R. 5563</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211012">October 12, 2021</action-date><action-desc><sponsor name-id="L000566">Mr. Latta</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HWM00">Committee on Ways and Means</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Internal Revenue Code of 1986 to allow individuals only enrolled in Medicare Part A to contribute to health savings accounts.</official-title></form><legis-body id="H43855DDD2F0C475786D02581F9563195" style="OLC"><section id="H544FF275159642EB97CCDB62BE3B32DF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stop Penalizing Working Seniors Act</short-title></quote>.</text></section><section id="HE785E1C084AE4116BCDFD6FF569F28AC" section-type="subsequent-section"><enum>2.</enum><header>Individuals over age 65 enrolled only in Medicare Part A allowed to contribute to health savings accounts</header><subsection id="H790758457C5B495AA47ECA7E2532DC96"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/223">Section 223(b)(7)</external-xref> of the Internal Revenue Code of 1986 is amended by adding at the end the following: <quote>This paragraph shall not apply to any individual during any period for which the individual’s only entitlement to such benefits is an entitlement to hospital insurance benefits under part A of title XVIII of such Act pursuant to an enrollment for such hospital insurance benefits under section 226(a) of such Act.</quote>.</text></subsection><subsection commented="no" display-inline="no-display-inline" id="H3FD06835B75649C0AD0078E150301F24"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this subsection shall apply to taxable years beginning after December 31, 2020.</text></subsection></section></legis-body></bill>
