which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To require the Secretary of Energy to carry out a Clean Cities Coalition Program, and for other purposes.</official-title></form><legis-body id="H26C1ACDFB489405A9DA8AF2E0953AA63" style="OLC"><section id="HE23DEB9C440C45EDAB14DF19A9C52F22" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Cities Act</short-title></quote>.</text></section><section id="HD5BA9B0A736E487E958D97CC5D580584" section-type="subsequent-section"><enum>2.</enum><header>Clean Cities Coalition Program</header><subsection id="H7F25A42ABDAA4CE09C5899438726FEF4"><enum>(a)</enum><header>In general</header><text>The Secretary shall carry out a program to be known as the Clean Cities Coalition Program.</text></subsection><subsection id="H43574CAD26ED4FD791E3DBE84A681602"><enum>(b)</enum><header>Program elements</header><text>In carrying out the program under subsection (a), the Secretary shall—</text><paragraph id="HE663B79430A143C5A30D691E6D1D4E6D"><enum>(1)</enum><text>establish criteria for designating local and regional Clean Cities Coalitions, including criteria that ensure that activities of Clean Cities Coalitions benefit all communities, including rural communities and environmental justice communities;</text></paragraph><paragraph id="HA7DA3B3ECE0D489EBD7570844ECB5A73"><enum>(2)</enum><text>designate local and regional Clean Cities Coalitions that the Secretary determines meet the criteria established under paragraph (1);</text></paragraph><paragraph id="HD8023635995C431A8C490419280A9EF2"><enum>(3)</enum><text>ensure that there are active Clean Cities Coalitions working in all 50 States, the District of Columbia, and the territories;</text></paragraph><paragraph id="H7AA4BD581F4A40AA8337009DF4F91AB0"><enum>(4)</enum><text>make awards to each designated Clean Cities Coalition for administrative and program expenses of the coalition;</text></paragraph><paragraph id="HFE52483E6177473FAA96C457FD2FFA1E"><enum>(5)</enum><text>make competitive awards to designated Clean Cities Coalitions for projects and activities described in subsection (c);</text></paragraph><paragraph id="H592A7C4710B64FFFAA32CAB69A05092F"><enum>(6)</enum><text>make competitive awards to non-profit organizations to provide technical assistance, training, and organizational support to designated Clean Cities Coalitions;</text></paragraph><paragraph id="HE56E52330C464E6DA00106D9B246BD24"><enum>(7)</enum><text>provide opportunities for communication and sharing of best practices among designated Clean Cities Coalitions; and</text></paragraph><paragraph id="HB7D5162056A048E1949FED948BD06095"><enum>(8)</enum><text>maintain, and make available to the public, a centralized database of information included in the reports submitted under subsection (d).</text></paragraph></subsection><subsection id="H641BFD170AA34645A7DC30B9A18AAFC2"><enum>(c)</enum><header>Competitive awards</header><paragraph id="HD0911F21C0FD44DCAC028BC8C9A6E461"><enum>(1)</enum><header>Projects and activities</header><text>Projects and activities eligible for awards under subsection (b)(5) are projects and activities that reduce petroleum consumption, improve air quality, promote energy and economic security, and encourage deployment of a diverse, domestic supply of alternative fuels in the transportation sector by—</text><subparagraph id="H3079F793A3414FC498E9E57DB41EFB53"><enum>(A)</enum><text>encouraging the purchase and use of alternative fuel vehicles and alternative fuels, including by fleet managers;</text></subparagraph><subparagraph id="H5E16D3C716CF4D27BE309ACBB336C7F0"><enum>(B)</enum><text>expediting the establishment of local, regional, and national infrastructure to fuel alternative fuel vehicles;</text></subparagraph><subparagraph id="H65EEC6B1C4DF44A59C9A7BDB953CCB45"><enum>(C)</enum><text>advancing the use of other petroleum fuel reduction technologies and strategies;</text></subparagraph><subparagraph id="H893634D9AB4443C9B51C11B113C865FA"><enum>(D)</enum><text>conducting outreach and education activities to advance the use of alternative fuels and alternative fuel vehicles;</text></subparagraph><subparagraph id="HBC6145E213AE45E19A6AC207A2B9519C"><enum>(E)</enum><text>providing training and technical assistance and tools to users that adopt petroleum fuel reduction technologies; or</text></subparagraph><subparagraph id="HB0A393D102F342B7B310D785DEAD6333"><enum>(F)</enum><text>collaborating with and training officials and first responders with responsibility for permitting and enforcing fire, building, and other safety codes related to the deployment and use of alternative fuels or alternative fuel vehicles.</text></subparagraph></paragraph><paragraph id="HE6A72EA912AA406BAD197FA77B458270" commented="no"><enum>(2)</enum><header>Cost share</header><text display-inline="yes-display-inline">The Federal share of the cost of a project or activity for which an award is made under subsection (b)(5) shall be not less than 80 percent.</text></paragraph></subsection><subsection id="H145E5270A7D046A99D6ADB9449EDE720"><enum>(d)</enum><header>Annual report</header><text>Each designated Clean Cities Coalition shall submit an annual report to the Secretary on the activities and accomplishments of the coalition.</text></subsection><subsection id="HAA59D12C5F1E474A8C3B7402D07116E9"><enum>(e)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H164DD7A35E8045FA9D207DA0D880341C"><enum>(1)</enum><header>Alternative fuel</header><text>The term <term>alternative fuel</term> has the meaning given such term in section 32901 of title 49, United States Code.</text></paragraph><paragraph id="HC94E8FEA36A44A1E96C38F49208A6355"><enum>(2)</enum><header>Alternative fuel vehicle</header><text>The term <term>alternative fuel vehicle</term> means any vehicle that is capable of operating, partially or exclusively, on an alternative fuel.</text></paragraph><paragraph id="HE67C71E195B34EE88C838B30BA700343" commented="no"><enum>(3)</enum><header>Community of color</header><text>The term <term>community of color</term> means any geographically distinct area the population of color of which is higher than the average population of color of the State in which the community is located.</text></paragraph><paragraph id="H609045C73AB84F89B303A44D90D2D749" commented="no"><enum>(4)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means any population of color, community of color, indigenous community, or low-income community that experiences a disproportionate burden of the negative human health and environmental impacts of pollution or other environmental hazards.</text></paragraph><paragraph id="H98DE20C25492432494701C93D650BAEB" commented="no"><enum>(5)</enum><header>Indigenous community</header><text>The term <term>indigenous community</term> means—</text><subparagraph id="HE2A7236F8E454AB0B7724B0569FCAE30" commented="no"><enum>(A)</enum><text>a federally recognized Indian Tribe;</text></subparagraph><subparagraph id="HFB74E13089E942D78FDF3E1D981C1D08" commented="no"><enum>(B)</enum><text>a State-recognized Indian Tribe;</text></subparagraph><subparagraph id="H5C55FB582AE8489FA03BC9735A47B5B9" commented="no"><enum>(C)</enum><text>an Alaska Native or Native Hawaiian community or organization; and</text></subparagraph><subparagraph id="H3423163905494FF7ADF6FE748319E90A" commented="no"><enum>(D)</enum><text>any other community of indigenous people, including communities in other countries.</text></subparagraph></paragraph><paragraph id="H8EF425EC44C642AE9A33566E5844F0DC" commented="no"><enum>(6)</enum><header>Low income</header><text>The term <term>low income</term> means an annual household income equal to, or less than, the greater of—</text><subparagraph id="H2C37EDFE0B944E6A826DD343BB1B20F4" commented="no"><enum>(A)</enum><text>an amount equal to 80 percent of the median income of the area in which the household is located, as reported by the Department of Housing and Urban Development; and</text></subparagraph><subparagraph id="HD7F1D563C2814324AA1AFD214F39639D" commented="no"><enum>(B)</enum><text>200 percent of the Federal poverty line.</text></subparagraph></paragraph><paragraph id="HDE0A08869CAF48CFB45BE0F5467C986A" commented="no"><enum>(7)</enum><header>Low-income community</header><text>The term <term>low-income community</term> means any census block group in which 30 percent or more of the population are individuals with low income.</text></paragraph><paragraph id="HC203EBD4FFB3444FAD2530AD063435C8" commented="no"><enum>(8)</enum><header>Population of color</header><text>The term <term>population of color</term> means a population of individuals who identify as—</text><subparagraph id="H3511FCF786CB4171A0F02779C4ED6F13" commented="no"><enum>(A)</enum><text>Black;</text></subparagraph><subparagraph id="HD23BF5BF8BFA46D39785939FB49DA336" commented="no"><enum>(B)</enum><text>African American;</text></subparagraph><subparagraph id="HE6E7D8F290954F4588BA1880219E75AB" commented="no"><enum>(C)</enum><text>Asian;</text></subparagraph><subparagraph id="HFC9DF0089A3C4E339907CEC2F71B14F1" commented="no"><enum>(D)</enum><text>Pacific Islander;</text></subparagraph><subparagraph id="H423987AB862648A1A82F4ACDD48FEBA6" commented="no"><enum>(E)</enum><text>another non-White race;</text></subparagraph><subparagraph id="H607AFF6083604CB5B67087D7FE0FE7C7" commented="no"><enum>(F)</enum><text>Hispanic;</text></subparagraph><subparagraph id="H9611E2185C5D4EA88DF96C92D6CE8769" commented="no"><enum>(G)</enum><text>Latino; or</text></subparagraph><subparagraph id="H48EA96DCC5834C87A9F7867A24FE027A" commented="no"><enum>(H)</enum><text>linguistically isolated.</text></subparagraph></paragraph><paragraph id="HF2E4C45D5DDA40768FB0BA604300415A"><enum>(9)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Energy.</text></paragraph></subsection><subsection id="H6FD76059581E4872AF410A7F7FD92E1F"><enum>(f)</enum><header>Funding</header><paragraph id="H68679E2571E749CE847FD1FD1AA66C73"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $200,000,000 for each of fiscal years 2022 through 2031, to remain available until expended.</text></paragraph><paragraph id="H5625C0A474F944AB86E3FD1FF736683C"><enum>(2)</enum><header>Allocations</header><text>The Secretary shall allocate funds made available to carry out this section in each fiscal year as follows:</text><subparagraph id="H0A1CDDB785C94975820EDC38AFE36758"><enum>(A)</enum><text>35 percent of such funds shall be distributed as awards under subsection (b)(4).</text></subparagraph><subparagraph id="H1F90605E6056471A8735634A00975E25"><enum>(B)</enum><text>50 percent of such funds shall be distributed as competitive awards under subsection (b)(5), of which not less than 40 percent shall be used to support activities that directly benefit rural communities or environmental justice communities.</text></subparagraph><subparagraph id="HBC842A6134AC440F984EC72B28B29ED9"><enum>(C)</enum><text display-inline="yes-display-inline">5 percent of such funds shall be distributed as competitive awards under subsection (b)(6).</text></subparagraph></paragraph></subsection></section></legis-body></bill>
