<official-title display="yes">To amend section 230 of the Communications Act of 1934 to limit the liability protection provided by such section when a provider of an interactive computer service knew or should have known such provider was making a personalized recommendation of third-party information or recklessly made a personalized recommendation of such information, and for other purposes.</official-title>

<section id="H1B9EBDEE5FAD4ADCAD1CA560D0BBB567" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Justice Against Malicious Algorithms Act of 2021</short-title></quote>.</text></section> <section id="HBE56752E2FBB456C9FB9CA63D5EFD648"><enum>2.</enum><header>Personalized recommendation of third-party information</header> <subsection id="HDDC63240AFAF447AAB5FFCD0D00D1ADA"><enum>(a)</enum><header>In general</header><text>Section 230 of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/230">47 U.S.C. 230</external-xref>) is amended—</text>
<paragraph id="HD4D6DCB907734F5786DE4CA79E76D36D"><enum>(1)</enum><text>by redesignating subsection (f) as subsection (g);</text></paragraph> <paragraph id="H548A4A767F0A49D2A40895F6691BF842"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text>

<subsection id="H324C524905344C5C9193F9DA9C1AEA93"><enum>(f)</enum><header>Personalized recommendation of information provided by another information content provider</header>
<paragraph id="H2C22695AA10A4EA88DC4E73077B3BACC"><enum>(1)</enum><header>In general</header><text>Subsection (c)(1) does not apply to a provider of an interactive computer service with respect to information provided through such service by another information content provider if—</text> <subparagraph id="H50B65DEE82FE4693988BCA3D0ED89D2F"><enum>(A)</enum><text>such provider of such service—</text>
<clause id="HD55961AEDB754E77B92548BB0E9070A9"><enum>(i)</enum><text>knew or should have known such provider of such service was making a personalized recommendation of such information; or</text></clause> <clause id="H339972B45D324216975D0575C395C0C8"><enum>(ii)</enum><text>recklessly made a personalized recommendation of such information; and</text></clause></subparagraph>
<subparagraph id="HBF95ACD4E03941BAB8302377FA73A385"><enum>(B)</enum><text>such recommendation materially contributed to a physical or severe emotional injury to any person.</text></subparagraph></paragraph> <paragraph id="H8930851B475247B289743B5D7ADC4E3B"><enum>(2)</enum><header>Exemptions</header> <subparagraph id="HAB8476C894694090A2A3A644D816FBFB"><enum>(A)</enum><header>Small businesses</header><text display-inline="yes-display-inline">Paragraph (1) of this subsection does not apply to an interactive computer service that (in combination with each subsidiary and affiliate of the service) has 5,000,000 or fewer unique monthly visitors or users for not fewer than 3 of the preceding 12 months.</text></subparagraph>
<subparagraph id="H17499D279F7E42D58DAC7CE806A95BAF"><enum>(B)</enum><header>User-specified search</header><text display-inline="yes-display-inline">Paragraph (1) of this subsection does not apply to a provider of an interactive computer service to the extent that the recommendation was made directly in response to a user-specified search.</text></subparagraph> <subparagraph id="H59E39F4C98074310A853DB8F69BC41EF"><enum>(C)</enum><header>Internet infrastructure</header><text>Paragraph (1) of this subsection does not apply to a provider of an interactive computer service to the extent that the service, system, or access software of such provider is used by another interactive computer service for the management, control, or operation of such other interactive computer service, including for—</text>
<clause id="HB884247935D5439689F594CA39636D09"><enum>(i)</enum><text>web hosting;</text></clause> <clause id="H20BAE53179B4467084B9795AFED432C3"><enum>(ii)</enum><text>domain registration;</text></clause>
<clause id="H6FC0AFD416EF4B1A98C4FFF83A126858"><enum>(iii)</enum><text>content delivery networks;</text></clause> <clause id="HC01A1662D4CD41EFAFF93E0B0E42A70C"><enum>(iv)</enum><text>caching;</text></clause>
<clause id="H9FB14EE856174C0BA6335110FDC4759F"><enum>(v)</enum><text>data storage; and</text></clause> <clause id="HE9F54FEEEBDE4815AA63FDE4E624AAE4"><enum>(vi)</enum><text>cybersecurity.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph>
<paragraph id="HC6A49E2B481E4493AA136C6236BC8742"><enum>(3)</enum><text>in subsection (g) (as so redesignated), by adding at the end the following:</text> <quoted-block id="H85B490C0F5F6430BBD93ABE47B37DC08" style="OLC"> <paragraph id="HF81D7F68258648A6BDDE378FD6DA7E8A" commented="no"><enum>(5)</enum><header>Personalized recommendation</header><text>The term <quote>personalized recommendation</quote> means, with respect to information, the material enhancement, using a personalized algorithm, of the prominence of such information with respect to other information.</text></paragraph>
<paragraph id="H55DE80DFBD854D3CBA1836CB809E5D71" commented="no"><enum>(6)</enum><header>Personalized algorithm</header><text>The term <quote>personalized algorithm</quote> means an algorithm that relies on information specific to an individual.</text></paragraph> <paragraph id="H8BB475587AAB4FB1B1A79637A11F2A8F" commented="no"><enum>(7)</enum><header>Algorithm</header><text display-inline="yes-display-inline">The term <term>algorithm</term> means any computational process, model, or other automated means of processing to rank, order, promote, recommend, amplify, or similarly alter the delivery or display of information (including any text, image, audio, or video post and any page, group, account, channel, or affiliation).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="H01BABAE72DC04CF498E13CA234E1A41D"><enum>(b)</enum><header>Conforming amendment</header><text>Section 223(h)(2) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/223">47 U.S.C. 223(h)(2)</external-xref>) is amended by striking <quote>section 230(f)(2)</quote> and inserting <quote>section 230(g)(2)</quote>.</text></subsection> <subsection id="H3D222631B97742F4BE3DFC263EF4E6CE"><enum>(c)</enum><header>Applicability</header><text>The amendments made by this section shall apply with respect to recommendations made after the date that is 180 days after the date of the enactment of this Act.</text></subsection></section>
