8344058B134217D0E1AE42"><enum>4.</enum><header>National Resource Center on Guardianship</header><subsection id="HE6B34E645EE84A9A9C973F176780C3BB"><enum>(a)</enum><header>Designation</header><text>The Secretary of Health and Human Services shall establish a National Resource Center on Guardianship (referred to in this section as the <quote>Center</quote>).</text></subsection><subsection id="HA1A85E66D03343C4B3BAFB9F3893BA4C"><enum>(b)</enum><header>The National Resource Center on Guardianship</header><text>The National Resource Center shall—</text><paragraph id="HCE6C927306BB4ABFAEE642260228A7C8"><enum>(1)</enum><text>collect and publish information for use by individuals subject to guardianship, guardians, courts, State and local governments, and community organizations;</text></paragraph><paragraph id="HAB9DA198A0944A3694633161EC7F5FAA"><enum>(2)</enum><text>post model standards, best practices, and guidelines for the appointment and regulation of guardianship cases developed under section 505 of the Elder Abuse Prevention and Prosecution Act (<external-xref legal-doc="usc" parsable-cite="usc/34/21752">34 U.S.C. 21752</external-xref>);</text></paragraph><paragraph id="H43CCAB67ADF54094A5F9834F901ABD6F"><enum>(3)</enum><text>promote the use of less restrictive alternatives to guardianship, including supported decision making and the restoration of rights of individuals subject to guardianship;</text></paragraph><paragraph id="H0543A1F850634DB9BB41C270B8020EE1"><enum>(4)</enum><text>annually compile and publish a summary of recently conducted research on guardianship systems and efforts to expand less restrictive alternatives, including information from agencies across the government;</text></paragraph><paragraph id="HB9784E4720ED421380CCA5AD2748AC59"><enum>(5)</enum><text>collect data from States regarding—</text><subparagraph id="HD739CB5A442640239D1C5F6FE17EAC48"><enum>(A)</enum><text>the number of individuals subject to guardianship;</text></subparagraph><subparagraph id="H50B97C50E23D4FD291E2065B61B2C2A1"><enum>(B)</enum><text>the duration of guardianships;</text></subparagraph><subparagraph id="H3C02CE4CB74D4E1ABDFC6E2206E43D2F"><enum>(C)</enum><text>whether the authority granted to guardians is classified as—</text><clause id="HEB8AE20A15774F2FA0E9527C4673074A"><enum>(i)</enum><text>full guardianship;</text></clause><clause id="HCA719D613E5B48E2A8DC703F55C86382"><enum>(ii)</enum><text>limited guardianship;</text></clause><clause id="HADA8D71F7FF34378AAF16620B566BD8D"><enum>(iii)</enum><text>emergency or temporary guardianship; or</text></clause><clause id="HCEFEFDA298464D19A0BE7B5C9312689E"><enum>(iv)</enum><text>a less restrictive alternative to guardianship;</text></clause></subparagraph><subparagraph id="H297C4BEC102A4F9F851E74213C4C016C"><enum>(D)</enum><text>the amount of financial assets under guardianship; and</text></subparagraph><subparagraph id="H118EFBB8336749B18C96B99F39B1AA32"><enum>(E)</enum><text>whether an appointed guardian is classified as a—</text><clause id="H6437BCB47C734A9EB1B30A60B3849131"><enum>(i)</enum><text>family or other nonprofessional guardian;</text></clause><clause id="HFA1066BF77CF41F684CA46C9669A0FFC"><enum>(ii)</enum><text>private or professional guardian or guardianship agencies; or</text></clause><clause id="H160402FC743C4CCB94346A093E0F207C"><enum>(iii)</enum><text>public guardian;</text></clause></subparagraph></paragraph><paragraph id="H4A997AD2775B406CB1C7882A63EA42A0"><enum>(6)</enum><text>maintain a public, national database on State laws regarding guardianship and less restrictive alternatives to guardianship, including requirements for the—</text><subparagraph id="H4294A913AB614B85973183435E6CF524"><enum>(A)</enum><text>use of least restrictive alternative;</text></subparagraph><subparagraph id="H4DE97FFB79F04368B2842641C130040A"><enum>(B)</enum><text>regular filing and documentation by appointed guardians;</text></subparagraph><subparagraph id="HA5251B9E58FF4603BA465CA43808294E"><enum>(C)</enum><text>oversight of appointed guardians;</text></subparagraph><subparagraph id="H3F0875D662E9457EA3B477C6452BFB44"><enum>(D)</enum><text>restoration of rights of individuals subject to guardianship; and</text></subparagraph><subparagraph id="HC8592471FEA24CE1A645D42B230306F8"><enum>(E)</enum><text>oversight of potential conflicts of interest among individuals and organizations involved in guardianship applications, appointments, and oversight;</text></subparagraph></paragraph><paragraph id="H4FC384C1E5964E5887203D4F396ED8D7"><enum>(7)</enum><text>identify issues relating to guardianship and provide and publish annual recommendations to States and Congress to address identified problems;</text></paragraph><paragraph id="H94F518B2DFA643A9AC47F17FF62BA630"><enum>(8)</enum><text>collect and analyze best practices relating to guardianship, and publish a report of such best practices, including model guidelines and standards for—</text><subparagraph id="H108188090FC8460B90B7E889D0D9A8A0"><enum>(A)</enum><text>ensuring appropriate representation and protection of legal rights for individuals subject to guardianship and guardianship proceedings;</text></subparagraph><subparagraph id="HB8363DD232F84C6DA8DC9C4BE74153D1"><enum>(B)</enum><text>conducting background check investigations on prospective and appointed guardians;</text></subparagraph><subparagraph id="HDB715AEF46C4400A969B257670AD9D72"><enum>(C)</enum><text>promoting the use of less restrictive alternatives to guardianship, including supported decision making; </text></subparagraph><subparagraph id="HB3024801C4E747D58939A90EB0151A88"><enum>(D)</enum><text>obtaining restoration of all or some rights;</text></subparagraph><subparagraph id="H9B5B947586D8459496579288D675166F"><enum>(E)</enum><text>implementing oversight programs; and</text></subparagraph><subparagraph id="HE054D3DA4CAE4E89B7202C64D918C778"><enum>(F)</enum><text>responding to abuse, neglect, and exploitation;</text></subparagraph></paragraph><paragraph id="H0591E3805CA84D8BBD2A22242BB08262"><enum>(9)</enum><text>compile and publish training materials for court appointed guardians related to duties and obligations, as well as ways in which to effectively support individuals subject to guardianship and to use less restrictive alternatives to guardianships; </text></paragraph><paragraph id="H4D32E09A339A4D869207C4B76F891D10"><enum>(10)</enum><text>facilitate State collection of guardianship information and the sharing of such information among States and Federal agencies; and</text></paragraph><paragraph id="H457179B89FF345F6888183B57A72CCFB"><enum>(11)</enum><text>carry out other activities, as determined by the Secretary.</text></paragraph></subsection><subsection id="HFE549B8502944C8FBB4025BD3DA60E15"><enum>(c)</enum><header>Consideration</header><text>In developing the Center, the Secretary shall take into account diverse stakeholder views, including people with disabilities, older adults, self-advocacy organizations, and organizations representing people with disabilities, older adults, family members, court-stakeholder partnerships and others, as well as available literature developed through academic or other research institutions. </text></subsection></section><section id="H69948E60E3424B07AA30D5CA9931B285"><enum>5.</enum><header>State guardianship databases</header><text display-inline="no-display-inline">Section 2042(c) of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1397m-1">42 U.S.C. 1397m–1(c)</external-xref>) is amended—</text><paragraph id="H0A0A11386E474C518D3A149A03259EFA"><enum>(1)</enum><text>in paragraph (1), by striking <quote>paragraph (2)(E)</quote> and inserting <quote>subparagraphs (E), (F), (G), and (H) of paragraph (2)</quote>;</text></paragraph><paragraph id="HF257376B44CD48F0B154D8B46C4E608C"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text><subparagraph id="H892E0CB7AB444C67809BBDBFB8D51B6B"><enum>(A)</enum><text>in the matter preceding subparagraph (A)—</text><clause id="H702B6D471A5D4CBABE3DE3C7D80B9FCD"><enum>(i)</enum><text>by striking <quote>Funds</quote> and inserting <quote>Subject to paragraph (7), funds</quote>; and</text></clause><clause id="H41BB5C544BEC49E4AD94F8DCD10B606C"><enum>(ii)</enum><text>by striking <quote>subparagraph (E)</quote> and inserting <quote>subparagraphs (E), (F), (G), and (H)</quote>;</text></clause></subparagraph><subparagraph id="H326505F2CC824ECE9E810B3D3A75EDDB"><enum>(B)</enum><text>in subparagraph (E), by striking <quote>or</quote> at the end;</text></subparagraph><subparagraph id="H7B83F65ED0544ED98B9BD11B2C4B6658"><enum>(C)</enum><text>by redesignating subparagraph (F) as subparagraph (I); and</text></subparagraph><subparagraph id="H227A675D18984C8CAAD4840F82A2292C"><enum>(D)</enum><text>by inserting after subparagraph (E) the following new paragraphs:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H7499BEE25CF4435FBE02FEA28B0EF2A0"><subparagraph id="HECFB5ED3304B40A9B5D598B407B764C6"><enum>(F)</enum><text>methods to assess State guardianship statistics such as the creation of State databases to collect information about the number and characteristics of guardianship arrangements, guardians, individuals subject to guardianship, and individuals receiving supported decision-making services or other alternatives to guardianship; </text></subparagraph><subparagraph id="H09A9B3A9783A43B5A066B14E000AEF13"><enum>(G)</enum><text>the use of trained court visitors to improve court administration of guardianship arrangements, including the appointment and oversight of guardians and adoption of less restrictive alternatives to guardianship, and to encompass a broad range of entities that could provide oversight and support to adults subject to guardianship; </text></subparagraph><subparagraph id="H1E29EFCB2B394FD6A6CA1F4E9BE8EE63"><enum>(H)</enum><text>methods for collecting, storing, and making available to the appropriate individuals, organizations, and entities information on prospective, current, and previously appointed guardians, which may include—</text><clause id="HDD043951EF414FB0B8F8C747F0FE872D"><enum>(i)</enum><text>information relating to background check investigations;</text></clause><clause id="H2421B7D5B99848CA8A52B6991AC867E0"><enum>(ii)</enum><text>court decisions regarding petitions for appointment as a guardian, including the rationale for such decisions; and</text></clause><clause commented="no" display-inline="no-display-inline" id="H8E3871435CF24141A3D29D379A6EE3AB"><enum>(iii)</enum><text>information relating to the cause for removal of the guardian or termination of the guardianship arrangement; or</text></clause></subparagraph><after-quoted-block>; </after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HF09335849B8D4E7384238758EE9CE742"><enum>(3)</enum><text>in paragraph (4), by striking <quote>paragraph (2)(E)</quote> and inserting <quote>subparagraphs (E), (F), (G), and (H) of paragraph (2)</quote>;</text></paragraph><paragraph id="H32F18AB28E0D40E895454A0B453E3E5C"><enum>(4)</enum><text>in paragraph (5), by striking <quote>paragraph (2)(E)</quote> each place it appears and inserting <quote>subparagraphs (E), (F), (G), and (H) of paragraph (2)</quote>; and</text></paragraph><paragraph id="H045F1231D8B0490CA763F39504327754"><enum>(5)</enum><text>by adding at the end the following new paragraph:</text><quoted-block style="OLC" display-inline="no-display-inline" id="H1F6C4CF573C64970970CC129EE7E7650"><paragraph id="HFC570E3608BF40E2ABAF90114FC8A05D"><enum>(7)</enum><header>Ensuring demonstration program funding for the highest courts of States</header><text>The Secretary shall ensure that at least 5 percent of the total of any funds made available to carry out this subsection in a fiscal year is awarded under grants to the highest courts of States for purposes of conducting demonstration programs described in subparagraphs (E), (F), (G), and (H) of paragraph (2).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></legis-body></bill>
