which was referred to the <committee-name committee-id="HAG00">Committee on Agriculture</committee-name>, and in addition to the Committee on <committee-name committee-id="HED00">Education and Labor</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Food and Nutrition Act of 2008 to expand the eligibility of students to participate in the supplemental nutrition assistance program, and for other purposes.</official-title></form><legis-body id="id891AB479515E4150985450CF3E5192D3" style="OLC"><section id="id6315001616C74656A3040EB7B34B8D39" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>College Student Hunger Act of 2021</short-title></quote>.</text></section><section commented="no" id="id85CAD81B71284022A502FEF8F29BB967" section-type="subsequent-section"><enum>2.</enum><header>Eligibility of students to participate in the supplemental nutrition assistance program</header><subsection commented="no" display-inline="no-display-inline" id="id6DE68F921EAB44418751A9DB5E85640F"><enum>(a)</enum><header display-inline="yes-display-inline">Definition of household</header><text display-inline="yes-display-inline">Section 3(m) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2012">7 U.S.C. 2012(m)</external-xref>) is amended—</text><paragraph commented="no" display-inline="no-display-inline" id="id74093312BE3045BBB06B7072B01B534B"><enum>(1)</enum><text>in paragraph (4), by inserting <quote>, except with respect to the individuals described in paragraph (5)(F),</quote> before <quote>constitute</quote>; and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAB098C35B1F84ADDB03DF25C2F8FAF7C"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (5), by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="idC6DB56579CBF48FDB570DEF965DDFDD9" style="OLC"><subparagraph commented="no" display-inline="no-display-inline" id="id4EB7A6140CFC48E3A8A6D3DA6A8AF7F0"><enum>(F)</enum><text display-inline="yes-display-inline">Students that are enrolled in and are residents of an institution of higher education (as defined in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>)) and are eligible to participate in the supplemental nutrition assistance program under paragraphs (1) through (11) of section 6(e).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection commented="no" id="id637DACFDF0FE4E209F35356D169B9A9F"><enum>(b)</enum><header>Eligibility of students</header><text display-inline="yes-display-inline">Section 6(e) of the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2015">7 U.S.C. 2015(e)</external-xref>) is amended—</text><paragraph commented="no" id="id4945229DD0EC46B58872CC064DC453C5"><enum>(1)</enum><text>in paragraph (4), by striking <quote>20</quote> and inserting <quote>10</quote>;</text></paragraph><paragraph commented="no" id="id2E6AB801A9A847C4A626A910B2DFC767"><enum>(2)</enum><text>in paragraph (7), by striking <quote>or</quote> at the end;</text></paragraph><paragraph commented="no" id="idF402E1B1DE0242B59113D7B5F817F343"><enum>(3)</enum><text>in paragraph (8), by striking the period at the end and inserting a semicolon; and</text></paragraph><paragraph commented="no" id="id2F7D5EB8E3F244D98F7E66FF9CF2E1AC"><enum>(4)</enum><text>by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id4E82BC320A68464BAFE8C757404C6322" style="OLC"><paragraph commented="no" id="id91AB0FACFEBA4A80BCE73D3CA15F54E0"><enum>(9)</enum><text>is eligible for a Federal Pell Grant under section 401 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref>);</text></paragraph><paragraph commented="no" id="idFAA1C0D161A04155A5374C2A657973BC"><enum>(10)</enum><text display-inline="yes-display-inline">has an expected family contribution equal to zero, as determined by the procedures established in part F of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087kk">20 U.S.C. 1087kk et seq.</external-xref>); or</text></paragraph><paragraph commented="no" id="idBD100494689E443F8D2F27EBF879996F"><enum>(11)</enum><text display-inline="yes-display-inline">is independent (as the term is defined under subparagraph (B), (C), (D), (G), or (H) of section 480(d)(1) of the Higher Education Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv(d)(1)</external-xref>)).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="id91CB64E0F7BE47AA95DBE1A80E5B99E0" section-type="subsequent-section"><enum>3.</enum><header>Eligibility notification for students</header><text display-inline="no-display-inline">Not later than 1 year after the effective date under section 7, the Secretary of Education, in consultation with the Secretary of Agriculture, shall—</text><paragraph commented="no" id="id97157C2CC1C343F18AB2D173B52EBF34"><enum>(1)</enum><text display-inline="yes-display-inline">notify each student who completes the Free Application for Federal Student Aid and is eligible for a Federal Pell Grant under section 401 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref>) or has an expected family contribution equal to zero, as determined by the procedures established in part F of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087kk">20 U.S.C. 1087kk et seq.</external-xref>), that the student may be eligible for the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>); and</text></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id17029039EC124DDC9D65ACA43D05B4B9"><enum>(2)</enum><text display-inline="yes-display-inline">direct each student notified under paragraph (1) to the appropriate State resource to apply for benefits under that program.</text></paragraph></section><section id="id87FC0553968E421586227D31F8BACD93"><enum>4.</enum><header>Communication of information on student eligibility for the supplemental nutrition assistance program</header><subsection id="idEF51B81414724358A6D54FC7E804F17B"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="id86196F1E420E4DE5ABFFBDF2D538B291"><enum>(1)</enum><header>College student</header><text>The term <quote>college student</quote> means a student enrolled in an institution of higher education.</text></paragraph><paragraph id="idAEEAE7DFD6894C04ADDB20C0A28A448F"><enum>(2)</enum><header>Inspector General</header><text>The term <quote>Inspector General</quote> means the Inspector General of the Department of Agriculture.</text></paragraph><paragraph id="idECF307959FCA4C9D8F22D09F6E5BFB9E"><enum>(3)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote> has the meaning given the term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph><paragraph id="id2BB4FD3CBD76416B810998499805F0FE"><enum>(4)</enum><header>Program</header><text>The term <quote>program</quote> means the supplemental nutrition assistance program established under the Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>).</text></paragraph><paragraph id="idF948E0E0595A4DFCAEE270CEA3175E6D"><enum>(5)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of Agriculture.</text></paragraph></subsection><subsection id="id3463B63419E9405481F34E887D250A4E"><enum>(b)</enum><header>Audit</header><paragraph id="id1D253B5E7ACA412DBFE4F5139C1A3691"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 90 days after the effective date under section 7, the Inspector General shall conduct an audit of the operations of the Food and Nutrition Service to examine the procedures and outreach practices used by the Food and Nutrition Service to provide to State agencies information about the eligibility of students at institutions of higher education for participation in the program.</text></paragraph><paragraph id="id6B7174BC351A4F4589829F49CBD7A7AE"><enum>(2)</enum><header>Report to Congress</header><text>Not later than 90 days after completing the audit under paragraph (1), the Inspector General shall submit to Congress a report describing the results of the audit.</text></paragraph></subsection><subsection id="id1CCE2E6D9EFA4D759F2F0A542CEF0C24"><enum>(c)</enum><header>Strategies report</header><text display-inline="yes-display-inline">Not later than 90 days after the Inspector General submits to Congress a report under subsection (b)(2), the Secretary shall submit to Congress a report that describes the strategy to be used by the Food and Nutrition Service—</text><paragraph id="id0C6DCEE5E2774CCA9F4616E55F9781F6"><enum>(1)</enum><text>to increase the awareness of State agencies and institutions of higher education about—</text><subparagraph id="idE4E8E74F44294BC292DA8F8075E7CA5F"><enum>(A)</enum><text>college student hunger;</text></subparagraph><subparagraph id="idE4BAE207DEC34269A1BD8DD312E17954"><enum>(B)</enum><text>the eligibility of college students for the program; and</text></subparagraph><subparagraph id="id5FD11D5BB84C470996DC760487323DDE"><enum>(C)</enum><text>the procedures and resources available to college students who are participating in the program to access benefits under the program;</text></subparagraph></paragraph><paragraph id="idDBF7C690114B4F36A35C4A67E423FC1E"><enum>(2)</enum><text>to identify existing or potential barriers and mitigation strategies with respect to those barriers; and</text></paragraph><paragraph id="idBE10A9DD2432482F96F7872E1B774506"><enum>(3)</enum><text>to update the strategic communications plan under subsection (d).</text></paragraph></subsection><subsection id="id910D65AAE77B4221800793AE01C31593"><enum>(d)</enum><header>Updated State Outreach Plan Guidance</header><text>Not later than 90 days after the Inspector General submits to Congress a report under subsection (b)(2), the Secretary shall publish an updated State Outreach Plan Guidance that—</text><paragraph id="id6CB2EF734F6C47E0A71B446CA215A6F7"><enum>(1)</enum><text>describes existing data on college student hunger;</text></paragraph><paragraph id="id9F040076235640B4B51EB8DF2446C2EC"><enum>(2)</enum><text>describes the manner in which college students can access the supplemental nutrition assistance program;</text></paragraph><paragraph id="id9950C3AA0B424881AD0BFDB54F3B06EE"><enum>(3)</enum><text>recommends outreach activities to address college student hunger and encourages States to conduct those and other outreach activities;</text></paragraph><paragraph id="idB9E9743F19D44167B62409038B29C90E"><enum>(4)</enum><text>provides a template for a State to submit information to the Secretary describing the outreach activities being carried out by the State to address college student hunger; and</text></paragraph><paragraph id="idD6ACA27D094F44B78A5132D120D3331D"><enum>(5)</enum><text>contains updated guidance based on the results of the audit conducted under subsection (b)(1) and the contents of the report submitted under subsection (c).</text></paragraph></subsection></section><section commented="no" id="id8BC2DDF5B8D44E9D855792ECE0856A4E"><enum>5.</enum><header>Demonstration pilot program</header><text display-inline="no-display-inline">The Food and Nutrition Act of 2008 (<external-xref legal-doc="usc" parsable-cite="usc/7/2011">7 U.S.C. 2011 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="id4D31D4A6F4CF490BB0BC7DFDF656EAA3" style="OLC"><section commented="no" id="id617EEBFF4FE342F0BD46E51FC0001A04"><enum>31.</enum><header>College student hunger pilot program</header><subsection commented="no" id="id6A6F2671BF28432683E4208D3417C0A1"><enum>(a)</enum><header>Definitions</header><text>In this section:</text><paragraph commented="no" id="id427D3974918F4AF6A583974F68D47418"><enum>(1)</enum><header>College student</header><text>The term <quote>college student</quote> means a student enrolled in an institution of higher education.</text></paragraph><paragraph commented="no" id="idA7C27D3C871D480CB2A24EAB47AAB0C7"><enum>(2)</enum><header>Institution of higher education</header><text>The term <quote>institution of higher education</quote> has the meaning given the term in section 102 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1002">20 U.S.C. 1002</external-xref>).</text></paragraph><paragraph commented="no" id="idB387619D8FE04D87A62742EFED30ECE4"><enum>(3)</enum><header>Pilot program</header><text>The term <quote>pilot program</quote> means the pilot program established under subsection (b).</text></paragraph></subsection><subsection commented="no" id="id1B3DA2E0E1864CA3B96EF10201BEB711"><enum>(b)</enum><header>Pilot program</header><text display-inline="yes-display-inline">The Secretary, in collaboration with the Secretary of Education, shall establish a pilot program under which the Secretary shall carry out demonstration projects in accordance with subsection (c)—</text><paragraph commented="no" id="idCE74E1F2D7364C6893E943618C368EA5"><enum>(1)</enum><text display-inline="yes-display-inline">to decrease student hunger at institutions of higher education; and</text></paragraph><paragraph commented="no" id="id42D0E350AB7B4AFBB0B0AB7F70DA0566"><enum>(2)</enum><text display-inline="yes-display-inline">to reduce barriers to college students fully utilizing supplemental nutrition assistance program benefits at institutions of higher education.</text></paragraph></subsection><subsection id="id4862972D6FD5494E857E1670290A85AA"><enum>(c)</enum><header>Demonstration projects</header><text>To carry out the pilot program, the Secretary shall carry out demonstration projects that test the following new supplemental nutrition assistance program delivery methods:</text><paragraph id="id0845B8A13FB242A6992DA30D470FA843"><enum>(1)</enum><text>Allowing a college student receiving supplemental nutrition assistance program benefits to use those benefits or the cash value of those benefits—</text><subparagraph id="idE3A5DD1D57E24542993185534FC153E9"><enum>(A)</enum><text>to purchase prepared foods from a campus dining hall, on-campus store, or other on-campus merchant or provider that typically sells prepared meals and is affiliated with the institution of higher education at which the student is enrolled; and</text></subparagraph><subparagraph id="id4CD9DECEA8FD4A5F9695286F5DB9EB16"><enum>(B)</enum><text>to pay the institution of higher education the cost of an on-campus college meal plan, in whole or in part.</text></subparagraph></paragraph><paragraph id="idBDDD3DE8A80347BAA7F019C9502D4B05"><enum>(2)</enum><text>Allowing a college student to use an EBT card or a campus-specific card at any of the locations described in paragraph (1)(A).</text></paragraph></subsection><subsection id="id7A4AB1696E7E48A38A4A8489D7C7A159"><enum>(d)</enum><header>Project limit</header><paragraph id="id7B7DBECBF805455C8EE1B9AAD3DE6DC6"><enum>(1)</enum><header>In general</header><text>The Secretary shall carry out not more than 10 demonstration projects under the pilot program simultaneously.</text></paragraph><paragraph id="idF6415942F58144F49F1F579B78A4EEEA"><enum>(2)</enum><header>Institutions</header><text>The Secretary shall carry out not more than 1 demonstration project under the pilot program at any single institution of higher education.</text></paragraph></subsection><subsection id="id6F6113F34D5E47D8AA3683538995799C"><enum>(e)</enum><header>Project administration</header><text>The Secretary shall establish criteria and parameters for selecting, operating, monitoring, and terminating each demonstration project under the pilot program.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="idA21DC398ED9B456EB50026345E7759E3"><enum>(f)</enum><header>Project termination</header><text display-inline="yes-display-inline">To the maximum extent practicable, the Secretary shall ensure that the termination of a demonstration project under the pilot program shall not cause sudden adverse changes or the elimination of benefits under the supplemental nutrition assistance program for students participating in the demonstration project.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id12AE4E4E72DA498A927CD661ABE8F93F"><enum>(g)</enum><header display-inline="yes-display-inline">Program termination</header><text display-inline="yes-display-inline">The pilot program shall terminate on the date that is 10 years after the date on which the pilot program is established.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="id5146320543B647698991138242BFC974"><enum>(h)</enum><header>Evaluation</header><text>For the duration of the pilot program, the Secretary shall, in collaboration with the Under Secretary for Research, Education, and Economics and the Director of the Institute of Education Sciences, conduct an annual evaluation of each demonstration project carried out under the pilot program during the year covered by the evaluation, including an analysis of the extent to which the project is meeting the desired outcomes.</text></subsection><subsection id="id2772838134DA48B99CF3601996CB8B3A"><enum>(i)</enum><header>Report</header><text>For the duration of the pilot program, the Secretary shall submit to the Committees on Agriculture, Nutrition, and Forestry and Health, Education, Labor, and Pensions of the Senate and the Committees on Agriculture and Education and Labor of the House of Representatives an annual report that includes—</text><paragraph id="idCD7FBFDB050941E1AB6F8CC69D2D449E"><enum>(1)</enum><text>a description of each demonstration project carried out under the pilot program during the year covered by the report;</text></paragraph><paragraph id="id80A76EAC76E3466B836CF218611E4E0B"><enum>(2)</enum><text>the evaluation conducted under subsection (h); and</text></paragraph><paragraph id="id50919AC3B6FE4B55BAD24BB65BF08759"><enum>(3)</enum><text>recommendations for legislation to improve the supplemental nutrition assistance program to better serve college students.</text></paragraph></subsection><subsection commented="no" id="id338EC121A241413488E5ACE53A052C7D"><enum>(j)</enum><header>Waiver and modification authority</header><paragraph commented="no" id="id50866F7BB08D4174B5975626E5D84618"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), the Secretary may, as may be necessary solely to carry out the pilot program—</text><subparagraph commented="no" id="idA9E3BE589EAE4266925C7D088ADF4C15"><enum>(A)</enum><text>waive any provision under this Act, including—</text><clause commented="no" display-inline="no-display-inline" id="id1BA342599C8F40289D187FB75A478357"><enum>(i)</enum><text display-inline="yes-display-inline">the requirement relating to local sales tax under section 4(a);</text></clause><clause commented="no" display-inline="no-display-inline" id="idEE3C11E7C6694283B8299409EB6F80D7"><enum>(ii)</enum><text display-inline="yes-display-inline">requirements relating to the issuance and use of supplemental nutrition assistance program benefits under section 7; and</text></clause><clause commented="no" id="id644C63931729421CB319C95E4DC81F5C"><enum>(iii)</enum><text>requirements for approval of retail food stores under section 9; and</text></clause></subparagraph><subparagraph commented="no" id="id4A02F02810C143BAA7C1DF8102DF1357"><enum>(B)</enum><text>modify the definitions under this Act for the purposes of the pilot program, including the definition of—</text><clause commented="no" id="id171A06754E284CA48C5410A5D5CB28BF"><enum>(i)</enum><text>the term <quote>food</quote> under section 3(k);</text></clause><clause commented="no" id="id34E8CCC96775461F95C0297344E17BE2"><enum>(ii)</enum><text>the term <quote>household</quote> under section 3(m); and</text></clause><clause commented="no" id="id80D9F411C5B64789B87A45E92BA9549A"><enum>(iii)</enum><text>the term <quote>retail food store</quote> under section 3(o).</text></clause></subparagraph></paragraph><paragraph commented="no" id="id1841468356654FC6A957CA6B276EC24D"><enum>(2)</enum><header>Limitation</header><text>The Secretary may not waive a provision or modify a definition under paragraph (1) if the waiver or modification will—</text><subparagraph commented="no" id="idFE241A417E9E4C559B7C193820F3E844"><enum>(A)</enum><text>cause increased difficulty for any household to apply for or access supplemental nutrition assistance program benefits; or</text></subparagraph><subparagraph commented="no" id="id9AE07E6E1A264CEDA558ED11C6C2DD3E"><enum>(B)</enum><text>reduce the value of those benefits for any household.</text></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id93E23AC2CE084D3F834DBC414EC54F59"><enum>(k)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to the Secretary such sums as are necessary to carry out this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="idBCB119526BC3477582C716974C1C1FFD"><enum>6.</enum><header>Effective date</header><text display-inline="no-display-inline">This Act and the amendments made by this Act shall take effect on the first day of the fiscal year that begins after the date of enactment of this Act.</text></section></legis-body></bill>
