R. 5560</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211012">October 12, 2021</action-date><action-desc><sponsor name-id="G000559">Mr. Garamendi</sponsor> (for himself, <cosponsor name-id="J000305">Ms. Jacobs of California</cosponsor>, and <cosponsor name-id="C001112">Mr. Carbajal</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HAS00">Committee on Armed Services</committee-name>, and in addition to the Committees on <committee-name committee-id="HAG00">Agriculture</committee-name>, <committee-name committee-id="HPW00">Transportation and Infrastructure</committee-name>, and <committee-name committee-id="HIG00">Intelligence (Permanent Select)</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To make improvements to the role of the Department of Defense in responding to domestic emergencies, including wildfires.</official-title></form><legis-body id="HFA01BCA02A494BA5B6E76DFA10F6CB75" style="OLC"><section id="HDA4382BD61D8419193199B401907E402" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Support for Fighting Wildfires Act</short-title></quote>.</text></section><section id="H1D3281BAE0B34340AE053A106AD1DBEF"><enum>2.</enum><header>Requirement of Secretary of Defense to reimburse State costs of fighting certain wildland fires</header><text display-inline="no-display-inline">Section 2691(d) of title 10, United States Code, is amended by striking <quote>may</quote> and inserting <quote>shall</quote>.</text></section><section id="H800E85D5085045CC81CD0AC0FADB0275"><enum>3.</enum><header>Authorization for FireGuard Program</header><subsection id="H43DCE2852CB14A7D900BB6CA3E18E57F"><enum>(a)</enum><header>Authority</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/32/5">Chapter 5</external-xref> of title 32, United States Code, is amended by adding at the end the following new section:</text><quoted-block id="HF7438C98C6AC4722A10D0924FEAA8102" style="USC"><section id="H953035ACA5FD44AA9B2F28359926355B"><enum>510.</enum><header>Authorization for FireGuard Program</header><subsection id="H0CB54C2AD52C40B8B1B33E9FF6BA500B"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The Secretary of Defense may use members of the National Guard to carry out a program to aggregate, analyze, and assess multi-source remote sensing information for interagency partnerships in the detection and monitoring of wildfires, and to support any emergency response to such wildfires. Such a program shall be known as the <quote>FireGuard Program</quote>.</text></subsection><subsection id="H18BF6723C00C4A598B7BCE4ED9075B33"><enum>(b)</enum><header>Resources; limitation</header><text display-inline="yes-display-inline">If the Secretary carries out a program under this section, the Secretary—</text><paragraph id="H75F48FF9BB18424FA03744C5AB88DEA9"><enum>(1)</enum><text display-inline="yes-display-inline">shall transfer the functions, personnel, assets, and capabilities of the FireGuard Program, in existence on the day before the date of enactment of the <short-title>Military Support for Fighting Wildfires Act</short-title>, to the FireGuard Program authorized under this section;</text></paragraph><paragraph id="H02E4EC39B4264680B79352AEE1277405"><enum>(2)</enum><text>may direct the Director of the National Geospatial-Intelligence Agency to provide such assistance as the Secretary determines necessary to carry out the FireGuard Program; and</text></paragraph><paragraph id="H395AA2C442BC40E3929158AE4B197FA8"><enum>(3)</enum><text display-inline="yes-display-inline">may not reduce support, or transfer responsibility for support to an interagency partner, for the FireGuard Program authorized under this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="HF97B061D536B43559C2A8F28F032611F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text><quoted-block style="USC" id="H83FCA72693504A22AC5C77E47CDF0F02" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">510. Authorization for FireGuard Program.</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HBD83E7B089014ADA8A730D5F744DFE94"><enum>4.</enum><header>Amendment to budgeting of Department of Defense relating to extreme weather</header><text display-inline="no-display-inline">Section 328(a) of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/221">10 U.S.C. 221</external-xref> note) is amended—</text><paragraph id="HFB5430DF57144D268E5D4E28E6B29604"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking <quote>; and</quote> and inserting a semicolon;</text></paragraph><paragraph id="HCDA99A7F3F4649E5B0B97FD5E745554C"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="H1D31148DE8564C8CA094E2E23B8F51D1"><enum>(3)</enum><text>by inserting after paragraph (2) the following:</text><quoted-block style="OLC" id="HE0A07B28458040F685E6D5861CE9A8D6" display-inline="no-display-inline"><paragraph id="H006D9A9C7E854D4FB4D45C160134470F"><enum>(3)</enum><text display-inline="yes-display-inline">a calculation of the annual costs to the Department for assistance provided to—</text><subparagraph id="H2CA6F1DE1C494A27A30755B69447E368"><enum>(A)</enum><text>the Federal Emergency Management Agency or Federal land management agencies—</text><clause id="H47EEE781356842E1B65801FFED898FF3"><enum>(i)</enum><text>pursuant to requests for such assistance; and</text></clause><clause id="HA7DD3668164449369B19153EC8C7152A"><enum>(ii)</enum><text>approved under the National Interagency Fire Center; and</text></clause></subparagraph><subparagraph id="H4213B2F159A3416A8C0B5179E479CEA9"><enum>(B)</enum><text>any State, Territory, or possession under title 10 or title 32, United States Code, regarding extreme weather.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HB43AE43859D0410CA5A060CFC09E4AAC"><enum>5.</enum><header>Expanded consultation in training of National Guard personnel on wildfire response</header><text display-inline="no-display-inline">Section 351 of the National Defense Authorization Act for Fiscal Year 2018 (<external-xref legal-doc="public-law" parsable-cite="pl/115/91">Public Law 115–91</external-xref>) is amended by inserting <quote>and the National Interagency Fire Center</quote> after <quote>Bureau</quote>.</text></section><section id="HE4EEB0728FD2487DBE1C2AF3DD844DB0" display-inline="no-display-inline"><enum>6.</enum><header>Transfer of aircraft to other departments for wildfire suppression and other purposes</header><text display-inline="no-display-inline">Section 1098 of the National Defense Authorization Act for Fiscal Year 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/66">Public Law 113–66</external-xref>) is amended—</text><paragraph id="H7762E02942614091B5B4BDDA7D549DDE"><enum>(1)</enum><text>by striking subparagraph (C) of subsection (a)(1); and</text></paragraph><paragraph id="H83874D44C208485A858182E08081CDF6"><enum>(2)</enum><text>in subsection (c)—</text><subparagraph id="H28556EBB22BE4A7E9BC8BEE643CB8E87"><enum>(A)</enum><text>in paragraph (1), by striking <quote>purposes;</quote> and inserting <quote>purposes, search and rescue, or emergency operations pertaining to wildfires; and</quote>;</text></subparagraph><subparagraph id="H72A52F6E3D6F4F5DB3A29D1103D154C1"><enum>(B)</enum><text>in paragraph (2), by striking <quote>; and </quote> and inserting a period; and</text></subparagraph><subparagraph id="H3DBEB578B4B049B499A6C8758C9FF745"><enum>(C)</enum><text>by striking paragraph (3).</text></subparagraph></paragraph></section><section id="HE7FF9110D2AE4FF6846316E068C62A7B"><enum>7.</enum><header>Transfer of excess aircraft to other departments of the Federal Government</header><text display-inline="no-display-inline">Section 1091 of the National Defense Authorization Act for Fiscal Year 2013 (<external-xref legal-doc="public-law" parsable-cite="pl/112/239">Public Law 112–239</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2576">10 U.S.C. 2576</external-xref> note) is amended—</text><paragraph id="H472E6E13D5684D929E1F080518F3D29C" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsections (c) and (e) and redesignating subsections (d), (f), and (g) as subsections (c), (d), and (e), respectively;</text></paragraph><paragraph id="H61934B18D3C34851AEF866BE6919089E"><enum>(2)</enum><text>in subsection (c), as redesignated—</text><subparagraph id="H7BD4D3879E35488382F4E697024C67E7"><enum>(A)</enum><text>in paragraph (1), by striking <quote>up to seven</quote>; and</text></subparagraph><subparagraph id="H1C189FFBE7974DDB8CCE47D61EED1A40"><enum>(B)</enum><text>by amending paragraph (2) to read as follows:</text><quoted-block style="OLC" id="H4F561BBE641D4D9C8F2AC8C09A3B4AB6" display-inline="no-display-inline"><paragraph id="HB5D86A0EF0224D1584326D881C19C631"><enum>(2)</enum><header>Expiration of right of refusal</header><text display-inline="yes-display-inline">A right of refusal afforded the Secretary of Agriculture or the Secretary of Homeland Security under paragraph (1) with regards to an aircraft shall expire upon official notice of such Secretary to the Secretary of Defense that such Secretary declines such aircraft.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="HEF7194B371D149C5ACFD4CAA70171EFB"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (d), as redesignated—</text><subparagraph id="H57A91ABB058A4A1684F5EDA6C5295C7F"><enum>(A)</enum><text>in paragraph (1), by inserting <quote>, search and rescue, or emergency operations pertaining to wildfires</quote> after <quote>purposes</quote>; and</text></subparagraph><subparagraph id="H649FAC43DC06483CB9CF1C5DC09F0CDD"><enum>(B)</enum><text>in paragraph (2), by inserting <quote>, search and rescue, emergency operations pertaining to wildfires,</quote> after <quote>efforts</quote>; and</text></subparagraph></paragraph><paragraph id="H2D5F83DCB67E4255B59ABBD9D3A26249"><enum>(4)</enum><text>by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HD2D83EFB464D4E59A840D500BA3CA7AD" display-inline="no-display-inline"><subsection id="HC378C09BA42C4E9DAC16DBDC6189D35D"><enum>(f)</enum><header>Reporting</header><text display-inline="yes-display-inline">Not later than November 1, 2022, and annually thereafter, the Secretary of Defense shall submit to the Committees on Armed Services of the Senate and House of Representatives a report on aircraft transferred, during the fiscal year preceding the date of such report, to—</text><paragraph id="H0471BE8BDA334ADC8EDD48C14A6CDDED"><enum>(1)</enum><text>the Secretary of Agriculture or the Secretary of Homeland Security under this section; </text></paragraph><paragraph id="H5B448E205B2047DA882625642947E3FA"><enum>(2)</enum><text>the chief executive officer of a State under section 112 of the National Defense Authorization Act for Fiscal Year 2012 (<external-xref legal-doc="public-law" parsable-cite="pl/112/81">Public Law 112–81</external-xref>); or</text></paragraph><paragraph id="H6A07DA3430FE412D8F4A12148ECCB963"><enum>(3)</enum><text display-inline="yes-display-inline">the Secretary of the Air Force, the Secretary of Agriculture, or the Governor of California, under section 1098 of the National Defense Authorization Act for Fiscal Year 2014 (<external-xref legal-doc="public-law" parsable-cite="pl/113/66">Public Law 113–66</external-xref>; 127 Stat. 881).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="HD88CD8F7077E4DF58B9D1E2F39C5EA3F"><enum>8.</enum><header>Updated review and enhancement of existing authorities for using Air Force and Air National Guard modular airborne fire-fighting systems and other Department of Defense assets to fight wildfires</header><text display-inline="no-display-inline">Section 1058 of the National Defense Authorization Act for Fiscal Year 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/136">Public Law 108–136</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/31/1535">31 U.S.C. 1535</external-xref> note) is amended by adding at the end the following new subsection:</text><quoted-block style="OLC" id="HF3A3A6006A744E79AC549B190FBB69A8" display-inline="no-display-inline"><subsection id="HBFE16CEDDED9466EADFA45DEE35DC17E"><enum>(g)</enum><header>Updated review and enhancement</header><paragraph commented="no" display-inline="yes-display-inline" id="H39930F88130F41698F771B824D7EB133"><enum>(1)</enum><text>Not later than 120 days after the date of the enactment of the <short-title>Military Support for Fighting Wildfires Act</short-title>, the Director shall submit to Congress a report—</text><subparagraph id="HCFD58FCFF49E4FE0B4476F4B4F9AF013" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">containing the results of a second review conducted under subsection (a) and a second determination made under subsection (b); and</text></subparagraph><subparagraph id="HB5DE2439421549D38286DB3C5B3E0F93" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">based on such second determination, describing the new modifications proposed to be made to existing authorities under subsection (c) or (d), including whether there is a need for legislative changes to further improve the procedures for using Department of Defense assets to fight wildfires.</text></subparagraph></paragraph><paragraph id="HCA2A4D4815004D41BF0E5142937FFD80" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The new modifications described in paragraph (1)(B) shall not take effect until the end of the 30-day period beginning on the date on which the report is submitted to Congress under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HE1B334A47DD4461499B30D7EADFE3708" section-type="subsequent-section"><enum>9.</enum><header>No reimbursement for use of National Geospatial-Intelligence Agency resources during a major disaster</header><text display-inline="no-display-inline">The Director of the National Geospatial-Intelligence Agency may not require the Federal Emergency Management Agency or a Federal land management agency to reimburse the National Geospatial-Intelligence Agency for use of resources for any request approved by the Director pertaining to—</text><paragraph id="HE58A687FABC2493F8E357BCF946806DE"><enum>(1)</enum><text>a request made by such a Federal agency through the National Interagency Fire Center; or</text></paragraph><paragraph id="HB751B5630F9B4F31B942B7A9218C529A"><enum>(2)</enum><text display-inline="yes-display-inline">an area of Federal land affected by extreme weather, as that term is defined in section 328(c) of the National Defense Authorization Act for Fiscal Year 2020 (<external-xref legal-doc="public-law" parsable-cite="pl/116/92">Public Law 116–92</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/221">10 U.S.C. 221</external-xref> note).</text></paragraph></section><section id="HB16CF755605F40C0AA0A609A8A64F240"><enum>10.</enum><header>Exemption from Economy Act for certain requests made through the National Interagency Fire Center</header><text display-inline="no-display-inline">Section 1535(b) of title 31, United States Code (commonly known as the <quote>Economy Act</quote>), shall not apply to any assistance provided by the Department of Defense to the Federal Emergency Management Agency or a Federal land management agency under a request—</text><paragraph id="H29FF21AA914B41ECA8D3FC02C135391F"><enum>(1)</enum><text>made through the National Interagency Fire Center; and</text></paragraph><paragraph id="H2CC52D669FD848F0BEF73D88351C1C72"><enum>(2)</enum><text display-inline="yes-display-inline">pertaining to an area covered by a declaration of a major disaster or emergency under section 401 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act (<external-xref legal-doc="usc" parsable-cite="usc/42/5170">42 U.S.C. 5170</external-xref>).</text></paragraph></section><section id="H2975961B38564572A5563AA3438DD4F5"><enum>11.</enum><header>Guidance for use of unmanned aircraft systems by the National Guard</header><subsection id="HD4147FEEEB4F4FF69CFE09DA63A9A254"><enum>(a)</enum><header>New guidance</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Secretary of Defense shall issue new guidance that treats the use of unmanned aircraft systems by the National Guard for covered activities in a manner no more restrictive than the use of other aircraft for covered activities.</text></subsection><subsection id="HE8C3BDE2447544F89F0C3545F762C482"><enum>(b)</enum><header>Covered activities defined</header><text>In this section, <quote>covered activities</quote> means the following:</text><paragraph id="HCAFBBBD2738F4767BEFC62AD373AFE41"><enum>(1)</enum><text>Emergency operations.</text></paragraph><paragraph id="HEBEB0201E65547E0AAF702CFF291DDBA"><enum>(2)</enum><text>Search and rescue operations.</text></paragraph><paragraph id="H6219DC74BE564E57B7ABCC422F838473"><enum>(3)</enum><text>Defense support to civil authorities.</text></paragraph><paragraph id="HC12D5F1D96A94873B5A6CB2C71A65C2B"><enum>(4)</enum><text>Support under section 502(f) of title 32, United States Code.</text></paragraph></subsection></section><section id="H5B81773A666E426D80B4E50CEECF11B4"><enum>12.</enum><header>Implementation of certain recommendations regarding use of unmanned aircraft systems by the National Guard</header><text display-inline="no-display-inline">Not later than September 30, 2022, the Secretary of Defense shall implement recommendations of the Secretary described in section 519C(a)(2) of the William M. (Mac) Thornberry National Defense Authorization Act for Fiscal Year 2021 (<external-xref legal-doc="public-law" parsable-cite="pl/116/283">Public Law 116–283</external-xref>).</text></section></legis-body></bill>
