R. 5542</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20211008">October 8, 2021</action-date><action-desc><sponsor name-id="S000344">Mr. Sherman</sponsor> introduced the following bill; which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name>, and in addition to the Committee on <committee-name committee-id="HJU00">the Judiciary</committee-name>, for a period to be subsequently determined by the Speaker, in each case for consideration of such provisions as fall within the jurisdiction of the committee concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To direct the Secretary of Health and Human Services to establish a grant program to facilitate the distribution of funding for travel related expenses paid by individuals impacted by restrictions to the provision of abortion services, and for other purposes.</official-title></form><legis-body id="HF62869C551274B11814A96E375FB07C9" style="OLC"><section id="H1EB57931E62E4D1BAAB3B6A8884B8C05" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medical Travel Assistance to Protect Women’s Right to Choose Act of 2021</short-title></quote>.</text></section><section id="HC69BD7B40FD748958510DAE226F6BF45"><enum>2.</enum><header>Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that the Attorney General shall undertake all necessary actions to prevent a State from frustrating the protections outlined in Roe v. Wade (410 U.S. 113 (1973)).</text></section><section id="H9D7FA6D1AD0943C6B8D48401F35C0BCA"><enum>3.</enum><header>Grants to individuals impacted by restrictions to provision of abortion services</header><subsection id="H610C66E304FD4638A6E803F3C0ADCCF4"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Not later than 30 days after the date of the enactment of this Act, the Secretary of Health and Human Services shall establish a program (in this Act referred to as the <quote>Program</quote>) to facilitate the distribution of funding for travel related expenses paid with respect to accessing an abortion service by an individual residing in a State that does not have a State law protecting the right to abortion services before the fetus is viable.</text></subsection><subsection id="H2BC1C067181847DDA2FE078821E8CD24"><enum>(b)</enum><header>Grant authority</header><text>In carrying out the Program, the Secretary may award a grant to each individual in accordance with this section.</text></subsection><subsection id="HF5D2786F820248B8B7A95EA98DA52AF9"><enum>(c)</enum><header>Eligible recipients</header><text>The Secretary may award a grant under the Program to any individual determined by the Secretary to—</text><paragraph id="H9D4ABD39C8BA42799208B9030ECCC135"><enum>(1)</enum><text display-inline="yes-display-inline">be a resident of a State that does not have a State law protecting the right to abortion services before the fetus is viable; and</text></paragraph><paragraph id="H388ED173D53D48E29F66C5EEBA4E38ED"><enum>(2)</enum><text>have traveled to a State other than the State of such individual’s residence to be provided abortion services.</text></paragraph></subsection><subsection id="HEF9EDD17BA2A449C8828F81677E058EE"><enum>(d)</enum><header>Applications</header><text>To be eligible for a grant under the Program, the individual shall submit to the Secretary an application in such form, at such time, and containing such information as the Secretary determines appropriate.</text></subsection><subsection id="HAB59B86A80D94062A0A6DED6A62DE93A"><enum>(e)</enum><header>Grant amount</header><paragraph id="H4EB6DAA7686640C69C481C35A8C937CA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The amount of the grant awarded under the Program shall be up to $1,000 and based on the travel related expenses paid by an eligible recipient.</text></paragraph><paragraph id="HCAF95DD1571042E5ADD2C1A41AC206CD"><enum>(2)</enum><header>Additional amount</header><text>In extraordinary circumstances, as determined by the Secretary, the amount of the grant awarded under the Program may exceed $1,000. </text></paragraph></subsection><subsection id="HBE707178E4DA499FB1F614CF64A6C6B4"><enum>(f)</enum><header>Travel related expenses defined</header><text display-inline="yes-display-inline">In this section, the term <quote>travel related expenses</quote>—</text><paragraph id="H2BE5FC84E77A4D0F878E066A7AE81367"><enum>(1)</enum><text>includes—</text><subparagraph id="HBCD7F5DF9CB44AD18C0571D9780506B5"><enum>(A)</enum><text>the expense of round trip travel to the location where the abortion service is provided; and</text></subparagraph><subparagraph id="HF0725579A9D5431FB548FA19B683720F"><enum>(B)</enum><text>lodging and meals; and</text></subparagraph></paragraph><paragraph id="HEED5CC7782EA4C2BAA2AC12FAEEEFA58"><enum>(2)</enum><text>does not include—</text><subparagraph id="HDC7BEEA9B84D40DBB416F57920CD2C69"><enum>(A)</enum><text display-inline="yes-display-inline">costs with respect to the provision of the abortion service; or</text></subparagraph><subparagraph id="HA0A4A880844F43C8B0E62DCE7804B2DB"><enum>(B)</enum><text>wages lost as a result of travel undertaken to receive such service.</text></subparagraph></paragraph></subsection><subsection id="H6FC783176C1D4BE0B553FC7F77128FE2"><enum>(g)</enum><header>Fetus is viable defined</header><text display-inline="yes-display-inline">The term <quote>fetus is viable</quote> means the time at which there is established medical consensus that the fetus has the potential to survive outside the uterus after birth, natural or induced.</text></subsection></section></legis-body></bill>
