which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To improve research and data collection on stillbirths, and for other purposes.</official-title></form><legis-body id="H4B49E1A784894CC8AF1B926E1F9C8EA3" style="OLC"><section id="H3C90E7C1DC454BFABD1E1FC245E0ED39" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stillbirth Health Improvement and Education for Autumn Act of 2021</short-title></quote> or the <quote><short-title>SHINE for Autumn Act of 2021</short-title></quote>.</text></section><section id="HC065314CA42E4C4D9A6D89AD34355597"><enum>2.</enum><header>Stillbirth research and data collection improvements</header><text display-inline="no-display-inline">Title III of the Public Health Service Act is amended by inserting after section 317L–1 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/247b-13a">42 U.S.C. 247b–13a</external-xref>) the following:</text><quoted-block style="OLC" id="H6DB9C2AB5EB5430FB4C0C3F843868319" display-inline="no-display-inline"><section id="HC82EA96F7CCA4CA3BB08697890DF3B3E" section-type="subsequent-section"><enum>317L–2.</enum><header>Stillbirth research and data collection improvements</header><subsection id="H70704EAD9C5D42D48562AD9B7E4F5485" commented="no"><enum>(a)</enum><header>Stillbirth surveillance and risk factor studies</header><paragraph id="HB5A8BE1D32D8404C8665726E7BD5D6CF" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary may award grants to States for purposes of—</text><subparagraph id="H2E31B295AC234BFBB7304CD4002B026A"><enum>(A)</enum><text>conducting surveillance and collecting data with respect to stillbirths; and</text></subparagraph><subparagraph id="H4E436B0AD8444A258736FBC5545D82EA"><enum>(B)</enum><text display-inline="yes-display-inline">collecting and reporting data on stillbirth risk factors, including any quantifiable outcomes with respect to such risk factors. </text></subparagraph></paragraph><paragraph id="HA27601D3CC0645B4BD98AF301614FFDF"><enum>(2)</enum><header>Authorization of appropriations</header><text>To carry out this subsection, there is authorized to be appropriated $5,000,000 for each of fiscal years 2022 through 2026.</text></paragraph></subsection><subsection id="H23AEA9D09A31470A9E3A7E2B971B4A93"><enum>(b)</enum><header>Guidelines and educational awareness materials</header><paragraph id="HBD65BBA77A624B5F9B261CD020F71024"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall—</text><subparagraph id="H637CDF7671BC483AB722E05C8B95175B"><enum>(A)</enum><text display-inline="yes-display-inline">issue guidelines to State departments of health and State and local vital statistics units on—</text><clause id="HFE2D9BC619C24B80988E13F6E01FC505"><enum>(i)</enum><text>collecting data on stillbirth from health care providers, and with the consent of the family involved, including any such data with respect to the clinical history, postmortem examination, and placental pathology; and</text></clause><clause id="HECE8FCBD8C6744D0A39BFB99977287A1"><enum>(ii)</enum><text>sharing such data with Federal agencies determined appropriate by the Director of the Centers for Disease Control and Prevention; and</text></clause></subparagraph><subparagraph id="H25B30667364541779C4A4E16A87F2597"><enum>(B)</enum><text>develop, and make publicly available, educational awareness materials on stillbirths.</text></subparagraph></paragraph><paragraph id="H13C2D57D7E7248A0B662A6C55D0F625F"><enum>(2)</enum><header>Consultation</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary shall consult with— </text><subparagraph id="HEE74F9074DBB4FB990D90AD35E51B6DA"><enum>(A)</enum><text>national health care professional associations;</text></subparagraph><subparagraph id="H576433B42E184D6F8B53AF393B89B5A4"><enum>(B)</enum><text>obstetricians and gynecologists;</text></subparagraph><subparagraph id="H0D13AEA99E3E4A6F8DD65611BD191F9A"><enum>(C)</enum><text>pediatricians;</text></subparagraph><subparagraph id="H204992D2EE13440BAD3E82E7C250106F"><enum>(D)</enum><text>maternal-fetal medicine specialists;</text></subparagraph><subparagraph id="H6A7822F9FF6B4BE69A33BD15AC6BD0ED"><enum>(E)</enum><text>midwives;</text></subparagraph><subparagraph id="H3AD7CC3392E246CF8012DD21AAC8E98B"><enum>(F)</enum><text>mental health professionals; </text></subparagraph><subparagraph id="HE5AFC49C020743BCB03FC5B5F42195BB"><enum>(G)</enum><text>statisticians; </text></subparagraph><subparagraph id="HA4CB1C8B8BED480797EBD7288E5AD212"><enum>(H)</enum><text>individuals who have experienced a stillbirth; and</text></subparagraph><subparagraph id="HAE19A09D85E84992ADE6F85E3BD01391"><enum>(I)</enum><text>advocacy organizations representing such individuals.</text></subparagraph></paragraph><paragraph id="H6FF48ACCA2A942A0B81E609DDB9132B6"><enum>(3)</enum><header>Authorization of appropriations</header><text>To carry out this subsection, there is authorized to be appropriated $1,000,000 for each of fiscal years 2022 through 2026.</text></paragraph></subsection><subsection id="HB3BEC8C0CAFC491F9C034E97097B1A31"><enum>(c)</enum><header>Definitions</header><text>In this section:</text><paragraph id="H4E5933362F4D41B786DE8F701ADAA81B"><enum>(1)</enum><header>Stillbirth</header><text>The term <term>stillbirth</term> means the death or loss of a baby before or during delivery, occurring at or after 20 weeks of pregnancy.</text></paragraph><paragraph id="HF380445E89474F5287A3C740C9B5FC53"><enum>(2)</enum><header>Vital statistics unit</header><text>The term <term>vital statistics unit</term> means the entity that is responsible for maintaining vital records for a State, or a political subdivision of such State, including official records of live births, deaths, fetal deaths, marriages, divorces, and annulments.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="HFE8643E1CF6747DA839DDB916FDC1622"><enum>3.</enum><header>Perinatal pathology fellowships</header><text display-inline="no-display-inline">The Public Health Service Act is amended by inserting after section 1122 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300c-12">42 U.S.C. 300c–12</external-xref>) the following:</text><quoted-block style="OLC" id="H13F6C61C045A498BAEB3C12B97E79A88" display-inline="no-display-inline"><section id="H58FE1FE0C90A4B1C968220963D81A3CF"><enum>1123.</enum><header>Improving perinatal pathology</header><subsection id="HD9FA196C90C04CDEB1C13A658CC81316"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall establish and implement a Perinatal Pathology Fellowship Program to—</text><paragraph id="H860491FFE2D245218758DF5EC1A65785"><enum>(1)</enum><text display-inline="yes-display-inline">provide postgraduate training in perinatal autopsy pathology;</text></paragraph><paragraph id="H8D59BDFBC4544589A42560AFD4500A26"><enum>(2)</enum><text display-inline="yes-display-inline">conduct research on, and improve data collection with respect to, fetal autopsies; and</text></paragraph><paragraph id="H635CA3E15F50453C9D173131F60A760D"><enum>(3)</enum><text display-inline="yes-display-inline">address challenges in stillbirth education, research, and data collection. </text></paragraph></subsection><subsection id="H3CC9ADF98CC84566BA277322EB2AEACF"><enum>(b)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There are authorized to be appropriated to carry out this section $3,000,000 for each of fiscal years 2022 through 2026. </text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section><section id="H9A2DD58E5F424564B18CCA69A7005D7C"><enum>4.</enum><header>Reports</header><subsection id="HC5EC2B7CBF3E491F93BAFF6A24AEE7AB" commented="no"><enum>(a)</enum><header>Report by Surgeon General</header><paragraph id="H2CA79752F1B8478FB23B3F9DE215B112"><enum>(1)</enum><header>In general</header><text>Not later than five years after the date of enactment of this Act, the Surgeon General of the Public Health Service shall publish on a public website of the Department of Health and Human Services a report with educational guidelines on stillbirth and stillbirth risk factors.</text></paragraph><paragraph id="H8DEDFA034C77403DA3DBED2486A00B49"><enum>(2)</enum><header>Contents</header><text>Such report shall include, to the extent practicable and appropriate, the guidelines issued and educational awareness materials developed under section 317L–2 of the Public Health Service Act, as added by section 2 of this Act.</text></paragraph></subsection><subsection id="H90895A25749043409DA590FD7C2F6B65"><enum>(b)</enum><header>Report by Secretary of Health and Human Services</header><text display-inline="yes-display-inline">Not later than five years after the date of enactment of this Act, the Secretary of Health and Human Services shall submit to the Congress a comprehensive report on the progress and effectiveness of the Perinatal Pathology Fellowship Program established under section 1123 of the Public Health Service Act, as added by section 3 of this Act.</text></subsection></section></legis-body></bill>
