R. 5471</legis-num><current-chamber>IN THE HOUSE OF REPRESENTATIVES</current-chamber><action display="yes"><action-date date="20210930">September 30, 2021</action-date><action-desc><sponsor name-id="T000478">Ms. Tenney</sponsor> (for herself, <cosponsor name-id="B001299">Mr. Banks</cosponsor>, <cosponsor name-id="D000615">Mr. Duncan</cosponsor>, <cosponsor name-id="H001071">Mr. Hice of Georgia</cosponsor>, <cosponsor name-id="M001199">Mr. Mast</cosponsor>, <cosponsor name-id="L000266">Mr. LaTurner</cosponsor>, <cosponsor name-id="B000825">Mrs. Boebert</cosponsor>, <cosponsor name-id="L000564">Mr. Lamborn</cosponsor>, <cosponsor name-id="R000612">Mr. Rose</cosponsor>, <cosponsor name-id="C001104">Mr. Cawthorn</cosponsor>, <cosponsor name-id="T000165">Mr. Tiffany</cosponsor>, <cosponsor name-id="B001291">Mr. Babin</cosponsor>, <cosponsor name-id="J000304">Mr. Jackson</cosponsor>, <cosponsor name-id="C001054">Mr. Carl</cosponsor>, <cosponsor name-id="S001195">Mr. Smith of Missouri</cosponsor>, and <cosponsor name-id="P000048">Mr. Pfluger</cosponsor>) introduced the following bill; which was referred to the <committee-name committee-id="HED00">Committee on Education and Labor</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the Occupational Safety and Health Act of 1970 to prohibit the Secretary of Labor from issuing a temporary standard with respect to COVID–19 vaccination or testing, and for other purposes.</official-title></form><legis-body id="HD3143C5F50424DDC877D0F8C453CA2EB" style="OLC"><section id="H4A140145C0AC4DD1A5DBAC04AA63CE29" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Health Freedom for All Act</short-title></quote>. </text></section><section id="H06B67CDC780846F3A6D76A872EDFB4EB"><enum>2.</enum><header>Prohibition on certain emergency tem­po­rary standards</header><subsection id="H1457C312C2DE4C94B7D2190FF19D5009"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 8(c) of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657(c)</external-xref>) is amended by adding at the end the following: </text><quoted-block style="OLC" id="HC34ACFA995874BDC92BA5B8FE575B778" display-inline="no-display-inline"><paragraph id="H2AE6ED3EF96D4823A81DB9128A211C70"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary may not issue an emergency temporary standard that requires an employer to ensure that employees of the employer have received a COVID–19 vaccine or undergo COVID–19 testing.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection><subsection id="H66FD89D15BBB4D5EACD875EE78744556"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">The amendment under subsection (a) shall not apply to any emergency temporary standard under section 8(c) of the Occupational Safety and Health Act of 1970 (<external-xref legal-doc="usc" parsable-cite="usc/29/657">29 U.S.C. 657(c)</external-xref>) issued before September 23, 2021. Any emergency temporary standard described in paragraph (4) of such section issued after such date shall have no force or effect. </text></subsection></section></legis-body></bill>
