R. 5569</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211012">October 12, 2021</action-date><action-desc><sponsor name-id="N000147">Ms. Norton</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HGO00">Committee on Oversight and Reform</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the REAL ID Act of 2005 to allow States to determine whether to require licenses and other identification to list a gender or sex, and for other purposes.</official-title></form><legis-body id="H28E7E6650B0843F69F72D880D1B84BD7" style="OLC"><section id="HC9AD1F36E54A49F8BEAA88C0F597E13E" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>REAL ID Gender Requirement Reform Act</short-title></quote>.</text></section><section id="H195B0C78639945F3AF7E621B7D020EE6"><enum>2.</enum><header>Identification requirements</header><subsection id="HDD3D3FBA311C462D9A927B3E2A16B39E"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline">Section 202(b) of the REAL ID Act of 2005 (<external-xref legal-doc="usc" parsable-cite="usc/49/30301">49 U.S.C. 30301</external-xref> note) is amended—</text><paragraph id="HD5C8D6F3F9B14ED8B98B613D81A98CC1"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (3);</text></paragraph><paragraph id="H5811253E5DB542099F2197F6F48F978E"><enum>(2)</enum><text>by redesignating paragraphs (4) through (9) as paragraphs (3) through (8), respectively; and</text></paragraph><paragraph id="H7DDFFC693C14452FA2115D9517F85DE5"><enum>(3)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HB2D856E919DD40CD9FEDD7C164AB3046" display-inline="no-display-inline"><subsection id="HA3D9F696460E427494A25BF91B7BB570"><enum>(e)</enum><header>State determination of listing gender</header><text display-inline="yes-display-inline">A State may determine whether to include a gender or sex field required for a driver’s license and identification card issued to a person by the State. If a State includes any such gender or sex identification, a person shall indicate the appropriate designation without any additional documentation requirement (such as a doctor’s note) and the State shall include a neutral or other designation in the gender or sex field in addition to male or female. </text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H5D52E5F56FCD48ECA882CEA74E4B839D"><enum>(b)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">Section 508(a)(1) of the Court Security Improvement Act of 2007 (<external-xref legal-doc="usc" parsable-cite="usc/49/30301">49 U.S.C. 30301</external-xref> note) is amended by striking <quote>section 202(b)(6)</quote> and inserting <quote>section 202(b)(5)</quote>.</text></subsection></section></legis-body></bill>
