which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Elementary and Secondary Education Act of 1965 to establish a grant program that will support efforts at the State level to establish anti-bullying task forces to study, address, and reduce bullying in elementary and secondary schools, and for other purposes.</official-title></form><legis-body id="H5EDBCE12F01C4FA88E33D95D73C363B8" style="OLC"><section id="H1ACF89EBFCD845939D3F537B30DBA926" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>STOP Bullying Act</short-title></quote>. </text></section><section id="H8208F6A27E614F2D9944090B7540402A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text><paragraph id="H4B170A559DCB46E08573D87C2D73F735"><enum>(1)</enum><text>Between one in four and one in three students in the United States report being bullied at school, and over 70 percent of young people say they have seen bullying in their schools.</text></paragraph><paragraph id="H3212EC5A9C134E44A7E833FC7E221930"><enum>(2)</enum><text display-inline="yes-display-inline">Since most instances of bullying take place on school grounds, school staff and teachers play an instrumental role in bullying prevention.</text></paragraph><paragraph commented="no" id="HA46A85F28394439B876C58744AC9E067"><enum>(3)</enum><text display-inline="yes-display-inline">Research shows that engaged educators who are supportive of all students help to reduce the overall presence of bullying and harassment on school grounds.</text></paragraph><paragraph id="HAF9514725F5F4C4B9168A9A9A676EFF0"><enum>(4)</enum><text>87.3 percent of transgender students report feeling unsafe at school, and nine out of ten students who identify as lesbian, gay, bisexual, transgender, or queer (LGBTQ) report being harassed and bullied every year.</text></paragraph><paragraph id="H62499E3A27D84C34BF73083290D2DC19"><enum>(5)</enum><text display-inline="yes-display-inline">Hostile school environments have a detrimental effect on the academic success and health of students.</text></paragraph><paragraph commented="no" id="H243F5239501E4CA8945317105A52A622"><enum>(6)</enum><text display-inline="yes-display-inline">Law in effect before the date of the enactment of this Act does not sufficiently address bullying prevention, and governments and educators in every State have a responsibility to ensure State and local education systems have processes in place for students to be able to learn in a safe environment, regardless of their actual or perceived race, color, national origin, sex, disability, sexual orientation, gender identity, or religion.</text></paragraph></section><section id="H6033823D704D46C3BD8CC8AC33ACACA2"><enum>3.</enum><header>State Anti-Bullying Task Force Requirement</header><text display-inline="no-display-inline">Subpart 2 of part F of title VIII of the Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7881">20 U.S.C. 7881</external-xref> et seq.) is amended by adding at the end the following:</text><quoted-block display-inline="no-display-inline" id="HF8249DA95F014BB88A5512CC47B73D2A" style="OLC"><section id="H336D4E164B5E409CABBAD718BD2D6AA7"><enum>8549D.</enum><header>State Anti-Bullying Task Force Grants</header><subsection id="H577F78EBDBCB4EB09B5211DD0F54065D"><enum>(a)</enum><header>Anti-Bullying Task Force Grant Program</header><text display-inline="yes-display-inline">The Secretary shall carry out a program to make grants to each State to establish and implement a task force to study, address, and reduce bullying in elementary schools and secondary schools.</text></subsection><subsection id="H3CCEB1EC6EBB49F5950E4C3E2203FF12"><enum>(b)</enum><header>Use of funds</header><text>Each State task force established under a grant under this section shall use the grant funds to conduct a study on bullying in the elementary schools and secondary schools of such State that includes—</text><paragraph id="H994D7C060DD14715BC3B5B5ADF235BA5"><enum>(1)</enum><text>policies of the local educational agencies in such State with respect to bullying;</text></paragraph><paragraph id="H3D71E407BE1B44DDBBC45DD3DB1D77E5"><enum>(2)</enum><text>teacher, parent, and student education with respect to bullying; and</text></paragraph><paragraph id="H967923C182BF4AF88619FAFFE883D114"><enum>(3)</enum><text>the incidents of student violence and self-harm as a result of bullying.</text></paragraph></subsection><subsection id="H57280489DD134778B0775C464992B623"><enum>(c)</enum><header>Membership</header><paragraph id="HBDE23B9D1B9C4ECBBC9F6BCD58582FEC"><enum>(1)</enum><header>Chair</header><text display-inline="yes-display-inline">Each Chief Education Officer of a State shall designate one individual to serve as the chair of the task force of such State.</text></paragraph><paragraph id="H2C4F35DD2A0E47FFB6E57F0EE7FA8F99"><enum>(2)</enum><header>Composition</header><text>Each State shall designate at least one individual from each of the following categories to serve on the task force of such State:</text><subparagraph id="H5A9EC01D95D9486F8E0AD9812D9DA737"><enum>(A)</enum><text display-inline="yes-display-inline">At least one teacher at elementary schools and secondary schools selected in consultation with the union or association representing educators.</text></subparagraph><subparagraph id="H829740BFE0BC41EEB2CB96577EB27E89"><enum>(B)</enum><text>At least one school administrator.</text></subparagraph><subparagraph id="HD1FCC153CE7545B1BC17AD45EE0916FC"><enum>(C)</enum><text>At least one parent of students.</text></subparagraph><subparagraph id="HB9A6244DFCC248968DF74BADF6E2FC99"><enum>(D)</enum><text>At least one K–12 student.</text></subparagraph><subparagraph id="HFDBD125986C549E0A88DFF1892E89A4C"><enum>(E)</enum><text>At least one guidance counselor.</text></subparagraph><subparagraph id="H391BFCE9F7044066B590E3AD201DD79B"><enum>(F)</enum><text display-inline="yes-display-inline">At least one child psychologist.</text></subparagraph><subparagraph id="H0528D9DF90FB42EBBDD3B45EBEF60388"><enum>(G)</enum><text display-inline="yes-display-inline">At least one school psychologist.</text></subparagraph><subparagraph id="HFADAB4DBF27C437AA23B6BCDCEF7D62C"><enum>(H)</enum><text>At least one paraprofessional.</text></subparagraph><subparagraph id="H5FA8699555004832B174CFD479E3905F"><enum>(I)</enum><text display-inline="yes-display-inline">At least one lawyer.</text></subparagraph><subparagraph id="H89115FD2858D45D29CAD72B460F5F8F3"><enum>(J)</enum><text display-inline="yes-display-inline">At least one representative from a community-based organization who specializes in providing supportive services to students who identify as lesbian, gay, bisexual, transgender, or queer.</text></subparagraph><subparagraph id="HA67243B964CF47F4806AB1C09005E0C0"><enum>(K)</enum><text display-inline="yes-display-inline">Professionals who specialize in providing support services to students who identify as lesbian, gay, bisexual, transgender, or queer.</text></subparagraph><subparagraph commented="no" id="HF4F1F4DBFB574C979F4B0444F94034DE"><enum>(L)</enum><text display-inline="yes-display-inline">At least one individual from the Sate Education Agency office focused on school improvement and school climate.</text></subparagraph><subparagraph id="HB2537C396CBD42C2BCDFB89F830A9121"><enum>(M)</enum><text display-inline="yes-display-inline">Additional individuals, as determined by the chair of the task force.</text></subparagraph></paragraph><paragraph id="H15B83E9985464C11B717CB564FB8C6A1"><enum>(3)</enum><header>Terms of members</header><subparagraph id="H629BCE98C7B24B86A6315796B2D080C0"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">Each member of a task force of State shall be appointed for the duration of the existence of such task force.</text></subparagraph><subparagraph id="H1409A2A5DD9C448FB4B84844BB42541D"><enum>(B)</enum><header>Vacancies</header><text>A vacancy on a task force shall be filled in the manner in which the original designation was made under paragraph (2).</text></subparagraph></paragraph><paragraph commented="no" id="HD9794F0C7C724F1DA83E9BFE306233DB"><enum>(4)</enum><header>Discretionary coordination</header><text>A task force of a State may coordinate activities under this section with other boards and commissions of such State.</text></paragraph></subsection><subsection id="HFAE385F0D4AD4ED58C6D2EF053F4C2D3"><enum>(d)</enum><header>Report to Chief Education Officer</header><paragraph id="H5C1708B5114349D48A49D647E2EF43B5"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date on which the State submits the study required under subsection (b), the State task force of such State shall submit a final report to the Chief Education Officer of such State and the Secretary of Education containing—</text><subparagraph id="H702A02BCED374D4A904062B255B18084"><enum>(A)</enum><text>the annual findings and conclusions of the task force;</text></subparagraph><subparagraph id="H19F0DB6CA329413F8875046C158970F6"><enum>(B)</enum><text>the recommendations of the task force for legislation or administrative actions; and</text></subparagraph><subparagraph id="H43C0A6F99D134B1E850B1348CED79A65"><enum>(C)</enum><text>best practices with respect to bullying in elementary schools and secondary schools that includes recommendations for how—</text><clause id="HD3178661C6194E6B9FD44D2CAD82EDCB"><enum>(i)</enum><text>to address and reduce bullying;</text></clause><clause id="HDB5713BC76E84D6C8C60653E2F4F578C"><enum>(ii)</enum><text>to best educate all relevant school staff on recognizing bullying; and</text></clause><clause id="HADF893904E16497D959A05F201270D43"><enum>(iii)</enum><text display-inline="yes-display-inline">parents can best address and discuss with their children the early warning signs of bullying.</text></clause></subparagraph></paragraph><paragraph id="HB66758227F71428CBB9DE9821882D822"><enum>(2)</enum><header>Publication</header><text>Each State task force shall make the final report submitted under paragraph (1) publicly available.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
