which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Workforce Innovation and Opportunity Act to promote the employment of older individuals, and for other purposes.</official-title></form><legis-body id="HBCE33A25A4E94B0CA3C279E176E38F13" style="OLC"><section id="H6F65C8F718604E978DC75ACA6BC8EC1A" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Supporting Older Workers Act</short-title></quote>.</text></section><section id="HB312502AB0784519B6A493D7FFE2BBE6"><enum>2.</enum><header>Incentive Grants and allowable activities to promote older workers</header><text display-inline="no-display-inline">Section 134(a)(3)(A) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3174">29 U.S.C. 3174(a)(3)(A)</external-xref>) is amended—</text><paragraph id="HFBFFCF252F5749DCB2EF9B4CB1CDCCDF"><enum>(1)</enum><text>in clause (viii)—</text><subparagraph id="H547CE61F47EC456EBC499FB131428C95"><enum>(A)</enum><text>by striking <quote>and</quote> at the end of item (ee);</text></subparagraph><subparagraph id="HC5B1A5C2B3B945AEAA01B7A29827313A"><enum>(B)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="HC048028EF2BF4B40A114BB6D6B950334" display-inline="no-display-inline"><item id="H8CC7C0EDAFF24B15B4E53D7E9FB863DD"><enum>(gg)</enum><text display-inline="yes-display-inline">programs under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>); and</text></item><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3892280BC283418B95A3B26F4AA65FEB"><enum>(2)</enum><text>in clause (xi), by inserting before the semicolon the following: <quote>, including for such performance that serves individuals with barriers to employment</quote>;</text></paragraph><paragraph id="H75C535F792334313AAFF96FF022FE47D"><enum>(3)</enum><text>by striking <quote>and</quote> at the end of clause (xiii);</text></paragraph><paragraph id="H53FFBD442151451BA8309484B1F389E5"><enum>(4)</enum><text>in clause (xiv), by striking the period and inserting <quote>; and</quote>; and</text></paragraph><paragraph id="HAB32D69819564B3180A269960F8F23D9"><enum>(5)</enum><text>by adding at the end the following: </text><quoted-block style="OLC" id="H9065D2D083744B6993418934134FAE91" display-inline="no-display-inline"><clause id="HAF4E02B78ED94574B9B97D4BB937FA1F"><enum>(xv)</enum><text display-inline="yes-display-inline">supporting the development of alternative, evidence-based programs and other activities that enhance the choices available to older individuals (including options for self-employment and other wage-earning activities that lead to economic self-sufficiency), and enhance skills (such as digital literacy) in older individuals. </text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section><section id="H0DB6A006857A4D8B95FC47AFEF65196F"><enum>3.</enum><header>Specialized centers; Older Workers Local and State Coordinator Grant Program</header><subsection id="H93E33BC45B0747E98E4863C0BAD8EE7C"><enum>(a)</enum><header>Specialized centers in one-Stop delivery systems</header><text display-inline="yes-display-inline">Section 121(e)(2)(C) of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3151">29 U.S.C. 3151(e)(2)(C)</external-xref>) is amended by inserting <quote>older individuals,</quote> after <quote>youth,</quote>. </text></subsection><subsection id="H22B3F18FC73241ACBEFE70521BDCF4CA"><enum>(b)</enum><header>Grant program</header><paragraph id="HBE639A3CA29D44C5A33CDC06193395B1"><enum>(1)</enum><header>In general</header><text>Subtitle D of title I of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3221">29 U.S.C. 3221 et seq.</external-xref>) is amended—</text><subparagraph id="HEE9AC53FEE0C4118B33D07EFB272AB9B"><enum>(A)</enum><text>by redesignating section 172 (<external-xref legal-doc="usc" parsable-cite="usc/29/3227">29 U.S.C. 3227</external-xref>) as section 173; and</text></subparagraph><subparagraph id="HDA8DE133A3704AE887DD014160787771"><enum>(B)</enum><text display-inline="yes-display-inline">by inserting after section 171 (<external-xref legal-doc="usc" parsable-cite="usc/29/3226">29 U.S.C. 3226</external-xref>) the following:</text><quoted-block style="OLC" id="HC33223F7DF544151A98E374F1B950F45" display-inline="no-display-inline"><section id="H7B8987F092344488B6966C8F172E438A"><enum>172.</enum><header>Older Workers Local and State Coordinator Grant Program</header><subsection id="HF883B3191A384D95BAA11A9E96C91381"><enum>(a)</enum><header>Authority To award grants</header><text display-inline="yes-display-inline">From the amounts appropriated to carry out this section, the Secretary shall award grants, on a competitive basis, to States and local areas to hire an older worker coordinator or coordinators to—</text><paragraph id="HCE908A0323CC431397CC98B10BA9B40E"><enum>(1)</enum><text display-inline="yes-display-inline">use a person-centered approach to increase recruitment, job training, and job placement for older individuals throughout the State or local area, including through outreach (such as through job fairs for older individuals and programming) to employers who may hire older individuals;</text></paragraph><paragraph id="HFCE975198F6E40FEB7DD3BAF084A9F94"><enum>(2)</enum><text display-inline="yes-display-inline">promote coordination of available supportive services for older individuals, including services available through area agencies on aging (as defined in section 102 of the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3002">42 U.S.C. 3002</external-xref>) or under the Older Americans Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3001">42 U.S.C. 3001 et seq.</external-xref>)), and which may include coordination with labor organizations, community colleges, small business development centers (as defined in section 3 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/632">15 U.S.C. 632</external-xref>)), women’s business centers (described under section 29 of the Small Business Act (<external-xref legal-doc="usc" parsable-cite="usc/15/656">15 U.S.C. 656</external-xref>)), non-profit organizations, community-based organizations, or community centers; and</text></paragraph><paragraph id="HC58A70C17EB3480F9FAB875F96ABEBF2"><enum>(3)</enum><text display-inline="yes-display-inline">document and share best practices for serving older workers.</text></paragraph></subsection><subsection id="H2D574FA5F0504F2B88F85A536595CA6A"><enum>(b)</enum><header>Reporting</header><text display-inline="yes-display-inline">Not later than 3 years after the first grant is awarded under this section, the Secretary shall report to Congress on the performance in serving older individuals by States and local areas with one or more older worker coordinators. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph><paragraph id="H3476CF2E9740443581C54DBF3CEE5980"><enum>(2)</enum><header>Table of contents</header><text>The table of contents of the Workforce Innovation and Opportunity Act is amended by striking the item relating to section 172 and inserting the following: </text><quoted-block style="OLC" id="HCAC7E53C61A846A5AF65636A9EFC3589" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="section">172. Older Workers Local and State Coordinator Grant Program. </toc-entry><toc-entry level="section">173. Authorization of appropriations. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section><section id="H69539F1B87C2492FA198A00CDC60A8A5"><enum>4.</enum><header>Older Workers Bureau</header><subsection id="H0349FA908733431AA10200F24BDC4E92"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Department of Labor an Older Workers Bureau.</text></subsection><subsection id="H83A20A51FC70402D8508E9423A06D8B9"><enum>(b)</enum><header>Assistant Secretary of the Older Workers Bureau</header><text display-inline="yes-display-inline">The President shall appoint an Assistant Secretary of the Older Workers Bureau—</text><paragraph id="H6AB20CA97233433A851456FD42F455F0"><enum>(1)</enum><text>to carry out the mission of the Older Workers Bureau; and</text></paragraph><paragraph id="HD5C0ECAA32D54BD6B8A3B39A2B9B97A6"><enum>(2)</enum><text>who shall be directed and supervised by the Secretary of Labor.</text></paragraph></subsection><subsection id="H8CB661EEF6654165A6C7BE931CDC07B8"><enum>(c)</enum><header>Mission</header><text display-inline="yes-display-inline">The mission of the Older Workers Bureau is lead and coordinate the Federal response to advance employment, economic success, and well-being of older individuals through policy development, research and reporting, and technical assistance. The Assistant Secretary of the Older Workers Bureau may administer grants and contracts in support of such mission.</text></subsection><subsection id="H514D3D6DDB214D159C1A3C19B9E21DED"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 2 years after the establishment of the Older Workers Bureau, and every 2 years thereafter, the Assistant Secretary of the Older Workers Bureau shall submit to Congress a report that—</text><paragraph id="H5D1CF24CAE1845FDBE7E460FD3F767B2"><enum>(1)</enum><text>catalogs Federal programs, including programs outside the Department of Labor, that support the employment, and the economic success and well-being, of older individuals; and</text></paragraph><paragraph id="HFC49F5DF3A8E496C8DF4BD2E56A69215"><enum>(2)</enum><text>identifies issues affecting older individuals in the workforce that may be improved with Federal support and coordination. </text></paragraph></subsection></section><section id="H662DE21E07294BFCB47498FEBCA997CF"><enum>5.</enum><header>GAO Study</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report on how accurately the State and local performance accountability measures under section 116 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3141">29 U.S.C. 3141</external-xref>) measure the success of older individuals, including older individuals who pursue self-employment or bridge employment prior to retirement, with a particular focus on older individuals who have additional barriers to employment and dislocated older individuals.</text></section><section id="H0CBCBA130C4143CA84DE5A6CB6D72521"><enum>6.</enum><header>Older individual defined</header><text display-inline="no-display-inline">In this Act, the term <term>older individual</term> has the meaning given the term in section 3 of the Workforce Innovation and Opportunity Act (<external-xref legal-doc="usc" parsable-cite="usc/29/3102">29 U.S.C. 3102</external-xref>).</text></section></legis-body></bill>
