which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the National Telecommunications and Information Administration Organization Act to provide for a standardized framework to facilitate the sharing of electromagnetic spectrum between non-Federal users and incumbent Federal entities, and for other purposes.</official-title></form><legis-body id="H71352B81E8E44691924665B4172DEA8A" style="OLC"><section id="HF857DE2956E847758573CD0639922468" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Simplifying Management, Reallocation, and Transfer of Spectrum Act</short-title></quote> or the <quote><short-title>SMART Act</short-title></quote>.</text></section><section id="H1C7F44BFD1A146D0B903F74BB8E4180A"><enum>2.</enum><header>Standardized spectrum sharing framework</header><text display-inline="no-display-inline">Part B of the National Telecommunications and Information Administration Organization Act (<external-xref legal-doc="usc" parsable-cite="usc/47/921">47 U.S.C. 921 et seq.</external-xref>) is amended by adding at the end the following:</text><quoted-block style="OLC" id="HD28D1692FFE44E3688317ECB821C9E0C" display-inline="no-display-inline"><section id="H56DE8B95165F4A50B02E5D9177C260AE"><enum>120.</enum><header>Standardized spectrum sharing framework</header><subsection id="H3971B8A1536D43C6964C52A93C3EF146"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Assistant Secretary shall—</text><paragraph id="HAE19FAB73FA04A55919366FD255D5941"><enum>(1)</enum><text display-inline="yes-display-inline">not later than 120 days after the date of the enactment of this section, begin to amend the Department of Commerce spectrum management document entitled <quote>Manual of Regulations and Procedures for Federal Radio Frequency Management</quote> so as to incorporate a standardized framework to facilitate the sharing of covered spectrum between non-Federal users and incumbent Federal entities; and</text></paragraph><paragraph id="HDED84A8CA09C4D458FD8C6A871B91ED0"><enum>(2)</enum><text>not later than the date on which amounts appropriated under subsection (c) first become available, begin to implement such framework.</text></paragraph></subsection><subsection id="H6F1C71D693B4424A8DBAC822D48C7259"><enum>(b)</enum><header>System To enable sharing</header><paragraph id="H5598A0A7C3ED472CA99C2C790958F562"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The standardized framework required by subsection (a) shall include a system to enable sharing, including time-based sharing, to securely manage harmful interference between non-Federal users and incumbent Federal entities sharing a band of covered spectrum, in order to ensure access by such non-Federal users to such band of covered spectrum.</text></paragraph><paragraph id="H5DE51DDA72564A75B558F5685AAD44AD"><enum>(2)</enum><header>Requirements</header><text display-inline="yes-display-inline">The system required by paragraph (1) shall contain, at a minimum, the following:</text><subparagraph id="HB32C5E35ACC54870A5B66613F6A18349"><enum>(A)</enum><text display-inline="yes-display-inline">One or more mechanisms to allow non-Federal secondary use as authorized by the Commission during times when there is no primary use by Federal entities encumbering the covered spectrum.</text></subparagraph><subparagraph id="H5DEA939DE81244F892D4A8451E35158D"><enum>(B)</enum><text display-inline="yes-display-inline">One or more mechanisms to address harmful interference to incumbent Federal entities, including through the following functions:</text><clause id="H9D9650801D404CA496A88F94C8747F43"><enum>(i)</enum><text>Sensing.</text></clause><clause id="H0A41FDFFCEF346AD994D6CFFC5451D65"><enum>(ii)</enum><text>Identification.</text></clause><clause id="H6BECE8B0B4F34E81AC90C58EB9D11A7F"><enum>(iii)</enum><text>Reporting.</text></clause><clause id="H04C51996DC9247E5B0D548CA021083D4"><enum>(iv)</enum><text>Analysis.</text></clause><clause id="HB7936862193342269278B2DA96BFDF03"><enum>(v)</enum><text>Resolution.</text></clause></subparagraph><subparagraph id="HB83100DB02B244E3B552FF5663DE610E"><enum>(C)</enum><text>Dynamic protection area analysis, definition, and control.</text></subparagraph></paragraph><paragraph id="H37576FB48DE244028E3A836B8EACDE70"><enum>(3)</enum><header>Compliance with Commission rules</header><text>The system required by paragraph (1) shall ensure that use of covered spectrum is in accordance with the applicable rules of the Commission.</text></paragraph><paragraph id="H14E0CECAD78546D4A1D5111C1EFAB562"><enum>(4)</enum><header>Input of information</header><text display-inline="yes-display-inline">Each incumbent Federal entity sharing a band of covered spectrum shall input into the system required by paragraph (1) such information as the Assistant Secretary may require regarding the frequency, time, and location of the use of the band by such Federal entity.</text></paragraph><paragraph id="H2643F06277A54689B6D48ED5B3F5B8CE"><enum>(5)</enum><header>Protection of classified information and controlled unclassified information</header><text display-inline="yes-display-inline">The system required by paragraph (1) shall contain appropriate measures to protect classified information and controlled unclassified information, including any such classified information or controlled unclassified information that relates to military operations.</text></paragraph></subsection><subsection id="HEA4D2FEEB5604A2FA32B845817AA3F8F"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Assistant Secretary to carry out this section—</text><paragraph id="H8E1946506442467F974796FFB6DEB8EE"><enum>(1)</enum><text>$117,400,000 for fiscal year 2023 (and such amount is authorized to remain available through fiscal year 2029); and</text></paragraph><paragraph id="H4AD910EFC4D44FA08627DD9611BB1AE8"><enum>(2)</enum><text>$8,700,000 for fiscal year 2030 and each fiscal year thereafter.</text></paragraph></subsection><subsection id="HCC62D723D222440299E2FCEF0409C51C"><enum>(d)</enum><header>Definitions</header><text>In this section:</text><paragraph id="HA1F2F893927B4489A139DE66145537B4"><enum>(1)</enum><header>Covered spectrum</header><text>The term <quote>covered spectrum</quote> means electromagnetic spectrum for which usage rights are assigned (including before the date on which the standardized framework required by subsection (a) is implemented) by competitive bidding pursuant to section 309(j) of the Communications Act of 1934 (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(j)</external-xref>) to a non-Federal user for use on a shared basis with an incumbent Federal entity in an area where the Assistant Secretary, in consultation with the Director of the Office of Management and Budget, determines it is infeasible for the systems of such Federal entity to be relocated to fully clear such spectrum.</text></paragraph><paragraph id="H453FA581196F47CB88766E2B6E03A269"><enum>(2)</enum><header>Federal entity</header><text>The term <quote>Federal entity</quote> has the meaning given such term in section 113(l).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></legis-body></bill>
