which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require reporting of bullying to appropriate authorities and assist with equal protection claims against entities who fail to respond appropriately to bullying, and for other purposes.</official-title></form><legis-body id="H8ADF060E03D349BEB0947C0CFCAD6992" style="OLC"><section id="HCF6B1CE9FDA84A288316C837636F2133" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Bullying Redress And Verified Enforcement Act</short-title></quote> or the <quote><short-title>BRAVE Act</short-title></quote>.</text></section><section id="HED992CF8DA3944A991542CDF42C52244"><enum>2.</enum><header>Reporting requirements</header><text display-inline="no-display-inline">Part F of title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7881">20 U.S.C. 7881 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="H45C2393AE46A4AEBA97875DB68CFB26C" style="OLC"><subpart id="H7418406460EA45EABA84EFC8A76635E5"><enum>6</enum><header>Bullying</header><section id="HA462975FA52E4367AA8C4CB83C313C69"><enum>8581.</enum><header>Official Reporting Requirements</header><subsection id="HD9761E93651146429C885F37685940D3"><enum>(a)</enum><header>Report of bullying</header><paragraph id="H76E1D73C352A4A7BB6072933009309C8"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), a local educational agency shall require an employee of the local educational agency who becomes aware of bullying to report to the individual designated under subsection (b) by not later than 7 business days after becoming aware of such bullying a description of—</text><subparagraph display-inline="no-display-inline" id="H2DC228E0D4C54DCFA5D78B3AAAB8047E"><enum>(A)</enum><text>the acts that constituted bullying;</text></subparagraph><subparagraph id="H5E46A556A73F4D2DA4076C2B6715C45E"><enum>(B)</enum><text>if the bullying included a reference to or was motivated by an actual or perceived protected characteristic of the victim, such protected characteristic; and</text></subparagraph><subparagraph id="H0BCC177842AA49AE8425E7E412D00331"><enum>(C)</enum><text>the response to such bullying by employees of the local educational agency.</text></subparagraph></paragraph><paragraph id="H77C82B42388649F29D6A2B94860CF6B1"><enum>(2)</enum><header>Exception</header><text>Notwithstanding paragraph (1), in the case of an employee of a local educational agency who is informed of bullying by a student attending a school served by the local educational agency, but the student requests that such bullying not be reported by the employee, the employee shall not be required to report such bullying under paragraph (1).</text></paragraph></subsection><subsection id="H2AC1D080D3AD42099FE26812019A1D11"><enum>(b)</enum><header>Receipt of reports</header><text display-inline="yes-display-inline">A local educational agency shall designate an individual to receive and keep a record of reports of bullying and shall inform each employee of the local educational agency of the contact information of the individual so designated.</text></subsection><subsection id="HBCA216EE919A4D6CA3160156A1891524"><enum>(c)</enum><header>Reporting to the local educational agency</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the receipt of a report under subsection (a)(1), the individual designated under subsection (b) shall inform all employees of the local educational agency of the acts described and the response by employees of the local educational agency and shall exclude any personally identifiable information of any student involved.</text></subsection><subsection id="HE144884143C345D08CF53D1D77553535"><enum>(d)</enum><header>Publicly available quarterly reports</header><paragraph id="H73A0963F47DB4C8598C9C58CD9B371D9"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (1), a local educational agency shall publish and make available to all students served by the local educational agency and parents of such students a report on a quarterly basis that—</text><subparagraph id="H7819BB60A7784F9B89E96EBF0FDA5442"><enum>(A)</enum><text>lists the number of bullying reports made since the previous quarterly report; and</text></subparagraph><subparagraph id="H4990214D2FF44D3F94281AAF91C34D12"><enum>(B)</enum><text>informs the public of the right to file a complaint under section 8582(b)(2).</text></subparagraph></paragraph><paragraph id="H20C588F68C4C42C6BB913BBCFF3B6C3D"><enum>(2)</enum><header>Exception</header><text>A local educational agency shall not publish a report under paragraph (1) in a case in which such publication would reveal personally identifiable information about an individual student.</text></paragraph></subsection><subsection id="H656569655DC04D379FDF989052B0A751"><enum>(e)</enum><header>Annual policy review</header><text>Each local educational agency shall review, on an annual basis, the policies on bullying for schools served by the local educational agency.</text></subsection></section><section display-inline="no-display-inline" id="H1093AF44DB85404EA4E9F1CBB1385CA8"><enum>8582.</enum><header>Federal enforcement</header><subsection id="HD8685546C6B846C7A392A2A5DE776B6D"><enum>(a)</enum><header>Condition of Federal funding</header><text>As a condition of receiving funds under this Act, a local educational agency shall—</text><paragraph id="H5286BCDAD8F948DBBB650D3978EED1DB"><enum>(1)</enum><text>annually certify to the Secretary in writing that such local educational agency has complied with this section; and</text></paragraph><paragraph id="HA9423FE2299244C2BC39211B45F5409C"><enum>(2)</enum><text display-inline="yes-display-inline">together with such certification, submit the 4 most recent quarterly reports published preceding such certification pursuant to section 8581(d).</text></paragraph></subsection><subsection id="H3CEB4849722B4CB78AAEFF9386143940"><enum>(b)</enum><header>Federal receipt of complaints</header><text display-inline="yes-display-inline">The Assistant Secretary who serves as the head of the Office of Civil Rights for the Department of Education shall—</text><paragraph id="H3A03C2315A194441B7AC5B6157D3DFCA"><enum>(1)</enum><text display-inline="yes-display-inline">establish a procedure for a student of a local educational agency, a parent of such student, or another appropriate individual to submit to the Assistant Secretary a complaint relating to a failure to comply with this section; and</text></paragraph><paragraph id="H804243C79D9F4981ABB2D4EA8FC0265F"><enum>(2)</enum><text display-inline="yes-display-inline">publish such procedure on the internet website of the Department of Education.</text></paragraph></subsection><subsection id="HB81B4DFEB75343EF88EA196FBC090DAF"><enum>(c)</enum><header>Federal response to complaints</header><text>After receiving a complaint pursuant to subsection (b), the Assistant Secretary shall—</text><paragraph id="HA5B6951FB41940879B89EEE5B0468F7D"><enum>(1)</enum><text display-inline="yes-display-inline">investigate such complaint to determine if a local educational agency failed to comply with this section; and</text></paragraph><paragraph id="HE695D5CE84BC4001BAC1B1EBCCB71243"><enum>(2)</enum><text display-inline="yes-display-inline">if such local educational agency is determined under paragraph (1) to have failed to comply with this section—</text><subparagraph id="HBB5A4D15687A4DAABEF92EA31D68F786"><enum>(A)</enum><text display-inline="yes-display-inline">withhold further payment of funds under this Act to such local educational agency;</text></subparagraph><subparagraph id="H56D3C0A013B64C30B041DBE6E500EE66"><enum>(B)</enum><text>issue a complaint to compel compliance of such local educational agency through a cease and desist order; or</text></subparagraph><subparagraph id="H5AB320A9196144AF99C98A1BA80D05DC"><enum>(C)</enum><text display-inline="yes-display-inline">enter into a compliance agreement with such local educational agency to bring it into compliance with this section,</text></subparagraph><continuation-text continuation-text-level="paragraph">in the same manner as the Secretary is authorized to take such actions under sections 455, 456, and 457, respectively, of the General Education Provisions Act. </continuation-text></paragraph></subsection><subsection id="HEA54DA995A8244FE82C1590C4B4965FA"><enum>(d)</enum><header>Public availability of information about complaints</header><text>Not later than 60 days after receiving a complaint pursuant to subsection (b)(2), the Assistant Secretary shall make available on the internet website of the Department information about such complaint, which shall—</text><paragraph id="H735C5EA053A946C0B60A3FE17F797057"><enum>(1)</enum><text display-inline="yes-display-inline">if the bullying included a reference to or was motivated by an actual or perceived protected characteristic of the victim, include a description of such protected characteristic; and</text></paragraph><paragraph id="H68CE98591AC84F8790A9EE7E6D8FDC93"><enum>(2)</enum><text display-inline="yes-display-inline">exclude any personally identifiable information of any student involved.</text></paragraph></subsection></section><section id="H074DAE5E5638423A88094BAF969C44E2"><enum>8583.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subpart:</text><paragraph id="H05A9F6A17E034F86B013D813FD8B7124"><enum>(1)</enum><header>Bullying</header><text display-inline="yes-display-inline">The term <term>bullying</term> means any severe, pervasive, or persistent electronic, written, verbal, or physical act by one student or a group of students toward another student during school hours and on school premises, or at a school-sponsored activity outside of school hours, that causes—</text><subparagraph id="H4DC2461550294239B719BEB370FC63B5"><enum>(A)</enum><text>harm to or reasonable concern for the person, property, or mental health of such other student; or</text></subparagraph><subparagraph id="HEEAB542D8C0D42268956539CC3576686"><enum>(B)</enum><text display-inline="yes-display-inline">such other student to withdraw from or avoid benefitting from the services, activities, or opportunities offered by the school.</text></subparagraph></paragraph><paragraph id="HAAF5524267604D5BA7FB434F8C7864FE"><enum>(2)</enum><header>Protected characteristic</header><text>The term <term>protected characteristic</term> includes race, color, sex, religion, national origin, disability, gender, gender identity, and sexual orientation.</text></paragraph></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H04735FE7ECE841E08992CA50BD98CF51"><enum>3.</enum><header>Table of contents</header><text display-inline="no-display-inline">The table of contents for the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/6301">20 U.S.C. 6301 et seq.</external-xref>) is amended by inserting after the item relating to section 8574, the following:</text><quoted-block display-inline="no-display-inline" id="H930A73E4DA594315BD073688D35375E9" style="OLC"><toc regeneration="no-regeneration"><toc-entry level="subpart">Subpart 6—Bullying</toc-entry><toc-entry level="section">Sec. 8581. Official reporting requirements. </toc-entry><toc-entry level="section">Sec. 8582. Federal enforcement. </toc-entry><toc-entry level="section">Sec. 8583. Definitions.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
