concerned</action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">chapter 3</external-xref> of title 5, United States Code, to require Federal agencies to maintain plans for responding to, mitigating, and adapting to climate change, and for other purposes.</official-title></form><legis-body id="H5AFB1FF58A2E4776BE43566C46CE9695" style="OLC"><section id="HE7D9DDD291CF4641B265DBC6D5E89BED" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Federal Agency Climate Planning, Resilience, and Enhanced Preparedness Act of 2021</short-title></quote> or the <quote><short-title>Federal Agency Climate PREP Act</short-title></quote>.</text></section><section id="HE3F74FA245364895B38E19D1051ED40F"><enum>2.</enum><header>Climate action plans</header><subsection id="HB9F6CAFB238D4418AD7DCE411077D49C"><enum>(a)</enum><header>Amendment</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">Chapter 3</external-xref> of title 5, United States Code, is amended by adding at the end the following new subchapter:</text><quoted-block style="USC" id="H9614EB4F438A47EF86E9D865A5FA9441" display-inline="no-display-inline"><subchapter id="H651E4E9A349540A6938F16EA7EAEF5A2"><enum>III</enum><header>Government-wide Coordination on Climate Change</header><section id="HEB49D223CDEC40489C4C3FC9B16A72E3"><enum>321.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subchapter:</text><paragraph id="H88A0141041CB4B29B5BCC32B21814E1A"><enum>(1)</enum><header>Adaptation</header><text>The term <term>adaptation</term> means adjustment to natural or human systems in response to actual or expected climate change, including both sudden-onset and slow-onset climate change-related risks or events assessed through historical data, recent climate conditions and risks, and climate change projections, to minimize negative impacts on human health and safety, equity, ecosystems, and the environment.</text></paragraph><paragraph id="H423C6FA8C62C48B68F5DEEB31354B83C"><enum>(2)</enum><header>Agency</header><text>The term <term>agency</term> has the meaning given the term <term>Executive agency</term> under section 105, but does not include the Government Accountability Office.</text></paragraph><paragraph id="HD1029D5D8DA2420FB2D1746D5787BF2A"><enum>(3)</enum><header>Climate change</header><text>The term <term>climate change</term> means the long-term change in the average weather patterns influencing local, regional, and global climates, that are primarily driven by human-produced greenhouse gas emissions, and observed through key indicators including global land and ocean temperature increases, rising sea levels, loss of polar and mountain glacier ice, cloud and vegetation cover changes, and increases in extreme weather such as hurricanes, heatwaves, wildfires, droughts, floods, and precipitation.</text></paragraph><paragraph id="HF0A23C42268042D5B8AE40602D81256D"><enum>(4)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the Office of Management and Budget. </text></paragraph><paragraph id="HE4618560ECF1421AA684B554A0AB3050" commented="no"><enum>(5)</enum><header>Disadvantaged community</header><text display-inline="yes-display-inline">The term <term>disadvantaged community</term> means a community that is harmed by environmental, economic, or socioeconomic injustice, and includes a community that—</text><subparagraph id="HED015128E8374D26ABA8F6870A3F2657" commented="no"><enum>(A)</enum><text>has a high concentration of low-income and low-wealth households, including households comprised primarily of members of groups that have historically experienced discrimination on the basis of race, gender, national origin, or ethnicity (including Black, Indigenous, Latinx, Arab, Asian, and Pacific Islander communities);</text></subparagraph><subparagraph id="HDF8C1D458485409EA424E314B6BBF891" commented="no"><enum>(B)</enum><text>faces economic transition, de­in­dus­tri­al­i­za­tion, historic underinvestment, or poverty; or</text></subparagraph><subparagraph id="HF66D5B59DA83454591A653A819870DA5" commented="no"><enum>(C)</enum><text>is an environmental justice community.</text></subparagraph></paragraph><paragraph id="H6C7AE959F4BB4C47A038F50C7B136D93" commented="no"><enum>(6)</enum><header>Environmental justice community</header><text>The term <term>environmental justice community</term> means a low-income or low-wealth community facing environmental injustice, including any community that—</text><subparagraph id="H1A32C209BDD14CEB909FFEA35CE96EE5" commented="no"><enum>(A)</enum><text>is located nearest to an existing area of grave environmental pollution or degradation;</text></subparagraph><subparagraph id="H67D428BB1B01422D94B4F5AC5AA3E806" commented="no"><enum>(B)</enum><text>bears a burden of negative public health effects of pollution;</text></subparagraph><subparagraph id="HFBF7689E76ED44B2994F500CCE4E3D60" commented="no"><enum>(C)</enum><text>includes one or more sites of—</text><clause id="HA711E5B68BD54123AA6C22F0DE2E3774" commented="no"><enum>(i)</enum><text>a facility that is a part of a polluting industry;</text></clause><clause id="H2C9661FF843A4986B5EC81B957219C78" commented="no"><enum>(ii)</enum><text>a waste dump; or</text></clause><clause id="H0806EA874F124DEC88F1DCB60DC75BEE" commented="no"><enum>(iii)</enum><text>a facility for resource extraction;</text></clause></subparagraph><subparagraph id="H440084AC73F24CBD8B9FB1532160403C" commented="no"><enum>(D)</enum><text>experiences a high incidence of climate change impacts and disasters;</text></subparagraph><subparagraph id="HA8D792096FE04E1792B6718ED79151DA" commented="no"><enum>(E)</enum><text>has been excluded or harmed by racist or discriminatory policies that have resulted in economic or health disparities;</text></subparagraph><subparagraph id="H670D40C0237A4DBDA5239273AC60EA8D" commented="no"><enum>(F)</enum><text>has a land-based or food subsistence culture that is experiencing ecosystem disruption and devastation;</text></subparagraph><subparagraph id="HA486C9A1238A47049B545A2616CC6E3B" commented="no"><enum>(G)</enum><text>faces relocation and resettlement resulting from—</text><clause id="H468235F29E4B463CAFE3123EFC0F7B27" commented="no"><enum>(i)</enum><text>climate change;</text></clause><clause id="HF454799CF4994E9FA04D7146EB27CF2E" commented="no"><enum>(ii)</enum><text>impacts to the environment and ecosystems; or</text></clause><clause id="H3E21583D3E404F5997D494FD7E32C71E" commented="no"><enum>(iii)</enum><text>impacts associated with economic inequities; or</text></clause></subparagraph><subparagraph id="HFAF77534974546BD906BC678A530AC4C" commented="no"><enum>(H)</enum><text>is an Indigenous community.</text></subparagraph></paragraph><paragraph id="HA67E84ED10554F00A19062173E97BFBD"><enum>(7)</enum><header>Impact</header><text>The term <term>impact</term> means consequences, both realized and expected, for natural and human systems.</text></paragraph><paragraph id="H33534C5F73944EAC87353812FE2F54D7"><enum>(8)</enum><header>Preparedness</header><text>The term <term>preparedness</term> means actions taken to plan, organize, equip, train, and exercise to build, apply, and sustain the capabilities necessary to prevent, protect against, ameliorate the effects of, respond to, and recover from climate change-related damages to life, health, property, livelihoods, ecosystems, and national security.</text></paragraph><paragraph id="H1C85524DC78C4B31871A5443787F12F9"><enum>(9)</enum><header>Resilience</header><text display-inline="yes-display-inline">The term <term>resilience</term> means the ability to anticipate, prepare for, and adapt to changing conditions and withstand, respond to, and recover rapidly from disruptions while ensuring the sustainment of mission-critical operations.</text></paragraph><paragraph id="H7AA669D222E64208AADB4551BBD8CF0E"><enum>(10)</enum><header>Risk</header><text>The term <term>risk</term> means an assessment based on formal analysis of the consequences, likelihoods, and responses to the impacts of climate change and how societal constraints shape adaptation options.</text></paragraph><paragraph id="HC82F248A2BD441B393D6043F779692B3"><enum>(11)</enum><header>State</header><text>The term <term>State</term> means each of the several States, the District of Columbia, each commonwealth, territory, or possession of the United States, and each federally recognized Indian Tribe.</text></paragraph><paragraph id="H5F3690E7FCE3483F8FFFD2EFD3AB7693"><enum>(12)</enum><header>Vulnerable population</header><text>The term <term>vulnerable population</term> means groups of individuals, including those with underlying health conditions, subject to greater climate change exposure, or adversely impacted by social determinants of health, who experience heightened sensitivity to climate-related health and economic impacts.</text></paragraph></section><section id="HEC7CF1A38D944864B751C2C8C61C6557"><enum>322.</enum><header>Agency climate action plans required</header><subsection id="HB5F828FC8618490BBCD615657DBDE73D"><enum>(a)</enum><header>Agency climate action plans required</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the enactment of this section, the head of each agency shall submit to the Director and the steering committee of the Council on Federal Agency Climate PREP an agency climate action plan.</text></subsection><subsection id="HADB16FE61076473BBC59B20692F28276"><enum>(b)</enum><header>Contents of plan</header><text>Each agency climate action plan submitted pursuant to subsection (a) shall include the following:</text><paragraph id="H90A9A8BDC0714C428C73E20AEEF8DCEB"><enum>(1)</enum><text>An identification and assessment of climate change-related impacts on and risks to the ability of the agency to accomplish its missions, operations, and programs.</text></paragraph><paragraph id="HCCB6979E5E2B47D1850192D840CB00F1"><enum>(2)</enum><text>A description of programs, policies, and plans the agency has in place and any additional action the agency plans to take to mitigate and manage the impacts and risks identified in paragraph (1) and build resilience, both immediately and at milestones that are 2, 5, 10, and 20 years after the date of the enactment of this section.</text></paragraph><paragraph id="HC205FD71F327475BAB4FA670A0314013"><enum>(3)</enum><text>A description of how any climate change-related impact and risk identified under paragraph (1) that is determined by the agency to be so significant that it impairs the statutory mission or operation of the agency will be addressed.</text></paragraph><paragraph id="H18088A835BD2458F91197DAC2C72528B"><enum>(4)</enum><text display-inline="yes-display-inline">An assessment of whether implementation of any of the programs, policies, or plans of the agency exacerbates climate change-related impacts and risks.</text></paragraph><paragraph id="HB9AF072ED0EB44A0B8D18E7C898353BF" commented="no"><enum>(5)</enum><text>A description of how the agency will consider the need to improve climate change adaptation and resilience, including—</text><subparagraph id="H53F7DCD615B14C51A902A19DC267F783" commented="no"><enum>(A)</enum><text>an assessment that monetizes the costs and benefits of such improvement, including the value of climate change adaptation, resilience, and mitigation; and</text></subparagraph><subparagraph id="H6FD99DBF56664AC1A7A5F507985B242F" commented="no"><enum>(B)</enum><text>with respect to agency suppliers, supply chains, real property investments, and capital equipment purchases such as updating agency policies for leasing, building upgrades, relocation of existing facilities and equipment, and construction of new facilities.</text></subparagraph></paragraph><paragraph id="H8DE2F00A02C24C5EBCB47B03EE7385EA"><enum>(6)</enum><text>In the case of the implementation of a program that uses cost-benefit analyses, a description of any additional methodologies used by the agency to incorporate climate change risks into the cost-benefit analyses, including the metrics and methodologies used.</text></paragraph><paragraph id="H863CA7BB46CB4BD3B48288D0955342D2" commented="no"><enum>(7)</enum><text display-inline="yes-display-inline">An assessment of the efforts of the agency to reverse the disproportionate impacts of climate change on disadvantaged communities and vulnerable populations, including—</text><subparagraph id="HCF8621FC59AB40C69A13B2D390671040" commented="no"><enum>(A)</enum><text>a description of opportunities identified to reverse such impacts;</text></subparagraph><subparagraph id="HBA482DD14B9B43B89CA5F4AA68923B55" commented="no"><enum>(B)</enum><text>a description of progress made in reversing such impacts; and</text></subparagraph><subparagraph id="H0EED704866F6483BB7631ACED0385B1D" commented="no"><enum>(C)</enum><text>a description of the methodology used by the agency for actively and widely soliciting and receiving input and feedback directly from such communities and populations regarding such opportunities and progress.</text></subparagraph></paragraph><paragraph id="HEAA30EA3F0B740F89CF7F7D5256C0F66"><enum>(8)</enum><text display-inline="yes-display-inline">A description of how the agency will promote the preparedness and resilience of the Federal workforce with respect to climate change.</text></paragraph><paragraph id="HED07671588D44BDAA086473666F982CD"><enum>(9)</enum><text>A description of how the agency will contribute to coordinated interagency efforts to support climate change mitigation preparedness, and resilience at all levels of government, including collaborative work across regional offices of agencies and through coordinated development of information, data, and tools.</text></paragraph></subsection><subsection id="HB35DA920AC7846EAB92DB94347583DDF"><enum>(c)</enum><header>Progress reports</header><text display-inline="yes-display-inline">The head of each agency shall submit to the Director and the steering committee of the Council on Federal Agency Climate PREP an annual progress report on the implementation of the plans required pursuant to subsection (a), including updated identification and assessments of climate change-related impacts and risks.</text></subsection></section><section id="H90CF6FA109494276B5274070CE29C2B5"><enum>323.</enum><header>Council on Federal Agency Climate PREP</header><subsection id="HFB00D4FB1CE348C49C5FB710B08CE765"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established an interagency council, to be known as the Council on Federal Agency Climate Planning, Resilience, and Enhanced Preparedness, or the Council on Federal Agency Climate PREP (in this section referred to as the <quote>Council</quote>).</text></subsection><subsection id="HED7B10A7E7604409A9BD3AFAFBDA1C74" commented="no"><enum>(b)</enum><header>Leadership</header><text display-inline="yes-display-inline">The Director shall serve as the Chair of the Council (in this section referred to as the <quote>Chair</quote>) and shall be guided by a steering committee, which shall determine priorities and strategic direction for the Council in accordance with subsection (f), made up of the National Climate Advisor, the Chair of the Council on Environmental Quality, and the Director of the Office of Science and Technology Policy.</text></subsection><subsection id="H6E1C11ED4AEB4221B6341DAF1584845C"><enum>(c)</enum><header>Members</header><text display-inline="yes-display-inline">In addition to the Chair and steering committee, the Council shall be composed of the following members who are senior officials (Deputy Secretary or equivalent officer) from the following: </text><paragraph id="H40B07A4544914567961A4C4E3783BC20"><enum>(1)</enum><text>The Department of State.</text></paragraph><paragraph id="H5F236A3A3D5D407AAD57F2F3EFAD2D2F"><enum>(2)</enum><text>The Department of the Treasury.</text></paragraph><paragraph id="HCF8B2EE659FB4FDCBD75867E3EB8611B"><enum>(3)</enum><text>The Department of Defense.</text></paragraph><paragraph id="H26F97451D7EF48BA8DCB7EF89F6EF5A9"><enum>(4)</enum><text>The Department of Justice.</text></paragraph><paragraph id="H80D27AA8D44D4AE3AAB250C33854AFD7"><enum>(5)</enum><text>The Department of the Interior.</text></paragraph><paragraph id="H142E19D56F5D4C22BF15C54BF448CD25"><enum>(6)</enum><text>The Department of Agriculture.</text></paragraph><paragraph id="H0FB6BF96272545F3A208E6BD1F2A4883"><enum>(7)</enum><text>The Department of Commerce.</text></paragraph><paragraph id="H81B714CAC7104A7B8AF513551F0FAE2A"><enum>(8)</enum><text>The Department of designate.</text></paragraph></subsection><subsection id="H21062BA33F2242059E623BBBB0188FD3"><enum>(d)</enum><header>Administration</header><text display-inline="yes-display-inline">The Director of the Office of Management and Budget shall provide administrative support and additional resources, as appropriate, to the Council. Agencies shall assist and provide information to the Council deemed necessary by the Chair or the steering committee to carry out its functions. Each such agency shall pay its own expenses related to participating as members of the Council.</text></subsection><subsection id="HEE5744BA958143938C83481A067F67A2"><enum>(e)</enum><header>Council structure</header><text display-inline="yes-display-inline">The Chair and steering committee may establish task forces and working groups as needed.</text></subsection><subsection id="H2D1740F6DC3B4514A6685C1A5F2D3FDA"><enum>(f)</enum><header>Mission and function of the Council</header><text display-inline="yes-display-inline">The Council shall coordinate across Federal agencies and offices, and in partnership with State and local governments, academic and research institutions, and the private and nonprofit sectors to do the following:</text><paragraph id="H2394B048E72641C4B35FD02CBBCC4E54" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">Facilitate the organization and deployment of a government-wide approach to combat the climate crisis.</text></paragraph><paragraph id="H7F4AECEFA22E4277BA67A32418DA8BB5"><enum>(2)</enum><text>Develop, recommend, coordinate interagency efforts on, and track implementation of Federal Government actions to—</text><subparagraph id="H9DBF7CC3C14B47DE9E5BCB30122F8103"><enum>(A)</enum><text>reduce climate pollution;</text></subparagraph><subparagraph id="H22651D1177B041DBBAB6B0768CDE6826"><enum>(B)</enum><text>increase resilience to the impacts of climate change;</text></subparagraph><subparagraph id="HB5E2457923044A5BBF82B3E8483AAA28"><enum>(C)</enum><text>protect public health;</text></subparagraph><subparagraph id="H79D765E85F28431E99AC0D6BE2D32AF7"><enum>(D)</enum><text>conserve lands, waters, oceans, and biodiversity;</text></subparagraph><subparagraph id="H3F293D0F434844DD97CA85DA09436056"><enum>(E)</enum><text>deliver environmental justice; and</text></subparagraph><subparagraph id="H3FFFCACA8D814E79AF93D2DC4F8BA287"><enum>(F)</enum><text>spur well-paying union jobs and economic growth.</text></subparagraph></paragraph><paragraph id="H8FE60D727A284E1BB6EF165F5D7AFFB9"><enum>(3)</enum><text display-inline="yes-display-inline">Provide expertise to assist regional, State, Tribal, territorial, and local action to—</text><subparagraph id="H63FCDB3A24B84B01869084626744A424"><enum>(A)</enum><text>reduce climate pollution;</text></subparagraph><subparagraph id="HA7DD960CC26B4F36B813D49B6C284816"><enum>(B)</enum><text>increase resilience to the impacts of climate change;</text></subparagraph><subparagraph id="H88E7F9D9CF8547408A47E7A1B513FF8C"><enum>(C)</enum><text>protect public health;</text></subparagraph><subparagraph id="H1B68898203E444E392DE6BC9BEACAF7D"><enum>(D)</enum><text>conserve lands, waters, oceans, and biodiversity;</text></subparagraph><subparagraph id="H7C5AC3B958834CD79D99C788C04BCF0B"><enum>(E)</enum><text>deliver environmental justice; and</text></subparagraph><subparagraph id="H633946D30385430CB589A12F8AD95937"><enum>(F)</enum><text>spur well-paying union jobs and economic growth.</text></subparagraph></paragraph><paragraph id="HA11F5F36FF354F7FBE143D805DCB8874"><enum>(4)</enum><text display-inline="yes-display-inline">Integrate climate change science in policies and planning, where appropriate, of agencies and the private sector, including by developing and deploying of innovative, actionable, and accessible Federal climate change-related information, data, and tools.</text></paragraph><paragraph id="HAAFC80A091CD41F3A796E0E12F9967AA" commented="no"><enum>(5)</enum><text display-inline="yes-display-inline">To the extent permitted by law, prioritize action on climate change in their policy-making, budget processes, contracting and procurement, and engagement with governments, workers, communities, and the private sector.</text></paragraph><paragraph id="H386133BFC9DE44C0B52323EFC87E8824" commented="no"><enum>(6)</enum><text display-inline="yes-display-inline">Carry out such other functions as the Director may determine necessary.</text></paragraph></subsection></section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H625AD1330FD94CA7B94A953D09FBF553"><enum>(b)</enum><header>Technical and conforming amendment</header><text display-inline="yes-display-inline">The table of sections for <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/5/3">chapter 3</external-xref> of title 5, United States Code, is amended by adding at the end the following new items:</text><quoted-block style="OLC" id="HDF1EDE55FB2B4AEC95C681A6778AB751" display-inline="no-display-inline"><toc regeneration="no-regeneration"><toc-entry level="subchapter">Subchapter III—Government-wide Coordination on Climate Change </toc-entry><toc-entry level="item">321. Council on Federal Agency Climate PREP. </toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section><section id="HA63BCC24FC044D59A017A3CD2CA77497" commented="no"><enum>3.</enum><header>White House office of domestic climate policy</header><subsection id="H8F843A16143041C6B580868CF425A4B4" commented="no"><enum>(a)</enum><header>Establishment</header><text>There is established, within the Executive Office of the President, the Office of Domestic Climate Policy (in this section referred to as the <quote>Office</quote>).</text></subsection><subsection id="HF02BE827F5D24066925C128550C15628" commented="no"><enum>(b)</enum><header>National climate advisor</header><paragraph id="HC85DDA1F868E48BCBF655BE6CBDAE417" commented="no"><enum>(1)</enum><header>In general</header><text>The Office shall be headed by the National Climate Advisor (in this section referred to as the <quote>Advisor</quote>) who shall be appointed by the President.</text></paragraph><paragraph id="H1532CE5EC7C04E7BB8790DBBF82BBC8A" commented="no"><enum>(2)</enum><header>Position</header><text>The Advisor shall hold office at the pleasure of the President.</text></paragraph><paragraph id="H6292F9A25EC7416583A4C96A9EA96520" commented="no"><enum>(3)</enum><header>Pay and allowances</header><text>The Advisor shall be entitled to receive the same pay and allowances as are provided for level II of the Executive Schedule under section 5313 of title 5, United States Code.</text></paragraph></subsection><subsection id="HE7AF8D6935AC405197B3EF83838C4E61" commented="no"><enum>(c)</enum><header>Duties of the national climate advisor</header><text display-inline="yes-display-inline">Subject to the authority, direction, and control of the President, the Advisor shall—</text><paragraph id="H68DCEDE8A238489B9E0402AC66643CFF" commented="no"><enum>(1)</enum><text>coordinate the policymaking process with respect to domestic climate policy issues;</text></paragraph><paragraph id="H43E42A833CB145178347FAAB09E8734C" commented="no"><enum>(2)</enum><text>coordinate domestic climate policy advice to the President;</text></paragraph><paragraph id="H70D8438C4BE0430EB6AB7D05C291ECD4" commented="no"><enum>(3)</enum><text>ensure that domestic climate policy decisions and programs are consistent with the stated goals of the President and that those goals are being effectively pursued; and</text></paragraph><paragraph id="HE9B964D2539C4B03A8B0AAEEF65A2890" commented="no"><enum>(4)</enum><text>monitor implementation of the domestic climate policy agenda of the President.</text></paragraph></subsection><subsection id="H81FC09293DED42DC96CDF652CE07B687" commented="no"><enum>(d)</enum><header>Powers of the advisor</header><text>The Advisor may, for the purposes of carrying out the functions of the Advisor under this section—</text><paragraph id="H1E3D4CECCF04466CB2B65E6FA63D054B" commented="no"><enum>(1)</enum><text>subject to the civil service and classification laws, select, appoint, employ, and fix the compensation of such officers and employees as are necessary and prescribe their duties;</text></paragraph><paragraph id="HE5450A5F85E643C6840A125241C665E8" commented="no"><enum>(2)</enum><text>employ experts and consultants in accordance with section 3109 of title 5, United States, Code, and compensate individuals so employed for each day (including travel time) at rates not in excess of the maximum rate of basic pay for grade GS–15 as provided in section 5332 of such title, and while such experts and consultants are so serving away from their homes or regular place of business, to pay such employees travel expenses and per diem in lieu of subsistence at rates authorized by section 5703 of such title 5 for persons in Federal Government service employed intermittently;</text></paragraph><paragraph id="H9395A06E298C4B138E2F8F6F354C8A84" commented="no"><enum>(3)</enum><text>promulgate such rules and regulations as may be necessary to carry out the functions, powers, and duties vested in the Advisor;</text></paragraph><paragraph id="HD69D6630E98346B4AF68AE5914B43165" commented="no"><enum>(4)</enum><text>utilize, with their consent, the services, personnel, and facilities of other Federal agencies;</text></paragraph><paragraph id="HF10C6DA633114701B2DC5F98DBF822E2" commented="no"><enum>(5)</enum><text>enter into and perform such contracts, leases, cooperative agreements, or other transactions as may be necessary in the conduct of the work of the Office and on such terms as the Advisor may determine appropriate, with any Federal agency, or with any public or private person or entity;</text></paragraph><paragraph id="H01CAF4AD945D4317B761B6BABDCCA8F2" commented="no"><enum>(6)</enum><text>accept voluntary and uncompensated services, notwithstanding the provisions of section 1342 of title 31, United States Code;</text></paragraph><paragraph id="H3450D816EF5245C885AB1FF774F0282E" commented="no"><enum>(7)</enum><text>adopt an official seal, which shall be judicially noticed; and</text></paragraph><paragraph id="HFC18AFF384334E9A8EAD34948D74B57B" commented="no"><enum>(8)</enum><text>provide, where authorized by law, copies of documents to persons at cost, except that any funds so received shall be credited to, and be available for use from, the account from which expenditures relating thereto were made.</text></paragraph></subsection></section></legis-body></bill>
