Stafford Disaster Relief and Emergency Assistance Act, and for other purposes.</official-title></form><legis-body id="H08D56DB7D4684A5AB12F9CAABAFD4913" style="OLC"><section id="H427F167F70D5425193FFFFF3A9DAD4AC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Emergencies Are Literally Tenets of HHS Act of 2021</short-title></quote> or the <quote><short-title>HEALTH Act of 2021</short-title></quote>.</text></section><section id="H688E0540EF764285AE46C9682BF5BCEB"><enum>2.</enum><header>Lead agency for Federal public health and medical response to public health emergencies</header><text display-inline="no-display-inline">Section 2801 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300hh">42 U.S.C. 300hh</external-xref>) is amended—</text><paragraph id="H986BEC0C1EF545F5804EE857A0A4FB09"><enum>(1)</enum><text>in subsection (a), by inserting after <quote>shall lead all Federal public health and medical response to public health emergencies and incidents</quote> the following: <quote>(including emergencies and disasters declared by the President pursuant to the National Emergencies Act or the Robert T. Stafford Disaster Relief and Emergency Assistance Act)</quote>; and</text></paragraph><paragraph id="HCFDD5D4B0C6F483FB17D230D35F3A480"><enum>(2)</enum><text>in subsection (b), by inserting after <quote>shall assume operational control of emergency public health and medical response assets, as necessary, in the event of a public health emergency</quote> the following: <quote>or in the event of an emergency or disaster declared by the President under the National Emergencies Act or the Robert T. Stafford Disaster Relief and Emergency Assistance Act</quote>. </text></paragraph></section><section id="H3AEF7A2E493B41B2A25C1FC8B08D9484"><enum>3.</enum><header>Deployment by the Secretary of Health and Human Services of National Strategic Stockpile</header><text display-inline="no-display-inline">Section 319F–2(a)(3)(F) of the Public Health Service Act (42 U.S.C. 247d–6b(a)(3)(F)) is amended by striking <quote>as required by</quote> and inserting <quote>in consultation with</quote>.</text></section><section id="H137113EB1A8E45108175D78E19EEF8D4" section-type="subsequent-section"><enum>4.</enum><header>Authority and responsibilities of the Federal Emergency Management Agency regarding the Strategic National Stockpile</header><text display-inline="no-display-inline">The Homeland Security Act of 2002 is amended—</text><paragraph id="H6C2D6C3E2C6C481287411375F975352E"><enum>(1)</enum><text>in subparagraph (A) of section 503(b)(2) (<external-xref legal-doc="usc" parsable-cite="usc/6/313">6 U.S.C. 313(b)(2)</external-xref>), by inserting <quote>, in coordination with relevant Federal agencies,</quote> after <quote>lead</quote>; and</text></paragraph><paragraph id="HECADCABF34D849548884E5D428A662E0"><enum>(2)</enum><text>in subparagraph (D) of section 504(a)(3) (<external-xref legal-doc="usc" parsable-cite="usc/6/314">6 U.S.C. 314(a)(3)</external-xref>), by striking <quote>requiring</quote> and inserting <quote>, at the direction of the Secretary of Health and Human Services, assisting in</quote>.</text></paragraph></section></legis-body></bill>
