which was referred to the <committee-name committee-id="HIF00">Committee on Energy and Commerce</committee-name></action-desc></action><legis-type>A BILL</legis-type><official-title display="yes">To amend the 21st Century Cures Act to support State and local agencies with responsibility for children services in their response to the opioid abuse crisis, and for other purposes.</official-title></form><legis-body id="H7E8BB1C9C87545009B90608BDD987EED" style="OLC"><section id="H55ADCE75B88C41F2A3849D7F51EBD748" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Furthering Opioid Services, Training, and Education Resources Act</short-title></quote> or the <quote><short-title>FOSTER Act</short-title></quote>.</text></section><section id="HBB5274B2465746E9B3DB4DD58C0EFC50"><enum>2.</enum><header>Opioid grants to support caregivers, kinship care families, and kinship caregivers</header><subsection id="H9A63A9344EF24A96993D56A31B0A6091"><enum>(a)</enum><header>Opioid grants</header><text display-inline="yes-display-inline">Section 1003(b)(2) of the 21st Century Cures Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-3">42 U.S.C. 290ee–3</external-xref> note) is amended—</text><paragraph id="H9CDA9DBD793246A3AAFB29428D0D1268"><enum>(1)</enum><text>by redesignating subparagraph (E) as subparagraph (F); and</text></paragraph><paragraph id="HE0E3BC872EF04B909B86904552DE4400"><enum>(2)</enum><text>by inserting after subparagraph (D) the following:</text><quoted-block style="OLC" id="HF125A0AFDC6E44968A7B64B6C9BD4905" display-inline="no-display-inline"><subparagraph id="HCADAA8A6AD514E1699DA8B1B958AC6A1"><enum>(E)</enum><text display-inline="yes-display-inline">Supporting opioid abuse prevention and treatment services within a State provided by State and local agencies for children and caregivers, kinship care families, and kinship caregivers through—</text><clause id="HCE30862520A54196B407C663930BE7B9"><enum>(i)</enum><text>workforce recruitment and training;</text></clause><clause id="HDB4917BB5E4E4627852A0AC143ECDE32"><enum>(ii)</enum><text>health care services (including such services described in subparagraph (D)); and</text></clause><clause id="H48C0330EAB2D4763B6743B99306C83AE"><enum>(iii)</enum><text>foster and adoptive parent recruitment and training.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="HDDA5F78A3043463792A29DFF4AB7D969"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Section 1003 of the 21st Century Cures Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-3">42 U.S.C. 290ee–3</external-xref> note) is amended—</text><paragraph id="H6B1107545AE34A1BA233374A65DBE875"><enum>(1)</enum><text>by redesignating subsections (h), (i), and (j) as subsections (i), (j), and (k), respectively; and</text></paragraph><paragraph id="H12E740977AD948C1AF26E1BE5C217F00"><enum>(2)</enum><text>by inserting after subsection (g) the following: </text><quoted-block style="OLC" id="H15B91E298C3C4F83998B427F611B0237" display-inline="no-display-inline"><subsection id="HF0163BEA0A43475FB1DE78134527A3D5"><enum>(h)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text><paragraph id="H27587F9F5E8047F3810C4B1D1241C048"><enum>(1)</enum><text display-inline="yes-display-inline">The term <term>kinship care family</term> means a family with a kinship caregiver.</text></paragraph><paragraph id="H2BC81AC911784E7EAEAB10D9C2E28A47"><enum>(2)</enum><text>The term <term>kinship caregiver</term> means a relative of a child by blood, marriage, or adoption, who—</text><subparagraph id="HC09720D6E3D64C6BBB7EA655032BB1EB"><enum>(A)</enum><text>lives with the child;</text></subparagraph><subparagraph id="HBD993426E5B84FFCBC1C01AE52D84DA2"><enum>(B)</enum><text>is the primary caregiver of the child because the biological or adoptive parent of the child is unable or unwilling to serve as the primary caregiver of the child; and</text></subparagraph><subparagraph id="HAB9E53C8DA8A436FB057DD29E9A0D915"><enum>(C)</enum><text>has a legal relationship to the child or is raising the child informally.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection><subsection id="H482B3F1E23374179A6ABAE1F1C53E806"><enum>(c)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">Section 1003(i) of the 21st Century Cures Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-3">42 U.S.C. 290ee–3</external-xref> note), as redesignated, is amended by inserting <quote>, and $255,000,000 for each of fiscal years 2022 through 2026</quote> after <quote>2021</quote>.</text></subsection><subsection id="HB554425F442840BE97AED33D55B03AD8"><enum>(d)</enum><header>Set aside</header><text display-inline="yes-display-inline">Section 1003(j) of the 21st Century Cures Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290ee-3">42 U.S.C. 290ee–3</external-xref> note), as redesignated, is amended—</text><paragraph id="H20B5F857ED7244B5ACC1695ACB0D6EF2"><enum>(1)</enum><text>by striking <quote>, and up to</quote> and inserting <quote>, up to</quote>; and </text></paragraph><paragraph id="H1F8257106E5A4ACCB8CBB56BCBFD03BF"><enum>(2)</enum><text>by inserting before the period at the end <quote>, and 1 percent of such amount for such fiscal year shall be made available to carry out subsection (b)(2)(E)</quote>.</text></paragraph></subsection></section></legis-body></bill>
